set up the server that housed clinton's private e-mail account is invoking his fifth amendment right, refusing to answer questions about the e-mails before a house committee. they subpoenas him last month. the i.t. specialist worked for clinton in her 2008 campaign and at the state department, setting up her e-mail in 2009. his lawyer saying he would not answer questions, asserting his constitutional right against self-incrimination. they say the clinton campaign encouraged him to testify and called his decision not to understandable but disappointing, adding, clinton has made every effort to answer questions and be as helpful as possible and encouraged her aides to do the same. two other aides will testify started today, and clinton herself will testify in a public hearing in october. the campaign also reiterated clinton has never sent or received anything marked classified.

clinton wick make stopped in puerto rico and new hampshire, and one aide said he's prepared to answer questions about all of this. >> all right, kristen welker at the white house for us. chuck todd is nbc's political director. moderator of "meet the press," too. good morning to you. >> good morning. >> there are lots of reasons an individual may assert their fifth amendment right. we don't know what this man's lawyer told him to do. as a political matter for hillary clinton to have a staffer who says i better not testify because i might incriminate myself, that doesn't look good. >> it doesn't. in the court of public opinion, when you plead the fifth as far as the political world is concerned, then you're already admitting to some potential wrong-doing. regardless of the legal part of this. and this is what makes this investigation so potentially damaging to hillary clinton, not just now, but also a reminder that let's take the clinton campaign at their word that they encouraged him to testify.

well, what's in the best interest of hillary clinton may not be in the best interest of mr. pag leono, which is of course, as you know, what a lawyer may have told him. when it comes to handling classified information, whoever you can easily see this lawyer telling him, hey, you set up the server. you did this. you may get tagged as inadvertently mishandling classified information. guess what. even inadvertently mishandling classified information could lead to legal problems down the road. >> let's imagine joe biden with his pros and consheet out. does this make him more likely to run? >> i don't know if any of this has been a part of his decision making process. but if it is, 100% this becomes a huge dash in the pro column because this is a reminder with this benghazi mitty on the hill, with subpoena power, you never know where these investigations go. the clinton campaign may think it has its arms around the

political problem, but when you cannot control different people in this situation who may decide, again, what's in the political interest of hillary clinton is not in my legal interest, then you know you have a problem down the road. if you're joe biden, you think, hey, this is out of her hands now. >> let's talk about the republicans, chuck. to donald trump, the meeting with reince priebus, the rnc chair today, and word potentially he could be asked to sign this pledge that states if you are not the nominee, you will support the eventual republican nominee and importantly, not run as an independent candidate. do you think that's likely? >> i think it's very likely donald trump has been hinting at this. he hinted at it to me in the interview i did with him. there's a filing deadline coming up fairly soon in south carolina that includes a pledge there about saying that you will support the eventual republican nominee regardless, so i think this feels, savannah, like a staged craft and event to let donald trump say, hey, i'm in it.

across the world this morning. it captured the human tragedy of all this and renews calls for action. bill neely is in greece on an island where the boy and his family were headed. bill, good morning. >> good morning, guys. good morning, everyone. i'm on a small greek island which has been overwhelmed by more than 20,000 migrants in the past week alone. this island can hardly cope. europe is clearly struggling, too, with so many countries being tested, including just to the north of here, hungary. the flashpoint today, a railroad station in hungary and a surge of refugees. for days, police have stopped them trying to leave the country, amid fury and frustration as they push to get to germany. now, it seems the hungarians have had enough and are letting them go. this woman walked here with her children. >> i have been day, walking. children, cold.

>> they have certainly suffered enough. a third of a million leaving their homes to reach europe this year. thousands drowning, and dozens dying in this truck of suffocation. they risked their lives in flimsy boats, these refugees rescued yesterday by a norwegian ship. other migrants try to reach england on top of trains. through a tunnel under the sea. their journey is long and dangerous. most leaving war-torn syria, iraq, and afghanistan. others aiming for a better life in europe through italy, greece, and hungary, to richer countries like germany, even sweden. europe, though, is struggling to cope. the refugees to find food and water. authorities are overwhelmed. even escaping greece to the next country, macedonia, isn't easy, but they are desperate. further north, hungary has put up razor wire fences to keep them out. their target, germany, though,

same-sex couples in kentucky. >> a county clerk in kentucky is due in federal court after refusing to issue marriage licenses to same-sex couples. gabe is outside the courthouse in kentucky. good morning. >> good morning. kim davis will go before a judge here today to explain why she should not be held in contempt for defying several court orders. on wednesday, she denied a marriage license to yet another same-sex couple during a tense confrontation. davis said her religious belief prevents her from issuing same-sex license to couples despite a ruling earlier this summer that made gay marriage legal nationwide. davis said to her this is a heaven or hell decision. now, two other county clerks is issue marriage licenses to same-sex couples. today, davis faces stiff fines and even jail time, although it's unlikely. the federal judge has ordered

her deputy clerks to court as well. that could suggest he's exploring other alternatives, perhaps having one of the clerks issue licenses on her behalf. although it's unclear what he will do. the clear question, is she unable to do her job or just unwilling? >> we'll be watching. gabe, thank you. two soldiers were injured wednesday when a blackhawk helicopter went down in colorado. it happened in a heavily wooded area south of denver. the helicopter from ft. carson was taking part in a routine training mission on u.s. forest service land. the injuries were not life-threatening. the cause of the accident now is under investigation. moscow's largest airport was evacuated today after a fire broke out, delaying at least 50 flights. passengers posted pictures on social media. the fire started in a storage facility that sent plumes of smoke into the terminal. normal operations resumed about two hours later. now back to that incredible but terrifying video we showed

you at the top of the show of an african bull elephant charging a safari truck in zimbabwe. the elephant pierces one of the tires. even kicks the truck off its wheels and then spins it. frightening moment were over in seconds, as you saw, but certainly, as we said earlier, not a memory that the tourists are likely to forget. surely they were pretty shaken up over the whole incident. it was a wildly entertaining day at the u.s. open on wednesday. but not because of the tennis. first, there was coco vandeweghe. never blame your tools, right? apparently, she did not get the memo. needless to say, she went on to lose the match in style, i guess. but a much different story for novak joke vich after he won his match in straight sets. he called a fan down to the court for a little tennis tango where maybe a jig. at arthur ash stadium. world's number one tennis player, the moves on the court and off the court as well.

with her ex-husband in monaco. kelly rutherford arrived at the monaco court this morning. >> thank you. >> in a bitter custody battle, she traveled here close to 80 times. during the latest trip, she hasn't been able to even see her children. kelly's son, 8-year-old hermes, and 6-year-old helena, live 4,000 miles and a world away from the actress. monaco is famous for casinos and billionaires, yachts and fast cars. they did spend summer in the u.s. rutherford kept them four days past their legal deadline. she had asked the new york judge to order their return to america. that appeal failed. leaving the gossip girl actress speechless. >> no words at this moment. no words. >> later, branding the decision the most cruel act against a child i have ever witnessed. her ex-husband, germanman left

america in 2012 after his work visa was revoked. a california court ruled the children should reside in the u.s. but agreed them to go to europe with their dad. three years later, kelly describes her continued separation from her young children as shocking, illegal, and abusive. on her instagram account this week, she posted everything will work out. things will get better. while thousands have been supporting her, one message saying, you are an inspiration. hang in there. this custody battle has been played out over years, yet still they are locked inside that courtroom. they haven't come out yet. they may not get an answer today. the judge may ask for different views from the different parties. >> keep your eye on the courthouse for us. as we turn to lisa green, a legal analyst and author of "on your case" a book of legal advice for women. can't imagine she got the legal advice to not return the

children when she was supposed to. and that seems to me to be kind of that fatal strategic error for her. she didn't return the kids when she was supposed to and now she's in a lot of trouble. >> let's assume she did it with a big heart, because it is excruciating to return a child across the seas to an ex you don't even like. as far as judges are concerned, that's a really difficult error and it puts her now in a position of someone who is considered a potential kidnapper, very serious. it means this monaco court is going to want to see some evidence she can follow the rules. >> what would you tell her? say you're her attorney in the courtroom. what does she need to do? >> she needs to start the kelly rutherford judicial apology. she said i was inciting, i shouldn't have done what i did and i will never do it again. even if she does, her ex-husband can rightfully say i am not sure this will not happen again. i'm not sure if these children should be allowed to go to america in the future. >> what's the strongest argument

she has, for seeing her kids and potentially down the road getting to see them in this country? >> here's a viewer advisory. legal analysis doesn't always match what we think is common sense. why are the kids in monaco, right? german dad, american mom. they're there because that's where they were sent in 2012 and courts want a fixed place for children. what kelly needs to tell the judge in monaco is, this really makes no sense. they belong in america with me. i will obey the law and they have more ties in america. >> however this chshakes out, kelly rutherford will likely pay a price for what led up to the heari hearing. what could change? >> we'll see a court that's likely to restrict the way she can see her children. it's really sad. but because of what you talked about, savannah, her decision to keep them in new york, you're going to have a judge who is looking really carefully at her behavior and isn't persuaded immediately that she can follow the rules. they're going to want to make sure she doesn't pull that stunt again.

some kids and some parents call it unwarranted snooping. when kids post on social media, it's there for anyone to see. now, a new computer program is combing the internet for their social media accounts in orange county. some complaints of administrators peeking at their postings is a violation. >> i don't like it. >> reporter: because? >> it's a private thing for me to use only. ♪ >> reporter: but in orlando, where kids return to school less than two weeks ago, administrators say it's a sign of the times. in maryland, three years ago, a student opened fire at school. the teenage gunman had posted threats on facebook before the rampage. and in washington state last year, a student gunned down four classmates after posting violent threats on twitter. orlando believes the computer program from a company called snaptrends could well save lives. >> it monitors key words that could present threats for example, gun, attack, or kill. words of that nature. >> reporter: the school district

says in a statement, because social media can be a source of bullying, school threats or mass cries for help, we believe it is appropriate to monitor public sites where you can view comments. some parents say they welcome the monitoring when the kids are in the classroom. what bothers them is school administrators are also watching the kids when they're off campus. >> their role isn't the parents. they need to stick to educating our children and let the parents parent. >> by them monitoring your social media, it's kind of like they're inviting themselves to sit at your kitchen table on sunday dinner. it's not okay. >> reporter: orlando is not alone. schools in glendale, california, also monitor. educators across the country say there's but one goal -- prevent violence. >> the bottom line here from the perspective of the school administrator is that it's better to be safe than sorry. >> reporter: will it work? at the end of the day, it is a computer. it's going to flag messages that look like cyber bullying like

could look like. >> it's damage to the tiniest blood vessels where as a heart attack is damage to the big blood vessels. >> the condition known as a broken heart syndrome is caused by extreme physical or emotional distress. it's often blamed when couples die within days or hours of one another. the overabundance of stress triggers the brain to trigger -- signal the adrenal glands causing them to surge hormones to the blood stream. it rushes through the heart paralyzing part of it causing it to balloon out and shut down. >> what people experience is that central crushing chest pain you get when you have a classic heart attack. the difference when you go to the hospital the doctors will find in a classic heart attack blockages to the coronary arteries to the outside is big. with this you don't find that. >> according to a new study 90 percent of those who experience broken heart syndrome are women.

79% are over the age of 50. researchers say men are more likely to die from an episode than women. the good news, unlike a broken heart, broken heart syndrome is usually treatable with medicine. most people make a full recovery within weeks and low risk for it happening again. so guys, the treatment for broken heart syndrome doesn't include a healthy regimen of ice cream and chocolate. doctors prescribe medicine to help relieve fluid build up, treat blood pressure problems, and manage anxiety until blood pressure returns to normal. typically a few days to a week. i've known a couple of people who have had similar experiences where they lost a loved one and had had physical changes in the body. >> it makes sense. dr. natalie azar is a medical contributor. the study compared patients with broken heart syndrome to people who had acute coronary syndrome.

what is the difference? >> the other name for the broken heart syndrome is called stress induced cardiomyopathy. the stress is the important clue. when we talk about stress in medicine we talk about physical or emotional stress. the brain senses that and stimulates a gland in the body called adrenal gland to produce adrenaline. you've heard of fight or flight. the adrenaline can rush to the heart and the muscle and weakening it. as opposed to an acute coronary syndrome which is caused by a blocked coronary artery. >> you're talking about two physical ailments. one is triggered by emotional things and the other is triggered by physical problems. >> right. usually a structure problem with a blocked artery or something. the interesting thing that came out of this. we've known for a long time that emotional triggers can cause this broken heart syndrome, but what these researchers found is that physical triggers were more common than emotional triggers. physical could be, you know, acute respiratory failure or surgery or grief and panic.

9:26 on your thursday morning. i'm sam brock. that breaking news, two children reportedly suffered life threatening injuries after being struck by a car in contra costa county. it happened in pacheco at second avenue near contra costa boulevard. this is some helicopter video from earlier this morning. a fire marshal says that car hit three people in total. the victims are believed to be a mother and her two children. now, according to the san francisco chronicle the fire marshal says both children suffered head injuries. he also says both children seem to be around 1-year-old and at least one of them was in a stroller. the helicopter had to air lift each one from the scene. there's no update yet on the mother's condition. we don't know also if the driver did or did not stay on scene. more breaking news now,

we've learned three workers at the santa clara county jail have been arrested, this in the wake of an inmate death last week in custody. sources tell an investigative unit say he suffered lacerations to his liver and spleen. so far on the record the sheriff's office has only said guards found him unresponsive in his cell. according to jail records three correctional deputies are now in custody. we'll have more on both of those stories. and after this break a look at weather and traffic.

heavy track coming through oakland along 880. there was slowing stop and go earlier but it's improving as we switch to the maps you can see we have a few accidents headed down 880 southbound approaching the san mateo bridge. as we switch gears and show you what's happening in the south bay though there you can see more accidents on the 101 northbound headed from santa clara all the way up towards palo alto. actually step outside and show you that there's san jose 101 stop and go all the way up towards palo alto. and that's what it looks like on southbound lanes starting to congest there as well. just imagine when we get closer to labor day. more traffic coming i think. thank you very much, anthony. appreciate that. we'll be back in 25 minutes with another update.

taking look at the headlines. a court report from the cdc offering a new look at children with adhd. the average age for a child being diagnosed with adhd is seven but about a third of the children are younger than six when diagnosed. usually it's a family member who notices behavioral or attention issues. in about one-third of the case it's the child's teacher who first notices a problem. more than 6 million school-aged children have been diagnosed with adhd in the united states. a new report finds that broken heart syndrome is very real and sometimes a deadly medical condition. according to a study in the "new england journal of medicine." the effects are similar to those
