more comfortable than yesterday. yesterday was pretty nice, but today our temperatures coming down two more degree. it's 58 degree in north bay. san francisco, 63 degrees and some clouds rolling in. cooler this afternoon with 70 in san francisco, 83 in the north bay, south bay 79 and 76 in the peninsula. east bay get ready for 74 degrees for a high, very pleasant today. heating up this weekend, i'll have a look at all the microclimates coming up. let's get a look at horning commute with mike. >> good morning. looking here toward 580 westbound around el charro. no visible construction here. westbound construction's cleared up the map, talking about earlier construction zone reportedly a klatter zone for some, gravel in the roadway between greenville and vasco. no cleanup ordered for the airport rest of the bay smoothly. we begin with a story still

developing. a questionable death of an inmate in santa clara county jail. three correctional officers under the microscope. investigators have searched the homes of the three officers. >> live at the santa clara county main jail. what do we know so far, damian? >> reporter: the three correctional deputies served with search warrants a few days ago, so their homes were, in fact, searched. this has turned into a criminal investigation on part of investigators here in santa clara county. we obtained court document yesterday and lists as the victim ain't mate named michael tyre, badly beaten in his jail cell. several sources tell our investigative unit he had wounds consistent with a physical beating, with lacerations to his live somewhere spleen. the coroner has not released the autopsy yet. as we first reported friday, in an unusual move, the sheriff put

the three correctional deputies on administrative leave after the incident. according to the court document, he was waiting to be transferred to a bed at momentum crisis residential treatment center. he had earlier appeared before a judge in a mental health court. sources tell us some argument ensued inside his jail cell, and a short time later guards found him dead. >> deputies doing a welfare check as normal, noticed the person was not responding to them, knocking on the door. they rendered aid. fire and pair are medics were called. >> reporter: our investigative unit contacted his sister out of state. the sister said she was not ready to speak to us at this time. now sources tell us that at least one of the correctional deputies had several excessive use of force complaints lodged against him. live at the main jail in san jose, damian trujillo. >> we'll stay on top of the story throughout the morning. head to our website,

nbcbayarea.com or download our free nbc bay area app. new this morning, west oakland b.a.r.t. station running, closed over three hours overnight after a man shot himself trying to get a gun out of his waste band during a confrontation with police officers. it shows the suspect after he apparently shot himself on accident. investigators say he was smoking on the platform, which is again the law. b.a.r.t. officers approached him and he reportedly threatened to jump on to the tracks, then reached for a gun in his waist band. officers proceeded to tase him he accidentally shot himself in the stomach. that man is in critical condition at the hospital. 4:34. today in san francisco, police will be talking about the use of body cameras. the department is holding a meeting to discuss the policy for the cameras. there's been more attention on the use of body cameras as more police encounters are caught on cell phones.

san jose police department launched its own body camera pilot program. follow up on a story we first broke, santa clara county says new video you're about to see, one example why one supplier turner construction from a hospital project. >> scary scene, as you see. a worker next to the pipe that exploded explosion happened as crews were installing a steam pipe last year. the video reportedly shot by an on site county inspector. the workers were not seriously injured. county says turner construction is way behind schedule on the new santa clara valley medical center suspect the company -- turner dedines allegations. if both sides fail to reach an agreement by friday a new contractor is going to be hired to finish the hospital.

a fiery issue, gallons of flammable crude oil within a mile of your child's school happening on railroad tracks across the bay area. now many are wondering, is this safe? >> live in emeryville with more on a new report just out. chuck, what does the report say? >> reporter: well, center for biological diversity just released a study of california schoolchildren near oil train routes. among its findings, here in the bay area, some 50,000 schoolchildren are in class while trains roll past. now a proposal to increase shipments to a proposed oil

depot in san luis obispo would bring an additional 200,000 schoolchildren within a mile of school trains. valley love says too many, too close. >> i found the number of children that go to school within one mile of a current oil train route staggering. >> now the association of american railroads says it's spending $30 billion on what it calls top to bottom operational reviews. implementing lower speeds, increasing train inspections and the use of track side safety technology as stepping up outreach and training for first responders in communities. this is all under the large umbrella of trying to prevent explosions and evacuation areas in schoolchildren, perhaps being too close to these evacuation areas. expect more debate on this. chuck coppola in emeryville,

at&t park, 69 degrees. some spots briefly hitting 70 degrees but then the clouds really get thick as we go into the evening and then we'll be dropping back into the lower 60s. we have this reinforcing shot of cool air rolling in as we speak. and it will bring in deeper marine layer, giving us more clouds during the morning and drizzle possible along the coast. and temperatures stay below average. so into the next few days, it will be cooler. but look at the weekend. it will be warming up. talking about 90s for the south bay as well as the east bay, tri-valley and north bay. and after that warm-up, it will be very warm memorial -- heading into labor day. what am i talking about? let's see how traffic is going with mike. >> you're forecasting way out there, good stuff. looking towards 680, i'll talk about the speed sensors have recovereden an overnight road crew, they must have been moving stuff very slowly through the

suffering a spinal cord injury while in custody, he died a week after the arrest. leaders and police gearing up for another round of protests and potential unrest during the two weeks of hearings. kentucky county clerk who says her faith is more important than the letter of the law is refusing to budge on granting marriage licenses to same section couples. >> based on what? why are you not issuing marriage licenses today? >> because i'm not. >> why? >> whose authority? >> under god's authority. >> that's an exchange from yesterday in a heated back and forth between the county clerk in dave swiss same-sex couple. was her first day back at work after the u.s. supreme court ordered her to issue marriage licenses to all couples. davis is facing fines and may receive jail time for defying the court order. getting her removed would be difficult because she's an elected official which means she'd have to be impeached. dave swiss deputies scheduled to

appear in court tomorrow. a bumpy road ahead for uber. a judge rules drivers can move forward with a class action lawsuit against the company. drivers claim they should be labeled employees instead of contractors. now there are some restrictions. only uber black, uber x, uber suv driver can join in the luft. those drivers must have driven for uber in california at any time since august 2009. if the drivers win, uber will be forced to pay expenses such as maintenance, insurance, gas, and for the cars themselves. pg&e wants you to pay more. utility is looking to collect an extra 2.7 billion from its customers over the course of the next three years, starting in 2017. the money would be used for technology upgrade and improved disaster response, that's what the company says. regulators have to improve that increase. if they do, your bill can go up by four bucks a month starting in 2017. >> good thing the weather's cooperating, at least for now.
