rethinking immigration policy in the wake of kate steinle's death. today her father testifies before d.c. lawmakers looking to make sweeping changes. and shots fired in a normally quiet bay area neighborhood. why police say the officer felt he had no choice but to pull the trigger. but first rumble in the east bay. the modest quake that jolted some beds in the middle of the night. >> announcer: from nbc bay area, this is "today in the bay." and a good tuesday morning, it's 4:30. i'm sam brock. >> and i'm kris sanchez in for laura garcia-cannon. lots to get to this morning including that earthquake, but

first a check of your forecast with meteorologist kari hall. good morning. >> good morning. i've got some great news for you. we will not have that searing heat like we had yesterday. it was so muggy. today those temperatures come way down. we start out the morning still fairly mild, in the lower 60s across most of the bay. in the north bay right now it's 58 degrees. and the low clouds have returned, too. in the east bay 74 degrees, 86 degrees will be the high in the north bay, south bay 83 degrees, and san francisco expect a high of 71 degrees. we will take a look at the rest of the forecast for the week. right now let's see how the roads are flowing with mike. stick with me for one second because bart did just give us word because of the early morning quake which we will tell you about in a second they are doing a system wide check and they standardly do that, 10, 15 minutes to finish, we are looking at minor delays possible. on the roadways no delays for 580 at 680, 680 southbound

moving well. yesterday had many problems i understand. anthony dealt with that all morning and all day. road crews at the interchange not completely clear there. the rest of the bay moves smoothly including the north bay coming in in towards san francisco. that earthquake woke me up, guys. we begin with that breaking news. it was felt from the south bay to the north bay even by mike inouye and it was a light quake that hit early this morning. >> it was a 4.0 earthquake that stuck just before 3:00 in fremont. we've seen several a aftershocks since. today in the bay bob redell is live with direction. >> reporter: i didn't feel it at home in livermore but plenty of feemt felt it in fremont especially at the niles district and it was the epi is center. they said it lasted very briefly, maybe two to three seconds, enough to scare him for that short amount of time and

remind him of the danger that lurks on the hayward fault which is where the usgs believes this morning's tumbler was based. when you look at what happened this morning, you look on a sighs mow graph. it looks very dramatic, as it is in that respect, but when you look at it from a scientific and geological point of view it was a 4.0 that struck at 2:41 this morning. it's what seismologists consider to be a light earthquake. it was felt throughout the bay area, especially here in fremont. there have been several aftershocks since, you had the 4.0 at 2:41. there was a 2.7 about 15 minutes and then a 2.6 at 3:07 this morning. fremont police received many phone calls but no reports of any damage. chp has tweeted out had this photo, they tell us that the major free ways am in union city and fremont all check out. as mike was telling us that is normal in a situation like this,

bart a performing track inspections which means they are going to be running their trains slowly for some time until they get the all clear. we could be seeing delays of up to 30 pins on bart. again, a 4.0 striking while most of us were still asleep, not i of course as we get up early, but definitely a little wake-up call this morning, a reminder of where we live here in earthquake country. reporting live in fremont, bob redell, "today in the bay." bob will continue to track it. you can also track the latest earthquakes in our area on line. go to nbcbayarea.com. you can find a realtime quake map there. just search quake map. though to a story still developing overnight, we're waiting to hear the condition of a man shot by fremont police. he is accused of chasing his roommates with a knife. that happened on baffin heavy right near new park mall. a woman called police saying that she and another woman were being chased by their roommate.

when police got there officers say they were confronted by a man with a knife on the front porch of that house. the two officers then opened fire. >> i was sitting in my bedroom and i heard three noises, three pops, i thought it was fireworks the at first. ten i heard some cars speeding town the street. >> the man was taken to the hospital, but this morning there is no word on his condition and the women were not hurt. happening today, tragedy in san francisco and now the reverb operations are being felt all the way in washington, d.c. it this morning kate steinle's father will testify before the senate lawmakers. >> some of those remarks today could actually act as a springboard for changes in immigration policy. "today in the bay" stephanie chuang joins us live in our san francisco newsroom with more this morning. >> reporter: a lot of it could really center on the sanctuary city policy which some lawmakers and politicians have been blaming for the release of that undocumented immigrant who is accused of shooting and killing 32-year-old catherine kate steinle on pier 14 with her father july 1st.

the pleasanton woman was walking with her father when she was killed. police arrested juan francisco lopez-sanchez within the hour after the shooting. he is a mexican national with seven felony convictions who had been deported five times. he was released from a san francisco county jail after the sheriff's department inn in order an immigration hold request, a move the department said would violate san francisco's sanctuary city policies. california lieutenant governor gavin newsom acknowledges there definitely needs to be some changes. >> i don't think it takes much to recognize that there's gaps here. >> reporter: it was republican iowa senator chuck grassley who requested this morning's hearing, he has invited the head of ice as well as the director of immigration services to speak after the steinle family addresses the senators. other victims' families are also set to speak at this morning's hearing which starts at 7:00 this morning our time and of course we will have coverage of this had here.

live in the san francisco newsroom, stephanie chuang, "today in the bay." more details now, the archdiocese of san francisco is asking leaders at all levels to work together in a press release archbishop cord leany said that new policies should not punish all immigrants because of the poor decisions of a few. he wrote this part, while it is important that we learn from this incident and work to prevent it from happening again it is also important we recognize the vast majority of immigrants, both those with and without papers, are not a violent threat to society and so should not be subject to guilt by association. he also offered kond renss to steinle's family. >> happening to you, top leaders from the bay area are representing california at the vatican. san francisco mayor ed lee, san jose mayor sam lick dough and governor jerry brown are attending a global conference on modern slavery and climate change. all three are set to speak this morning. urban inequality and social

inclusion will be one of the key topics. a big issue for the bay area as more low and middle income families struggle to afford housing. >> new this morning a slue of fires, first this one in oakland in a neighborhood forced six people out of their home overnight. it happened after 12:30 on montclair avenue. that house is split into three apartments. flames started on the first floor but quickly spread to the upper story. we spoke to one woman who was inside the home at the time and she said she heard a loud explosion and then saw the flames and smoke. everyone was able to get outside safely. also in vallejo ten people looking for a new place to stay after two duplexes burned overnight. that fire started just after midnight. when fire fighters got there one duplex was burning, another was threatened. crews had to call for backup, but put those flames out in about 20 minutes. the cause still under investigation. two cars up in flames this

morning at a san jose apartment complex and crews are investigating how this happened. one car is destroyed as you can see, another was significant damage at the monterey apartment complex off moore park avenue. tire fighters say there are no obvious signs of what might have caused that fire. person is dead after their car slammed into a funeral home. this happened a little before 10:00 last night at hudson funeral home on telegraph and west mic arthur. it appears the car likely crashed at a high rate of speed. many people live in the area, they were stunned by what happened. police were on hand afterward to keep the crowd at a distance. no other vehicles were involved. so far no information on the driver who died. at 4:39 right now, some relief from the heat. we love those words. meteorologist kari hall joining us now with more. >> good morning. sam and kris, we see the low

clouds as we get a view from the castro, they're become and we are back to more average weather for this time of year. 71 degrees though in hayward, livermore 63 degree, santa rosa 58, san francisco wakes up to 60 degrees. this afternoon we are not looking at those 90s like we saw yesterday and we don't have to deal with that high humidity. 83 degrees will be the high in san jose, redwood city 78 degrees and soma 71 degrees. santa rosa 86 degrees and oakland popping out at 74 while pleasanton reaches 86 degrees. a lot of sunshine today, too. more on that and we will take a look at the rest of the week and the weekend. it's coming up in a few minutes. let's get a look at traffic now. it was that humidity. over here oakland we're looking at right in the middle of your screen i just saw the bart to oakland airport shuttle move across. that's moving. bart is talking about the potential of a 30 minute delay, but they are just warning folks.

they are running trains a little slower now as they get their first run around the system just to make sure there are no anomalies on the track. and the computer system not reporting any problems. we're looking at your maps. we do see no problems for the roadways as well. we're tracking the traffic but so far an easy drive all around the bay. something tall definitely throw commuters down the road, what happens when city officials have to temporarily turn off the transbay tube? traffic mayhem? not when agencies all team up to get commuters around the jam. details on the impending closure.

>> announcer: you're watching "today in the bay." all new this morning, a warning about scammers trying to take advantage of people worried about losing their electricity. according to the mercury news the palo alto utilities department said someone called a customer claiming to be the palo alto utilities department. they told that customer the city was installing new meters and that rates would rise 16%. the person on the phone then offered methods to avoid the increase. the customer got suspicious and hung up. now, the utility company says it's going to send several letters before turning off a customer's power. they're warning you don't respond to those calls. bart officials are shutting down the transbay tube in less than two weeks and today we will get a better idea of how riders

can get around that closure. the transbay tube will close on august 1st and 2nd so at that crews can make repairs to the track. six agencies, transit agencies, from both sides of the bay are teaming up to provide extra buses and ferry service during the shut down. bart has set up temporary trans bay terminal it at the corner of howard and beal streets in san francisco and buses will travel between that point and the 19th street bart station in oakland. a second closure is also planned. that one coming up on labor day weekend. the people demand transportation work around, they also are wall seeing today in san francisco, restaurant workers, that is, demanding higher pay. workers interest my noodles in sonoma county is going to lead a march through the city tonight at 5:30. employees of that restaurant have been locked in a battle with management over wages and it's part of a growing movement across the country demanding respect for restaurant workers and a $15 minimum wage. it is not just restaurant workers looking for a raise, home care workers are rallying

outside of the sonoma county board of supervisors meeting today and they are urging supervisors to include long-term caregivers in the proposed living wage ordinance. the county is considering a mandatory $15 minimum wage for county workers and for large contractors receiving county subsidies. the board is set to vote on that issue next month. on the heels of that famous prime day another online retailer wants to take on amazon. >> we turn now to landon dowdy who is live at cnbc's headquarters working out all the deals. >> good morning. the markets look for more gains today after small advances on monday. futures are mixed with the dow likely weighed town by ibm's 'tis appointing earnings report. the nasdaq closing at a record for the third straight session, earnings will take center stage again today, we get results from verizon, apple, microsoft and yahoo. the do you rising to 18,900 the

drones. two california lawmakers want emergency responders involved in firefighti firefighting, air ambulance or search and rescue operations to be able to force those drones out of the sky and not be liable for any damage. >> we need to put a stop to it. we're going to give them the ability to take out a drone if they are endangering people's lives. >> ideally faa would need to be able to dispatch an emergency signal for a specific gps location to where all drones would receive that information and ground themselves safely. >> drone advocates say that zapping a drone's circuitry or shooting it out of the sky could be dangerous because the drone might strike a firefighter or at any time bystander as it fall. they warn it may even start another fire. meteorologist kari hall doesn't need a drone to see it this forecast because it's right there on the radar. good morning. >> good morning. and we start out with some good news and bad news. the bad news is that we missed out on the only slight chance of rain we had in the forecast, the good news is that it will be a

lot cooler. as you head out this is what you need to know. we start out with a typical low clouds, they are back, and the clouds clear by midmorning, as usual, and we are back to about 16 to 12 degrees cooler than it was yesterday. sunset at 8:28. this morning it's 58 degrees in the north bay, san francisco 60 degrees, 63 degrees in the south bay and reaching 83 degrees in the south bay, east bay 74, san francisco 71 and in the north bay expect highs to reach 86 degrees. of course, tri-valley one of the hot spots, reaching 87 degrees, but it won't be as humid, once again, it will be dryer all across the bay. we don't have that uncomfortable heat as we started the workweek. once again, some fog and low visibility in spots, you may want to allow extra time to get to work this morning as we will see, especially in parts of the coastal areas, north bay and also the coastal areas of the east bay as well, we are seeing

morning commute for thousands of drivers is now three hours instead of one. the i-10 cloesure is in a rural area but impacts cities like phoenix and los angeles. crews say it could take months to get the bridge back in order and kris i even wonderer in southern california would you notice a difference if it were a three-hour compute on a given day? >> it's always a three-hour commute give or take 45 minutes. here is mike inouye. luckily for us it's not a three-hour commute. >> no, but we had some horrendous tri-valley commutes yesterday because of late road work. it went on all day with problems for 680. let's take this full to screen. 580 moves slowly so does 680 at that interchange. there's the dublin bart system, there are delays for that system there. the bart lines reporting 15 to 20 p minutes on average as they continue it to run trains a little slower system wide doing
