gunman. police say 59-year-old john houser killed two people and wounded nine others last night before taking his own life. they said he had been in louisiana for a month staying in a motel. police say they found wigs and disguises when they purchased his room and police believe that housier intended to escape afte the shooting. >> the gunman's original plan was to he leave the theater alive, his car was parked at the exit. as he was leaving in the crowd, he saw the law enforcement, local police officers, went back inside, that's when he shot and killed himself. >> police say of the nine people injured in the shooting two have been released from the hospital, one is still if in critical condition. authorities have not identified a motive for the shooting but they believe houser wasz8sñ wor alone and there are no other suspect or threats. happening today, the man accused of killing a hayward police officer heads to court into this afternoon mark estrada is going to make his first court appearance for the shooting

sergeant of sergeant scott lunger. the investigation into the shooting continuing it this morning. >> "today in the bay" bob redell live at the santa rita county jail. bob, you also have video of a car that hayward police are looking for as well. >> reporter: correct. while mark estrada sits in santa rita jail awaiting his first court appearance scheduled for later this afternoon. his family attorney is telling us that he not be judged, that mark estrada not be judged until his case is put before a court of law. police transferred the 21-year-old man, mark estrada, from oakland here around 9:00 last night from an oakland hospital where he was being treated for a gunshot wound. estrada allegedly shot and killed hayward police sergeant scott lunger during a traffic stop. sergeant lunger's partner turned fire hitting estrada. hayward police say they have no idea why estrada did it this,

but they are looking into another lead in this case and that's what you were just alluding to. investigators would like to know if you recognize this video. a surveillance camera recorded this sedan in mark estrada's oakland neighborhood shortly after sergeant lunger's murder early wednesday morning. >> either it fits in the puzzle and we put it as part of our case or it doesn't and we eliminate and move on to the next thing. >> reporter: this was a heart breaking scene yesterday as sergeant scott lunger's colleagues escorted his body from the coroner's office in oakland to the chapel of the chimes in hayward. throughout the route officers saluted his casket while members of the public paid their respects to this 15-year receipt ran of the hayward police department. his funeral is set tentatively for thursday morning at the neighborhood church it in castro valley. bob redell, "today in the bay." we do have new details about the man shot by a fremont police officer earlier this week. prooemt police say troy francis

threatened and chased two women with a kitchen knife inside a home on monday night. when officers got to the home police say francis then charged at the officers still holding that knife. he is now recovering in the hospital. the officers were not hurt. today we could learn more about the two men and a woman who were shot in val low. right now police calling this a murder-suicide. neighbors say they heard several gunshots last night coming from a home on songwood drive. when officers arrived on the scene they say they pound one man shot at the front door. essay life and in critical condition it in the hospital. inside the home, though, this they found another man and a woman also shot, but they died of their injuries. neighbors tell us there were several children at home at the time. >> fortunately from what i know no kids were hurt, but sadly, there were kids in the house when this happened. >> investigators are not releasing the names of the victim just yet and they are also not saying who pulled the

trigger. at 6:03 a big break in a recent deadly south bay shooting. police say they have made two arrests. it happened on june 26th in east san jose near terilyn avenue and pensacola drive. the victim 17-year-old jonathan natareno died at the scene. police say two san jose men ages 18 and 21 are now facing murder charges. investigators say one of the two opened fire after some sort of argument. san francisco's reportedly launching a new effort to help reform policing strategies, particularly when it comes to minorities. the examiner reports that the city will track demographic data involving all police stops and all people who are detained. it is hoped that a benchmark can be derived to ensure law enforcement teams avoid racial profiling. the move comes in the wake of recent charges of racist and homophobe i can texts exchanged by some san francisco police officers. the plan is it still has to get approval by the board of

supervisors. in new this morning, if you saw flaring coming from the chevron refinery in richmond, don't worry. chevron says the flaring allows for equipment depressurizing and is perfectly normal even though you may think it looks out of place. in less than an hour we hope to learn the latest conditions on a wildfire burning right now still near lake berryessa. it's the third day that crews will be battling those flames. the fire is only 15% contained and some who live in the area are still being kept away from their homes. we have live team coverage of the fire this morning. let's begin with "today in the bay" stephanie chuang who is live at the incident command post. there are 1,300 fire personnel on this and they recently this a shift change. >> reporter: more than 1,300 actually and they are waiting for a briefing this morning at 7:00. you can see here at the command post in vacaville there is firefighters as well as support staff. private contractors, dozers and water tenders who are grabbing breakfast right now before they

go to that briefing where cal fire will go over the plan of attack. the feeling is they will be here for some days. you can get that settled in it feeling. almost 1,400 of the firefighters and personnel, almost triple of how many started yesterday morning. the wragg is fire still at 6,900 acres. containment still only 15%. although they do expect that figure to climb. cal fire spokesperson telling us this morning that the winds died down yesterday and humidity was up really helping that fire fight. >> we do expect similar weather today and we are going to focus on effort on controlling the perimeter and getting evacuation areas lifted as soon as we possibly can. >> reporter: now, san francisco fire crews scanned neighborhoods yesterday checking for hot spots. there are many bay area out here working as well as air support. they helped fight with water drops. cal fire spokesperson saying this morning that people are

feeling, quote,vv÷ cautiously optimistic that the containment figures will be going up today although we won't hear the specifics until 7:30 this morning. live here in vacaville, stephanie chuang, "today in the bay." another fire could change your weekend plans. this one shut down it the main road to south lake tahoe. right now highway 50 is closed as crews continue to battle the flames there. there are about 100 acres burning on both sides of the highway near sly park road and west of myers. there's a campground in the area, that's being evacuated as well. firefighters say the flames are only 5% contained this morning. ironically, the cause of this fire called the kyburz fire might be the same as the napa county fire. this is video that investigators are looking at right now, it shows a truck that lost a wheel and then caught fire on the side of the road. time to check your microclimate forecast as we give you a live look outside, the

golden gate bridge, the weekend is beck thing. >> it will be a nice weekend. humidity starts out nice and low as the crews try to battle those wildfires, especially the one south of lake berryessa. the temperature now at 56 degrees, look at the humidity, 88%, and that drops down to the upper 30s and lower 40s today as far as the percentage of humidity in the air as we go through the day. right now as we start out the day you see temperatures in the it -- mostly in the 50s. look at the north bay, nice cool 49 degrees, a little more sun than yesterday at this time with the sun coming up, not as many clouds. in san francisco today's high will be 67 degrees, 73 east bay and upper 70s, lower 80s elsewhere. if you are heading out to the giants versus the a's game tonight, if you don't have a ticket you can watch it right here on nbc bay area.

states like iowa and new hampshire, donald trump took his campaign right to the border with mexico. trump spoke yesterday at the u.s./mexico border in texas. sticking to his calls for tougher border control, although not use aing the controversial language that he has been using in the past couple weeks. in washington the so-called donald trump act cleared the house. this would prohibit federal funds for sanctuary cities that protect immigrant sus is spects from deportation. it is a big issue in san francisco where an undocumented immigrant is accused of murdering a woman along the embarcadero. >> there are cities more interested in providing a sanctuary for those criminals than theroux viegd a sanctuary for their law abiding citizens. >> presidential candidates will be on the road this this weekend promoting their own views on immigration policy. a new poll shows voters don't prefer one political party over the other when it comes to immigration in particular.

weekend overall? >> yes, it also nice, quiet, morning low clouds, afternoon sunshine, typical stuff. what will not be typical, next week the heat. we could for the first time hit 110 degrees in parts of the bay area. i just hope the computer models aren't right. as we take a look at the live at&t park, they are warming up and just getting that field ready for the big game later on tonight. giants versus the a's. it will be great weather for that as we take a live look also outside across the bay bridge and you see those clouds, beautiful sunrise, the sun peaking through. along the coast it has been cloudy these past couple of days, expect a little more sunshine today and a tad bit warmer, but the fog returns tonight, expect sunset at 8:22. right now it's 58 degrees in livermore, 57 degrees in sun sunnyva sunnyvale. a nice cool start to the day also fairly mild temperatures into the afternoon.

in san jose 79 degrees, mountain view 76 degrees and the castro at 64 degrees. in the lower 80s in the north bay, calistoga and also in walnut creek, in the tri-valley still low 80s there and this weekend one of the events you will want to check out, the gilroy garlic festival. this weekend great weather for that. maybe you will want to try some of that garlic ice cream. it will be warmer this weekend, just a few degrees. we will really feel that heat cranking up as we go into next week. by the middle of the week it will be down right uncomfortable, maybe unbearable in many spots. enjoy the weekend, still some mild weather, nice and school with mostly 70s and 80s across the bay. let's see how traffic is moving with mike. we will start in the north bay, a good deal of sunshine bright thing this shot. southbound 101 no need for slowing. all the way down to the golden gate bridge. the bay bridge we will show you the toll plaza it's a little cloudier and we have a lot more traffic. the backup for these cash lanes

>> announcer: you're watching "today in the bay." san francisco has a splashy new idea aimed at getting people to stop urinating on the streets. the public works department is installing -- or putting on liquid repellant paint in ten locations in the city. here is the guy has going to tell you how it works. >> when people urinate on the wall the pee actually bounces back and hits your pants or gets you wet. so we are piloting it to see if we can discourage people from peeing on many of our hot spots. >> this isn't a crazy idea. some german cities have used it already and this success with that paint. in san francisco the paint is paired with signs saying, hold it. this is not a public restroom.

hayward police sergeant scott lunger is scheduled to make his first court appearance today. mark estrada expected to answer to charges. and the after smooth of those shooting rampage, this time in louisiana. about an hour ago lafayette police give us a better idea of the victims and gunman in in last night's shooting in a movie theater. >> tracie, what are police telling us to far? >> reporter: we're learning more about john russell rusty houser a fan from phoenix city, alabama whose original plan was to leave that theater, but as we learned early this morning there were three victims, one a self-inflicted gunshot wound, he killed himself there at the theater and now they are trying to figure out why. they searched his car, they searched his home, there was a search going on in a motel 6. the bomb squad went in first before authorities went in to

search that area. a 58-year-old man who according to what police say went into that theater, was sitting there with the patrons and then all of a sudden opened fire. we know that two other people were killed, nine other people were shot, one was critical as of early this morning and they are still on the scene investigating at this hour. we will continue to follow that story thank you for the update. happening today, a final good-bye for two of the marines killed during last week's shootings in chattanooga. funerals will be held for staff sergeant david wyatt. his family will bury this him in chattanooga national cemetery because of the outpouring of support in that community. there will also be a service in georgia for lance corporal squire wells. four marines and a sailor tied when a gunman attacked two military services. a bay area's father plea for

immigration appears to have worked. the house passed a bill to crack down on sanctuary cities like san francisco. this it comes after the murder of kate steinle. the suspected gunman is an undocumented immigrant with multiple prior deportations. the bill would block federal funding for cities that refused to enforce federal immigration law. republicans support the bill, democrats call it an irresponsible spub lick policy. the white house says president obama will veto that bill. all this new at 6:00, five miles off highway 116 off the sonoma coastline have been renamed to honor a deputy. the stretch of highway will be known as the deputy sheriff mare receipt wp deeds memorial highway. the sonoma county sheriffs honor guard is going to unveil signs alongside the highway. deeds was shot by an ex-con in 1975. time to check the microclimate forecast as we look out our window on san francisco

slowing around the bay, san francisco, the a's giants game later on today, prepare for post work traffic there. look at the bay bridge approach, the maze an easy drive,th the upper east shore freeway where there is a concern westbound 80, reports of a car fire on the shoulder. the latest update i just got was that the car is engulfed in flames, that means it's going to be quite a spectacle. no injuries reported. no one reportedly in that fire. as we look at the rest of the bay we pass by the san mateo bridge. i will jump in there and show you that westbound is moving smoothly, light volume back out to the maps we do have a disabled car mortgage bound 87, not a major concern. the south bay easy, just that traffic we expect heading south toward gilroy for the garlic festival. >> gates open in two and a half hours. thank you, mike. 6:35. still ahead, swimming 30 miles

jose. the trees looking green from here although we know that the draught has taken the toll around the bay area. two bay area athletes are hoping to swim into the history books by attempting an unprecedented feat. they are trying to swim 30 miles through shark infested waters from the golden gate bridge to the farralon islands. oh, by the way, they are to go it without wet suits, too. so there's that. the bay area news group reports simon dominguez of marin county will make his attempt sometime next week depending on the weather. and then kim change percent of san francisco hopes to be the first woman to complete the swim sometime around august 8th. this swim has been completed four times before, but only in the opposite direction. speaking of shark-infested waters, this is a map showing the last 100 years of shark attacks in the bay area. of all these attacks only one proved to be a fatal attack in

the recorded history of the region. the san francisco chronicle posted the map online. statewide only ten people have been killed by sharks since 1926. a family visiting glacier national park in montana narrowly escaped a wildfire this week and it was caught on camera. the duncan family was in the process of leaving the park because of that fire. the fire broke out less than a mile from where they were camping. the son pulled out his cell phone and started recording. at first it looked like the fire was at a relatively safe distance but it catches up to them as they're driving away. >> oh, my gosh. go. >> we need to go. >> go. >> no, fast. t dad, go. holy crap. >> the family did make it to safety, the wildfire has burned more than six square miles and forced the evacuation of a small town and two campgrounds and firefighters say evacuate,

we begin with new developments in the movie theater shooting in louisiana. within the last 90 minutes authorities identified the gunman. police say 59-year-old john houser killed two people and wounded nine others last night before then taking his own life. they say he had been in louisiana just for a month, staying in a motel. he is described as a drifter. police say they found wigs and disguises when they searched his hotel room. police believe houser intended to make an escape after the shooting. >> i want to emphasize the gunman's original plan was to

this is after an oakland hospital finished treating him for at least one gunshot wound that he received in his encounter with hayward police early wednesday morning. later today at 2:00 estrada, a 21-year-old plan from oakland will make his first appearance in court where we expect he will be formerly charged in the murder of hayward police sergeant scott lunger. police say he shot sergeant lunger without warning during a traffic stop. estrada was hurt when sergeant lunger's partner fired back at his. estrada's mother tells our sister station telemundo that estrada is a good son with a good heart. here is what his family attorney this to tell us where he had. >> they ask that no judgment be passed until the entire case is before a court of law. >> reporter: hayward police would like you to take a look at this surveillance video and see

if you recognize the is sed tan. a camera recorded this vehicle in mark estrada's oakland neighbor shortly after the murder. hayward police would like to speak with the driver of that car, officers won't say why, but they feel that this person could play a significant role in their investigation. reporting live in dublin, bob redell, "today in the bay." we do have new details on the knife wielding man who was shot by a fremont police officer, two of them, earlier this week. fremont police say troy francis threatened and chased two women that he lived with inside the home that they shared on monday night. when officers arrived to the home police say francis then charged at officers still holding the knife. both officers so the francis. he is now recovering in the hospital. no officers were hurt. now to a developing story we've just learned crews have made progress on the wildfire burning near lake berryessa. this is the third day crews will battle the flames and at 6900

acres that fire is now 20% contained. up interest 15% last night. some who live in the area are still being told to keep away from their homes. we have live team coverage of the fire this morning. let's go with "today in the bay" stephanie chuang who is live at the incident command post with more. steph. >> reporter: right now lots of vehicles are passing by right now coming in, some are checking out. this is part of a shift change going on. you can see behind me hundreds of fire crews getting breakfast i'm told it's a very big breakfast, eggs, sausage, everything. they deserve it. then 10, 15 minutes there is a briefing to go over the attack plan for the day. this is a much bigger command post than the previous one, firefighters will likely be here for days. again, containment numbers were expect to go up and they have, up to 20%. we got video of the only building to burn town, this burn highway 128 west of winters, the only other structure damaged was a house. damaged by flames.

flames there as well. about 100 acres is burning on both sides of the highway near sly park road and west of fires. a campground in the area is being evacuated as well. firefighters say the flames are only 5 pr contained this morning. ironically the cause of this fire might be the same cause of the napa county fire. a car crash. investigators are looking at this video of a truck that lost its wheel and caught fire on the side of the road. >> it looked like it lost the whole axel. you can see how that would spark a fire in those dry grasses and brushes along the side of the road. a check of the forecast now with kari hall. we're looking forward to beautiful day if san francisco and really all around the bay. >> look at the difference there. you could see the sunshine this morning and that was not what we saw yesterday, pretty much all day in san francisco. as we go into the afternoon more sun and also we keep the comfortable weather. just a touch warmer. that will be the trend as we go into the weekend and early next week. we've been talking about the

are on. upper east shore freeway for westbound 80 it does jam up. it looks like they might have put that fire out on the roadside. back to you. today we could learn more about two men and a woman who were shot in vallejo. right now police are calling it a murder-suicide. neighbors say they heard sufrl gunshots last night coming from a home on songwood drive. when officers got there they say they found one man shot at the front door. essay life but in critical condition this morning. officers say that inside the home they found another man and a woman. they were also shot, but they died of their injuries. neighbors tell us there were also several children at home. >> fortunately from what i know no kids were hurt, but sadly, there were kids in the house when this happened. investigators are not yet releasing the names of the victims. they are also not saying who pulled the trigger. a big break this morning in a recent deadly south bay shooting. police now say they have made

two arrests. the shooting happened june 26th in east san jose near terilyn avenue and pensacola drive. the victim 17-year-old jonathan natareno died at the scene. police say two san jose men ages 18 and 21 are now facing murder charges. investigators say one of the two opened fire after some sort of argument. san francisco is reportedly launching a new effort to help reform policing strategies. particularly where it comes to minorities. the examiner reports that the city will track demographic data involving all police stops and the people who are detained. the hope is to create a benchmark to avoid racial profiling by law enforcement in the future. the move comes in the wake of recent charges of racist and homophobic texts exchanged by some san francisco police officers. the plan still has to get approval from the board of supervisors. judges in san diego are going to hear a new right to die argument that may allow california doctors to prescribe
