bridge just starts slowing heading to the peninsula, guys. >> those are the stories locally. we are watching what's happening in washington, d.c. with the supreme court ready to issue some rulings. the "today" show picks up that coverage. test. good morning. another arrest. the second prison workers accused of helping those inmates who escaped in upstate new york. was he doing favors in exchange for richard matt's prison artwork? why authorities say the two men on the run may be armed. fiery crash. a national guard f-16 goes down overnight with one pilot on board.. whole foods under investigation for overcharging customers. did they overstate the weights of certain foods. and was that intentional? and heckled at home.

and released on bail overnight. let's go to stephanie gosk. she has been following it from the beginning. good morning to you, steph. >> reporter: good morning. gene palmer is a 28-year veteran prison officer. he worked on the honor block where richard matt and david sweat were housed. he's accused of giving them tools in exchange for their artwork and letting them onto the catwalks so they could use the hot plates. the same cat walks the prisoners used to see scape almost three weeks ago. they are very much still on the run. 57-year-old gene palmer faces multiple criminal charges, promoting prison contraband, tampering with evidence, and official misconduct. >> we intend to bleed not guilty. >> reporter: according to the criminal complaint palmer is charged with accepting a number of paintings from richard matt and david sweat in exchange for providing them with tools on four separate occasions, going back to

november 2014. earlier this week, the d.a. told nbc news palmer didn't know there were tools stuck inside hamburger meat he passed along to david sweat and richard matt. >> he had no knowledge they were planning on escaping. he passed the polygraph test. >> reporter: joyce mitchell told him she put the tools in the meat two hacksaw blades, drill bits, and a hole bunch. >> it's unraveling in front of us all at the same time. there's allegations that she conned multiple people. in my mind, she is just as man nip latetive the two escapees are. >> reporter: she sits heinz bars waiting for her trial, pleading not guilty for charges she helped matt and sweat. as the search continues in the area around the hunting cabin, there's new concerns that the escapees may be armed with rifles. at a police conference state police admitted that weapons may be missing. >> a number of people cycle through these camps and cabins, and they don't have a definitive

number of weapons. they cannot tell us what is missing and what is not. >> reporter: mitchell's husband believes other prison workers knowingly helped the convicts. >> there's something more that they're not telling us. how did they cut the hole? is there's so many unanswered questions for me that i don't know. >> reporter: even more questions will be asked about the honor block where palmer worked and sweat and matt were housed. working there is considered a privilege. >> that's a plum job. you get it with seniority. the reason it's a good job is because the prisoners who go there don't make trouble, supposedly. >> reporter: palmer's lawyer said they are caught off guard by the charges and his client is devastated. the next hearing in this case is later today. matt? >> all right, stefanie, thank you very much. nbc news analyst clint van zandt is a former fbi profiler. clint, good morning to you. >> hi, matt. >> let's talk about what gene palmer is accused of doing. in one report i read, he's accused of giving sweat and matt, these two prisoners, access to the catwalks behind the walls of their prison blocks.

why would anybody do that if not to help them escape? and why would no one else notice that the two prisoners disappear from plain sight? >> three things. he gave them access to the catwalk, supposedly so they can get behind their cell where the electricity was shorting out to their hotplate. they said let us get back there. we can fix it. while on the catwalk, they hotwired the lights back there so they can turn the lights on and work in the dark. number two, he gives them access to tools. and number three, he brings in paint. you remember when the guys first escaped, there was this cardboard cut out over the hole. where did the paint come from to match it? it looks like the guard probably supplied it to them, either willingly or not willingly. >> not to sound like that

commercials, but wait, there's more. it appears that gene palmer was receiving artwork from richard matt in exchange for the favors and gene palmer allegedly destroyed some of the artwork when the investigation started to heat up. >> yeah, i think this was kind of a panicked reaction on his part. all of a sudden, he put two and two together. now we're told he passed the polygraph test. some of us are fans of polygraph. others are not. i think what we're going to find out is just like investigators have told us from the beginning, there is more people that were somehow complacent in this other than simply joyce mitchell. now we have the second domino to fall. how many more within that prison either willingly or unwillingly provided support for these two convicts so they could escape. >> before i let you go, clint, let's talk about the manhunt. authorities have dna evidence from inside a cabin. they have articles of their clothing, socks and underwear. are you surprised the k-9 units

haven't been able to track them down yet? >> in a way. we know they likely switched clothes. hunting cabins, we might have extra clothes, boots. unfortunately the people apparently have left guns in those cabins, too. this is like the third time law enforcement has said we're right there. we can reach out and touch them. well, so far, they haven't touched anybody, and now the biggest fear is that even though they think they can run them to the ground this time, they may have guns. have these guys made a decision to give up or they going to fight to the death? >> clint van zandt, thank you very much. meantime, an investigation is under way this morning into the crash of an f-16 fighter jet in arizona. jim miklaszewski is at the pentagon. mik, what are you hearing? >> reporter: this was international guard f-16 fighter jet. it had just taken off on a nighttime training mission near

douglas, arizona, overnight when suddenly, without warning, it fell out of the sky. it exploded into a fireball when it hit the ground, igniting a nearby wildfire. now as of this morning, u.s. military officials cannot say whether the pilot survived the crash. there are no early indications as to what may have caused this terrible incident. now investigators are on the ground this morning. and this is just another grim reminder that on or off the battlefield, u.s. service members often find themselves in harm's way. >> very dangerous work. jim, thank you. turning now to a dangerous situation out west heavy winds are fueling dangerous wildfires. they're sweeping through parts of california, forcing homeowners to flee. nbc joe fryer is on the scene. good morning to you, joe. >> reporter: good morning. the fioe. >> reporter: good morning. the fire came dangerously close

to some homes. and good morning, everyone. breaking news from the supreme court this morning. this is a key ruling impacting the health care coverage of millions of people living in this country. >> it all comes down to four words in a statute that are being challenged by people who did not want to have to buy insurance on a federal exchange, all part of obamacare. nbc's justice correspondent, pete williams, is at the court this morning. pete, i know we have the decision. do we know what it says yet? >> reporter: i'm just looking at it, just handed to me. it appears to say that the tax credits -- this is the big question, who is eligible for the subsidies that make health insurance affordable? is it only in the states that have their own exchanges, which would be just a small part of the country, 16 states, or is it available in all the rest of the states that do have insurance through the federal health care exchange?

and my reading of it is that the subsidies are available to individuals to states that have a federal exchange. so it is a big victory for the obama administration. basically, the supreme court has, for the second time, bailed out obamacare. it has rescued it from a legal challenge. you may recall a couple of years ago, there was a constitutional challenge to whether the whole law could live or die. this was a narrower question. but so much was at stake here because the administration feared that if the supreme court said those subsidyies were available only in the states that set up their own exchanges, then the health care costs would go up for everybody else, they wouldn't be able to afford it, they wouldn't have the subsidies and it would go into what the administration called a death spiral, making health insurance more expensive for everybody else and basically causing this health insurance system to collapse. so, this is a very big victory for the administration. the subsidies are available

nationwide. it doesn't matter, the supreme court says, whether you live in a state that has its own exchange or got your insurance through the federal exchange, healthcare.gov, either way, you get the substudy. for the average person, it was about $270 a month, but for many people, it was much more than that. and it made the difference between whether they could afford health insurance or not. so, bottom line here, big victory for the administration. this saves for the second time the obamacare law. it will go forward. now, congress can still change the law, if it wants, but people who feared that the obama administration would lose here hoped that congress might make some changes, but that seemed unlikely. so, the ball does not automatically go back to congress. the administration wins a big one here today. >> yeah, but pete, let's just make hurricane is the headline, you pointed to this very appropriately a second ago, the headline here is that this has not been saved on constitutional grounds.

this is much more of a technicality. >> right. well, yes. i mean, the case three years ago was about the constitutional framework here, did congress have the power to do what it did? this was a much different case. the supreme court basically does two kind of jobs here, interpret the constitution, which is a big deal, or more narrowly, interprets what federal laws mean. this was that latter kind of case. what did the words of the statute mean in the chal? the tax break, the subsidies were only available for insurance purchased on an exchange established by the state. and they said if you just look at those words, then that that means that the subsidies are only available narrowly. but the court said you have to look at a statute as a whole, you have to look at the whole meaning of the law and quite clear what congress meant this whole thing -- how this whole thing was supposed to work. so the insurance is available to everybody. pete, we basically have status quo. you mentioned this 156-3 decision.

we remember the chief justice saving obamacare three years ago. what's the roll call now? who wrote the opinion? who is in the majority? >> it is a 6-3 decision and chief justice roberts wrote this decision. he wrote sort of a deciding opinion three years ago when they bailed out obamacare. and he wrote it again this time, joined by justices kennedy and beginsburg, breyer, soto mayer and kagan. justice scalia filed the dissenting opinion, which thomas and alito joined, 6-3, roberts once again coming to the rescue to for the administration. there were some early suggestions that the court might do this in a couple of other decisions earlier this year, when even the conservatives said you have to read a statute as a whole. so i must say, after hearing the argument, it did seem like the administration got less of a roughing up than would you have expected, if it was going to lose. so, we all thought maybe 5-4,

but to have it be 6-3 is a surprise. >> pete, i remember three years ago, we sat here after the first challenge and the court upheld the affordable care act. i said to you, pete is there anything else in the pipeline that will challenge this in the future, you said, yes, and here we are today. i will ask the question again, is there anything else in the pipeline on obamacare that can bring it back before the supreme court? >> well, yes, absolutely. but i don't know any that had quite the legs that this one did. there is still a continuing turmoil in the courts about who gets a religious exception to obamacare. you know, certainly, churches don't have to provide contraceptive coverage, but there's still a turmoil in the lower courts about how broadly that goes. by the way, speaking of the dissent, now that we have had two times where the supreme court has upheld this, justice antonin scalia said we should start calling this scotus scare, using the abbreviation for supreme court of the united states, instead of obamacare.

>> justice scalia has way with words. we know that stand by with the court. we want to get the political fallout here. nbc's chris jansing is at the white house for us. many years shallz a this case was going through the courts, the administration didn't give it that much credence thinking it is not really going to go anywhere, then makes it all the way to the supreme court, people started getting nervous. what's the feeling there now? >> reporter: obviously, feeling of relief because even though josh earnest said just a couple of days ago that nobody at the white house was losing any sleep over it and the president repeatedly over the last several months, when asked about this, had expressed confidence and confidence in the legal analysis of his team, there was always the possibility. and they acknowledged they didn't have a plan b, that this could throw the health care system into chaos according to a lot of health care experts and experts who work here at the white house. for them, there is a very real logistical outcome to this

moving forward and not having 5 million people who essentially have their health care up in the air. there sis a political intent here. the polls are pretty split on obamacare itself but when you look at should the federal government help people get insurance, about 70 in the most recent poll said yes and the white house has felt all along that this was going to be very much like social security and medicare, that the longer it became entrenched in the system, the more people would like it, the more people would come to depend upon it and they believe that that is already happening. and of course, there is also the issue of president obama's legacy. this is something when it first passed back in 2010, he likened to part of the american dream. >> right. >> and so, this is key for him in terms of his legacy going forward. this is something he very much wants to have when the history books are written. >> as long as you said, you know there is the political side of this, let me ask to you look down the road to the u.s. capitol and how is the republican-controlled congress

likely to react? what's their next move? >> well, their next move has always been, and this is for a handful of people who believe very strongly that obamacare is wrong, they have already voted, i think it's something like 56 times is the latest count, either to repeal or some way undermine obamacare, that it will continue to be on that docket but also, it's going to continue to be part of the conversation as we have this ever-expanding number of republicans who are going to be answering questions. and i can tell you as somebody who has been out there in iowa and new hampshire and these early states, these are questions that are raised. so it's going to be become part of that conversation as well what do we do next? >> chris, for some republicans, it's probably a sigh of relief, as a practical matter, because many of them would say privately, if you throw millions of people off of the health care rolls, as this case had the poe attention to do, then you got to come up with an alternative. >> and they didn't have an alternative. that was the admission that many

of them were forced to make in private. so, you're right. this is, for many, at least privately, a big sigh of relief that this does not create that huge problem for them, savannah. chris, thank you very much. want to go back to pete williams on this. pete, you have had a little more time to read deeper into the decision. anything else jump out at you? >> well, a majority opinion says congress passed this law to improve health insurance markets, not to destroy them. the dissent, justice antonin scalia says it is clear that the supreme court has some favorite statutes. the headline here, obamacare is saved. >> all right, pete williams at the court. so for the second time in three years, the highest court in the land, the u.s. supreme court, has upheld obamacare or the affordable care act law. >> a very interesting road for the obamacare law, first challenge three years ago on the essential constitutional grounds, does congress even have the power to do it, now on something very narrow, very technical and once again, as pete said, the supreme court to the rescue for this law. so things are, as they stood before the court ruled this

overstated the weights of prepackaged foods and this morning the company is vigorously defending itself. some shoppers have become accustomed to sometimes paying higher prices for high quality foods in whole foods. but no one was expecting this when the new york department of consumer affairs found all the products had mislabeled weights meaning customers are being overcharged. >> sometimes $2 or $3 per item. sometimes $6. we are talking about significant sums of money that add up over time. >> reporter: the u.s. department of commerce does allow some wiggle rooms when its comes to label discrepancy. but 89% of the whole foods packages tested failed to meet that standard. >> i think that was wrong. >> i feel cheated. >> it's disappointing. >> it absolutely makes me think twice about shopping at whole foods. >> reporter: and it isn't the first time whole foods has come under fire for overcharging.

2012 investigation in california found pricing irregularities that resulted in a lawsuit. whole foods wound up paying close to $800,000 in penalties. whole foods issued a statement saying, we disagree with the dca's overreaching allegations and we are vigorously defending ourselves. we cooperated with the dca from the beginning until we disagreed with their monetary demands. despite our request to the dca they have not provided evidence to back up their demands nor have they requested any additional information from us. but instead, they have taken this to the media to coerce us. an attorney says mistakes may happen but they're not intentional. >> a lot of times the errors are in the favor of the customer rather than whole foods market. for them to say that we have done some systematic or systematically overcharged customers is inaccurate. >> reporter: whole foods say that the dca is trying to poison public opinion and strong arm them into paying a hefty fine.

documents. >> reporter: this is the episode of "finding your roots" that was pulled after finding out that the show's host professor gates jr. violated pbs standards by failing to shield the creative and editorial process from improper influence. >> anything in particular you wondered about? >> reporter: ben affleck admitted he asked professor gates not to reveal that one of his ancestors owned slaves. gates said i sincerely regret not discussing my editing rationale with the partners at pbs. the scandal first surfaced after private e-mails between gates and sony entertainment ceo michael lenten were made public after being hacked. gates said, one of our guests asked us to edit out something about ancestors, the fact he owned slaves. he's a megastar what do we do? when news went viral, he quickly addressed the controversy on facebook. i regret my initial thoughts

happened here. >> reporter: for the second time the president has walked back from the cliff here on his health care law. the supreme court said it's not correct that the only people who get these tax credits are people who live in the 16 states that have set up their own exchanges. that's what the challengers argued. they said the plain meaning of the words of the law passed by congress limited the subsidies. but the supreme court said no, that's not right. you have to read the health care law as a whole. it's clear that congress meant that people had to buy insurance in order to spread the risk around and make insurance affordable and it's clear that the law said that everybody gets the subsidy whether they live in a state with an exchange or whether they buy the subsidy or whether they buy the health care on health care.gov. if the challengers won, then the insurance program would go into a death spiral. all right. pete. here's the president. five years ago, after nearly a century of talk decades of

trying a year of bipartisan debate we finally declared that in america health care is not a privilege for a few, but a right for all. over those five years, as we've worked to implement the affordable care fact there have been successes and setbacks. the setbacks i remember clearly. but as the dust has settled, there can be no doubt that this law is working. it has changed and in some cases saved american lives. it set this country on a smarter, stronger course. and today, after more than 50 votes in congress to repeal or weaken this law, after a presidential election based in part on preserving or repealing this law, after multiple challenges to this law before

the supreme court, the affordable care act is the here to stay. this morning, the court upheld a critical part of this law. the part that's made it easier for americans to afford health insurance regardless of where you live. if the partisan challenge to this law had succeeded, millions of americans would have had thousands of dollars worth of tax credits taken from them. for many insurance would have been become unaffordable again. many would have been become uninsured again. ultimately everyone's premiums could have gone up. america would have gone backward. and that's not what we do. that's not what america does. we move forward. so today is a victory for hard working americans all across this country whose lives will continue to become more secure in a changing economy because of this law. if you are a parent you can keep your kids on your plan until they turn 26 something

that has covered millions of young people so far. that's because of this law. if your senior or an american with a disability this law gives you discounts on your prescriptions, something that saved nine million americans an average of $1600 so far. if you are a woman, you can't be charged more than anybody else even if you have had cancer or your husband had heart disease or just because you are a woman. your insurer has to offer preventive services like mammograms. they can't place annual or lifetime caps on your care. because of this law. because this law, and because of today's decision millions of americans who i hear from every single day will continue to receive the tax credits that have given about eight in ten people who buy insurance on the new marketplaces the choice of health care plans that cost less

than $100 a month. and when it comes to preexisting conditions some day our grandkids will ask us if there was really a time when america discriminated against people who get sick. because that is something this law has ended for good. that affects everybody with health insurance. not just folks who got insurance through the affordable care act. all of america has protections it didn't have before. the law's provisions have gradually taken effect more than 16 million uninsured americans have gained coverage so far. nearly one in three americans who was uninsured a few years ago is insured today. the uninsured rate in america is the lowest since we began to keep records. and that is something we can all be proud of. meanwhile, the law has helped hold the price of health care to its slowest growth in 50 years.

if your family gets insurance through your job, or you are not using the affordable care act, you are still paying about $1800 less per year on average than you would be if we hadn't done anything. by one leading measure what business owners pay out in wages and salaries is now finally growing faster than what they spend on health insurance. that hasn't happened in 17 years. and that's good for workers. and it's good for the economy. the point is this is not an abstract thing anymore. this is not a set of political talking points. this is reality. we can see how it is working. this law is working exactly as it's supposed to. in many ways this law is working better than we expected it to. for all the misinformation

campaigns, all the doomsday predictions, all the talk of death panels and job disruption -- for all the repeal attempts this law is now helping tens of millions of americans. and they've told me that it has changed their lives for the better. i've had moms come up and say, my son was able to see a doctor and get diagnosed and catch a tumor early. and he is alive today because of this law. this law is working. and it's going to keep doing just that. five years in this is no longer about a law. this is not about the affordable care act as legislation or obama care as a political football. this is health care in america.

and unlike social security or medicare a lot of americans still don't know what obama care is beyond all the political noise in washington. but across the country, there remain people who are directly benefitting from the law, but don't even know it. and that's okay. there is no card that says obama care when you enroll. but that's by design. this has never been a government takeover of health care despite cries to the contrary. this reform remains what it has always been, a set of ferrer rules and tougher protections that have made health care in america more affordable more obtainable and more about you, the consumer the american people. it's working. and with this case behind us

let's be clear. we've still got work to do to make health care in america even better. we'll keep working to provide consumers with all the tools you need to make informed choices about your care. we'll keep working to increase the use of preventive care that avoids bigger problems down the road. we'll keep working to boost the steadily improving quality of care in hospitals, bring down costs even lower, make the system work even better. already, we've seen reductions for example, in the number of readmissions in hospitals. that saves our society money. it saves families money. makes people healthier. we're making progress. we're going to keep working to get more people covered. i'm going to work as hard as i can to convince more governors and state legislatures to take advantage of the law, put politics aside, and expand medicaid and cover their citizens.

we've still got states out there that for political reasons, are not covering millions of people that they could be covering despite the fact that the federal government's picking up the tab. so we've got more work to do. but what we're not going to do is unravel what has now been woven into the fax fabric of america. my greatest hope is rather than keep refighting ballots that have been settled again, and again, and again, i can work with republicans and democrats to move forward. let's join together make health care in america even better. three generations ago we chose to end an era when seniors were left to languish in poverty. we passed social security. and slowly it was woven into the fabric of america and made a

difference in the lives of millions of people. two generations ago, we chose to end an age when americans in their golden years didn't have the guarantee of health care. medicare was passed. and it helped millions of people. this generation of americans chose to finish the job, to turn the page on a past when our citizens cobb could be denied coverage just for being sick to close the books on history where tens of millions of americans had no hope of finding decent affordable health care had to hang their chances on fate. we chose to write a new chapter where, in a new economy, americans are free to change their job, start a business chase a new idea raise a family free from fear secure in the knowledge that affordable health

care is there for us and always will be and that if we get sick we are not going to lose our home that if we get sick, that we're going to be able to still look after our families. that's when american soars, when we look out for one another, when we take care of each other, when we root for one another's success, when we strive to do better and to be better than the generation that came before us and try to build something better for generations to come. that's why we do what we do. that's the whole point of public service. so this was a good day for

[ applause ] >> president obama shaking the vice president's hand as he concludes his remarks commenting on the affordable care act, the decision by the u.s. supreme court today to uphold a major provision of that law. the president says the law is working. he says the affordable care act is here to stay. we want to go to chris janicing now in the rose garden. chris, the president took a number of swipes against those efforts to repeal this law. what is the reaction? >> reporter: well obviously, they are thrilled here. there were a number of senior staff members who were alongside the doors of the white house. and even though they had been expressing confidence all along there is always a concern that a ruling like this could go against them. this is a victory lap for the president that he called a great day for america. but this is also a signature achievement of this presidency and it preserves that part of his legacy. however, when he did say that you know this is not about
