anthony slaughter had in for mike inouye tracking the morning road and how it's looking out there. we will get you out the door on time with a full report coming up. >> announcer: from nbc bay area, this is "today in the bay." and a very good tuesday morning to you. thanks for joining us. i'm laura garcia-cannon. >> and i'm sam brock. we will begin this morning with a story from prowler to predator. police in the east bay looking for a man right now who went from breaking into people's homes to sexual assault ago girl. >> "today in the bay" kris sanchez joins us in the studio this morning. kris, police say they actually know what the man looks like. >> i would say and they want to find him because with sunday's sexual assault of a girl his behavior is clearly escalating. police say this is the man captured in a surveillance picture, he is the person of interest. these are hickey mouse and doing rock, paper, scissors. he is a young, dark skinned man 18 years or older with a haircut

that's curly on top, short on the sides. the pictures were captured in a break-in that happened at the roadway inn on webster street but the description is the same in the sexual assault and the fighter other hot burglaries or hot proud burglaries in west alameda. alameda police took nbc bay area on a ride along to show us all of the open windows and unlocked doors in which those hot prowl burring czar is getting if in. a girl under the age of 18 was sexual assaulted last he weekend. in one instance he stole a car, in the others he robbed people of hair sense of security. police though on the lookout and so are the people who live in west alameda. >> this neighborhood is really safe and so something like that that's happening in our neighborhood is really scary and we definitely have to it look out for each other is it. >> reporter: so look again here at the suspect's photo. the description is the same, again, in those six hot prowl burglaries that happened between

june 15th and august 9th. that's when the girl was sexual assaulted in her own home. all of had in west alameda. police are urging people to keep their doors and windows locked and to call with any sightings of the suspect. sam and laura. >> thank you very much. frightening. 5:02. more drama if for san francisco sheriff ross mirkarimi. this time a suspended license for months. the dmv says it suspended his license back this in february after he failed to submit paperwork related to an october crash. through a spokesperson the sheriff says he did not know he was only allowed to drive to and from work until now. the controversy comes as the sheriff runs for reelection. supporters say political opponents are trying to make him look bad while krit it particulars say it's part of his pattern of bad behavior. >> everyone is embarrassed by it, but if reality the sheriff should not better, he is the head raw person in the city. >> the sheriff says he's working to fix the problem and has contacted his insurance

representatives to see why the proper report was never submitted. happening today, it is a story that we've talked about a lot in the past, rising crime rates in san jose and a depleted police force. just this this week two shootings involving police officers in a 24-hour period. but later today san jose police hope to get the go ahead to take their crime fight to the sky. "today in the bay" chuck coppola joining us live in san jose right now, where, chuck, san jose city council expected to vote on that drone program. it is a subject that has stirred up strong emotions in the ast. >> reporter: that's right. this has become a question of whether government intrusion into our private lives trumps crime fighting or the other way around. san jose police also bought the drone using federal money but the department needs the approval from the city council to fly it even for a one-year pilot program. what's gotten people concerned is that the police did this without am i public discussion beforehand. it that is since held public discussions on this, the flying robot has cameras, but according

to police would not be used for surveillance but instead for dangerous police situations such as someone shooting at them, but it would not carry weapons. >> we don't know what they're going to see, we will never know what they are going to see and how that could actually affect our lives. >> i think there needs to be a balance between what is being done, what i can request and what the public should know. >> reporter: mayor sam liccardo is on board with its limited use. san jose city council is scheduled to take up the matter this afternoon at its 1:30 meeting at city hall. reporting live at san jose police headquarters, i'm chuck coppola, "today in the bay." it's 5:04. follow-up now to a story we hold you about yesterday. all signs point to arson. investigators say a huge fire that burned down two businesses yesterday morning in san leandro were intentionally set. they say they found a gas can in a dumpster next to a building

and scorch marks led to that dumpster to one of the buildings. investigators also noticed a strong smell of gas after the fires was out. a supermarket and medical supply store were destroyed. no one was hurt. now to a developing story, is second fire burning near clearlake is now twice as big. take a look. the jerusalem fire burning just ten miles away from the rocky fire. rocky fire as you well now has been burning for nearly two weeks. our nbc chopper got these new pictures of the flames yesterday. the second fire began sunday afternoon just off of highway 29 south of clearlake. so far it's burned more than 6,000 acres. mandatory evacuations are in effect near that tire. crews expect this new fire will take about a week to contain. we've seen some modest temperatures here the last couple of days but wind still an issue. is it going to be today? let's check in with meteorologist kari hall >> it will still be breezy as we go into the afternoon. of course, the morning hours the best time to get those wildfires -- try to get a little

bit of a handle on them with high humidity and a calm wind. as you head out today this is what you need to know, morning clouds and bay fog will be becoming mostly sunny and slightly cooler and breezy, just like yesterday. low clouds return this evening, sunset will be at 8:04 in san jose. it's 63 degrees in in livermore, san jose and sunnyvale, 62 in concord and santa rosa 57 degrees. highs reaching 79 degrees in san jose, half-moon bay 68 degrees, outer sunset will be at 64 and embarcadero will be at 68 degrees, napa 82, oakland 70 and dublin reaching 86 while pleasanton tops out at 80 degrees. we will start a slow warming trend as we head closer to the weekend. i will have more on that and just how hot it gets in just a few minutes. we want to start you off with this shot in dublin. we don't have any major concerns from the shot but it's way off

in the distance, we have lots of cars coming in westbound, also eastbound you can see some overnight construction wrapping up. what i want to point your attention to is we have a car fire and this is just before you get to the livermore coming through the altamonte pass coming in in from tracy. that's right at greenville. also on 84 right at isabelle there was an earlier accident so that's causing some slowing headed through the sunol grade. things are moving smoothly approaching the bay bridge toll plaza. we had an accident earlier at 4 and 80 where they connect. at 101 there was an accident where a person hit a guardrail, you pay see some crews there as you get into san francisco. there may be some confusion this morning on some of the streets because, stephanie chuang, she's live there in san francisco with what's happening along market street. steph, i was thinking about it, it's pretty hard to find where you can make a left turn on market, but now no right turns? >> reporter: yeah. that's right, anthony.

there are more restrictions now. expect a little bit more gridlock as drivers try to adjust. starting today no more turns on to market between 3rd and 8th streets. starting 7:00 this morning parking control officers will be at every i'm acted intersection starting to help guide traffic. this is part of the safer market treat project. part of a bigger plan to eliminate all traffic deaths in san francisco by 2024. the city says market street has four of the top 20 worst intersections for people on foot, getting injured in collisions and the top two worst intersections for cyclist injury collisions. one project leader points to the heavy tourist traffic area as a key reason behind those numbers. >> probably a lot of folks who are driving on market street are people who are from out of town who might be looking down at a map or a gps device, not paying attention. >> reporter: now, the penalty for making that illegal turn on to market between 3rd and 8th is $238 and that does include drivers for company like uber

and lyft, they cannot use that stretch of market. back here live you are looking at the exceptions, that trucks can turn on to market as well as public transit with buses, you also have taxis and bicyclists that can also turn on to market from 3rd and 8th, but parking control officers will be here not just this this morning, but for two weeks to help guide traffic. live here in san francisco, stephanie chuang, "today in the bay." >> it might take some getting used to. thank you very much. the numbers are in, more than 200,000 people from across the country all converged in san francisco for outside lands. now the arrest report. this this man, zachary holland, of los angeles was arrested for battery after he knocked a san francisco police officer to the ground while they chased him fortress passing and trying to sneak into the concert. police say holland had entered the event without buying a ticket. here is the overall arrest numbers for the annual music festival, 77 people in total were arrested fortress passing, five for peddling without a permit, three for alcohol

mobile home community announced it was closing, that will force more than 100 mostly elderly residents to find new affordable housing. if the moratorium is approved it would put that process on world. people who work for places like google -- >> do we even have a middle class here? >> alba get/google. google has changed its name to alphabet. larry page made that announcement in a blog post. you will still use goog it will to google and we will call that figure facility in mountain view google, but they have created a parent company and that is alta bet. they will be the parent of many companies, google of course, but all the other things they do like fiber and google venture and capital. alphabet will be run by google founder larry page. there will be google x as well, this is the pie in the sky stuff, self driving cars, drones, internet balloons, that

it captured a tornado that spawned from a monstrous typhoon this weekend. debris was flying everywhere. the white car you just witnessed disappeared in that twister. the typhoon killed at least 21 people in china and taiwan. >> you heard the warnings for that typhoon and that's evidence as to why. dead fish and dry rocks, our drought taking a toll on several bay area bodies of water that includes san jose's guadeloupe pay river. it used to run through did downtown san jose now that has dried up. on the left-hand side of why you are side what the guadeloupe pay river used to look like four years ago, on your right all dry, bare rihn, what it looks like right now. the river has recorded its lowest water levels this history. there's one positive note, the drought has allowed volunteers to get rid of years of trash on the river bed. >> clean it up, perhaps take care of some of the structural things that need to be done and so we will be who are ready when

the rains come. >> we certainly hope they come soon. the dry up has also had a figure effect on the area's wildlife. dozens of fish were stranded when that water stopped slowing. >> pretty sad to see. i remember days when it was overflowing because of rain. maybe this winter. let's check in with kari right now. pretty nice day today. >> beautiful day. if you are taking a walk anywhere we will have comfortable weather and all throughout the next couple of days we are in a cooler than average pattern thanks to some strong on shore winds. as we go into the next couple of days this is what you need to know. as we take a look at the time lapse we had a little bit of sunshine yesterday in san francisco and then, there you see t the clouds rolled in. this is a look for the overnight hours, we are seeing the clouds now and we will have a couple more breaks as we go into the afternoon. the seven-day forecast is coming up it at the bottom of the screen, come over and check that out. right now it's 62 degrees in the east bay, north bay 57 degrees, this is much warmer than it was

yesterday, but not much more of a rise in those temperatures, and 70 degrees in the east bay, peninsula 80 degrees today and in the tri-valley it warms up to 86 degrees but that will be nothing compared to what you are getting ready to experience this weekend. so with the mild weather here, enjoy. a look at the temperatures in san francisco today as we look at the lunchtime hour it will be in the mid to upper 60s, eventually making it up to 68 degrees over by at&t park and then the clouds start to move back in, temperatures drop this evening. we are also watching hurricane hilda out there in the pacific moving closer to hawaii. here is hawaii right ear and the hurricane now continues to weaken with wind speeds at 90 miles an hour. as it approaches the big island it will be weak thing to a tropical depression and by friday it will continue to move off towards the west as that storm weakness. by this weekend high pressure moving in, it will replace the low pressure that's giving us the cooler than average temperatures and it will weaken

that on-shore flow allowing for that des it ert heat to build and highs will be topping out in the 90s, even near 100 degrees this weekend. a look at the forecast for saturday and sunday is, get ready for hot weather, maybe you want to make plans to head to the beach. let's see how traffic is moving with anthony. you mentioned san francisco, the evening game, heads up, there will be evening traffic for you. i want to start you off on the south bay, 101, we had an accident yesterday on 101 southbound where tully was closed off. no problems here this morning. things are moving without a problem. you can see on the traffic maps right on 101 lots of green so things are moving smoothly. off towards the altamonte pass we had a car fire but it has been taken off the chp report, it was right before you get to livermore and right when you get on to 84 at isabelle there's an accident that's keeping things jammed here. the bay bridge toll plaza lots of green. as you get towards the treasure island off ramp also the stall that could impact your commute

over towards the westbound side headed into the city. let's show you what's happening at the bay bridge toll plaza. cars are starting to build, metering lights not on just yet. it's 5:20. we hear the complaints of middle child syndrome all the time, middle children who say they never get enough attention. tonight san jose giant are doing something to remedy that. middle children can get am pre for tonight's game at municipal stadium. they can also get a discount at the did dug wrought store. the team also plans to include middle child themed songs, videos, even graphics during the game. tomorrow is national middle child day. >> so they are getting plenty of love after all. it is early, you are probably tired. imagine directing a sky full of airplanes on too little sleep. a new study shows that's what's happening all the time. air traffic controllers are not getting enough sleep and that could lead to dangerous flying conditions. the faa says it has a plan

>> announcer: you're watching "today in the bay." welcome back, it's 5:24. the faa just released a study it kept secret for years showing air traffic controllers' schedules often lead to chronic fatigue. officials posted that suddeny online yesterday though the report was completed three years ago. the study found two in ten controllers made significant errors in the previous year and most blamed the errors on fatigue. overall controllers in the study averaged less than six hours of sleep per day. the faa says it's taking steps to reduce controller fatigue, like requiring at least two controllers on midnight shift.

ferguson, missouri, as demonstrators clash with police, this time it ended with nearly two dozen arrests >> but not shootings as we had seen yearly err in the week. "today in the bay" jay gray joins us live from ferguson. how is the situation is this how are things this morning? >> reporter: the sun has come up here the things have calmed down, still, though, there is an uneasy tension, there is concern and frustration on both sides of the protest line after what was another difficult 24 hours here. protesters and police in full riot gear squared off again overnight in ferguson. officers stepping up their presence and intensity when they say things turned dangerous with many in the crowd throwing rocks, bottles and other objects at the police line. a handful of protestors were arrested on a day when activist groups called for civil disobedience in ferguson and across the country. demonstrators shut down i-70 west of st. louis for a short

time during rush hour, 60 or more were arrested. dozens more were taken into custody during a protest downtown at the federal courthouse. and supporters gathered in other cities throughout the day. >> i'm troubled by the continued police violence and overreaching against people who are protesting, against people who are out here exercising their -- their rights. >> reporter: the protests were for the most part peaceful tuesday. after a gun battle sunday night that ended when police critically wounded 18-year-old tyrone harris, jr. after they say he opened fire on undercover officers. in the wake of that violence county leaders dee layered a state of emergency. >> last night, you know, around last year we saw a city burn and we are not going to see that again. i'm taking every measure possible to allowed that scenario. >> reporter: in a community

still on edge right now. now, the state of emergency here provided more officers along the front lines of the protests and county officials say they will continue that stepped up presence for as long as they believe it's necessary here. live am ferguson, i'm jay gray. sam, laura, back to you. we have new details on an apparent drive by shooting in san francisco. two men in the hospital this morning with life-threatening injuries. police say the shooting happened last night at 24th and bartlett in the inner mission district. the suspects drove up in a car and shot the two victims both am their 20s. police say the victims ran from the scene, they were later found and taken to the hospital. police this morning still looking for the gunman. an al immediate at that girl sexual assaulted in her own home by a man whose behavior is actually escalating. in addition to the sexual assault police believe he has broken into five other homes while people were there. >> kris sanchez joining us now in studio.

the face before firing four or five shots in the air and it all started because of a parking spot. the victim is expected to be okay. cling is faces several charges including assault with a deadly weapon. too much crime, mott enough cops. in san jose a surge in violence is stretching thin an already depleted police force. this week two shootings involving officers happened in a 24-hour period. today san jose police hope to get the go ahead to take their crime might to the sky. chuck coppola joining us live in san jose. we're talking about drones. >> reporter: absolutely. the san jose police department bought last year a flying robot with cameras, but it's been unable to use it until it got -- got city council approval. well, that is what could happen today at 1:30 this afternoon at city hall. police say the drone won't spy on the general public, but that it will be used for dangerous police situations. however, the potential for police abuse of the drone's

cameras is a concern, particularly because the department bought it without any public discussion beforehand. >> obviously police should be able to use it as a tool in case they're chasing somebody, that's a lot safer than following them at high speeds. so there's probably a lot of legitimate uses for it. >> we're really containing the use of drones to very specific circumstances where you have an explosive device or we've got an active shooter. >> reporter: even if the council gives police the go ahead for a one-year pilot program the federal aviation administration has yet to approve public agencies using drones. that policy is expected to be finalized at the end of the year. reporting live at san jose police headquarters, i'm chuck coppola. things appear to be looking up for the oakland police department and the conduct of its officers. as you probably know a federal monitor is overseeing department reform. according to the bay area news group federal monitor robert

warshaw is now suggesting the department raise its bars for what it considers potential problem officers. that's because officers as a whole are behaving remarkably well in respect to the current standards. warshaw cites the dramatic drop in citizen complaints and officers' use of force. happening now, crews are blocking a major south bay road to repair a broken water pipe this morning. the break happened last might on hills tail avenue right here highway 87 in san jose. this new video of this area where crews are quickly working to repair all that damage. water flowed into the street for a few hours because public works crews couldn't find the shutoff valve. right across the street from career technical education center and part of the school was without water for much of the night. things should be back to normal this afternoon. homeless people in santa rosa could find a helping hand soon from the city.

according to the press democrat today the city of santa rosa and its city council will explore options to provide portable bathrooms and showers to people in need. right now they are looking into possibly renting portable toilets and hand washing stations or renting a restroom shower trailer. city leaders say either option would reduce the amount of waist in local rivers. let's check the forecast with meteorologist kari hall. nice day on tap. >> yeah, beautiful. more comfortable weather as we start out with morning clouds and skies will be clearing and end with mild temperatures. this is what you need to know and also how your day shapes up, south bay 73 degrees at the lunchtime. a great day to take that lunch outside, 68 degrees in the east bay at noon and san francisco will be at 67 degrees. highs will be in the 70s and 80s across most of the bay, wind keys down, a nice breeze as you head home during that evening commute, south bay will be at 79 degrees, east bay 73 degrees and the it peninsula at 80 degrees.

pretty nice day. >> beautiful weather the next couple of face and i think if you enjoyed yesterday you will like today. more of the same, although we do have the low clouds that will have a hard time clearing out of san francisco. as we get a look at what's happening out there now we start out with temperatures in the lower 60s all across the bay, it's 57 degrees, though, in the north bay, 61 in san francisco and the south bay you see that clear sunrise, it is 63 degrees. the seven-day forecast is coming up at the bottom of the screen and notice by the end, which is this weekend, it is going to be a scorcher. so these nice cool temperatures will not last for all of the forecast. right now as we look at today's high in the east bay it will be 70 degrees, 80 in the peninsula and the south bay reaching 84 degrees. wind coming in from the west giving us a nice ocean breeze and that's the reason for the cooler hand average weather to start out the week. the winds do pick up at about 15 to 20 miles an hour during the evening commutes, we will have

mostly sunny skies inland and a nice breeze, too. if you are heading out to the giants game at at&t park it will be a cool one, only 64 degrees at first pitch and we will keep those temperatures in the lower 60s, breezy and cool, bring a nice blanket or warm jacket to wear throughout the game. with our cooler than normal temperatures it's because of that on-shore flow and area of low pressure that conditions to sit on shove. on the weekend it's replaced by high pressure and then that desert heat starts to build and creep into the bay area. that will make those temperatures rise for saturday and peaking as well on sunday is. here is a look at that weekend forecast, mostly 90s all across the bay and the tri-valley could be topping out in the triple digits. san francisco will even be warm reaching 80 degrees and the east bay also at 80 degrees and once again with that hot weather it will be ear, make some beach plans this weekend. let's see how traffic is moving with anthony. i'm already thinking about what are we going to do on the

beach with the kids. 101, this is northbound, you can see coming through san jose, stop and go in some spots and that's the typical building, we are seeing no accidents here but i did want to show you that traffic flow if you are about to head out right now, we are seeing that typical slowing coming in from 101 north of capital expressway. about 20 minutes ago there was an accident at 880 and takata and that's right before the dumbarton bridge. you can see the red tick marks leg all the way back to the san mateo bridge. that's stop and go traffic. if you are going to be using 880 keep in find you are going to run into major slowing getting in through this area. our final stop takes us into san francisco, this is right just at the treasure island of a ramp, there was a stall keeping things slow and that evening game as the giants take on the houston astros. that leads me to this, "today in the bay" stephanie chuang is here with us live with some changes coming to market street. we were talking earlier how you can barely make the left turn and now they are saying no right turns. good morning.

>> reporter: that's right. i counted, anthony, good morning, 14 more turns that are now no longer allowed. market street one of the most dangerous for people walking and on tear bikes. check out the signs, they are already up, no turn on to market between 3rd and 8th streets, only commercial vehicles, buses, taxis and bicyclists allowed on this stretch. that means no private cars, that includes ubers and lyfts, the goal is to make market street safer. we're talking 70% of the severe and fatal pedestrian accidents are happening on just 12% of the city streets and that of course includes market. supervisor jane kim says she supporting eliminating cars off market all together. >> i'm biking more and walking more and that is what a city is and that's the direction that we're headed in. >> reporter: this safer market street project includes an extension of existing transit only lanes, also new loading and safety zones. it's all part of the greater vision zero plan and that is to

prevent all traffic deaths in the city by 2024. no turns on to market between 3rd and 8th, the penalty if you do, $238. now, starting 7:00 this morning there will be parking control officers at every impacted intersection here that will run through 7:00 at night and go for two weeks to help with this adjustment. live in san francisco, stephanie chuang, "today in the bay." >> steep fines will keep that reminder fresh. cyclists are staging another protest on san francisco's streets tonight. they are going to follow the letter of the law to a t. the so-called stop in coming in response to police crack down on cyclists who aren't polling posted traffic rules like stopping at some stop signs. according to streets blob sf bikers are planning to meet at dee bows park at 5:00 and are going to read single file with each person stopping one at a time at each stop sign. they held a similar line last month that tied up traffic on several city streets. they say police should be

focusing on deadly traffic behaviors like drivers running red lights and not yielding to pedestrians. within four years santa clara county may have a brand-new jail. today supervisors will discuss preliminary plans to replace the outdated main jail south. that wing dates back to the 1950s. the more modern main jail north next door opened in the late 1980s. county leaders are putting together a proposal to get the state to pay for about a third of the estimated $240 million price tag. a new wing could come online by late 2019. people in richmond making a last ditch effort to stop a jail expansion. the contra costa board of supervisors expected to vote next week on a land to build a high security wing at the west county detention facility in richmond. city leaders and community oppose the plan. they are actually holding a vij jill outside the sheriff's office to protest next week's

vote and ask supervisors to come up with another plan. police and transit workers in san francisco taking extra steps to keep cable car operators safe. over the last couple of months two separate crashes have sent operators to the hospital. drivers are required by law to stop at a safe distance behind cable cars while passengers board and exit. police right now planning on stepping up their enforcement of that law later today and launching a public awareness campaign. we could learn more about what caused a crash on the new jersey turnpike that injured tracy morgan and killed one of his friends. if he had val investigators will meet to talk about that crash. the former "saturday night live" and "30 rock" star suffered multiple injuries when a walnut truck slammed into the back of his limb hoe. his friend james mcnare died in the crash. a preliminary report found the driver of the truck was going 65 miles per hour in a construction zone before the crash. a terrifying scene at a southern california movie theater had had people running

for the exits. police say that was all a prank. the incident and in newport beach on saturday night where police say at least two men entered the movie theater through an emergency room and revved a gas powered leaf blower. many in the theater feared that the men was going to start shooting. >> everybody just got up and fight or flight, ran, and i got to the aisle and some lady kind of pushed me to try to get out and i just completely like face planted, fell toward and like seven or eight people were stepping on me, trampling on me trying to get out. >> the callous prank happened during the screening of a thriller called the gift. police right now are searching for the men responsible. 5:52. hospital infections are responsible for about 75,000 deaths every year. while cleaning methods have improved it's still unclear which methods work the best for

busiest street. a good tuesday morning. i'm sam brock. >> and i'm laura garcia-cannon. new details on an apparent drive-by shooting in san francisco. two men are in the hospital with life-threatening injuries this morning. police say the shooting happened last night at 24th and bartlett in the mission district. the suspects drove up in a car, shot two victims, both am their 20s. police say the victims ran from the scene and were later taken to the hospital. police are still looking for the gunman this this morning. also happening right now, alameda police are looking for this this young man. they say that he cut through a screen, crawled through a window and then sexual assaulted a girl early sunday morning. that same suspect also linked to at least five break-ins and now police are warning people to be on alert.
