one u.s. marine. it happened last night at camp lejeune in north carolina. the helicopter came down during a training exercise. at least nine other marines were hurt. the name of the marine who died has not been released. a marine spokesperson says the crash is under investigation. we are monitoring the situation from our newsroom as well. we'll bring you the very latest developments as they become available to us. you can also get information any time of the day on our nbc bay area app. now to a story you'll only see on nbc bay area. after months behind bars in the bay area, a texas man is free this morning. he was almost deported to mexico even though he is a u.s. citizen. >> today "today in the bay" chuck's copolo is live in the newsroom. chuck, how could this happen? >> well, it is a tricky one. at the heart of the case is whether u.s. immigration authorities violated a 2009 memorandum to fully investigate claims by u.s. citizens that they are in fact u.s. citizens. roberto salizar's mother was

born in the u.s., and though he was born in mexico, he had claims to u.s. citizenship. but, u.s. immigration authorities held him in the u.s. jails after he went to mexico in may and then tried to return to his home in texas. >> whashd have happened is when he told them that he thought he was a u.s. citizen because his mother was born here, they should have followed the -- there was a mem bum from 2009 that was issued that explains what the procedure is for someone that claims u.s. citizenship. . i.c.e. is supposed to basically investigate it. >> yesterday salizar walked out of richmond's west county jail after his attorney found the documents proving his citizenship. his attorney is now looking into what sort of liability immigration authorities may face for detaining a u.s. citizen for four months. meanwhile, immigration authorities say they take these claims very seriously.

in the san francisco newsroom, i'm chuck copola, "today in the bay." 5:02. today we could find out if there is enough evidence to try juan francisco lopez sanchez for murder. his preliminary hearing is expected to wrap up today. the woman was shot and killed while walking outside with her father in july along the elm ba embarcadero. sanchez is an undocumented immigrant who has been deported several times. there have been dozens of delays, questions with no answers, and no justice for the family of missing morgan hill teenager sierra lamar. finally this morning movement in the case. >> the man accused of killing lamar will finally face a jury but there could be some complications. >> that man has been sitting in a jail cell here at the main jail for the last 3 1/2 years but you're right, after dozens of delays, it looks like that day is finally here.

sierra lamar disappeared while walking to school in morgan hill back in 2012. a week later investigators arrested torres. sierra's body has not been found but prosecutors are still pushing forward for the death penalty for torres in the murder. they say dna evidence belonging to sierra appeared in the suspect's car. torres was a clerk at the nearby safeway store at the time. torres' lawyers are trying to fight the charges still. >> i was glad. i was happy, yeah, a little bit relieved. i was shocked, too. that's probably the most overwhelming emotion was shock because i had my expectations set pretty low. >> there are some serious problems with this case that have been there since the beginning. might have a question about the appropriateness of the death

penalty in this case. >> april 25th is when garcia torres is expected to go to trial but his lawyers will add challenges including a possible change of venue request. this might not be over just yet. i'm hearing from sources that tips on this case continue to come in even this week. on the run for weeks but today behind bars. the suspect considered armed and dangerous is accused of a deadly office shooting. police tracked down the tfugitie in san jose. he and two other men are accused of terrorizing and killing a man inside an office building last month. police say he's been seen on surveillance video, and that he was holding a ball and chain. that kind of weapon. he is the only suspect still alive. the other two died in separate police shootings. happening today, will she go to jail? the kentucky county clerk who is

refusing to issue same-sex marriage licenses because of her religion will face a judge herself in just a few hours. >> today in the bay's kris sanchez joins us in studio. >> jail and fines are on the table as the county clerk in kentucky faces a federal judge. while he can throw the book at her, as an elected official she cannot be fired, at least not today. she will face a federal judge to explain why she's defying the u.s. supreme court in refusing marriage licenses to same-sex couples. her lawyer says this is a case about religious freedom but opponents say this is an issue of civil rights. the argument that will play out in court today played out in the clerk's office once again yesterday. >> your interpretation of the bible does not form the constitution. your interpretation of the bible does not form the united states constitution. >> our constitution is founded on -- >> no, it is not. our country is not founded --

>> the voices that you hear in the background are supporters from both sides of the issue. davis says she's not disobeying the supreme court because she's waiting for an appeal and she adds that she's not discriminating because she's not issuing marriage licenses to any couples, same-sex or otherwise. meanwhile, another county clerk in casey county, kentucky also refusing to sign marriage licenses. he's on a 400-mile bike ride to show solidarity with kim davis who he says is just doing the job that she was elected to do. kim davis heads to federal court this morning, and if she is found guilty of misconduct eventually and goes to jail for that, the state legislature could impeach her but that is farther off certainly than the hearing. >> right. and the fact that she's waiting for those appeals. very interesting. 5:07. many location l veterans now say could get some closure after a vandalism case in the east bay. an 18-year-old man from utah now

facing a felony charge after allegedly spray painting a war memorial at oak hill park in danville. many people say it is a sacred place. it happened back in june. closing out the week right now heading into the weekend, how is the going to look? >> it is going to be great this weekend but getting a little bit hot in some areas. as you head out today, we start out with nice, quiet conditions. areas of clouds and fog along the coast. sunrise at 6:39 now. it will be clearing quickly. some comfortable temperatures again today. mostly clear and breezy this evening. sunset at 7:33. these days are getting so short. it's 80 degrees -- it will be 80 degrees today in los gatos and san mateo. 70s for the north bay. oakland 73 degrees, san ramon reaching 76 degrees. mostly sunny skies today, more sunshine this weekend.

declared whether or not he's going to run and take on hillary clinton. it's vice president joe biden's second day in battleground florida focusing today on iran, amid speculation about whether he'll run for president. >> people who aren't willing to risk failing never succeed. >> the draft biden campaign is hiring staff in south carolina. analysts say he could be more of a threat to republicans than hillary clinton. >> he has a likability factor. he's able to connect with voters. this is something that hillary clinton lacks. >> clinton's numbers have dwindled with questions about her e-mails. a top aide is expected to plead the fifth on capitol hill today. insiders think biden's path to victory may force him to go on the attack. >> i don't know if joe biden has the stomach to launch a campaign based on attacking hillary clinton. >> reporter: on the republican side, carly fiorina is thrilled.

while clinton's numbers fade, fiorina's are steady improving. now, keep in mind, it's politics. politics is about money, because that's how you get the message out. right now, hillary clinton has raised more than the top three republicans combined when you take donald trump out of the picture, and that means she's in the best position to get her message out. but joe biden, who hasn't announced, hasn't raised anything yet. >> very interesting. a lot of people talking about it. the candidates certainly watching the economy. democrats pointing to years of growth. >> meantime, republicans are looking for any weakness that they can find, whether it is falling stock markets or now an important jobs report. >> yeah. that one comes 24 hours from now. an early preview we got looking at job placement from a private firm's data show this may not be a very good number on friday. friday's report will be important to the fed as well

which may raise interest rates this month. the fed looks at two major data points -- employment and inflation. a weak jobs report could cause the fed to ponder waiting on a like. fed governors also looking over the latest economic reports from various fed districts. report for historical reasons called the beige book. when it comes to the san francisco region which is actually way bigger than san francisco, the fed says hiring in tech is very hot. many tech companies having trouble finding employees. they're already working at other companies and because of that, they're seeing higher and higher wages. i didn't really need the fed to tell me that. one interesting note though is banks are also reporting they're having trouble finding employees. but due to heavy competition with other banks they can't charnel customers more money to compensate. we're all making more money apparently, at least in our paychecks, if not in our 401(k). let's check our 401(k). good morning.

rolling out there on this thursday morning and we will have a few clouds starting out the day. upper 50s in the north bay. san francisco now 61 degrees. expect a high of 68 degrees. our temperatures being kept down by some clouds along the bay. in the north bay it will be 79 degrees. in the south bay, 80 degrees. 76 degrees in the peninsula. the sea breeze keeps the coast cool. we're talking 60s along the immediate coast. inland areas will be in the 70s and 80s. the storm track stays well to the north of us. unfortunately, no chances of rain in that forecast for us. high pressure starting to build across the southwest and that will get stronger over the next couple of days. we do have some breezy conditions now but into the labor day weekend, that high pressure will be what affects our weather and changing our temperatures making them go up a few more degrees each day. so expect that. if you are heading out to the sausalito art festival this weekend, great weather. talking upper 70s for saturday, sunday and also into monday.

a lot of sunshine, too. great weather out there at the festival if you're making plans to go there. elsewhere across the bay, 80s on saturday for most of us. then some 90s starting to pop up in the south bay. tri-valley and the north bay. we'll see more widespread 90s as we head into labor day. i'll have another look at this forecast coming up. let's see how the roads are moving now with anthony. >> the unofficial close of summer with 90s? and the water parks close? all right. let's talk about san jose. this is 101 northbound where we usually see the slowing coming through south san jose but not that bad right now. switching over to the maps, once you actually get past where our camera is there is a hazard in the roadway, a tire actually. then another accident you get past that, 101. heading up the peninsula, not bad. now just now in san francisco seems as though there was an accident. computer model not picking it up but right at 101 and cesar chavez.

this college student avoided injury or even worse thanks to his iphone.

it stopped a bullet. a student walking home to his amount and a man approached him with a gun. the suspect grabbed the student's computer and fired one shot and that bullet shattered the iphone in the victim's pocket. the student wasn't hurt. but the shooter is still on the loose. >> what can't the iphone do? a 5:24 right now. call it potty patrol. the latrine team or potty sitters. san francisco installing more public restrooms and paying people to actually monitor them. the city spends $1 million a year to clean human waste off of the street. so it says bathrooms like these are absolutely necessary. so are the attendants who are paid $15 an hour to clean and watch out for suspicious activity. >> so they know what they can do and can't do when i'm around. i'm proud of my job. i'm good at what i do. >> the number of steam cleaner requests to come out and clean up human waste has gone down in the areas where these toilets are. >> getting san francisco cleaner. the city will continue to install bathrooms like these. so far there are eight. but five more are expected in

confronted cory powle about smoking on the platform on tuesday night. they say then he tried to get away. at one point powell reached for his waistband and officer said they used a stun gun on him. that's when powell shot himself in the stomach. ript now he is in critical condition. a bizarre new twist in an already-strange kidnapping case. the man charged in the vallejo kidnapping for ransom now claims a side effect from a vaccine is to blame for his behavior. he appeared in court yesterday on a dublin home invasion charge. according to an fbi report, he blamed the vaccine for his actions. but nothing's off the record when you are being interviewed in jail. >> i haven't seen it, i haven't heard it. i heard they filed something in federal court. we'll take a look at it. >> he is accused of slipping into this dublin home, striking the homeowner in the head and leaving before committing a robbery.

police say on his way out he dropped his cell phone which investigators used to track him down in tahoe. that's when police say they discovered evidence linking him to the kidnapping in vallejo. now to one of the bay area's most high-profile murder cases in years. it's been an excruciatingly long wait for one family. now after dozens of delays, the man accused of killing the morgan hill teenager, sierra lamar, is finally going to face the jury. >> damian, this is a fascinating legal process for lamar's parents. >> it's been a frustrating 3 1/2 years for the sierra lamar family and for those church volunteers who had been out there for most of that time but now finally they do have a date here at superior court in san jose. next spring is when garcia-torres is set to stand trial for the death of sierra lamar. he was a clerk at the local safeway and sierra's dna was found in his car. sierra's body though has still not been found. the prosecutors are still pushing forward with the death penalty against garcia-torres.

garcia-torres had to change lawyers at one point. he's now being represented by the alternate defender's office. sierra's father says he was pleasantly surprised by the news of the imminent start of the trial but torres' lawyer says he will continue his fight. >> i was glad. happy. yeah, a little bit relieved. and i was shocked, too. that's probably the most overwhelming emotion was shock because i had my expectations set pretty low. >> there's some serious problems with this case. that have been there since the beginning and might have a question about the appropriateness of the death penalty in this case. >> april 25th is when this trial is scheduled to start and there are indications the suspect's lawyers may make a change of venue request of the judge because of all the local publicity in this case. that may cause some more delays at some point here in this case.

sources tell me that the tips continue to come in even today in this case. new this morning, we may get a better idea today about what led to high-speed crash that killed an innocent man during a police chase back in april. 24-year-old anthony wynn of san pablo was a passenger in a car struck by a driver trying to evade richmond police. eventually they arrested that suspect who ran from the scene. rye now he faces criminal charges. both the driver and a second passenger in the car suffered major injuries. today the coroner's inquest is going to be held in martinez. there are no charges pending against police. 5:36. happening today, clerk verses is court. is she expecting religious freedom or being biased against same-sex couples? the kentucky county clerk who stopped issuing marriage licenses because of her own religious beliefs will be in court today. >> kris sanchez joins us in

davis says she is not disobeying the supreme court because she is still awaiting an appeal. she adds that she's also not discriminating, again because she's not issuing any marriage licenses at all. meanwhile, another county clerk, this one in casey county kentucky, is also refusing to sign marriage licenses. he's now on a 400-mile bike ride to show solidarity with kim davis who he says is just doing the job she was elected to do. so because she was elected to that job, there are jail times and fines on the table. but firing is not on the table. however, if she's found guilty of misconduct some time down the road, as this hearing progresses, the state legislature could eventually impeach her. follow-up now. a victory for renters in san jose. the city council approved a plan to strengthen the city's rent control laws. san jose's current law allows landlords to hike rent 8%. the council voted to explore reducing that percentage.

they're also looking into creating an ordinance that will prevent landlords from convicting renters without cause to bring in tenants to pay higher rents. a new concept to the high-tech twist to help people in need in the south bay. called feeding silicon valley. san jose and several non-profits are launching a mobile app today to improve food donations. grocery stores and restaurants are going to be able to access to app to donate their extra food. great idea. people can also use it to donate money. california is working harder than ever to make the grade whether it comes to nutritious lunches. today one east bay lawmaker will get a taste of how it is progressi progressing. a congressman will visit ignacio valley school in concord where unique produce options are now being offered daily. children across the mount diablo district are getting better options because of a new walk-in

refrigerator beefing up some food storage. in a san francisco elementary school they took down signs off the restrooms for first graders making them gender neutral. >> the. principal of the school says there are about eight first graders who don't fis gender norms. students range from tomboys, they say, to transgender. a city and state law requires students use restrooms consistent with their gender identity. they plan to make restrooms for older students gender neutral as well. mountain lions may be able to cross interstate 101 in l.a. a 200-foot long overpass would allow big cats and other wildlife to cross over from the santa monica mountains. those mountains are surrounded with dense urban areas making roaming very difficult for animals. >> interesting. 5:40. time to check our own forecast. >> it's been so nice.
