news this morning that clinton has reversed course and now turned over her personal e-mail server. federal investigators looking into whether it contained classified information, while jeb bush goes on the attack, blasting clinton's time as secretary of state and laying the rise of isis right at her feet. we've got all of this covered this morning starting with nbc's andrea mitchell on this e-mail controversy. andrea, good morning to you. >> reporter: good morning, savannah. more controversy for hillary clinton today, indeed. despite her repeated past denials, the intelligence community's inspector general now says two of her e-mails should have been classified top secret, the highest level of u.s. intelligence. even as the fbi is finally getting control of that private server. hillary clinton in new hampshire tuesday as aides confirm she has turned over her private server to the fbi. in addition, her attorney, david kendall, gave the fbi two thumb drives containing her e-mails. all of this as the intelligence community's watchdog contradicted clinton's repeated

claim that nothing on those private e-mails was classified. >> i did not e-mail any classified material to anyone on my e-mail. there is no classified material. >> reporter: clinton has said there were no classified markings on any of her >> i am confident i never sent nor received any information that was classified at the time it was sent and received. >> reporter: but the inspector general has now told congress two of clinton's e-mails should have been classified top secret with code words indicating electronic evesdropping from satellites, so sensitive it could not be shared with foreign allies. raising serious questions about the security of the private system, set up in her home. >> a server at a house probably wouldn't have the security monitoring you would expect at a government facility where you have surveillance cameras and security staff watching those systems around the clock. >> reporter: the controversy has

been a huge distraction for clinton's campaign and fodder for republicans. >> it's sad to think but probably the russian and chinese government know more about hillary clinton's e-mail server than members of the united states congress. >> reporter: clinton said she deleted more than 30,000 of the e-mails from the private server that were purely personal, she said, before turning them over. thousands more to the state department. now the fbi could be able to recover those deleted e-mails. in any case this is a controversy that's not going away any time soon. matt and savannah? >> all right, andrea mitchell in washington, thank you. >> in the meantime, clinton's biggest republican rivals in the presidential race are taking direct aim at her this morning. nbc's kristen welker has that part of the story for us. kristen, good morning. >> reporter: matt, good morning to you. for jeb bush and donald trump tuesday was aimed not only at laying out their policies and attacking hillary clinton, but also looking at their potential

blamed the rise of isis on president obama and by extension his former secretary of state. >> isis grew while the u.s. disengaged in the middle east and ignored the threat. and where was the secretary of state, where was secretary of state clinton in all of this. >> reporter: the strategy is a risk for bush whose brother started the iraq war and who struggled to articulate his own iraq policy. on tuesday, bush got specific, calling for more support for the iraqi military, ousting the syrian president and a change in leadership here. >> the president and secretary clinton, the storied team of rivals took office. so eager to be the history-makers, they failed to be the peace-makers. >> reporter: the clinton campaign called bush's speech a bold attempt to rewrite history arguing isis is the result in part of former president george w. bush's decision to invade iraq in the first place. meanwhile, a new poll shows bernie sanders now leads clinton 44% to 37% among likely

will linger a long time. >> we should caution, that poll is a small sample size, but what a headline, bernie sanders beating her in new hampshire? >> and the trend has been in that direction. he's gotten closer and closer, drawing tens of thousands of people, big crowds, and his authenticity and his heart showing identification with the democratic base. she is in pressure in new hampshire, which, remember, in 2008, that was her best state. it's also a strong state for bernie sanders. she's going to have to fight to beat him. >> speaking of fighting, jeb bush going on the attack. a lot of his supporters wanted him to do that. rters wanted him to do that. interesting he chose to take on her foreign policy, specifically the rise of isis and by extension iraq policy. >> he goes to the reagan library and goes to his biggest weakness, association with his brother and the unpopular iraq war. he needs to prove to republicans he can take on hillary clinton in areas like iraq that are bush family weaknesses. he was good last night. he's fighting for his life, too. he's declined in the polls since the debate.

he needs to fight like hillary clinton, the legacy candidates. >> who won -- trump >> a u.s. black hawk chopper injured several people on board. mik, good morning. >> good morning, matt, there was quite a scare earlier this morning when it was first reported that a u.s. military helicopter crashed into the ocean off the coast of okinawa. military officials now say, however, that this army black hawk helicopter made a hard landing on a u.s. navy supply ship. seven crew members were all injured and have been flown ashore for medical treatment. but if you take a close look at this video, this was not a hard landing. this instead was a controlled crash. take a look at the helicopter

and you can determine that it appears the helicopter had some kind of mechanical difficulty and the pilot was forced to try to land that on the ship. not on any kind of helipad but forward on the ship amidst the cargo. it was an emergency landing an kudos to the pilot who would have not ditched at sea but tried to make that hard landing on the ship, an investigation, is under way. >> all right, mik, thanks very much. >> now to new fallout tied to the brazen escape from the new york prison by two convicted murderers. now the question, did officers cross the line with other inmates as they were trying to track down the fugitives and find out how they got out? today national correspondent craig melvin has that story. >> good morning to you. according to new information from the new york times, inmates claim that within hours after

that prison break, they were beaten, choked, slammed against walls by guards in a frantic search for information. the new york times calls it a campaign of retribution. following the three-week manhunt for richard matt and david sweat. the times reports prison guards abused dozens of inmates while looking for information about the escape. the times quoting two inmates who worked in the prison tailor shop, a guy tied a plastic bag around his neck tightening until he passed out. the other inmate, who supervised the shop said corrections officials put him in solitary confinement for three weeks and threw out most of his belongings, including family photographs and his wedding ring. following the escape, more than 60 prisoners filed escape with legal services, an organize that helps indij ent prisoners. >> the amount of complaints and descriptions we're hearing about

the tensions within the prison and in particular in clinton, it's very concerning. >> reporter: the prison came under fire following the escape, some saying the relationship between prisoners and prison workers was too friendly. form former taylor shop working joyce mitchell pled guilty to aiding the fugitives. they say the abuse allegations have been under investigation for several weeks and also been referred to the state inspector general. any findings of misconduct or abuse against inmates will be punished to the fullest extent of the law. according to the times, one inmate said after being beaten during interrogation he was pressured to say a report saying he was not assaulted. >> if what they say is true and things did happen that they say, why? and why was it handled this way. >> cassidy also told us many prisoners making claims of abuse feel they are being blamed for

where her ex-husband, german businessman daniel giersch, has raised them since 2012. >> best of luck, kelly. >> thank you. >> rutherford summoned into court tuesday after keeping her kids four days past a european court deadline to put them on a plane back to their father. but 8-year-old ermez and his 6 yold sister, helena, weren't with rutherford as she arrived at the courthouse, another messy chapter in a long custody dispute. when rutherford and her ex lived in the u.s., the couple had joint custody, but after giersch's visa was revoked in 2012, the california court ruled the children should temporarily live with him in monaco. rutherford's attorney argued, three years is not temporary, and that since the children are u.s. citizens, they have a fundamental right to live in their own country. earlier this year, a judge in monaco allowed the children to spend the summer with rutherford in the u.s., but after she refused to send them back, giersch called it kidnapping. his lawyer now saying he's

pleased that the american judicial system has prevailed, but adding, giersch's stance of promoting kelly's time with the children has not changed. all right, let us bring in legal analyst lisa green, author of "on your case." good morning. >> good morning, matt. >> kelly rutherford held her children in this country days after the deadline to send them back. yesterday they did get on a plane with their grandmother. did she have any other choice? >> really not, and it didn't help her case at all to disobey what a court ordered. doesn't matter if you're a judge in new york, california or monaco, where this case ends up, no judge likes it when someone decides to take the law into their own hands. >> so, by keeping them here longer, she may have hurt her future ability to see those children. >> yes, because now she has a worldwide reputation as someone who doesn't listen to judges. judges loath that. >> what about rutherford's lawyer's assertion, that these are american children and they cannot be forced to live outside this country? does that hold up? >> you know, totally sympathetic argument, but in the law, that doesn't matter as much as you might think in international

custody cases. what matters the most is where the kids are resident, and you saw these kids, they're going to school, they have friends, they're bi-lingual. every passing day, better for the dad. >> the couple lived in the united states. then the father's visa was revoked back in 2012. interesting to note, he has not reapplied for a new visa. can he be compelled to do so to bring this family closer together? >> you know, in a way, kelly rutherford's biggest legal mistake was getting in that moving van and getting out of california, because the california court which issued the order says we have no connection to this family anymore. and if no one can enforce the order, why would the father go ahead? >> we asked the question, where does this bitter custody battle go from here? it goes to monaco. and on september 3rd, i think it is, there is another hearing. but keep in mind, the kids are going to be back there, they're going to start school, they're going to become entrenched in their schedules. does it become harder and harder for a judge to uproot them? >> especially in monaco. there's a home court advantage for the father, and no one is alleging that he's a bad parent, nor is anyone alleging that

largest wireless company, eliminating those service contracts. but beware, the move does come with a catch. >> can you hear me now? >> reporter: remember this verizon commercial? >> can you hear me now? >> reporter: well, now hear this. verizon is ditching all of its annual cell phone contracts. no more confusing payment plans. no more being stuck for the life of the contract. no more free phones. wait. hold the phone. yes, that's the catch. in return for the freedom of being unchained from verizon, you're free to buy any smartphone you like at full price. before now, you could sign a contract with verizon and get an iphone 6 for $200. you can still get one for the retail price of $649. analysts say you were never really getting a discount. just paying off the phone over the length of the contract. with this new plan, you can still do that. but you also have to pay an access fee for the network. t-mobile has been using this model for a while. and at&t and sprint are moving

in that direction. >> that era of contracts and subsidies and really confusing dealings with the mobile phone companies is over. it's going to be simpler. you're not really going to pay that much less in the long run, but at least you'll know what you're paying and you'll know what your phone is worth. >> so what should you consider before getting your next phone? jean chatzky is "today's" financial editor. good morning to you. >> hello. >> i think most people go to a cell phone store because they want a particular device. they want the iphone or the galaxy. the plan probably is the second thought. what should people be thinking? >> people should be understanding that now we're in this bring-your-own device era so you can pick the phone, the contract, you do it separately, not the contract, the data plan, and you pick which is the best for you. >> so 600 and something dollars for an iphone, it used to be baked into the contract. you've got to fork that over now to start. >> or they'll let you pay it out over time without interest. but you are paying for the phone. there are no more subsidies.

>> you still need the data. you still need the network. what should we consider? >> they're selling data on verizon in sizes that sound like t-shirts. a small plan. one gigabyte all the way up to an extra large plan, 12 gigabytes. and the cost of the data goes down the bigger the bucket that you buy. once you've got your bucket, you can take it and you can distribute it among all the people that are on your plan. so if you've got kids in the family, the friends and family terminology is going away. but you can set it up so that they get the number of gigs that you want to give them. >> i have two cell phone-using kids out of three. so i need a big bucket. >> you are going to need a big bucket. and there are apps that will allow you to limit the data that they have, which i found is a very good thing with teenagers. >> the obvious assumption is it's going to cost us more money, but that's not always the case. who is this going to be good for? >> it's good across the board in part because it's transparent, in part because it's flexible.

you can take your device and you can go to another carrier. >> transparent because you know exactly what you're paying for. >> absolutely. but let's say you're at the end of a two-year contract. and you are thinking should i go into this no-contract plan? i would say yeah, you should. it's not going to save you a huge amount of money if you get a new phone because you are going to be paying for that either up front or over time. but if you hold on to your phone, if you decide i'm going to keep it three years rather than two, you could save a couple hundred dollars. you can also sell your device, or you can buy a used one, which is really helpful. >> and a couple of extra tips. >> know how much data you need. we've put an app, a calculator, up on the "today" show website so you can figure this out because if you're buying data after you buy your plan, it's going to cost you significantly more money. and don't just look at the big carriers. look at some of the smaller ones. they're being rated very well by "consumer reports," and they, too, can save you some money.

rescue crews a still combg the waters around good wednesday morning. it's 8:26. i'm sam brock. that breaking news we're following this morning, rescue crews still combing the waters around the bay bridge. that's where earlier today a woman jumped from the span after a minor crash. it all started a little after 2:00 this morning. that's when chp officers responding to the crash approached the scene. two of the women believed to have been seen in that car started walking away. officers apprehended both of them. as for the third woman, officers say she was standing on the adjacent bike bath before she climbed the rail and jumped into the water. officers later followed up on reports that a woman walked from the water and got into a car, but investigators never imagined to confirm it. we'll continue to follow that story. meantime, a little hiccup on the bay bridge as a result this

morning. how are things looking now? >> looking pretty good. it's all jammed up, no surprise. on t in the south bay, 101 jam packed to santa clara. a few accidents on 85 up towards palo alto. let's take you outside and show you what it looks like. southbound lanes are moving without a problem, but it is slow going northbound. there's your answer, slow. >> ask and you shall receive. thank you very much. we knew that was going to be the result there. we'll be back in 25 minutes with another local news update.

good wednesday morning. i'm sam brock. right now happening at this moment, a bay area based coast guard crew that seized a record amount of drugs on the high seas is returning home. that includes this bust of a semisubmersible last month that was carrying 16,000 pounds of cocai cocaine. members of the coast guard are arriving this morning at their home base in alameda. they've been out at sea for the past 116 days. the crew helped seize tons of

cocaine being transported across the eastern pacific ocean, and their efforts have helped the coast guard seize more than a billion dollars worth of illegal drugs over the past ten months. we're continuing to follow a situation on the bay bridge, searching for a woman who fell off of it. we'll have an update in 25 minutes.

the new simple nut bar from nature valley. ==topvo== rescue cws arstill good wednesday morning. it's 9:26. i'm sam brock. a developing story this morning, rescue crews still combing the waters around the bay bridge. that is where earlier today a woman jumped from the span following a minor crash on the eastbound portion of the bridge. this started a little bit after 2:00 this morning. chp officers responding to the crash approached the scene. two women believed to have been in the car started walking away. officers apprehended both. as for the third woman, officers say she was standing on the adjacent bike path before she climbed the rail and jumped 70 feet into the water. officers later followed up on reports that a woman walked from the water and got into a car. but investigators never managed to confirm it. and that search effort continues this morning. meantime, also happening today overnight work starts on

car pool lanes along interstate 680. you're actually looking at video there of the jerusalem fire now. that massive fire is burning out of control. it has doubled once again. the numbers on that it is now up to 16,000 acres burned. again, this is in lake county about 100 miles north of san francisco. it's only about 5% contained at this point. now, fire crews fear it may ultimate lly merge with the roc fire which they've just about contained. keeping a very close eye on that situation as well. coming up after this we'll have a look at weather and traffic.

good morning. i'm meteorologist kari hall. a lot of sunshine now as we take a live look from sunol. we see it is a beautiful start to the day. right now it's 68 degrees in the east bay. let's get a closer look there where temperatures are at 70 in discovery bay. and brentwood 72 degrees. 73 antioch. and oakland is now at 65 degrees. we start out with a lot of sunshine. and that is what we will see throughout the afternoon.

and temperatures will be a couple of degrees warmer than yesterday. saratoga expect a high of 87 degrees. half-moon bay 72. 64 degrees in bodega bay while napa tops out at 86 degrees. walnut creek 87, livermore reaching 88. we are getting ready for a rm waing trend over the next few days, getting closer to the weekend expect highs to be in the 80s and even some low 90s. it continues to heat up this weekend. sam. another burst of summer this weekend even though school is now started. thank you so much, kari. we'll be back in 25 minutes with another update.

taking a look at the headlines, complaints from airline passengers are soaring this year according to the department of transportation complaints about delayed flights, missed connections and lost luggage jumped more than 20% in the first half of the year compared to the same time a year ago. american, united and spirit airlines had the most complaints. at the same time on-time arrivals improved for the nation's biggest airlines. about 75% on time in june compared to 72% last year. a new study is suggesting that uber may be reducing trunk driving deaths. researchers looked at alcohol-related deaths on california roads and found death rates trapped as much as 5.5% in areas covered by uber-x.

trans-fats are linked to an increased risk of heart disease. looking at data from 50 studies, researchers found trans-fats in margarine and snack foods were linked to a 21% higher risk of heart disease and a 34% increase in risk of death from any cause. they found no extra cardiovascular risk from saturated fats from things like butter and milk. experts say rather than eating lots of saturated fats it is best to look for healthier alternatives. your car one day may help you navigate traffic lights on city streets. bmw is working with an oregon tech company on a way to alert drivers when the next traffic light will turn red or green and suggests the best speed to drive before the light changes. it uses the enlighten app already available for smartphones. the bmw system would display on the instrument panel and in the future may warn you if you are about to run a red light. if you are headed to the beach any time soon this video

knows it well. after cindy and lou lost their son ty to cancer they started the muddy puddles project. they organized a day like no other to celebrate ty and other kids who have faced cancer. a muddy puddle in memory of py. a fire truck in memory of tanner. and a food fight in memory of cole. all part of messfest, a fund-raising event honoring kids dealing with or who have lost their battle with pediatric cancer. >> let's celebrate the idea that the kids can have fun and do activities in honor of those who can't sprks cindy and lou's son ty was diagnosed with a tumor at 2. >> he was the love of my life. from the time he was born my world began and ended with him. >> reporter: he passed away at 5. >> how much did ty help you get through things maybe you wouldn't have thought you couldn't have gotten through? >> without him here it's much harder.

when he was next to me, how can i not be happy that he was there? it didn't matter that he was sick. it didn't matter what was happening. if i was laying next to him in a hospital bed i was in the best place i could be. >> reporter: they created the muddy puddles project as a way to raise money for pediatric cancer research. >> it was just a simple question. one day that i asked him when he wasle really not doing well. i asked him what do you want to do when you get better. he said, i'm going to jump in a muddy puddle. it was just the simplest thing and it stuck with me forever. as a grown-up that would be the last thing on our minds. >> reporter: emily, lindsay and their son ailyn come in memory of mac. >> it's having fun and remembering at the same time. >> reporter: brindly is in remission. she had leukemia. her younger brother became her bone marrow donor. >> last year she wasn't allowed to go in the mud pit. she wasn't allowed to go in the pools. this year she can do it all.

>> is it fun? >> first things first. we are standing right beside a fire truck. that's the activity that's dedicated to your son. can you tell me about him? >> tanner was diagnosed with a brain tumor before his second birthday. he passed away at three and a half. he believed he was a firefighter. every year we are touched that cindy and lou dedicate the fire truck to tanner. it means so much to us. >> reporter: tanner's brother chase got into the spirit. a big high five. oh! right in our faces. >> three, two, one!
