already convicted of killing a bay area police officer could come to a screeching halt today. and you've got questions, bart says it's got answers. what the agency is doing today to address concerns about this weekend's transbay tube shutdown. a very good tuesday morning to you. thanks for joining us. i'm laura garcia-cannon. >> and i'm sam brock. we are getting ready to crank up the heat in parts of the bay area which are bracing for triple digit temperatures today and just the beginning as tomorrow is going to be even hotter. meteorologist kari hall joining us now. kari, how long is this heat wave going to last? >> a few days here. as we take a look, we see 90s, each triple kinlt in the south bay today, in the peninsula in the 70s in pacifica, but mountain view up to 92 degrees, 92 also in burlingame and the outer sunset at 67 while the embarcadero reaches 84 degrees,

her death and disappearance. "today in the bay" stephanie chuang is live in santa cruz. stephanie, the scene behind you is is it still active it this morning. >> reporter: very active. in fact, we have just seen investigators and police and folks from the coroner's office huddled around a blue recycling dumpster. it appears they have just pulled the body of madyson middleton from that dumpster. we saw them load the body on to a gurney so they are getting ready to take her body away in the coroner's van, a tragic story here, it's focused in that garage at the tannery arts is center, this apartment complex that houses artists, it's double the heart breaking story for the folks here. a 15-year-old boy who lives here arrested on suspicion of the murder. we blurred his face because of his age. you could see police officers rushing over to the area of dumpster just before 8:00 last night. this is where middleton was last seen riding her scooting sunday afternoon. this her image captured on a

surveillance camera on this this building. she had been playing with friends. witnesses put that 15-year-old in the area and time of maddy's disappearance. >> you have people in the complex who saw the individual. as far as what they actually saw him to, i don't know. but we do have people that we will be interviewing. >> reporter: the fbi and specialized search and rescue dogs helped in this search. it's unclear why it took more than 24 hours for investigators to make the it discovery of this body found on the property. if the body had been there the entire time or put there later. again, to recap in just the last few minutes we have seen police and investigators pull what appears to be that body on to a gurney. we are expecting it will be loaded into the coroner's van shortly and taken away here. we saw them earlier as well taking pictures, constantly we know that the state department of justice was depd called in for this crime safety which has gotten a lot of attention since sunday is afternoon.

stephanie chuang, "today in the bay." >> someone's little girl. thank you. it is 6:03. the trial against a man accused of killing a woman on san francisco's pier 14 could move forward today. juan francisco lopez-sanchez allegedly shot kate steinle earlier this month. sanchez is an undocumented immigrant with a criminal past who had been deported several times. he had just been released from san francisco county jail this in april. a judge is expected to set a date for a preliminary hearing today. another unexpected twist in the case against the man convicted of killing a bay area police officer. jim capoot. problems with the jury could force a judge to declare a mistrial. kris sanchez joins us now. a mistrial means a whole new jury and the penalty phase would start over. >> reporter: the judge may have to scrap the whole trial, conviction included if he cannot convince two jurors to put their lives on hold just a little bit longer. the family of vallejo police officer jim capoot has been waiting for closure ever since the officer was shot while chasing ago suspect through

backyards in vallejo, that was bery four years ago. henry smith was convicted and now faces life in prison without parole or the death penalty. but today a judge may have to declare a miss trial if he cannot find a way to get those two jurors to see the process through. the jury was on this case for the month long trial, the penalty phase expected to take maybe as long as that, but important as that jury duty is, one juror reminded a journal of a move out of state planned for next week, another told the judge of a planned trip out of town. now, order thaerl that would heap bringing in an alternate juror, someone whos has sat through the whole trial, but there are no at fat jurors left. last week the judge dismissed a juror for alleged bias against police, the week before that another juror was dismissed because of a health emergency. earlier in the trial a jury was excused over misinformation on the jury questionnaire. no alternates remain. so the judge can seat an

entirely new jury for the penalty phase but legal experts say that is really unheard of. so this could be grounds for an appeal and back to the drawing board, sam. >> hopefully they will be able to continue that trial. thank you very much, kris. follow-up this this morning on a devastating string of teen suicides on cal train tracks. cal train is joining the city of palo alto to replace four miles of fencing on those tracks with taller fences and are testing out heat seeking cameras which would alert officials when someone is on the tracks. an early warning could give responders time to stop a train or get someone out of harm's way. >> there are going to be kids who always fall through the cracks. so i wanted to also address the fact that saving one life is actually saving potentially hundreds of lives and at least hundreds of people from suffering further. >> some people argue the city would be better off spending money on mental health treatment rather than more fencing to prevent suicides.

crews will start replacing that fence next month. this morning officers in san francisco checking to see if a dog they shot last night has a violent history. it happened last night near city hall. police say they pulled over someone for a drug bust, that person this a dog who reportedly charged at officers. they shot the dog in the ear. it survived. >> after he charged and our officers discharged the firearm the owner was able to regain po possession of his dog and calm the situation. >> the dog did not bite the officers. it's now being treated by animal control. time to check your microclimate forecast on this tuesday morning at 6:07. we give you a live look outside right now and it looks so nice and peaceful in f. >> almost even cool in that shot. >> it's a cool looking shot. what it will not be is a cool feeling day. meteorologist kari hall joining us. >> today even in san francisco it will be hot. at least warm in their standards

as we don't have a lot of ac pumping in the city today, elsewhere we will have those highs reaching into the 90s, even close to 100 degrees. north bay 97 degrees today, a lot of clear skies, 87 degrees in the east bay, peninsula 92 and the south bay expect a high of 98 degrees. in the tri-valley today a high of 102 degrees and 84 am san francisco. now, this will not be the peak of the heat, in fact, we reach that tomorrow and then it comes down gradually in time for the weekend, but we may be trading this dry heat for some milder humidity. i will talk about that coming up in a few minutes. right now mike is tracking some problems in the tri-valley. what's happening? we have two crashes reported. this first one we will show you the map is west 580 through the livermore valley right around the truck scales, reports of a motorcycle that was involved in a crash with a car there. that motorcycle down blocking your left two lanes, your two

fast lanes. we should see more slowing right about where it says livermore on the map. then the arrow turns and southbound 680. the crash is on the northbound side, a big rig has stopped to help. that's likely causing spectator slowing. slow south through pleasanton and sunol. the rest of your bay moves slowly, just a little build 880 the nimitz freeway. a addition to the bay bridge toll plaza we have a building. this is 101 right at 680. >> it's a little later for the commute. 6:09. a major construction project on the peninsula could mean major delays for commuters. starting today caltrans crews are going to be working on the southbound off ramp of 101, that's at broadway and burlingame. if you are heading south take the broadway exit you could be diverted to the cadillac way intersection.

this project is going to last for eight months. caltrans is urging drivers to use other routes. bart wants to answer any questions riders have about this weekend's closure of the transbay tube. bart officials will host a line online town hall meeting to address guess and concerns about the repair work taking place on a critical section of track near the tube, riders can submit questions and the meeting will be streamed live on bart's website. here is a topic we can never get enough of. drones taking center stage at nasa today. and the nsa has decided to forget about you, it's erasing your phone ym. nice start to our day. we keep talking about the warm up because it is on its way. how hot will it get in your neck of the woods? a billion android phones could

be hacked with a single text do you have a droid? at least a billion android phones could be hacked with a single text message, that according to a mobile security researcher. experts at a security firm say there is a gaping hole in the software. hackers can break into someone's phone and take over just by knowing that phone number. the hacker is going to send you a text and your phone would be hacked without you even opening up the message. they say they sent their findings to google along with patches to fix the problem. drones will be at the center of attention at a nasa research today. that's where the unmanned system traffic management convention is taking place. one of the keynote speakers is

the co-founder of a.m. zone primary. that's the drone delivery service amazon is testing. the conference runs for three days and will focus on making drones safer and more reliable. local jobs lost. oil giant chevron cutting 500 jobs from its headquarters in san ramone. the company says it's part of a global effort to slash costs by a billion dollars. chevron will also cut 1,000 jobs from its houston office. those layoffs already starting and they are expected to be done by november. dozens of bay area students are giving up their summer to compete for solar ships. sack sung a sponsoring a summer app coding program. during the four-day course students will learn how to develop and code a mobile app that addresses a community issue. students will then be able to submit their apps to win more than $35,000 in college scholarships. 6:14. a few minutes from now crash

investigators with the ntsb are going to discuss what they think caused the crash of spaceship 2. >> scott mcgrew is you actually talked to the designer a short time ago. >> i did. the crash is the one thing he doesn't want to talk about, not until we get to today's report. the space shift crashed in the mojave desert last fall. earlier reports say one of the pilots unlocked the feather ring tail system while the ship was still in boost phase. in fact, cockpit video shows him doing so. this absolutely mystifies the people that i have talked to. the tail system only to be used long after the rocket engine this exhausted itself. there simply is not a reason to use it early. the pilot who unlocked the tail was killed, the other pilot survived. the ntsb will meet at 6:30 our time and we will monitor that meeting. we hope to get a lot of an/"yj as to why an experienced test pilot moved the one lever in the cockpit he would have known

would have caused catastrophe. other news this morning the nsa says it will start deleting your phone records. the national security agency tracked everyone's calls. the number called, length of the call, kept those records. we know this tanks to edward sthoeden. the new u.s.a. freedom acty passed one month ago ended that practice and gave them 180 days to erase those records. another female executive has left san francisco's reddit. in the case of reddit it's been accused of being a bit like a frat house online. it's notable we are seeing the fourth high level woman leave. jessica moreno was headp+"cñ of community. reddit says it wishes moreno well. she says, guys, she is going to fa into thanks a lot. a follow-up right now. people who live in los altos

live to wait al least another day before they drink from their tap. some people who live in the peninsula community have been told to boil water before they drink it for)f use or for cook since sunday. all of this because that water might have been contaminated by e.coli. cal water officials are testing the water again but we will not have those results in until tomorrow. as we expect hotter temperatures firefighters making progress on a fire near lake tahoe. it has already charred 1,700 acres but crews now have the lowell fire about 20% contained. during the struggle to fight those flames four firefighters were burned in the process, one still in the hospital. the fire is burning west of alta in place over the next threer and nevada counties, nearly 2 dozen structures remain threatened. if you add up all the fires cal fire is dealing with more than 9,000 toek at acres of flames, this as crews battle 270 new fire that broke out within

the last week. firefighters are on the front lines. two of the biggest threats are fires currently burning in northern california. and the fire dangers stay elevated as we take a life box outside. san francisco a beautiful sunrise capturing that moment right as it's happening but that heat is going on coming in full force. >> it even looks hot. temperatures kind of mild right now but going to crank up. >> yes. when we start the day with not a cloud in the sky, you know it's going to be a hot day. we've seen a change in our weather pattern and not a lot of clouds across the bay starting out you won't see any this afternoon. now as we take a live look at san jose you see the hazy conditions and also a nice cool start to the day but as the seven-day forecast comes up at the bottom of the scene you see that those temperatures will be going much higher today and even higher a couple more degrees it tomorrow and then it comes back down. let's take a look now at sunol where we see a clear sunrise, a

thin veil of clouds settling into the valleys. as we start out, you head out it's 62 degrees in livermore, 60 sunnyvale, san francisco at 58 degree, 52 degrees in the north bay. so nice cool weather in spots. it will be a warm day to sit out and enjoy the game at the at&t park, the clients game. first pitch 78 degrees, back down to 70 degrees by the end of the game. great weather for that. but hot today, especially in the tri-valley, more of a northerly wind, high pressure continues to build and it's keeping back that on-shore flow and that means even along the bay we could have highs reaching the 80s today, 90s for the north and south bay and east bay reaching over 100 degrees. by the time that starts to move off towards the east, that high pressure, we will have a surge in monsoonal moisture. this looks to begin on friday and may continue into the

weekend. it won't bring of much in the way of any rain, but may increasez'rthat humidity and ev though temperatures come town, it won't really feel that much better. so it looks like we stay hot for the next few days, the dry heat turns into a milder humidity. our temperatures in the 90s, even 100 degrees for the next three days. tri-valley 102 degrees today, 103 tomorrow. this weekend once again, it gets a little bit milder, but it will feelvé let's check in now with mike for traffic. overall approaching the bay bridge this section of the bay's commute looking really good. in fact, 880 not so is bad just the build through hayward passing that san mateo bridge. the tri-valley a tough morning. we had a crash southbound 680 is jammed because of the mortgage bound 680 crash which just cleared all lanes, that big rig should no longer be a distraction. we should see recovery from that dublin interchange and that crash west 580 only blocking your fast lane as approaching

judge to declare a miss trial in a closely watched case. jurors are deciding the sentence for the man convicted of killing officer jim capoot. if you are headed out the door this this morning and run into a few potholes on your commute and you were thinking, hey, maybe this problem will get fixed some day, maybe not so much. "today in the bay" tracie potts joining us live from washington, d.c. where there is a standoff in congress over paying money to fix roads and bridges and they only have a couple more days to if i go this thing out. >> reporter: let me he tell you how that breaks town for people who drive in california. $586 a year, that's the extra you are paying because of the types of roads that your car is on, almost two-thirds of them in poor or mediocre consider according to the government but lawmakers here on capitol hill can't grey on how to keep that repair money flowing from washington. roads, bridge repairs, trains and transit projects on hold.

if congress can't agree on a transportation bill by friday. >> we are up against a deadline at the end of the week. job are on the line. >> reporter: could think has passed 33 temporary extensions in the last six years. the house wants another five-month extension. >> if we pass a five-month bill, like some of our opponents are calling for here and in the house, we don't have dime one to fix any bridge. >> reporter: the senate wants to deal with this once and for all, a six-year $350 billion plan, but only half of it's paid for. the house won't even consider that. so stalemate. >> we're going to keep working to get there, it's just a very tough moment. >> reporter: and it's in the middle of the busy summer construction season. authorization to send the money from washington to states to pay for these projects runs out friday at midnight. now, we're actually already paying for some of this work. every time you fill up your tank

18 cents a gallon goes into the federal highway trust fund but it's been 18 cents a gallon for decades now and we have a lot more roads that need to be fixed not to mention some of those other projects. that's why the trust fund is running low. this week officials say could slow down those payments for the road projects coming from washington. that's why congress really needs to act. >> thanks so much. it is 6:33. caltrans reportedly on the hook for heart of a six figure fine from a construction accident last winter north of the bay area. it happened in january on highway 1011 bypass project in willits. three workers were hurt after a 150 foot section gave way. according to the press democrat cal osha says caltrans and two contractors committed serious worker safety violations. all are being ordered to pay a $165,000 fine. one of new york city's major airports is getting an overhaul. new york governor andrew cuomo and vice president joe biden

announced plans yesterday to rebuild laguardia. biden once compared that airport to a third world country. the plans include tearing down existing terminals and building a larger unified terminal to handle better traffic loads there. the first phase of the project is expected to be completed sometime in 2019. a new study shows auto insurance companies are raising rates on recently which had doed women. the study were the consumer federation of america looked at six major insurers. researchers found preem wrums went i get significantly for women who recently lost a spouse. thebypñ study found insurers chd higher premiums for other single women. the insurance industry claims married people are statistically less likely to be in an accident than single people. >> more responsible maybe. 6:34. time to check your microclimate forecast as we get a quick look outside. we saw a burning sun before coming up over the bay.

right now just a little haze from the san bruno mountains. >> things are going to warm up. in fact, you said that it could be some dangerous temperatures. >> yeah, especially in the tri-valley and the inland valleys where we had those highs today that will be soaring into the triple digits. now it's nice and comfortable as you start out the day in the south bay, peninsula and east bay 60s, east bay 52 did degrees and san francisco a cool 58 degree. high of 84 degrees in sf, north bay 97 degrees, 87 east bay and the tri-valley is where we could see highs well over 100 degrees, 92 in the peninsula and the south bay reaching 98 degrees. after feeling the sizzling temperatures today and tomorrow as well as thursday the heat starts to come back down in time for the weekend, but then the humidity comes up. i will talk more about that, what it to expect for the next several days, it's coming up in a few minutes. now mike gives you an idea of what to expect before you head out the door.

>> things change second by sing second over9&m#ñ on the commute that's why it's always exciting. 580, over here westbound, the headlights coming toward us, seeing a little more traffic through the dublin interchange. the arrow shows you where that camera shot is. in a good section with the speeds but we will get more traffic as this crash has just cleared all lanes, we just got that update from chp. over at first that unleashes traffic over toward 580. 680 we just this this enough time for these speeds to improve down towards sunol where the earlier crash this things jammed up and traffic is mofl slowly after they got that off of the roadway. >> the rest of traffic flows around the bay no problems, the san mateo bridge shows a little build, that's nothing unusual and of course we have the backup at the bay bridge toll plaza. >> there we go. >> naturally every day a new adventure. kicking down the doors of shoe history, the new chuck taylor all stars hit stores later today.

prison last month. guilty plea from the prison worker charged with helping two convicted killers escape from a new york prison last month. joyce mitchell's attorney says that his client will likely plead guilty. she allegedly hid hacksaw blades and other tools inside of frozen meat and that meat was given to the prisoners who used the tools to break out of prison. mitchell could get up to seven years. big news for an organization that's ban part of america for more than a century. the boy scouts of america voted to lift the national ban on openly gay leaders. many people pushed for that major change. am 2013 the national petition drove the boy scouts of america to lift the ban on gay youth. now that leaders are accepted one assistant scout master says he's thrilled. >> they know a lot of people who haven't wanted to be with boy scouts because of this -- this policy. >> but not everyone is happy with the changes. the mormon church is angered

with the decision and released this statement, quote, the admission of openly gay leaders is inconsistent with the doctrines of the church and what have traditionally been the values of the boy scouts of america. 6:41. treasure hunters in florida struck gold with an epic haul cç surface. >> this sounds a little johnny depp, pirates of the caribbeanish. eric schmidt and his treasure hunting family found 51 gold coins including a single rare coin from 1715. they got it all on video. they discovered it in the wreckage of a sunkel spanish ship off of the florida coast. the coins are valued at more than $1 million and sat on the association floor for 300 years. this is the third year in a row the family was recovered a haul of spanish treasure on the florida coast. next time we are going with them. >> it doesn't even look that deep. coming up, much more than a test drive.

"today in the bay" stephanie chuang live in santa cruz. police will likely release more information on this case in a couple of hours? >> reporter: we're hoping for that, laura. what i can tell you now is that in the last hour the coroner took away the body of eight-year-old madyson maddy middleton. unfortunately what we did not want to hear this news here at the tannery apartment complex. that building there is where local state and federal investigators have focused their attention all night and all morning in that garage is the blue recycling dumpster where police made the discovery before 8:00 last night. it this morning we saw about eight to ten investigators and crime scene technicians head to that dumpster and open the lid, taking many pictures, taking out

cardboard. about 10 to 12 minutes later we saw them pull the body out of the dumpster and load it on to a fwurny before taking it away. it is it is double the heart break, police arresting a 15-year-old boy on suspicion of murder. neighbors say he has lived with his mother at these apartments iryears. >> i have known him for a long time. he was a nice kid. you know, he's very well spoken for his age. he was just seemingly a nice guy. it's very unfortunate circumstance to say the least. >> reporter: still a lot of questions of course. it is unclear why it took more than 24 hours for investigators to make the discovery of this her body which was pound on this this property. if the body had been there the entire time or if it had been placed there later. we are expecting an update from police later this this morning. they are adding it is likely but doubtful there will be any more arrests made in this case. stephanie chuang, "today in the bay." we will monitor that news

degrees in the east bay, san francisco 58 degrees and 52 degrees in the north bay. a closer look at the east bay we have temperatures anywhere from the mid 50s to the low 70s starting out, discovery bay now at 73 degrees and danville it's 55 degrees, the north bay once again a nice cool 52. this is where we're'ded this afternoon, in san jose 94 degrees, gilroy 100, burlingame 92, mission district at 82 degrees, even some 80s in san francisco, 97 in napa while we see 87 in oakland and pleasanton reaching 101 degrees. hot weather today because of a northerly wind and high pressure giving us the sinking air and clear skies, it's also fighting back that ocean breeze. into the next couple of days we will have the sizzling temperatures and then this high pressure moves through the east it draws in monsoonal moisture. we will replace this hot and dry weather for some milder humidity

and this weekend may still not be all that comfortable, especially with the highs dropping back in the 80s and the high humidity to go along with that. so today the three-day outlook shows those highs reaching into the 80s and 90s across missouri of the bay, even 100 degrees in spots like the north bay and the tri-valley and the east shore expect highs in the upper 80s and then dropping back to 78 degrees by thursday. i will have another look at the weekend forecast coming up. let's check in now with mike for traffic. i've got to be honest, sizzling and humid are not two of my favorite forecast words. we are looking at the san jose area where we are looking at north 87, recovering from earlier debris, presumably a traffic break right around concerner. speeds are better now. 101 heading up the airport typical build. 280 at 92 two lanes blocked. we will get an jun date. over here the tri-valley continues to see a smooth drive but looking for more traffic

toward the dublin interchange. earlier crashes in livermore have cleared. a quick look at the san mateo bridge, here is the live look westbound starting that build over toward the peninsula we should see some slowing for 101. specialized search dogs now part of a greater search for a missing san francisco teacher. ed cavanaugh was last seen friday july 17th when he left on a dirt bike ride west of tahoe. cav gnaw was staying at his cabin north of placerville in the el dorado national forest. that search turned up nothing so far. cavanaugh works at downtown continuation high, but friends and family are especially concerned because he is diabetic and does not appear to have his medication with him. >> the trial against a man accused of killing a woman on san francisco's pier 14 could move forward today. juan francisco lopez-sanchez allegedly shot kate steinle earlier this month.

sanchez is an undocumented immigrant who had been torted several times. he had just been released from san francisco county jail in april. a judge is expected to set a date for a preliminary hearing today. another unexpected twist in the case against the man convicted of killing bay area police officer jim capoot four years ago. problems with the jury could force the judge to declare a mistrial. "today in the bay" kris sanchez joining us with more. a mistrial means a whole new jury and the penalty phase would have to start over. >> reporter: in fact, the judge may have to scrap the whole trial including the conviction part if he cannot convince two jurors to put their lives on hold just a little longer. the family of vallejo police officers jim capoot has been waiting for closure ever since he was shot following a bank robbery four years ago. henry smith was convicted on friday and now faces life in prison without parole or the death penalty. today the judge made it clear a

mistrial if he cannot find a way to get those two jurors to see the process through. the jury was on the case for the month long trial, the penalty phase expected to take about that long as well. but as important as that jury duty is, one swroor remind td the judge of a move out of state next week, another told the judge of a planned trip out of town. now, ordinarily that would mean bringing in an alternate juror who sat through the trial in its entirety, but there are no alternate jurors left. last week a juror dismissed for alleged bias against police, the week before another juror was dismissed because of a health emergency and earlier in the trial a jury was excused over misinformation on the jury questionnaire. now, without alternatives to complete a jury the judge can seat an entirely new jury for just the penalty tase, but legal experts tell nbc bay area that it is nearly unheard of for a judge to do that and a it could be grounds for an appeal. the other option is that mistrial which then starts the whole case all over again.

>> thank you, kris. firefighters in vallejo paying a special tribute to a fallen comrade more than 30 years after his death. the vallejo fire depth will launch the robin mackbee program today. he spent time tutoring kids at the local boys and girls club. he was killed in the line of duty in 1980. the program will serve vallejo high school students through mentoring and career development. so many families have had to watch a devastating string of teen suicides on cal train tracks. cal train is now joining the city of palo alto to try to stop this by replacing four miles of fencing on the tracks with new taller fences. that was video of a recent community meeting. they are also testing heat seeking cameras which would alert officials when someone is on the tracks. an early warning would give responders time to stop a train or get someone out of harm's

way. >> kids who always fall through the cracks and so i wanted to also address the fact at that like saving one life is actually saving potentially hundreds of lives and at least hundreds of people from suffering further. >> some people do argue the city should be spending its money on mental health treatment rather than more fencing to spree vent suicides. a murder suspect turned himself into police after a shooting on 880 in san leandro. shooting happened early saturday morning. chp officers heard the gunshots and rushed to the scene. they found a man inside a car on the freeway shoulder shot several times. he died at the scene. chp says the suspect shooter was transferred to san leandro after turning himself in yesterday. new this morning it started out as a typical test drive but it ended with an arrest and between those two points are accusations of kidnapping, attempted robbery, a police chase and a crash. around 3:00 yesterday afternoon

a man asked to test drive a van at a dealership in concord. he and a salesman trove around for a bit and then the suspect asked if they could drive to his house in pittsburg to show his family the car. while driving back to the dealership the suspect claimed it was a robbery and began driving erratically. when he slowed the salesman managed to jump out and call police. the suspect eventually crashed and was taken into custody. even if he had gotten away, he reportedly left a copy of his driver's license at the deal dealership before that test drive. so much for that plan. officers in san francisco are checking to see if a dog they shot last night has a violent history. it happened last night near is it city hall. police say they pulled over someone for a drug bust. that person this this a dog who reportedly charged at the officers. they then shot the dog in the ear. it survived the hoogt. >> the good thing was that after he charged and our officers discharged the firearm the owner was able to regain possession of

this his dog and calm the situation. >> the dog did not bite the officers. it's now being treated by animal control. san francisco police are going to be talking about shaping their policy for the use of body cameras today. the department is holding a meeting to discuss how it is going to use those cameras and under what circumstances. there has been more attention on the use of body cameras as more police encounters are captured on cell phones. san jose's police department just launched its own body camera pilot program. a follow-up now. people who live in los altos are going to have to wait at least another day before they drink from their tap. some people who live in that peninsula community have been told to boil their water before they drink it or use it for cooking since sunday. that is because the water might have been contaminated by e.coli. cal water officials are testing the water again but the results won't be in this until too many. bart wants to answer any questions riders have about this

weekend's closure of the transbay tube. starting at noon bart officials will host a live online town hall meeting to address questions and concerns about the repair work taking place on a critical section of track. riders can submit questions via e-mail and twitter and the meeting will be streamed live on bart's website. accident investigators right now for the ntsb meeting in washington talking about3crzñ w went wrong in the crash of spaceship 2. >> scott mcgrew has been monitoring that meeting. >> we saw several videos published of this launch just a couple of seconds ago by the ntsb including the catastrophic break up. we're examining those videos before deciding whether or not to show those to you on tv. as this meeting continues as we speak we can point out this is the first time the ntsb has ever met to discuss a reusable sub orbital spacecraft. we're waiting to hear why. why did one of the pilots move a switch he should not have.

in the inland valleys. here is a look at the next three days, it really doesn't back off until about thursday. we start to see the heat coming down in some spots like san francisco. still the 80s and 90s, widespread across the bay and a quick look at that weekend forecast brings this some milder temperatures, but the humidity will be going up. >> that will get you. mean important as that jury duty, typical bull prits in terms of backups on the roads. >> exactly. after early problems for the tri-valley things sorted themselves out. the south bay with the northbound build, 87 back to its typical commute after debris caused unusual slow down. a fender-bender reported south 880, south of 238 heading down toward a street but no lanes reported blocked, that's the initial report. the arrows show the general portions of the east bay and tri-valley. of course, a slower drive for the upper east shore freeway just developing toward the bay bridge where the metering lights are on. this is pretty good for a tuesday. >> you're making it sound very pleasant. >> it is pretty pleasant because i'm mott driving right now.
