what is being done this weekend to try and reverse that trend. and two college campuses on edge after two women were attacked inside bathrooms. tonight police are looking for someone new in order to catch the culprit. then, traffic trouble this labor day weekend. the shutdowns happening right now across the bay and you're best options to get around. thanks for joining us for this special edition of nbc bay area news. i'm vicki nguyen in for vicki and terry. s chp is calling this one of the deadiest years on bay area roads in a while. the chp has seen 120 crash deaths. tonight the spotlight is on drunk drivers in an effort to catch them before they hurt someone. there are check points across the bay. including one right off of highway 85 in saratoga. that is where we join nbc bay area's mariage favro live. what can drivers expect tonight? >> reporter: right now you can she sheriff's deputies are

saiding up -- setting up this dui check point to open up in a few minutes here on saratoga off of highway 85 in saratoga. and they are out here during a maximum enforcement puch during the holiday weekend. the sheriff's deputies hope the dui check point will not keep drunk drivers off the road but discourage holiday drivers from getting behind the wheel at all after drinking. >> the chp said during the labor day holiday last year, 27 people were killed in traffic accidents in california. including three in the bay area. nearly half of those killed were not wearing their seat belts. the chp said so far 2015 has been one of the deadliest years on the road in recent years. with chp officers alone responding to 120 fatal collisions across the state. that is up 20% compared to last year. >> reporter: deputies recommend

that you plan ahead by calling uber or a cab or asking to have a sober driver come along with you and drive you home. now they are also asking if you are out on the road and see a suspected drunk driver, be sure and call 911. this maximum enforcement push is going to continue ol an monday night at midnight. reporting live in saratoga, marianne favro, nbc bay area news. >> thank you. happening now. a major bart shut down all weekend long. the transbay connecting san francisco and oakland is closed for repairs again. that means no trains across the bay. the quickest way across now is the bay bridge. you are looking at it live. christie smith joins us live at the temporary transbay terminal in san francisco. that is where bart is offering to take riders by bus across the bay. how is it going out there? >> reporter: well we ran into a few delays today. but despite the closure and the construction, there is a big concert going on here in the city but people seem to be

moving. we're at the temporary transbay terminal. that is where people are coming and going and no big lines at all. a lot of folks told us they left hours early. >> we're going to bring up the other bus. >> near the 19th street bart station in oakland, riders went from bart to bus and into san francisco. >> you just had to follow directions and you got it right. it was easy. >> reporter: even with sefrm transit agents helping out, there is still confusion. >> there are no pickup or dropoff. i've been waiting there for a while. >> the close of the transbay two, the link between the east bay and san francisco allows work on wornout tracks. riders got the message. 40% less chose bart. >> ridership is low over labor day weekend so it is ripping off the band aid. it wouldn't be fun no matter which weekend we chose. >> the suggestion is to stay close to home or find another way. >> i was looking at bart,

mainly, because i wasn't even thinking. >> reporter: the ferry expanded service. but the ride to at&t park for the billy joel concert sold out. this pair got tickets early. >> i'm very familiar with taking bart. it is very convenient. but this is another way and it looks beautiful. and i've seen the ferry at at&t. >> our ride across the bay bridge this evening wasn't gridlocked but near the park it was packed. there is construction by fourth and king. still jenny span made it across the bay with ease to the concert. >> i decided to go with lyft and it works, it works great. >> did you get here early. >> i was. i was in the bay area area because i knew there was traffic, but there actually wasn't. >> there are a number of transit workers out here offering directions to those who need it. but we are not seeing big lines at all. the transbay tube will reopen on tuesday morning just in time for the commute.

have surrounded an apartment building in morgan hill and evacuated 20 people. they believe a robbery suspect might be hiding in the complex on berry court and cherry. they could be the two two robbed a game stop around 11:30 this morning. they provided police with the getaway car. it was spotted at the apartment building. the driver got out and ran. officers believe he is in the complex. the whereabouts of the second suspect are still unknown. if you are heading to the beach this weekend, be careful. there is a warning out about high surf and strong rip currents for beaches that are south and south western facing in california. yesterday afternoon the wind was so strong it blew a kite surfer into traffic. he was hit by a car and had to go to the hospital. wind gusts were up to 50 miles per hour at the time. the winds today, strong as well. there is a look at the waves from just a few hours ago at ocean beach.

you can see surfers taking advantage of those biller than normal waves. meteorologist rob joins us now. where are the giant waves coming from. >> we're seeing storms to the south and west and the long period swell reaching the coast. and you can see the waves along ocean beach with sunshine right now. now our wind speeds not as strong as yesterday but still 20-30 miles per hour off the coast and wave heights 7-10 feet. so again from now through monday evening on the south and southwest facing beaches and rip currents and larger set coming in breaking closer to shore. again use caution toward the coast. and notice the temperature is still 71 near livermore. tomorrow another chilly start but that is the exception to the rule. morning temperatures that feel like fall but set to soar well into the 90s over the next seven days. we'll look at the rest of the labor day weekend forecast in a few minutes. >> looking forward to it, rob.

>> the hunt continues for the suspect involved in a disturbing burglary case in fremont. surveillance captured the break-in last friday showing shattered glad from the sliding door. and burglary victims spread food on the glass for the dog to eat. they are still trying to track down the people responsible for the cruel act. the dog is expected to be okay. changes at whole foods after a security guard beat a shopper unconscious in oakland on thursday. the security guard and security company are now permanently off the job. an eyewitness posted these pictures on facebook after the incident. a spokesperson for the grocery chain said the customer made physical contact with an employee before the guard intervened. .customer is hospitalized in stable condition. police and whole foods are investigating. a company rep issued a new statement today saying, quote, we do have a zero tolerance policy for violence.

security vehicle. the bomb squat came in and set up a perimeter but the threat was unfounded. evacuations have since been lifted. scary moments unfolded off the coast of southern california this afternoon. a kayaker was attacked by a hammerhead shark near malibu. ventura county firefighters said he was fishing with a friend and dangling his feet in the water and the shark swam up and took a bite out of his foot. he flagged down a nearby fishing boat where he was able to control the bleeding. he was airlifted to the hospital. witnesses say the shark circled the man's kayak before it bit him. the drought is effecting california in many ways. farmers are being asked to conserve and lawns are turning brown and tonight there is new evidence it is hurting the majestic and giant sequoia trees. the trees which can live to be 3000 years old are dying at higher rates than after.

gauty swords went climbing with a team of scientists to make the trek to monitor the trees. >> reporter: towering above the national forest, living icons that have survived storms and insect infestation, attracting thousands to stand next to their massive trunks. but in this historic drought, something is happening to the mighty tree. >> this areaazowd fied as having the highest number of trees showing symptoms of drought stress. >> as some of the treats have -- trees have lost 75% of the needles. that is what you are seeing on the forest flor. but to see the true stress of the trees, we have to go up. >> these team of scientists inching their way to the top. >> these are some of the most interesting organisms on the planet. they areain then beautiful beings. >> we were given rare access to join the climb. these are the largest tree on

earth and some of them can suck up to 700 gallon water a day and all of that has to make it into the trunk and up to the top of the tree. 20 stories high, ambrose peeks his head through the crown and collects vital data. >> the measures that we're getting of the amount of tension in the water and the foliage indicates there is more stress than we've measured before. and one of the most remarkable things about the view from the tree top is the overview of the forest and unfortunately a lot of the trees we see out there are dying because of the drought. >> reporter: back on the ground, researcher nate stevenson walks us through an area nearby where other trees smaller are dying at an alarming rate. >> one in every four trees has died here. >> it is still too soon to tell what the data will mean for the national forest but many scientists are comforted knowing that although the trees are showing troubling signs -- >> they are the monarch of the plant kingdom. >> they have lived for thousands

your meteorologist is here with your micro climate forecast. and does it look like good weather for a bacon festival tomorrow. >> things are warming up but the truly sizzling temperatures coming up next week. as you can see in the seven-day forecast. in the meantime, cool start to the morning. clear skies during the day and high clouds passing by. beautiful view there. and temperatures still in the 70s. around concord and livermore. and the temperatures across the bay running a few degrees warmer at this hour. even though the numbers drop off into the 50s overnight, we'll see temperatures tomorrow in the 80 toss low 90s. notice the humidity level coming back but still 28% humidity out there in concord. after 9:00 at night. again the winds out of the north. that is a dry breeze for us right now. and winds at time slightly off shore tomorrow and will likely keep the skies mostly clear, even out to the coast. and set the stage for a warm-up that is more or less going to stick around for up to seven days or longer. in the meantime, mostly clear

skies. high clouds passing by the day tomorrow and tomorrow day one of a warm-up that will follow up most of next week. so kind of interesting spread of temperatures. low 50s in the valleys for the morning. napa airport this morning was 44 degrees. tomorrow should see upper 40s and low 50s in the north bay. and then as early as lunchtime, look at the rebound for napa. in the 80s by noon. and mid-80s around livermore and teams around san francisco and oakland in the mid-70s by lunchtime and eventually upper 80s and low 90s around san jose. so a warmer sunday. san francisco, upper 70s to low 80s as well. palo alto in the mid-80sch and nor the north bay, temperatures in the 80s to near 90 degrees toward santa rosa. the same trend around the tri-valley for tomorrow as the numbers climb into the low 90s. if you are heading for the coast, watch out for the rip currents and beacher waves and hazard continuing through monday but pleasant temperatures around half moon bay and santa cruz. 70s and 80s as you wrap-up labor

day weekend. so the mornings are feeling like fall. but here is where we're heading over the next seven days. we have the cool trough pattern across the west coast with the jet stream driving across the west. and watch the trend from saturday through the end of next week. high pressure builds across the entire west coast and that is the reason why the long range forecast looks like this for san jose. you can see dound climbing into the low to mid-90s, from tuesday into friday, and look at livermore, the average time is 86 degrees, climbing into the mid-90s toward the middle part of the week and staying there through friday. and in san francisco, the average high is 70. should see upper 70s to 80 for the better part of next week. and a sneak preview for next weekend. the heat could stick around. that is referred to as the last unofficial weekend of summer but summer lyme temperatures will continue very likely into next weekend as the warm-up gets

upgrades and repairs. this week, gov some of the reads you -- roads you drive every day need updates and repairs. this week governor jerry brown unveiled his plan to pay for the fixes but it means you may pay more to drive your car. what you pay to rowe reknew your car would go up. $65. and the gas tax could go up 6 cents a gallon to start or even more batsed on inflation. a gallon of diesel will go up 11 cents and these fees and extra

could add up to $3.6 billion to make upgrades on highways and local streets. it is a start but a far cry from the $59 billion needed in repairs across the state. and the plan is not a done deal. because it is a tax, two-thirds of the state lawmakers have to say okay and the governor might not have that kind of support. some welcome relief for the tens of millions of americans hitting the roads this holiday weekend. gas prices are at the lowest in more than a decade. and it is adding up. americans will save more than a billion dollars by the time your barbecue is over on monday evening. nbc's carey sanders hit the road and had the report tonight. >> if you were in traffic this labor day weekend, then you already know, gas prices have not been this low since 2004. >> it makes it a whole lot better for everybody when the gas price is cheap. >> the national average is now $2.41 per gallon with the lowest prices in south carolina. averaging $1.99.

aaa estimates more than 35 million motorist driving this weekend will save more than $1 billion when compared to last year when on average gas cost $1 more gallon. why the price drop? thank china's slowing economy. >> it is old-fashioned supply and demand. there is ample oil supply. >> to give context on how cheap a gallon of gas is today, in the early 1970s, before the oil crisis, some stations sold a gallon for 33 cents. today in some parts of the country, it could be had for $1.85. if you adjust for inflation, some motorists are paying less today than they did back then. >> prices so low we found four friends on u.s. 27 in the florida everglades. they made a 16 hour spur of the moment drive from tennessee, just to pose with an alligator at holiday park.

the bart transbay tube will be closed again for repairs. but the second time in five weeks folks in the bay area will have to figure out how to get around with the tube. it has been closed since yesterday morning and will remain closed until tuesday around 4:00 a.m. this is all happening so that crews can replace a wornout section of the tracks. as an alternative, people with use a bus bridge from the east bay to san francisco. officials say to expect trax, with a lot going on, like the billy joel concert at at&t park. that is a live look right there from our camera at the park. luckily though, bart had a plan in place. >> we'll have extra trains in place to get people from the concert, we're providing extra buses to help bart with the transport over the bridge and we're having bus shuttles in place for the shutdown at night. >> you can also take muni but keep in mind the line at fourth and king will be down. they are upgrading the traffic signals there. we have extensive coverage

this weekend's closure, we posted tips on how to get around on nbc bay area.com or download our free nbc bay area app. crews were busy battling flames in sunnyvale. new video captures how intense the smoke was near highway 237. at one point the smoke forces firefighters to shut down the highway for a short time. the smoke floated over to park america. it charred about 10 acres engineer the sunnyvale baylands park area. crews knocked down the flames in about an hour. >> we have about 20 firefighters out here and right now they are lopping up to make sure that when heavier winds come up this afternoon it doesn't rekindle. >> the cause of the fire is still under investigation. firefighters also battle the fire in downtown san jose this morning. this is what is left behind tonight. heavy flames burned there the

vacant two-story house just after 3:00 this morning, it happened near san jose state university. a firefighter had to be taken to the hospital for minor injuries. now to a developing story overseas where thousands of refugees continue their harrowing journey across europe. 10,000 migrants from syria, iraq and afghanistan fleeing unrest in their countries. now they are in munich, germany, days after leaving hungary. germany welcomed them and waived asylum rules. germany has pledged to take 35,000 refugees by 2016. austria is also offering aid. >> they have offered to take the illegal migrants and take care of them. from this we are fulfilling and keeling law and order. >> 4 million people have fled syria since the crisis began in 2011. a kentucky county clerk is

in jail tonight after a judge found her in context of court for refusing to issue marriage licenses to same-sex couples. kim davis said doing so will violate her religious beliefs. once she is out of jail she has no plans to issue marriage licenses. her supporters compare her to civil rights figures, including martin luther king. >> she's not going to offered to. she can't sacrifice his conscious so she's willing as martin luther king wrote from the birmingham jail to pay the consequences of that decision and that is why she's here. although she shouldn't be. >> the county has resumed issuing marriage licenses to everyone. beta soft systems is a $20 million staffing firm based in the east bay. the company has advertised they've trained and places people at google, wells fargo and e-bay. but they began to dig into the promises after job seekers complained.

the company trained him and marketed this resume. >> i would say only about 10% of it is true. >> and how is that? >> i wouldn't know. i've never been there before. >> but after several failed interviews, he decided to speak out to warn other job seekers about the risks. >> making career suicide here. >> we found multiple online reviews about beta soft, the company received five star ratings and positive comments. in march a person wrote they were able to find a job utilizing all of their job skills. >> they have exceptional marketing staff and provide great support. but others gave them a one or two-star rating and we found complaints about beta soft's fake resumes going back to 2011. >> it is alarming for a lot of reasons. >> lor yu wilson represents the better business bureau. records show they received four complaints in the last three years, half about fake resumes.

>> if you get your dream job and you've done something wrong to get it, that could pose a problem for you in the future. >> and it is not just beta soft. we find online reviews of other i.t. staffing companies complaining about rock bottom pay and fake documents an fake work experience. >> i think what we're seeing at this particular point in time is the hyper environment of the valley. >> kirk is the director of the center for applies ethics at santa clara university. he worked for four decades as a business edgist. >> if she get a higher paying job, the companies make money. >> certainly. this is all about the fees that a placement company gets. there is a shortage of people with certain kinds of training. and there is a greater temptation today than maybe there was five years ago, to misrepresent the capability of the employees that you are placing. >> beta soft ceo received glowing profiles in newspaper and magazine articles.

in 2013, she was named a woman of influence. but no one from the company would speak with us about allegations it was providing fake resumes. >> as for ramen, she finally received a refund of her $1,000 deputy -- deposit after she remailed the company to tell them she filed a complaint with the district attorney. lewis never got his money back. both are still looking for jobs in i.t. >> and it is not honest. and it is unethical. >> there is just more time and money lost. at this point, i'm back where i started. >> the d.a. confirmed it received the complaint but can't common further. we have also learned the oregon department of justice is investigating the firm for alleged unlawful business practices in connection with the recruiting services. beta soft attorney said she expected to be able to successfully answer all questions in that investigation. if you have a tip for our

and distributed by a california company are making people sick. nbc's hally jackson has the latest. >> reporter: the bacteria more commonly associated with raw meat or eggs now linked to cucumbers. in a salmonella outbreak that spread to 27 states, affecting 285 people. one person was died and 53 other hospitalized. more than half of the illnesses reported in children who are especially vulnerable. symptoms clue diarrhea, vomiting and fever. the cdc traced it back to the suspected source, a farm in mexico. the produce, distributing by a san diego based company which is voluntarily recalling what are called slicer cucumbers. they have a thicker skin and more seeds than the common english cucumber. in arizona where 60 cases have been reported, health officials recommend asking your grocery store where they buy the

water. and now resonating with many visitors. >> this is gorgeous to spend time here. but when something is that, that that is out there, a family needs to be concerned. >> the river is still open. but officials say if you do go there, stay away from the algae and keep your pets out of the water. despite the best effort, crews are unable to free a blue whale in a fishing net off the southern california coast. teams went out to untangle the whale. a whale watcher spotted it five miles from san pedro. the whale is about 80 feet long and the size of two buses. the rescue mission had to be called off night because dangerous conditions in the water. attempts to find the animal today were unsuccessful. rescues fear unless they free it, the massive mammal could eventually die. a famous american astronaut is taking over the international space station.

nasa's scott kelly is now the nine crew members watched as he took the reins this afternoon. he is replacing an astronaut from russia. he will stud yu the effects of long space travel for the possible trip to mars. our meteorologist is here now with a look at the micro climate forecast. things look like they are warming up. >> one of the side effects of the warm-up and the change in wind direction is the lack of any low clouds. now 62 across the san francisco bridge. belevedere. tiburon in the distance. 59 degrees. oakland 67. and around the tri-valley, still close to 71 in dublin. and in san jose, a few high clouds and 67 degrees and the wind at times has been out of the north and that pattern will hold up during the day tomorrow. and as the winds turn off shore, the temperatures tend so soar up. and in this case looking at 80s

inland and low 90s nor tomorrow and trending even warmer through the next few days. so here is the future-cast. and notice the absence of clouds there on the coast as the winds will be somewhat off shore. this is a source of drier air that warms up as it heads toward the ocean. and for the valleys tomorrow, temperatures climbing to 80s and 90s and trending warmer as we get towards tuesday and wednesday. so keep in mind, if you are heading out to the beaches, the temperatures look great. but watch out with the beach hazard statement through monday evening for high surf at times, rip currents increased by the waves that are off shore, about 10 foot swells coming in, so sneaker waves ab rip currents are an issue even as the weather is nice. look at santa cruz tomorrow. mid-80s and supper 70s closer to monterey for tomorrow into labor day monday. ing temperatures, do feel like fall. numbers into the 50s for most spots in the morning. but look at how quickly it turns around by noon tomorrow. a lot of 80s in the tri-valley

and san francisco oakland beginning to climb into the 70th and finishing into the upper 70s and low 80s. so downtown san jose should see numbers five to eight degrees warmer around the area and 80s and 90s. san francisco, 70s and 80s. north bay, 80 and zeroing in on 90 degrees and the same trend toward the tri-valley and from more augusto so snout creek. so despite the fact the mornings are cool right now, the heat will be turning orn around california and most of the west coast coast. this is the pattern across the last couple of days. a trough of low pressure lifting off to the east and in its place high pressure now building in very strongly. by the time we get toward wednesday, thursday and friday, and just in time for that, will be the temperatures over the next few days, warming up considerably. so we had a high today in the lower 80s around san jose. and you can see for downtown, soaring into the 90s into the middle part of the week. same stories for the inland

incredible journey. college football is finally upon us. cal hoping to turn the tide. the bears haven't been to a bowl game let alone had a winning season since 2011. sand on the other side of the bay, stanford has had success the self past years. but for the first time they stumble in the season opener. stanford opening at northwestern. in the second quarter, game tied at 3-3. stanford defense gets burned. a quarterback keeper, taking it 42 yards to the house. northwestern up 10-3 at the half. now late in the fourth quarter, a comeback but the pass is picked off in the end zone. and stanford is upsetting the opener, 16-6. they have a lot of work to do. >> we didn't execute. we have to look at what we're
