clouds and we are now in the lower 60s, though 50s in the north bay. north bay we will see a high of 90 degrees, in the south bay 89 degrees and san francisco 74. we will check out that weekend forecast coming up in a few minutes. let's see how traffic is moving. this morning the bay bridge toll plaza is jam packed already, folks gets an early start on the weekend. now and again we are getting a lighter flow but things are backed up here not only from this vantage point but all the way from 880 coming in from oakland. traffic flow not all that bad but once you do get towards lake merritt you may ran into some smoke. also finding there's slowing on 880 southbound near fremont. once you get past the accident things it to start to improve but there is an accident right at fremont boulevard that's going to keep things slow on 880 southbound. we also have an update to that breaking news. that fire you mentioned, it is out now, but not before forcing who are than a dozen people out of their homes in oakland.

the huge fire broke out overnight am a strip mall at international and 8th avenue. that's in oakland's chinatown neighborhood. firefighters say at least six is apartment units above the shops were damaged in the fire and that displaced about 15 to 20 people. luckily no one was hurt. more breaking news, this from the east coast where a new york city firefighter is in the hospital this morning after a fugitive shot him outside of a satten island home. you are looking at video from earlier in the morning but this is an ongoing situation. authorities say that it happened after federal agent -- we now have a live picture -- tried to serve a warrant for a fugitive inside of that home who then tried to set is the home on fire. when firefighters responded the fugitive shot one of them in the leg. we've learned that the firefighter's injuries are not life-threatening and the fire did not damage. right now as you can see there is still an active standoff going on with new york city s.w.a.t. teams with that fugitive apparently hunkered town in the basement. this morning the contra costa sheriff's office is

remembering one of its own. a deputy tround in lake tahoe trying to save someone else's life. "today in the bay's" damian trujillo live at the sheriff's office am martinez. dami damian, authorities from will actual areally going to lake tahoe we understand this morning. >> reporter: they should be there though actually. just another tragic turn of events here in the bay area. the bay area has lost mother peace officer. lots of heavy hearts here at the contra costa share testify office in the city of martinez. the sheriff's office says that deputy carlos francies was off duty vacationing in south lake tahoe. that's where he tried to save a person who was apparently drowning in the lake but deputy francies ended up drowning himself. there were choppy conditions on the lake yesterday, winds were 20 to 30 miles per hour. there is no word at this hour if the person he was trying to save also drowned. the sheriff of contra costa county put out a statement, sheriff david livingston wrote, did deputy carlos francies died

doing what he was sworn to do, putting himself in harm's way to protect the lives of others. he is a hero and an example of exactly what is right in law enforcement today. the investigation is being handled by the so south lake tahoe police, but again a team from contra costa county is it in lake tahoe right now to look into this tragic incident. the sheriff's office says they are trying to gather more information into exactly what happened in the lake. we're live in contra costa county, i'm damian trujillo, "today in the bay." nine years later still no answers, this morning a mother is going to return to the are very spot where her 17-year-old son was gunned down in front of his san francisco home. this happened back in 2006 and every year since she's handed out flyers hoping somebody will remember something. brown has been going through and still going lieu losing her son, wanting answers. with the killer or killers still on the run. as you mentioned, every year since 2006 she has done the same thing, she's gone back to grove and baker, the corner where her son was gunned down in 2006 on august 14th he was just 17 years old, we are talking about aubrey abrakasa, his mom says that he saw six men with guns, walking down the street, headed to shoot someone else it looked like, she said aubrey yelled run, the other group scattered but aubrey himself was shot 30 times. despite a $250,000 reward there has been no leets but paul let says she will not some until her son's killer or killers are behind bars. >> this is the way i heal. also the way i keep my sanity is by keeping him alive. even though he is dead he's still alive in my heart. >> reporter: paul let says she believes witnesses have not stepped forward because they are scared of what will happen to them but she is stead fast am

shooting in the community. >> no, i don't trust the police. huh-uh. because he had a gun, he didn't want to drop that gun. oakland's mayor is urging people mott to rush to judgment. happening today it really is a question of life and death, the sensitive debate taking lace in center stage in san francisco in a courtroom this morning, terminally ill patients and the doctors who treat them are suing the state for the right to die. "today in the bay" kris sanchez joining us live in our studio. this is a case a lot of people will be watching carefully. >> reporter: they are. a san francisco woman is hoping that a san francisco superior court judge will do something that the legislature and another court failed to do in recent weeks which is to protect doctors who help their patients end their lives. christie white watt ld leukemia twice and succeeded but should it person she wants to make sure she has the right to die on her own terms. attorneys for her and two other plaintiffs will argue in court today in san francisco for an injunction which would protect

doctors from prosecution for prescribing life ending medication. a hundred-year-old statute prevents them from doing that. for christie white it is the difference between dying at home or not. >> i don't want to have to leave california. i live here, my family and friends are here. i have a farm two hours north of here. you know, i have my vision if that day comes of what i want it to be and it's not in a strange place in oregon that i don't know. >> that reference to oregon is a are reference to another california woman, brittany maynard, who moved to oregon with her husband in order to end her life before the suffering from terminal brain cancer became too much. i mentioned another court's action just a moment ago, that was about three weeks ago, a san diego superior court judge dismissed a similar lawsuit to the one that will be heard today saying that the issue is not one for a superior court judge but rather an issue for legislators to decide or voters to decide but four iams in the last 20 years voters failed to pass an

aid in dying initiative. clearly a difficult issue no matter who is deciding it, the courts, legislature or voters. 6:07. police in fremont want your help finding a driver who hurt a woman in an apparent case of road rage. this happened wednesday just before noon. police say the woman was driving to work when the suspect cut in front of her and slammed on the brakes. the woman pulled over on to bar tease low court but the suspect made a u-turn heading straight towards her. police say the suspect was in a new we are model dark gray toyota highlander with tinted windows. dozens of people who live in this san francisco building are suing the owner. one person died in that fire, a lawsuit filed this week claims the owner reflected repairs to the building. ten plants say that that definitely played a role in starting the fire while dilapidated conditions helped the fire to spread.

grocers a group claiming to help bay area veterans has collected cash for months in front of local grocery stores. after a viewer a veteran himself called us with questions our investigative unit looked into gift a vet. here is investigative reporter vicki nguyen with what she under covered. reporter: day after day we watched as men outfitted in military clothes sat at tables with flags and ammo boxes, they accepted cash donations and made big promises to our hidden cameras. they said gift a vet gives money to homeless and disabled

veterans and partner with groups in santa clara county. both the county and court leaders say they have never worked with gift a vet. with en we asked the co-founder fallean mintz questions he jumped in a car. we heard they are not registered with the irs as a charity or nonprofit. when we dug founder into the co-founder's history we now mints was arrested for brand theft. dorothy arndt is listed as the group's founder but we never saw her out collecting cash. she was convicted of aggravated sexual abuse of a 15-year-old in 2007. she never returned our messages for comment. nonprofit experts say this is part of a troubling trend, groups taking rang of the good will toward veterans. they say unless it's an organization you recognize, steer clear of donating cash until you have had a chance to look up the group on a site like guide star.com. you can see our full report

around or jumping for joy to being the center of a child's attention, the animals at the humane society of the silicon valley is are never bored. a team of 1100 volunteers help care for the animals as they wait for a new family and a new forever home. >> i started volunteering with my husband 13 years ago because we had a pet dog, it was our first and we fell in love with all dogs at that point. rather than getting a second dog we decided to volunteer here and get doggy love every day. people come here not just to adopt an animal but to find a companion. dogs and ats a cats and pets just make such a difference in all of our lives and i think that when i get to make that love connection that i'm enhancing not just the life of the animal that i've really come to move and enjoy but the familc that takes them home as well. >> for mrs. lafrty it's a no-brainer you offer these pets a home, they offer you uncan believe love. >> it will be the best time you have ever invested.

81 degrees will be the high today in the east bay, tri-valley making it into the lower 90s, south bay 89 degrees and 90 in the north bay, san francisco topping out at 74 degrees, a little bit more sunshine than yesterday and our winds have shifted and we are getting more of a northerly wind. it will start to pick up, though, as we go into the afternoon. here we are at 4:00, winds coming in at about 15 to 20 miles an hour, look at what happens this evening along the coast, half-moon bay a wind at 27 miles an hour, it may be even more gusty as we go into the weekend and some clearing across the bay except for around ocean beach, you will see those clouds holding on a little bit longer, also down to about pacifica, but the rest of us seeing mostly clear skies and the heat continues to build as high pressure moves in the next couple of days and here is a look at those numbers, some 90s even hitting over 100 degrees, tri-valley 102 on sunday, monday still pretty hot across the bay

with widespread 90s and some 70s coming back into san francisco by the start of the new week. we will keep you up to date with that right now anthony is keeping you up to date with traffic. earlier had morning we were telling you about a fire in oakland and some of the smoke over the highway. now that we can see the horizon i'm zoomed out to show you not much smoke out there across 880. that's good news do remember drivers. elsewhere across the bay as we switch over to the maps you can see headed down soords san leandro, hayward not a problem. the first accident at mowry avenue and the other one off the highway but you can see that one near mowery one lane blocked there keeping things slow. we will continue to follow that. the rest of the bay area moving pretty smooth. coming up right now at 6:22 a potential game changer, a local lawsuit with national implications as a former cal bear accusing the university of turning a briend eye to concussions.

breaking news right now coming from southern california. our nbc chopper over a brush fire burning in semi valley, this is a live look, you can see all of the smoke. how did it start? we are told a car went over the side of the 118 freeway and ignited the flames. as you can see there are not a lot of homes in that area, it is removed from residential developments, but if crews don't get those flames out soon they will soon be facing triple digit temperatures later today. we will keep you updated as a story develops.

a new lawsuit surrounding head injuries may change the face of college football at cal and across the nation. ber marred hicks is suing the school for medical malpractice. he says he suffered permanent head injuries are from con can ugss am his playing days. it accuses cal of paling to take adequate measures to prevent concussions and failing to warn will long-term consequences. >> what a wrir is ultimately going to decide is did the university of california, did coach ted[b ford and his traini staff act reasonably under the circumstances for what was known back in 2004 through 2008 into the university responded to the suit saying, our coaches, physicians and medical staff and everyone involved with cal athletics are dedicated to the safety of our student athletes. while we cannot comment on any student's specific medical history we were saddened to read the lawsuit's statements about mr. hick' health. a face to the case. take a look look at this picture. she is the woman that

this happened yesterday. winds were between 20 and 30 miles per hour in south lake tahoe yesterday, the waves were choppy. deputy carlos francies saw a person on the lake who was drowning. that's when the deputy who was spray tags thing jumped in the lake to try to save that person but the deputy tragically ended up troung himself. there is no word if the person the deputy francies was trying to rescue also drowned, but the loss has left a huge void here in the contra costa sheriff's office. sheriff david livingston issued a statement it read in part, deputy carlos francies died doing what he was sworn to do, putting himself in harm's way to protect the lives of others, he is a hero and example of with a exactly is right in law enforcement today. the south lake tahoe police department is handling the investigation into the drowning, but a team from contra costa county arrived there yesterday to gather information on what exactly happened. a lot of unanswered questions here in the city of martinez. we're live am contra costa

armed with guns heading down his street apparently going to shoot someone else so he yelled run, the gunman then shot aubrey 30 times. despite a $250,000 reward there have been no leads. >> when the funeral is over no one is there for us after months down the line. we're still grieving and crying. >> it's a shame that there were people around am this neighborhood because it was broad daylight that saw something that won't come and step forward. >> and that's george arant who works for the san francisco sheriff's department reentry project that's been helping to track down leads. paulette says there are more than 100 unsolved killings in san francisco. she is trying to help get breaks in those cases to help those families as well. paulette along with homicide detectives will be back at grove and baker at 3:00 this afternoon. you hay wonder why 3:00 in the

afternoon, that's the time her son was shot and killed. stephanie chuang, "today in the bay." it's 6:36. sunnyvale is not known for violence but this morning police are investigating the death of a woman who hwas apparently kille with a hammer. lindy smith was arrested outside of her home at a plaza del rey mobile home park. police say she called officers herself to report the incident yesterday. after investigators arrived at the discovered the body of a woman inside the home who had blunt force injuries and there was a m had aer mere bi. neighbors on vienna drive say the victim and suspect were related. a follow-up now, we now have a face to go along with a bizarre case. the chp released a picture of the woman had they believe fell from the bay bridge earlier this week. it's 25-year-old erlen sanchez edwards from richmond. she is accused of crashing ael stolen car on the bridge and running from the scene.

thee then fell off the bridge as a chp officer ride to grab her. investigators say she swam to shore and was picked up by a dump truck driver and still on the run this morning. a fairfield man behind bars for intentionally setting several fires. this is the suspect's second arson arrest. david loflin was arrested wednesday. investigators say he set five fires in fairfield in one night. a witness saw loflin watching one of the fires. police say loflin had a lighter and a box of matches in his pocket when he was arrested. progress for firefighters as conditions start to heat up they are gaining ago handle on the jerusalem fire burning in lake and napa count wrees. that fire is 52% contained. 24,000 acres have burned so far though luckily no homes have been destroyed. firefighters are bracing for triple digit temperatures expected had weekend in the north bay. the goal is to have full containment by monday. with all those fires and a lot of heat it's odd to say get

east bay and the tri-valley up to 91 degrees today. so it does start to heat up, if you are heading out to the giants game later on this evening it will be 68 degrees at first pitch, we will also have mostly clear skies and wind coming out of the west at 10 to 15. this weekend a lot happening around the bay area including moja the african festival and soccer tournament in oakland at 10:00. it will be 75 degrees, but temperatures jump up to 86 degrees so is you will want to bring lots of water and remember the sunblock, too. in burlingame it will be also bright and sunny, warming up there for the festival, the vendors going on during the day on the treats. you will want to also try to stay hydrated and combat that warm weather. we're talking about 80s, 90s and even over 100 degrees this weekend. by sunday it's 102 in the tri-valley, on monday it's 94 degrees and the peninsula will also be pretty warm, reaching the lower 90s this weekend.

this morning. fire broke out overnight in a strip mall at international and 8th avenue. that's in oakland's chinatown neighborhood. firefighters say at least apartment units above the shops were damaged in the fire. about 15 to 20 people now don't have a place to live. the good news, how, none of them were hurt. a family vacation turns tragic. a contra costa county sheriff's deputy drowned in lake tahoe. he was off duty, trying to save someone else's life.
