"today in the bay" starts right now. thank you for joining us, i'm sam brock. >> and i'm laura garcia-cannon. we begin with a look at our forecast this morning for friday, the heat up is coming to come, kari? >> it will come this weekend, but right now we're starting out with mild weather and today a little bit warmer than yesterday, but p not by much. we will feel that difference tomorrow. right now it's 66 degrees in livermore, concord and hayward as well as sunnyvale and san jose at 64 degrees. here is a look at those highs, 82 in san jose, mountain view 86 degrees, noe valley at 76 degrees, 84 in petaluma and oakland 77 degrees, san ramone up to 91 degrees and we will see more 90s tomorrow, even some triple digits. more on that coming up in a few minutes. let's see how traffic is moving. things are really light this morning, we don't have any major concerns. i want to show you the traffic flow coming through the altamonte pass. cars on the road, things are moving nice and smooth. i do want to show you there is

overnight construction wrapping up on 680 at the 580 connector and also an accident on the 580 westbound right at the 680 connector. do keep that in mind. across the south bay things are nice and quiet except for a couple of accidents 880 northbound right at brokaw and also 101 southbound headed away from the flow of traffic near can a capital expressway. things are moving smoothly this this morning. we do have an update now to breaking news. firefighters looking for hot spots from this strip hall fire in oakland, happened off of international and 8th street. the flames so large there overnight they actually had had to call for backup twice. the battalion chief on scene tells us at least six units were damaged in that fire. the units a combination of basis with residential units on the second floor. about 15 to 20 people were actually displaced by the fire. the good news is that they got out and no one was hurt. more breaking news now.

this from new york city, specifically staten island. a firefighter there in the hospital right now after a fugitive shot him outside of a staten island house. authorities say that violence came after federal ragts were trying to serve a warrant for the fugitive inside the home who then tried to set the house on fire. when firefighters responded the fugitive shot one of them in the leg. that firefighter's injuries are not life-threatening and the fire did no damage but as you can see from the fire trucks and the s.w.a.t. team units there, there is an active standoff going on with the fugitive apparently hunk erred down in the basement. now to a devastating loss to the contra costa county share tiffs office. a deputy died doing his job off duty. he drowned in lake tahoe while trying to save someone else's life. >> "today in the bay" damian trujillo joins us live from the sheriff's office in martinez with reaction and damian he did what he was supposed to do but still so sad ming this morning. >> reporter: just a tragic turn of events. no one has showed up yet here at the sheriff's headquarters in

mart hez but you can understand that they will be upset, once they show up to work here today understandably. deputy carlos francies did drowned in lake tahoe. they said he was off duty vacation ming in the lake, he tried to save a person who was apparently drowning, but deputy francies ended up drowning himself. there were choppy conditions on the lake yesterday, winds were 20 to 30 miles per hour. it is still unclear if the person he was trying to save also drowned. the sheriff of contra costa county put out a statement late last night. sheriff david livingston wrote, carlos prann sees died doing what he was sworn to do, putting his life in the arm's ways to help others. now, a team from contra costa sheriff's office is headed to lake tahoe yesterday actually to do their own investigation into this tragic accident but the

official investigation is being conducted by south lake tahoe police. tragic turn of events here am in contra costa county. we're live in martinez, i'm damian trujillo, "today in the bay." happening today, the sensitive debate over life:#úw death will play out in court. terminally ill patients and doctors who treat them are suing the state for the right to tie. "today in the bay's" kris sanchez has more on what's expected to be a very high profile controversial case. >> reporter: it is, it's high profile, controversial and certainly something that families talk about at the dinner table as well as in the legislature, our lawmakers talk about it there as well. it's going to be a long time before the issue is settled here in california, legislative side, the most recent actions stalled, which is why this san francisco woman and others like her are taking their fight to court. also christie white who twice fought for her life and now her leukemia is in remission, but she wants to make sure that if her leukemia returns she has the right to die on her own terms.

attorneys for her and two other plaintiffs will argue in court today for an injunction protecting their doctors from prosecution if they prescribe medication to help end their lives. for christie white it is the difference between dying at home or dying in mother state. >> i don't want to have to leave california. i live here, my family and friends are here, i have a farm two hours north of here, you know, i have my vision if that day comes of what i want it to be and it's not in a strange place in oregon that i don't know. >> that reference to oregon is referring to the death of brittany hay nard, a san francisco woman who moved to oregon with her husband so that she could end her life before the is suffering from terminal brain cancer became too much to bear. there is a 100-year-old statute that prevents doctors from participating in a patient's suicide. the attorney general will present the state's case. just about three weeks ago a san diego superior court judge

dismissed a similar lawsuit saying that the issue is not one for a superior court judge, but one for legislators or voters to decide. sam and laura. >> maybe they will depending upon the outcome of had case. now to a painful anniversary for a bay area mother. today marks nine years since her 17-year-old son was shot and killed in front of his home and still no answers. "today in the bay" stephanie chuang is live from our san francisco newsroom with more on her quest for closure. good morning, steph. >> reporter: both that who are and san francisco detectives are asking for help in solving this nine-year-old cold case. a 17-year-old gunned down trying to help save other people's lives. that's according to paulette brown who every year goes to grove and baker near golden gate park to post the pictures of her son, this is since 2006. that's when she says her son, 17-year-old aubrey abrakasa was headed to work on this day, august 14th, when he spotted six men with guns walking down his

street headed to another group of people. he yelled run, that other group scattered but aubrey was hen shot she says 30 times. despite a $250,000 reward there has been no real leads in this case. a nine year old murder case, but paul let says she will not stop million her son's killer or killers are behind bars. >> i don't know how long, i don't know p it's going to be in my lifetime but i do have hope. that's why i continue to do this. >> reporter: and on that note paulette brown will once again be at grove and baker today on the ninth anniversary of her son's murder along with homicide detectives at 3:00 this afternoon to hand out flyers and answer questions. 3:00 p.m. a is around the time when her son was killed. again, so far nothing but paul let is very determined, she has also been helping on a different mission and we will have more on that coming up in her next half hour. live this our san francisco newsroom, stephanie chuang, "today in the bay." it is 5:07. sunnyvale not known for violence, but this morning police are investigating the death of a woman who was

apparently killed with a hammer. lindy smith was arrested in connection to that case outside her home at the plaza del rey mobile home park. police say she called officers herself to report the incident. after they arrived they discovered the body of a woman inside the home. the woman had blunt force injuries and there was a hammer nearby. neighbors on vienna drive say the victim and suspect were related. this is sunnyvale's first homicide in a year. in fremont police looking for your help finding a driver who hurt a woman it in a case of road rage. it happened wednesday just before noon. police say the woman was driving to work when the suspect cut in front of her and slammed on the brakes. the woman pulled over on to barlow court but the suspect made a u-turn and drove straight at her, hitting her car door and injuring her leg. police say the suspect was in a new we are model dark gray toyota highlander with twinted

windows. a fairfield man behind bars for intentionally setting several tires. david laugh man was arrested wednesday. investigators say he set five tires in pair field this in one night. a witness saw loflim watching one of the fires. police say he had a lighter and a box of matches in his pocket when he was arrested. conditions could be right for more fires this weekend. we hope not but temperatures are on their way now. let's turn to meteorologist kari hall. >> not only will it be hot and dry, but we will also have some gusty winds, too. we start out this morning in the lower 60s and it's 63 degrees in san francisco while the north bay is now at 53 degrees. some clouds, fog and some mist in spots, but that will clear to give us a sunny afternoon, 89 degrees in the south bay, a bit warm in the peninsula, too, 84 degrees east bay, 81 degrees in the tri-valley. making it into the lower 90s as

well as 90 degrees in the north bay. i will talk about the heat this weekend, what to expect and when it rolls out of here, it's coming up in a pew minutes. let's see how traffic is moving with anthony. i want to start you off with this shot if you are just joining us, we were talking about this fire in oakland and the spoke billowing up over the highway. just want to give drivers a heads up, 880 dealing with some smoke this morning as you get towards the lake merritt exit. traffic moving without a problem. as we switch over to the bay bridge toll plaza wide open lanes. i to want to show you the traffic maps, that's where the fire is and where some of the smoke will be billowing up over the highway. really not affecting traffic all that much right here this morning. >> luckily no one hurt in that one, too. coming up, what's inside hillary clinton's private e-mail server? many have wondered. the new details coming out this morning next. plus --

happening today, it is the first time this has happened in half a century, the u.s. is going to raise the american flag over our embassy in havana later today. >> but the event is being soured somewhat by accusations by if i had dell castro. brian mooar has more reaction from washington, d.c. good morning, brian. >> reporter: a lot has changed and then again maybe not so much. that flag will be flying over the u.s. embassy in havana in two hours' time.

firefighter out of rubble, some 32 hours after huge explosions killed dozens. that firefighter is now at the hospital recovering with injuries to his face, chest and feet. 17 of the more than 50 killed were firefighters. this of course in tianjin china, but there are still others missing. meantime, investigators searching for any clues to figure out what caused those explosions at a warehouse used to store toxic chemicals and gas. client niece media reporting an atomic energy response team is heading to the scene. there's new details this morning that we're getting an idea about the sensitive and perhaps top secret information discovered on hillary clinton's private server. the "associated press" spoke exclusively with some u.s. officials. they reviewed clinton correspondence deemed top secret earlier this week by an auditor. one e-mail involved a drone operation, the other apparently refers to highly classified material, but still sources say the reporting of that information may have been inadvertent and clinton did not

actually transmit the information. a new lawsuit surrounding head injuries may change the face of college football at cal and perhaps across the nation. former cal bear bernard hicks is suing the school for pael. he says he suffered permanent head injuries from concussions in his playing days. the suit accuses cal of failing to take adequate measures to prevent concussions and failing to warn about long-term consequences. >> what a jury is ultimately going to decide is did the university of california, did coach ted ford and his training staff act reasonably under the circumstances for what was known back had in 2004 through 2008. >> the university responded to the suit saying, our keeps, physicians and medical staff and everyone involved with cal athletics are did dedicated to the safety of our student athletes. while we cannot comment on any student's specific medical history, we were saddened to read the lawsuit's statements about mr. hicks' health. now to a saga that certainly

hit home here in the bay area. barry bonds speaking out for the first time since federal prosecutors dropped the obstruction of justice case against him. bonds made an appearance last night at at&t park where he told the "associated press" he is not holding think judges about the federal court case. bonds says he is just thankful the entire process is over. he also reiterated what he told nbc bay area's raj mathai last year, he feels he, quote, deserves to be in the hall of fame. >> it's 5:17. tesla wants more money. >> in order to get it it's going to sell more stock, scott mcgrew. not something current shareholders want to hear. >> no, it dilutes the value when you do this. companies can manufacture stock just like they do cars. tesla doesn't own stock in itself, no company does, but it can make more stock and is sell it for cash. in fact, this is not the first i am tesla had done this, it sold stock to pay off its department of energy loan. so tesla will it tell 2.7

million new shares worth about $600 million. this will help it pay for all the factory conversions it needs to make the model x and model 3. now, lodge lee tesla's share price should fall because there are more shares out there, but investors seem pleased that tesla is going to have the extra money and that seems to have offset any worry. not every company can get away with this. apple has released its latest diversity numbers it's slightly less male, slightly less white than it was but only slightly. what the report really shows is how massive apple is. tim cook says the company fired 11,000 women last year, but apple is such a huge company it barrel who have had the needle. let's check your news before the bell, landon cloudy is live at cnbc world headquarters. good morning. >> happy friday to you. the markets look to end the week in the green as stocks lame this session on thursday as a drop in oil prices weighed. crude is training at six year lows between $42 is barreling

and slumping global demand. we get data today on inflation, manufacturing and the consumer that are rising five points to 17,408 the nasdaq falling 10 to 50.33. scott, back over to you. >> we were talking earlier this week about how many different projects google was working on. so many it actually made sense to rename google just to cover them all. the latest is mosquitoes. google has at least one jeannette cyst talking to google about genetically modified mosquitoes. it's an idea that's been around for a wiechlt you release these modified mosquitoes -- do you know what, what should we talk about -- let's talk about mosquitoes for a little more then i will get to the guy on the goose i promise. so they don't spread malaria, they replace the current population, malaria kills a half a million people a year. this is wyatt scott, let's listen to him as well, he is running for parliament if canada, he has released what may be the most awesome political ad

was yesterday as we take a live look at san jose we see that it is a nice way to start out the day as you walk out the door, it doesn't feel so bad, and as you head out this is what you need to know, these are your weather headlines as we get a live look, another view of san jose. clouds and fog and some patchy mist to start, but it will be clearing gradually, some gusty winds picking up and mostly clear this evening, sunset will be at 8:01. these days are getting much shorter and fast. look at these temperatures now in the mid 60s with highs today reaching the mid 80s in the south bay, gilroy, though, topping out at 91 degrees, burlingame 80 degrees and mow would he valley at 70 degrees -- still some spots where you can go cool off from those 90s inland. burlingame on the avenue happening this weekend, it will be kind of warm though with highs topping out in the lower 80s. weather coming up.

we've got light traffic this morning, flow is moving good across the altamonte pass. you can see 580 westbound moving without a problem. as we switch over the to the maps past that into the castro valley things are moving pretty good. same for hayward towards fremont, 880 looking wide open. some slowing getting on the san mateo bridge. it's mott all that bad but every now and again you will notice some congestion here as cars start to get over the foster city side. the rest of the bay area and a the south bay is looking pretty good, those earlier accidents have been cleared. back to you. we will be right back.

it's 5:25. behind every good shelter, animal shelter, is a good volunteer. this is a very special week for us here at nbc bay area, there are nearly three dozen animal shelters taking part this this our clear the shelters pet adoption happening tomorrow. >> which we personally will be out there tomorrow as well am berkeley. among the dozens of volunteers one from the humane society of silicon valley says helping out is her way of giving back. here is nbc bay area's raj mathai. >> reporter: from lounging around or jumping for joy to being the sent err of a child's attention, the animals at the humane society of the silicon valley are never bored. a team of 1,100 volunteers help care for the animals as they

county this morning. a man to protected the streets has now died trying to save a life. they were not ideal conditions in -- south of lake tahoe yesterday. the waves were choppy, winds were between 20 and 30 miles per hour where he had. deputy carlos francies spotted a person in the lake who was drowning. that's when the deputy who was vacation thing jumped in the lake to try to save that person but the deputy ended up drowning himself. it is still unclear if the person, the deputy francies was trying to rescue, also drowned. this has left a huge void at the contra costa share tiffs office. this he issued a statement, it read in part, deputy carlos francies died doing what he was sworn to do, putting himself in harm's way to protect the lives of others, he is a hero and an example of exactly what is right in law enforcement today. the south lake tahoe police department is handling the investigation into the drowning, but a team from contra costa

county arrived there yesterday to gather information on what exactly happened, and that is what the sheriff's office tells us, that they still don't have a lot of information, they are looking into this matter. live in martinez, i'm damian trujillo, "today in the bay." it is 52 3 3:00. san jose is's police sun is scheduled to vote on a long awaited wage offer from the city but only on certain conditions. the police union went back on terms of an earlier deal on pension and disability for officers. both sides have been at odds since voters passed measure b back this 2012 which dramatically cuts those benefits causing officers to really leave the department in droves. the city council is meeting in a closed session in morning to discuss the issue. the police union says if the council agrees to stick to that original offer union members will vote on this afternoon. san jose mayor sam liccardo expected to deliver a speech on the heels of the first major shakeup of his ten tour. he is scheduled to address the

aid in dying initiative. so clearly a difficult issue no matter who is deciding it. thank you very much. it is 5:35. a black lives party rally scheduled today at the site where oakland police can killed a robbery suspect earlier this days. it comes days after intense demonstrations polling that shooting. protesters took to the streets blocking traffic, smashing windows of a starbucks at well, at least one person was cited. we are learning more about the shooting that parked those protests. oakland's mayor tells us the officer's body camera shows the hand pointed a bunn at the officers. police say three officers then fired at the man. right now also still mixed reaction about the deadly shooting in the community. >> i don't trust the police. huh-uh. because he had a gun. he didn't want to drop that gun. >> oakland's mayor is urging people not to rush to judgment. for many of us today is just a friday in august, but for one bay area mother it's a painful
