no reports of any injuries and no word yet on what caused that blaze. new this morning, a c carjacker faces charges. just about 11:30 last night, police on routine patrol attempted to talk to a group of people. one of the men ran away. as officers chased him, he pulled a gun and started shooting. officers fire backed as that suspect attempted a carjacking, failed and then successfullied carjacked another driver. the chase made it to onto the freeway where the suspect tried to drive into an officer. witnesses say they saw the driver speed by in upwards of 100 miles an hour. >> this guy was shooting at the police. shots fired three times on 101 and 28th in santa clara. he was hopping on the highways and going crazy.

>> no officers were injured. the suspect did hit another car in the chase and both people in that car were taken to the hospital with nonlife threatening injuries. the suspect was taken to the hospital. investigators say his injuries are not from gunfire. he will be booked to county jail for attempted homicide on an officer, carjacking and felony reckless evading. the u.s. forest service is investigating how a firefighter died battling the frog fire. that's one of the many wildfires raging across northern california right now. david ruhl is from rapid city, south dakota. governor jerry brown remembered him in a statement saying ruhl left his home state to help protect one of california's majestic forests. the 38 year old is a father of two. his body was discovered friday morning on the fire line and that fire he was battling ignited thursday northeast of redding. there currently are 23 large fires burning across the state. more than 7,000 men and women have been called into action. closer to the bay area, the

rocky fire continues to burn. the latest update as of this morning, about 18,000 acres have charred and the fire is only 5% contained. do trees fuel wildfires or do trees stop fires from spreading? that's the question many people are asking in a fight over cutting down trees in the east bay hills. they have been working on a plan to thin trees ever since the firestorm in 1991. the oakland city council was awarded a grant to get started but many environmentalists say it's not the way to go when it comes to fire safety. they're circulating a petition to try to block the tree cutting. >> it's ignoring the significance of trees that collect moisture and drip it on the ground. in the east bay hills that's 16 inches per year. that's significant. >> the mayor released a statement on the controversial subject saying, "this fema plan

is 20 years in the making and reflects the demands of the public for a long-term, comprehensive plan to reduce fire risk and restore and protect the resources in our hills." there are a myriad of problems for firefighters battling the more than 20 blazes across northern california and now the cal fire emergency command center in morgan hill is watching for more lightning strikes that could spark more fires. they want to add human eyes to back up their sophisticated monitoring equipment. >> we'll see sporadic opportunities for lightning or thunder cells to move through the bay area over the next 36 to 72 hours. >> cal fire also staffed its lookout station. we're constantly updating acreage and evacuation information and you can get updates by following us on facebook and twitter. to continuing coverage on the murder of 8-year-old maddie

middleton. we're getting more answers and insight into this case. maddie's father has now stepped forward. in a statement, michael middleton writes, i want to believe she was taken from us for a higher purpose to show the world how to love so much more. maddy middleton was killed in her apartment complex. her 18-year-old neighbor is a suspect. a friend of the family says community support has been critical. >> it will be okay. it will be a long time before we're okay. he's in good hands and he has a lot of love around him. this community has pulled together in an amazing way to show support for michael and laura. >> two gofundme pages have been set up and they have raised more than $13,000. if you would like to help donate money, you find that information on our website, nbcbayarea.com.

happening now, b.a.r.t.'s transbay tube is shutdown for the weekend and that means no trains between san francisco and oakland and some major traffic on the bay bridge. the closure will give crews a chance to repair a critical section of track near the tube. it's 2400 feet of ageing track. b.a.r.t. is suggesting to stay home if you can but if you do need to get across the bay and you don't want to drive, b.a.r.t. is running buses between 19th street in oakland and the temporary transbay terminal on howard street in san francisco. there also is increased service on ac transit and the san francisco ferry. >> it's going to be madness and traffic and a headache and annoying. >> b.a.r.t. says on saturdays alone about 100,000 people use the transbay tube. we posted detailed information to get you from point a to point b during the closure on the front page of our website, nbcbayarea.com. and it's not just b.a.r.t. there's another transit shutdown.

from 10:00 p.m. to start of service at 5:00 a.m. there will be bus bridges. this subway tunnel upgrade is expected to end in january 2016 so those overnight closures for six months. a new lawsuit two years after the asiana crash at sfo but this time the plane's manufacturer, boeing, is being sued. the lawsuit filed in san francisco points to a flaw in the automatic pilot system of the boeing 777. this is a problem that we first exposed one month after the crash. it's called the flch trap. experts say the flaw can allow a plane to drop below the critical air speed and altitude in order to land safely and that pilots can be fooled into thinking nothing is wrong. the suit was filed on behalf of two korean survivors who were injured in that accident. boeing denies the allegations.

"today in the bay's" peggy bunker has more. >> reporter: it's not the utopia it once was. >> the noise is so loud with the jets going it actually shakes the house. >> reporter: michael has lived here for almost 25 years. he says the last two have been hellish after the faa began using a system which packs more flights into airspace using satellites instead of old fashioned radar. the flights are so low, so loud, they shake his house, interrupt business calls and jolt his family from sleep at all hours. >> i personally filed over 3,000 noise complaints and the reaction of sfo noise abatement is thanks for sending in the data. you're in an area where we can't help you. too bad. >> definitely, yeah.

welcome back. we're taking a live look at the golden gate bridge. traffic moving very nicely. cloudy skies but really nice temperatures. 60s across the bay area. if you're headed out for a walk or saturday morning stroll. a bay area lawmaker is pushing to allow the u.s. post office to ship alcohol. peninsula representative introduced the bill this week. she says the current ban on shipping alcohol which went into effect during the prohibition puts the postal service at a competitive disadvantage because u.p.s., fedex, and other companies can ship spirits and beer. it could bring in added revenue each year. facebook boss mark zuckerberg posted that he and his wife are expecting their first child. it's not just their pregnancy that's making the headlines.

it's their difficulty getting pregnant. their sharing sparked an emotional response on a very sensitive topic. our own raj mathai has the story. >> reporter: the usually private mark zuckerberg made a very personal revelation. in a long facebook post, he writes, "this will be a new chapter in our lives. we've already been so fortunate for the opportunity to touch people's lives around the world. we want to share one experience to start. we've been trying to have a child for a couple of years and have had three miscarriages along the way." that prompted thousands of messages. local doctors and fertility experts are embracing the comment from one of the most famous people in the world. >> it's a very private issue and it's hard to discuss miscarriages with other people so they don't get the support they might need from friends and family. >> reporter: zuckerberg who is

when you said that? >> looks beautiful this morning, darling. we're looking at rain coming through the sierra. want to start you off with that. not all bad even though we are going to see humidity, the rain would mess up that hairdo. let's talk about this forecast. you can see the showers building across las vegas down toward southern california. if you are doing traveling that direction, heads up you may run into showers near yosemite park, las vegas near tahoe. the rest of california is expected to stay dry with temperatures in the 70s and 80s for the most part. san francisco today at 68 degrees. elsewhere, lots of sunshine and temperatures nice and california-like in the 70s and 80s. you notice we wake up to cloud cover this morning from the south bay over toward san francisco into the north bay as well. temperatures not that bad. very mild this morning. into the 60s. through the day today, we'll see the sunshine in the south bay. 84 degrees. 77 for the peninsula today. east bay good mix of 60s and 70s. san francisco, not overly warm or cool. temperatures at 68 degrees. lots of sunshine expected later

on will make it feel nice. 83 for the north bay today and tri-valley our warm spot near 90 degrees for your high for today. now, the other thing we have to compete with today is the humidity. you measure that by dew points and that's always present in the atmosphere and our dew points are usually below 55 degrees in the bay area so you really don't even notice the moisture in the atmosphere. today they're going up just a little bit to the noticeable category. yesterday they were in the humid category. again, it's all relative. it won't be overly humid but you will definitely notice it especially if you are headed out to fremont for the festival of the arts happening today and tomorrow. nbc bay area proud sponsor of that. temperatures mid 70s today and tomorrow. lots of sunshine expected there and the other place that has a fair going on, santa clara county fair happening today and tomorrow. wraps up this weekend. temperatures not as hot as they have been but still nice and toasty. mid 80s expected with lots of sunshine. the reason we have the sun in place and temperatures so warm

because we have high pressure across the desert southwest bringing record heat to the pacific northwest. for us we haven't got in on that extreme heat because we're right up against that coastline. we've had more marine influence through the weekend. it won't be overly hot. we're tracking showers and thunderstorms across the sierra. you notice we put futurecast into motion today at 1:00 another yosemite, expecting showers and thunderstorms. they die down tonight. then we do it all over again tomorrow. this is monsoonal moisture so that's why we have that added moisture in the atmosphere and it may feel sticky at times. over all not too bad. temperatures really comfortable. 77 degrees for san jose today. 79 tomorrow. we go back up just a little bit as we move toward the middle part of this upcoming week. east bay valleys mid 80s. upper 80s toward tuesday and wednesday. notice this about san francisco. this is where you should usually see temperatures in the 70s and 80s this time of year, nothing like that. nice and cool and comfortable. 60s and 70s expected for the next couple of days.

this is only happening during the overnight hours from 10:00 p.m. until start of service at 5:00 a.m. there will be bus bridges for people who need to get around. this subway tunnel upgrade is expected to end in january 2016. california's dmv is cracking down on drivers willing to break the law just to get better parking. the department will now more closely scrutinize any driver applying for a disabled parking placard. more than a dozen people were recently arrested for falsifying information on their placard applications. dmv employees say these criminals are slick but the department is now catching on. >> there was something strange about a large number of disabled placard applications signed by the same doctor with the same handwriting and sometimes even they described the person's health problem in the same way. >> 16 people have been convicted of perjury and forgery since the

dmv began its investigation late last year. we are seeing soaring temperatures across the country and scary moments. children being left in hot cars. in the latest cases, bystanders and police rescued a toddler in new jersey. the infant is okay but the mother was charged with child endangerment. another case in oklahoma, a 1 year old was left in a car for 45 minutes. experts say the temperature in a car can shoot up 20 degrees in just ten minutes. there currently are 19 states with laws against leaving children unattended in cars but there's a push to do more. >> we need to put a huge campaign together and get the auto industry, government, all of the safety advocates on the same page. >> there's already new technology to help. for example, a car seat built with an alarm that sounds when the ignition is turned off and the child is left in the seat. a local mom and her baby boy

are reunited with the firefighters who delivered the baby on the freeway. that is frank, jr. this all happened in south san francisco two months ago on 101 near 380. firefighters were dispatched to a woman in labor in the middle of the night but that baby would not wait until the hospital and mom delivered frank, jr., in the ambulance at 4:00 a.m. >> when we saw his head was coming out, the baby is coming, before he could even find a safe spot to pull over, he was already out. we said just keep going. >> all of the city's firefighters have paramedic training so they were able to safely deliver the newborn and remove the baby's umbilical cord. baby and mom are doing great and yesterday the crew surprised the family with baby clothes and toys. much more ahead on "today in the bay".

vs the rangers las the giants leave the bay area heat for texas heat and humidity. they started a three-game series versus the rangers last night. san francisco had their ace on the hill but madison bumgarner had unexpected results. he gets roughed up. the rangers would score six runs against the world series mvp. giants lose to texas 6-3 the final. and the a's taking on indians game tied at one in the top of the ninth. a ground rule double with a runner at second and that would prove to be the game winner. the indians beat a's 2-1. we have much more ahead on "today in the bay." coming up, a call for the extradition of the minnesota dentist who killed a treasured lion in zimbabwe. authorities there want him to

welcome back on this saturday. 7:42 the time. a shot from our satellite and radar perspective because we do have showers that will make their way through the sierra today. doing any traveling across parts of yosemite over toward tahoe, even down toward las vegas, you are expected to run into showers. keep that in mind. they are expected to billow up toward this afternoon but you notice across the coastline headed right down toward l.a., san diego, lots of sunshine. temperatures in the mid to upper 70s. very nice temperatures across most of the state today. right now you'll notice temperatures in the 60s for the most part. we do have cloud cover from the south bay over toward the north bay as well. even san francisco looking at those low clouds. they'll move out of here as we head toward the afternoon hours and temperatures will be nice. 80s for inland valleys.

mid 70s for the east bay and peninsula. san francisco meanwhile will be at 68 degrees. a hot spot without a doubt per usual, trivalley with temperatures near 90 degrees for today. north bay temperatures in the mid 80s for today. the other thing we have to deal with is humidity and you measure that by the dew points. that's usually where we see our dew points in the bay area and in dry category below 55 degrees. today they'll go up a bit. you'll feel it. it won't be humid or unhealthy but you'll notice it when you step outside and get going for the rest of your day and we also have better air quality, something suffering over the past couple days especially with the wildfires and the offshore winds and now we've got that onshore wind and that's helping to mix out our atmosphere a little bit so if you have respiratory ail elemenments, go. lots of festivals going on. the aloha festival. this is california. we know if you are headed to hawaii, that's what you say.

alhoa. today to 5:00 p.m. temperatures nice and comfortable mid 70s. as we move through the day today, we'll see high pressure build in. that will mean for monsoonal surge as we head through most of the day. that's also going to make for showers and thunderstorms across the sierra. put this into motion and you notice by 1:00 we see showers start to pop up across the sierra. over near yosemite. they die down tonight and then tomorrow we do it all over again. tomorrow afternoon showers and thunderstorms pop up. you notice the bay area no green on the map for us here. it's going to stay dry and comfortable. the only thing i mentioned is you'll have to compete with humidity as you move through the day. today and tomorrow that humidity is with us. by monday and tuesday it moves out of here. by wednesday temperatures start to creep up but nothing oppressive. nothing like we saw last week with temperatures in triple digits and 90s for east bay valleys. more comfortable this upcoming week. san francisco, not going to be

so how are the fees that high for a case that never went to court? "today in the bay's" sam brock has this morning's "reality check." >> reporter: shock and horror. >> suspect in a gas mask. >> reporter: as a gunman opened fire at a movie theater in aurora, colorado. for sandy and lonnie, devastation at the loss of a young daughter, 24-year-old and now three years later their tragedy continues. >> they've taken our daughter and now they want to take our money. >> reporter: after failing to sue ammo dealers, a colorado district court judge dismissed the case and then ordered the phillips' family to pay retailer attorney fees. >> we're on the hook for $200,000 now which would drive us into bankruptcy. >> reporter: in his order, the judge wrote "those who ignite a

fire should be responsible for suppressing it." how can a trace thcase that did it to trial cost so much? >> $200,000 sounds crazy. you would be shocked how quickly these can go up high the amount of time preparing these lawsuits and working on their defense. >> reporter: in fact, the court order tallies up all of the costs. the phillips will be charged for attorneys fees, travel expenses and even postage but despite the shocking headline about costs, legal experts say the outcome of the case isn't really that surprising. >> there have been a number of cases that have worked their way through state or federal court. >> reporter: a federal law, a shield law, protection of lawful commerce in arms act makes it very difficult to bring any legal action against arms or

ammo makers and dealers. >> as it's written, it provides a fairly broad and blanket shield for those manufacturers. >> there's absolutely no other industry in this country that receives that kind of protection from our government. >> reporter: is it so ironclad that the phillips stood no chance at all? >> when it comes to this case, the optics aren't good in the sense that you have a family that's lost a child, they're looking to change the system as a result and they end up with a $200,000 bill. is it justice or should they have expected th e ed that kouo. >> there are claims that one could make. >> reporter: the reality is this couple is stuck with a $200,000 bill. the case never saw the light of day and according to our second amendment expert, the couple could have poked holes in that federal shield law but it wasn't

welcome back. this morning some special guests for pets in need. thanks for joining us. you have three kittens with you. >> three kittens. this is petunia and these two down here are fonzy and chester. >> they are really cute. really tiny. >> three of the many kittens we have in our shelter this week. >> yes. you need forever homes for them or foster homes. >> right. >> they're 10 weeks old. >> 10 weeks old, spayed, neutered, microchipped, vaccinated. we've given them lots of tlc over the past 10 weeks. >> they seem happy. you say you have 30 cats right now in the shelter. >> we're still in the midst of kitten season so all of our shelters, our in particular overwhelmed with kittens. we probably have 30 to 50 kittens alone in the shelter out of 120 or so animals we have. most of them are kittens.

many are kittens. >> this is kitten season as you told us. and going along with that theme that you need to get some homes for these kittens, we actually nbc bay area and telemundo are doing an event called clear the shelters. two weeks from today. you, pets in need, you're part of it along with 37 other animal shelters. >> right. >> what are you doing that's so different for our viewers that day? >> we're having extended hours. we're going to promote the clear the shelter event on our website, facebook. we're going to have our mobile van in operation that day. lots of exciting things are happening really throughout the bay area with those 38 or so shelters that are participating to try to get as many people as possible into shelters that day. >> it's really great. bay area is such a huge sprawl
