close to the border of mexico. a single f-16 air draft went down approximately 5 miles east of the douglas municipal airport. the town of douglas is about 230 miles southeast of phoenix. according to the air force national guard, this happened during a night training mission. one person on board, no word yet on the stats of the pilot. a spokesman for the douglas fire department tells nbc news they said the crash has sparked a brush fire. and a second person, a prison employee, facing charges after two convicted murderers escaped a upstate prison earlier this month. gene palmer a guard at the clinton correctional facility was arrested yesterday. according to the clinton county jail he bailed himself out shortly after midnight. he was arraigned wednesday and another hearing scheduled this afternoon. palmer has been charged with promoting prison contraband and official misconduct. the charges carry prison terms ranging from 15 months to seven years. palmer's attorney tells nbc news

he had no knowledge that the two were escaping and and will plead not guilty. >> he's devastated, embarrassed, sorry for the attention he's getting right now. he wants the focus to be on prison security and capturing these two individuals and putting them back where they belong. >> prison seamstress joyce mitchell has already pled guilty and she told investigators she smuggled escape tools inside raw, ground beef sk then took that beef to the inmate but told investigators he had no idea the meat contained contraband. meanwhile, the search for david sweat and richard matt, continues. the man convicted of the boston marathon bombing has broken his silence. more that two years after the attacks killed three people and injured more than 260. dzokhar tsarnaev told a packed courtroom that he was sorry for the deaths he caused. statement came as he was

formally sentenced to death. nbc justice correspondent pete williams was in the courtroom. >> reporter: some of those most affected by the marathon bombings, came to court for an opportunity they waited years for. bill richard, the father of 8-year-old martin, the youngest to die stood with his wife, denise as tsarnaev sat 20 feet away. said tsarnaev could have stopped his older brother, tamerlan who planned the bombing and chose to do nothing. he chose, hate, destruction and death. heather abbott said the jury had oo hard time deciding between life and death. i can't understand how he made the decision about who would live and who would die. one of the most forceful statements came from rebecca gregory who lost a leg, she said i'm nobody's victim, referring to the video shown in court of his gesture to the surveillance camera she said that is so fun

y that you smirk, that is what we do to you every day. she said the response to bombing brought out the best, we are boston strong and america strong. choosing to mess with us was a terrible idea. how is that for a victim impact statement. finally, tsarnaev stood, choking up when he said i am sorry for the lives i have taken and i would like the ask for victims mercy and ask allah's mercy. many survivors said it was too late. >> i regret having ever wanted to hear him speak. because what he said showed no remorse, no regret and no empathy for what he's done to our lives. >> at no point did he renounce the reasons for which he committed this act. he never renounced terrorism, he did not repudiate violent extremism. >> but liz norton whose two sons each lost a leg said it was helpful. >> i really feel like a weight
