>> that's right, laura and sam. that remains unclear. law enforcement sources close to the investigation say that, yes, that gun was stolen from a federal agent's car. what is still unknown is whether the accused killer himself stole the gun. now, lopez sanchez had told multiple reporters that he found that gun wrapped in either a towel or a t-shirt near a bench. the mexican national who has been deported five times was released from san francisco county jail in april after charges of marijuana sales were dropped. in san francisco sanctuary law adopted in 1989 and made more stringent two years ago, meant immigration officials were not notified when he was released. it left politicians to prosecutors talking about sanctuary policies and how to treat undocumented immigrants. >> done by one individual no matter how terrible and tragic, doesn't represent a whole community. >> it's the confusion at the federal level that has allowed local communities to sort of be

mischievous and in some eyes to be overly creative with these sanctuary city policies. >> lopez sanchez is accused of shooting 32-year-old kathryn steinle in the back as she walked pier 14 with her dad a week ago today. his public defender told the judge the shooting had a high probability of being accidental. prosecutors argue he willfully, unlawfully, and with malice shot and killed steinle. the judge granted half of the bail. lopez sanchez's next court date is july 22nd. they're working separately on the area of sanctuary city paulalpau policie policies. we will have more in 30 minutes. >> thank you very much. in the meantime, hillary clinton weighing in on the sanctuary city policy. she said san francisco officials made a mistake and they were wrong to release lopez sanchez

from jail. she says they ignored strong evidence he should have been deported again. many republican leaders agree with clinton. >> he was released in general society to commit a murder. does that make any sense to you? it doesn't make any sense to the american public. >> that senator ron johnson from wisconsin aggressively questioning a representative from i.c.e. during a senate hearing on security. >> this started with donald trump weighing in, putting his two cents into the immigration debate. he's not getting very positive feedback. trump is second right now in several gop polls but his comment about mexican imgrpts are not sitting well with latinos, including some of those working on his new hotel in washington. he recently said immigrants are bringing drugs and crime into the u.s. a protest is planned for tomorrow at the hotel he's building. nine companies have already severed their relationship with

charges including robbery, assault with a deadly weapon and kidnapping. >> two men held a 10-year-old girl at gunpoint as they robbed her family's san jose house. this happened at an apartment complex on ranchero way. the family said it started with a simple knock at the front door. then two men rushed inside with handguns. one of the suspects grabbed the girl around the neck and pointed the gun at her temple. the robbers demanded property and money, and the suspected forced the girl to force the family to cooperate. >> well, startling sight in san francisco. several people say they have seen a mountain lion walking the streets. one person even has a picture to prove it. >> we heard about this in the south bay. experts say they were skeptical about a mountain lion in the city until they saw this grainy image. >> bob redell live in san francisco. a lot of people want this big cat captured. i'm sure you're looking over

your shoulder. >> laura and sam, yes. four sightings of this creature in over the past week in the san francisco area. what makes it so unusual is that this is taking place in an urban setting. look behind me, this is one of the locations around the south block, just a couple blocks away from st. mary's cathedral and back to the image you were talking about, that's a screen grab from a surveillance video that captured this guy walking down a sidewalk. also captured in the presidio and near lake merced. they think it's unlikely this big cat would go after anyone. there's a better chance it would just run away. >> most likely, it could have been a young adult male that was leaving its mother's range looking for a new range in which to live.

>> we plotted the location of the four sightings on a map. the first two a week ago last night in the one presidio neighborhood. the next day, and then a couple days later near lake merced. we reported last night another possible sighting in daly city. the thought is that this creature is headed south back down the peninsula where sightings are more common. in may, law enforcement locked down a neighborhood in san mateo to tranquilize and capture a mountain lion. this image is from october with a big cat stood on someone's car in san jose. reporting live in san francisco, bob redell, today in the bay. >> thank you very much. wildfires could soon be treated like federal disasters. that is a proposal from house republicans goes through. that bill will be considered tomorrow and part of a broader attempt to target overgrown

forest lands. it would allow federal agencies to tap into a disaster fund if they run out of money to fight fires. the obama administration says the house bill is a step forward but it still does not go far enough. state water leaders are trying to figure out how to meet the governor's drought regulations twiel stick making money. they're hosting a workshop today in hopes of figuring that out. they want californians to cut back on water use, but those cutbacks cost water districts money. the water board has asked some communities to cut back by as much as 36%. okay, drought buster? probably not. but a little bit of rain may be on the way for tonight. let's check in right now. >> and the best thing that comes along with that is there could be some lightning too, and it's already dry. so we'll be watching out for that. as you head out today, this is what you need to know. a mild and cloudy morning. sunrise coming up in about 45 minutes and clouds later today, and some high terrain storms.

we're tracking the possibility of storms across the sierra and areas of lightning tonight in the bay and a little bit of rain in a few spots. san jose today reaches 77 degrees. and 76 degrees in redwood city. mission district, 67 degrees. 78 degrees in santa rosa. notice the icon there showing some rain and lightning. you may get a little bit of some measurable rain tonight and into the day tomorrow. walnut creek reaching 80 degrees and pleasanton topping out at 80 degrees. overall, a fairly quiet day until tonight when we start to track some of the showers and storms moving in. i'll detail that and we'll check out the weekend coming up in a few minutes. right now, i'll send it to mike for traffic. >> i have a warning for folks heading across the golden gate bridge. overnight road crews have it down to one lane. your far right lane southbound coming into san francisco. this is not the project. but we're looking at the center

divide that has not been moved for the morning commute. we're look at the map and see no problem for the speed sensors. a little slowing southbound as a result of one lane open. we'll track that, but it's scheduled to be clear by now. the rest of the bay moving smoothly behind me. your typical slight build there. in the south bay, no issues. northbound is your commute issue, and then the overnight road crew has reopened the lanes, but one truck in the central divide. >> one area you're watching out for is the golden gate bridge. now we have an update there. drivers should be prepared for delays in san francisco as crews are preparing to close doyle drive, the access road to the golden gate bridge. it's going to be closed in both directions at 10:00 p.m. tomorrow so the crews can work on the new presidio parkway. it's going to reopen to the public at 5:00 monday morning. drivers are encouraged to take

flag is now in the hands of the south carolina house of representatives. the house had its first reading yesterday after the senate overwhelmingly voted to remove the flag from the grounds of the state house. debate over the measure continues in the house today for two more readings. right now, lawmakers are on track for a final vote on the issue tomorrow. the bush era no child left behind education law, you remember that one. will be up for debate on capitol hill today. they're thinking about tinkering with it. the senate is working toward a bipartisan measure to rewrite the law that would shift much of the oversight of schools down to the states and local districts. the white house wants changes specifically a cap on the amount of time spent on standardized testing which is a key part of the law. >> it's time for launching a bold new effort to streamline what has been the tangled process of transferring from a community college. if you have ever transferred from an in-state community college, you know how confusing it can be and how some courses

won't transfer. all that is supposed to end. each campus will now require the same classes for the most popular majors and each school will operate under a more consistent and simple system. >> this has nothing to do with the crisis in greece at all, but chinese stock markets right now fell apart again overnight. hong kong's main index dropped 5%. >> these are not markets americans really know a lot about. >> that's right, laura. in the next hour, we'll do a deeper dive into what's gone wrong. for now, if you need to go out the door, note three things. one, the chinese stock markets are in a free fall. two, it's mostly their fault. this is not some kind of global contagion. three, the chinese government is making major moves to stanch the bleeding. a weird combination of capitalism and communism. you mentioned greece, over in europe, the prime minister of greece, the new finance minister met with european leaders.

5:17. fierce opposition from religious groups stalled california's right to die bill. the authors of the bill did not present it to the senate committee as scheduled, pulled it back because they were told it didn't have enough votes to advance. it delay means the bill cannot pass out of committee this year. the bill would have allowed terminally ill patients to end their lives with the help of a physician. >> two major tobacco bills will be looked at today. one is aimed at curbing youth smoking by regulating e cigarettes and the other is changing the legal smoking age to 21. votes passed in the senate last month but face tough obstacles. tobacco companies are putting up a tough fight. >> one bay area city became the first one in california to hike the age limit to buy tobacco products. you must be 21 to smoke cigarettes in healdsburg. other cities might not be far behind. three quarters of adults agree states should raise the minimum age to buy tobacco to 21 years

old. >> 5:18. heroin is raging in popularity and the number of lives it's taking. new numbers from the cdc and fda shows heroin-related deaths have nearly quadruples in the last decade from 2002 to 2013, heroin use spiked 63%. twice as many women are now using heroin, and the numbers seem to show it doesn't discriminate. heroin today has turned into a disease that is really out of control. >> we're seeing heroin affecting people in urban and rural areas, white, black, and hispanic. low, middle, and high income. we're seeing heroin defusing throughout society. >> the new report also shows people who become addicted to pain killers are 40 times more likely to ultimately become addicted to heroin. experts are calling for expanded access to drug treatment facilities. medical news now, the biggest advance against heart failure in more than a decade.

the fda has approved a new drug that's from nuvarts's drug company, and the excitement has been growing since a large clinical study found the drug reduced the risk of heart failure more than any medication on the market. the trial shows a 20% reduction in the risk of death from cardiovasural causes or hospitalization from heart failure. >> great to hear. >> our meteorologist joins us with a look at the midweek forecast. >> i'm excited we have a chance of rain in the forecast and hopefully we'll be able to get measurable rain in the next 24 hours across the bay area. right now, though, really dry. c we see some low clouds as you head out the door. a live look at san jose. we see things are flowing smoothie and looking good for the start of the day. not a lot of low clouds here, but we're seeing them in the city, and the seven-day forecast now coming up at the bottom of the screen, you'll want to come over and take a look at that.

we do also have the low clouds that will be with us a little longer today than yesterday as we zoom in to take a look at san francisco, the darker shades of gray show where we do have the low clouds and fog, and even at noon, we see those clouds in parts of the city and all along the bay area, along the coastal areas, and then quickly moves back in by 5:00, so it doesn't look like especially for the coast, we'll see a lot of clearing. i think we'll get a mixture of sun and clouds at at&t park, long enough for the giants to face off with the mets. 62 degrees at the start of the game. by the fifth inning, 65 degrees. much more comfortable with those midday games. and a slight chance of rain begins later on this evening for parts of the peninsula and the south bay. a few more showers may start the day tomorrow. want to keep the umbrella somewhere close by so the plants close by just in case you get under one of those showers that moves through quickly and clears out in time for the weekend.

trace amounts of rain all across the bay area. maybe .03 inch, the better chance will be for the north bay and sierra. that's where we could also see some lightning, so keep that in mind during the overnight hours, or if you're traveling to the east, you may have heavy rainfall and lightning in the forecast. let's get a look at how the roads are flowing. >> a lot better against the golden gate bridge. i'm chuckling because i saw a pickup truck driving in reverse probably the fastest i have seen while picking up cones, clearing the southbound lanes across the bridge, and now we'll see that middle divider move over for the morning commute. we're catching up a little lost time at the golden gate bridge. at the bay bridge, we're starting to lose time. for the cash lanes, the fast track still the fastest way in towards san francisco from oakland. as we look at the map, we remind you about the midday game. midday traffic getting in from oakland to san francisco, but right now, no major issues. again, the golden gate bridge congestion should clear up southbound. the south bay looking good, same for the peninsula and across the

influence of drugs and alcohol and the collision happened as relatives were traveling to the bay area for his sister's wedding. >> never hear hi, mom, it's greg, again, and it hurts so much. >> police are urging the district attorney right now to charge the driver with a long list of felony charges. >> very sad time for that family. 5:35. we're learning more this morning about a deadly plane crash in alaska that killed nine people last month. the ntsb released their preliminary report saying the crash happened during reduced visibility, but it was still safe to fly. true cause remains a history. the plane crashed on a steep cliff killing the pilot and eight passengers. >> perplexing people in san francisco, on high alert, why? because a mountain lion has been spotted walking the streets. >> there have been several sightings of the mountain lion in the past week alone. bob redell live in san francisco, finding and capturing the big cat is on the mind of a lot of people.

>> laura and sam, we're here on the 1,000 block just down the street from cathedral hill. this is where somebody spotted this mountain lion last week. you can see it's a very urban setting, and here he is again in the seacliff neighborhood about fourory five miles from where we are at, captured on a surveillance camera walking down the sidewalk. i say he because the president of puma project says she believes it's a male mountain lion who left its mother for the first time looking for its own range to roam. clearly out of his element. >> the mountain lion seen on the video is probably going to run the other direction, probably quite scared, being in that setting. so i think that the chances are very slim that the lion would actually approach any person. >> if you're curious where this mountain lion has been spotted in san francisco, you look on your tv skrecreen, we plotted t

get enough rain out of that to at least make things damp before we head into a dry weekend. right now as you walk out the door, about 61 degrees. we're seeing that all across the bay with the low clouds. this afternoon, it will be so comfortable with highs only making it into the 60s and 70s. and in the east bay, 74 degrees, while the tri-valley reaches 82 degrees. there will also be a chance of a shower or thunderstorm, too, later on this evening, and then into the day tomorrow. you're heading out to the giants game, we will get a slow clearing of the clouds, a mixture of sun and clouds throughout the day, and 62 degrees at first pitch. at the end of the game, 63 degrees. overall, not a bad day to hang out at at&t park, and into the weekend, we'll get sunshine returning. i'll detail that and talk more about the rain chance and lightning coming up a little later. right now, let's check in with mike who is tracking problems on the roadways. >> that's right, fremont, we start there. also, just got word of an issue

be laid off. this coming one day after president obama said the u.s.-led coalition fighting isis would step up its campaign in syria. >> some wildfires could soon be treated like federal disasters if a proposal from house republicans goes through. the bill will be considered tomorrow and it's part of a broader attempt to target overgrown forest lands. it would allow federal agencies to tap into a fund if they run out of money to fight fires. the obama administration says the bill is a step forward but it doesn't go far enough. >> we are bracing for the wildfire season. any sight of water would help. >> we have a little bit in the forecast, but we also have lightning, too, that may spark the skies as we go into tonight. we'll be watching for the possibility of some thunderstorms moving into the bay area. right now, as you walk out the door, this is what you need to know. check out the gorgeous view. you see those low clouds as we

get a view from the north bay. the seven-day forecast coming up at the bottom of the screen. a lot to take in because we have changes on the way. it will be a mild and cloudy morning, and sunrise happening right about, let's say, eight minutes, and a mixture of sun and clouds later today. high terrain storms meaning into the sierra. we could have those lightning strikes coming down. also areas of lightning for the bay area, too, with sunset at 8:31. now, temperatures are in the upper 50s to lower 60s. livermore now at 63 degrees. and what you'll notice today, different from yesterday, it will take longer for the low clouds to clear out, especially in san francisco. you can see the clouds still hanging on across the golden gate bridge and into the san francisco bay. and then it rolls back in fairly quickly, so it may not be a lot of time that you get sunshine in the city and also for parts, other parts of the bay area. we have a stronger onshore flow, so it will be a little more

breezy today. here we are at noon, winds coming in at about 15 miles per hour, picking up to 20 miles per hour, and that makes it feel cooler. with that possibility of rain moving into the forecast for tonight. and .03 inch will be possible in san jose, the normal amount in the entire month of july. hoping we'll get that tonight. let's check in with mike for traffic. >> a big issue for the bay bridge. situation details changing in the last couple seconds. the detail now from chp is in treasure island tunnel we have the left two lanes blocked by the on ramp. two lanes blocked in the tunnel. look at it slammed all the way across from the incline up toward the treasure island san francisco side clear because of the lighter traffic that's led up to the jam here. this is a major delay for the bay bridge right now. we don't know how long it's going to take to remove what sounds like a van on its side. this is a jam forming here, and we'll see the repercussion for

suspects got out of two separate vans and started shooting into a crowd. a woman and two men were killed. so far, detectives are not naming suspects or possible motives but the university is warning students to use caution in that area. fireworks were not the most memorable part of one new mexico sheriff deputy's fourth of july patrol. a naked man drove away in his cruiser. >> sir, sir! hey, get out of there! hey! >> you see the car going away there, and there's the naked man. deputies were responding to reports of that guy walking right down the highway, wearing nothing but his birthday suit. the man was acting very erratically and claimed he had been poisoned. in one deputy's body camera video, you can see the man run around a patrol car, jump in and take off. another deputy was able to catch him and make an arrest. >> it's 5:50. there is new backlash against comedian bill cosby. this time, the removal of a statue to honor the comedian.
