concert last night. fans packed the stadium for the sold out show. they had to find an alternate route to get there. it is the second shut down for the transbay tube connecting san francisco and oakland. no trains are crossing the bay. quickest way across is to take the bay bridge. here's a look at the bay bridge this morning, nice and mellow this sunday morning. this is the second time in five weeks folks in the bay area had to figure out how to get around without the tube. options include muni, b.a.r.t., bus, or the ferry to name a few. >> i am very familiar with b.a.r.t. it is very convenient. but this is another way and it looks beautiful. >> the tube has been closed since friday morning, and is expected to reopen tuesday. some folks are opting to drive themselves, you may notice increased traffic on the roads, too. keep track of all of the traffic all weekend with our nbc bay area app and on digital platforms, including facebook

and twitter. chp called this one of the deadliest years on bay area roadways. that's why officers are increasing efforts to catch drunk drivers and prevent serious accidents this busy holiday weekend. more deputies are on patrol, they set up check points around the bay area. they say highway 85 in saratoga is a spot they're catching a lot of dui drivers and have seen a number of accidents there as well. deputies have been asking drivers to show their licenses and prove they're capable of being behind the wheel. >> have something to drink tonight, we pull them out of the vehicle, bring them down here, bring them through sobriety tests. >> deputies say 120 people died on crashes in california highways this year, more than last year. last labor day weekend 30 people throughout the state were killed in car crashes, three in the bay area. dui check points continue. we won't tell you exactly where.

to a developing story in morgan hill, people are out of their apartments because a suspected armed robber may be inside. the standoff on berry court and crest avenue. they ended up there after chasing a suspect they believe robbed a game stop store yesterday. it was an armed robbery. his alleged accomplice is on the run. officers are still searching for a suspect that shot a man at an east bay b.a.r.t. station. oakland police say the victim was shot several times in the parking lot of the rockbridge station. it happened yesterday evening. they detained one of the suspects, another is still on the run. the victim is expected to survive. and new details on the sexual assault in a bay area college campus. police are trying to track down a possible witness. napa valley college student says she was sexual assaulted in the campus bathroom last week. we are learning the victim told police another woman may have seen the attacker. she was reportedly in the

bathroom right before the assault. police are investigating another attack inside a bathroom. this one at santa rosa junior college. anyone with information is urged to contact police. in kentucky, another day behind bars for the county clerk who was jailed for refusing to issue marriage licenses to same sex couples. while supporters praised her outside the detention center, her lawyer promises the fight isn't over yet. >> reporter: outside the carter county detention center. >> kim davis has given all believers a lesson in faithfulness. >> reporter: 200 people gathered in support of the kentucky county clerk jailed since thursday, charged with contempt of court. >> we want to make a stand and show they can't get no religious freedoms from us. >> we are not here to instigate or, you know, we are here for

sight. in the bay area, the hunt continues for the suspect involved in a disturbing burglary case in fremont. surveillance cameras captured the break-in friday, showing shattered glass from a sliding door where burglars threw food out for the family dog to eat. police tweeted that they're trying to track down the people responsible for this act. the dog is expected to be okay. changes at whole foods after a security guard allegedly beat a shopper unconscious in oakland thursday. the security guard and company are permanently off the job. an eyewitness posted photos on facebook after the incident. a spokeswoman for the chain says a customer made physical contact with an employee before the guard intervened. the customer is hospitalized in stable condition. oakland police and whole foods are each investigating. a company representative issued a statement saying, quote, we do have a zero tolerance policy for

==kris/vo== south ba it is just about ten minutes after 7:00. a beautiful look at the sunrise in san jose this morning. you can see the trees there and it is a lovely start. south bay crews were battling flames yesterday afternoon. you can see in the video how intense the smoke was near highway 237.

at one point, smoke forced firefighters to shut down the highway for a short time. the smoke also floated over to park goers at great america. it charred about ten acres near sunnyvale park land area. they knocked down the flames in about an hour. the cause of the fire still under investigation. the state's historic drought impacting everyone from farmers cutting back on watering to homeowners who are letting lawns turn brown. there's evidence that it is hurting the majestic giant sequoia. that crunching sound is evidence of the drought in sequoia national forest. some of the trees lost 75% of needles because of drought stress. a team from berkeley is climbing the massive trees to survey damage. >> measurements are the amount of tension in the water and foliage, indicates more stress than we've ever measured before. >> water is vital to them. they are the largest trees on

earth. some suck up to 700 gallons of water a day. but there's hope. although they may be showing trouble signs, they have lived for thousands of years after survived droughts before. scary moments unfolded off the coast of southern california this weekend. a kayaker was attacked by a hammerhead shark near malibu. venture a county firefighters say two kayakers were fishing two miles from shore yesterday afternoon when they noticed an 8 to 10 foot hammerhead circling them. that's when they say the shark swam off but then attacked one of them. >> we saw this fin, then it dove. we didn't see it for like five minutes. all of a sudden he had his foot over the side, he got bit, put his foot on the kayak, he was like dude, i just got bit. >> the wounded kayaker flagged down a nearby fishing boat where he was able to control the bleeding. he was eventually airlifted to the hospital.

==kris/cu== a blue whale is still caught in a and we are looking live at the bay bridge this morning where if you are driving, you may notice increased traffic because the transbay tube is closed down, that has a lot of folks hitting the roadways. a blue whale caught in a fishing net, despite several attempts to free it. the new problem this morning, rescuers can't find it. teams went out yesterday to untangle the whale, and whale watcher spotted that creature five miles from san pedro, the

whale is 80 feet long, the size of two buses, the rescue mission was called off friday because of dangerous conditions in the water. then the whale disappeared overnight. attempts to find the animal yesterday were unsuccessful. rescuers fear unless they can free it, that massive mammal could eventually die. a famous american astronaut is taking over the international space station. nasa's scott kelly is now the space station's new commander. nine international crew members watched as kelly cook the reigns yesterday afternoon. he is replacing an astronaut from russia. kelly will study the effects of long space travel for his possible trip to mars. a silicon valley startup has an out of this world deal to help nasa control satellites. we have a first look at what this means. >> reporter: remember the hover board? a silicon valley startup showed how magnetic fields can elevate

bay, peninsula. but the tri-valley will see a hot day. talking the return of 90s for folks there. maybe head to the sausalito art festival. day two of that today. it will be cooler than the tri-valley. temperatures are still warm. especially for sausalito. talking upper 70s to close to 80 degrees in some places. today, 73 degrees, cooler, 71 for tomorrow. as the sun goes down, it will feel more comfortable but hot. even in san jose, the third annual bacon festival happens today. got your interest, right? saw you look over. looking at temperatures in the mid-80s by 3:00. may be able to make some bacon on the sidewalk. probably don't want to do that. little dirty. talk about the beach. rip currents in place today. if heading out there, keep in mind it will be a little dangerous. of course this is the time of year folks like to head to the

beach with temperatures like this. 74 degrees for pacifica. make sure you take it easy. 80 for half moon bay. warmer towards santa cruz. up to 83 degrees. winds aren't as breezy, only 10 to 15 miles per hour. starting the morning clear with high, thin clouds. winds shifted around an area of high pressure across the pacific. this will get close to us each and every day. that means inland temperatures are warming into the 100 degree range over the next couple days. most likely, tri-valley will see that. even san jose will see a hot start to labor day. we talk about 90 degrees tomorrow. same for the east bay valleys. as we look at the upcoming week, talking mid to upper 90s by wednesday and thursday. even san jose will stay warm with temperatures near 90 degrees. at the coastline, san francisco, you'll see warm temperatures, just not uncomfortable. temperatures in the mid to upper

is to honor them all. today in the bay garvin thomas has this morning's bay area proud. >> toward the end of the second world war, franklin roosevelt signed the gi bill into law. at the time the president said he expected those benefits would be extended to merchant mariners. they weren't. many of us don't remember that because we weren't alive 70 years ago. the subject of tonight's bay area proud was and does. >> this is a tanker. >> reporter: the common way a life is measured is number of years spent on earth. >> there's another one on the tanker. >> reporter: a better way might be just how many great stories came out of those years. jack has 96 of one and a million of the other. >> that night i packed my sea bags and i was gone. >> reporter: particularly about his time in the merchant marines. >> i was gone. 600 miles on a train through the

night i went. >> reporter: at this point in his life, there's one story jack would like you to hear more than any other. because perhaps if he tells it enough, something might change. >> because i think it is important. >> reporter: he was a merchant mariner 1942 to 1952, working on boats that supplied troops in world war ii and korea. it wasn't combat. but sure was dangerous. >> had more casualties than any branch of the service. >> reporter: he doesn't feel like his fellow mariners got the respect they deserve. with fewer of his generation alive every day, they may never get it. he would like to see even at this late date the merchant marine included in the gi bill. something president roosevelt said he was for when he signed it into law 70 years ago. >> but he died.

vegas this weekend. two people dead, four others injured after a suspected drunk driver crashed into a shuttle bus owned by grand canyon tours. it happened yesterday near the downtown area of the city. that bmw hit the bus so hard, it caused a three foot tent in the side of the bus. two people that died were trapped inside the shuttle. right before the crash a friend of the bmw driver called 911, told police his friend left the bar and was drunk when he got in his car. the driver of the bmw is also in the hospital and that driver faces several felony charges. new this morning, a warm welcome from germany. hundreds of migrants and refugees were greeted by large groups of well wishers with banners and balloons on their arrival yesterday and this morning. one syrian refugee noted how people treated him so kindly.

average is $2.41 a gallon, lowest prices in south carolina, averaging 1.99. aaa estimates more than 35 million motorists driving this weekend will end up saving more than a billion dollars compared to last year, when on average gas cost a dollar more a gallon. why the price drop? thank china's slowing economy. >> it is just old fashioned supply and demand. there's ample oil supply. >> reporter: to give context on how cheap a gallon of gas is today, in the early 1970s before the oil crisis, some stations sold a gallon for 33 cents. today in some parts of the country it could be had for $1.85. if you adjust for inflation, some motorists are paying less today than they did then. prices so low, we found four friends on us 27 in the florida everglades. they made a 16 hour spur of the

moment drive from tennessee just to pose with an alligator at holiday park. then take an airboat ride. >> wanted a vacation, got in the car and went. >> 900 miles. and the price of gas didn't even cross our mind. >> reporter: when gas was $4 a gallon, friends told robert to buy a sub compact. instead he bought a pickup and suburban. >> i am laughing at them for buying such a small vehicle. >> reporter: racking up the miles and savings on this last blast before summer ends. kerry sanders, nbc news, miami. >> here's a look at gas prices around the bay area. san jose seems to be the cheapest on average, $3.11 a gallon, oakland's average is $3.14, and san francisco, $3.29. look at this. one of our nbc bay area staffers recently spotted this price. 2.60 a gallon, just under that.

and if passed, it would continue californ california's role as leader, places environmentalists against the energy industry. that's a faceoff that environmentalists usually won in the past. what's uncertain here is whether the legislature is willing to increase the environmental ratchet again because it comes at a political cost, particularly in the form of serious opposition from the energy industry. >> let's talk about the basics of the bill and how it might effect those of us downstream. >> okay. the bill has three basic elements. first, it would reduce gasoline use by 50% through creased fuel efficiency, more reliance on fuel, solar and wind, and battery run automobiles. second, it would increase energy efficiency in existing buildings, older buildings by 50% to bring them closer to the

standards for current construction. and third, it would require california to generate 50% of its electricity from renewable sources by 2030. up from the current goal of 33% by 2020. the utility interests are already doing, by the way. it is important to note that california really is already the most energy efficient state in the nation. as a producer, this state produces 1% of all the global emissions in the world. so because of that the leaders want to do more. we have to do more because of our role. >> you can see the appeal in terms of cleaner air and better respiratory health for all of us, but there are hangups from the energy companies. >> look, the energy industry, these are the guys getting hurt here. they've set their sights on this bill calling it unworkable and jobs killer. the oil industry is not to be

trifled with, it spent more than $70 million on lobby efforts just since 2009. its concerns are understandable. yet the industry complained before about new energy goals. you know what, every time they've done it, those goals have been met in spite of their opposition. >> so it is crystal ball time. what can we expect one week for this decision to happen. >> my crystal ball is a little muddy. not working too well. seriously, look for this to go down to the wire. when i say the wire, i mean the legislature, you said at the top, the legislature ends its session this coming friday. we've got a couple of days to get this fixed one way or another. sb 350 already passed the state senate by 24-14. in the assembly, republicans adamantly oppose that bill as precursor to higher energy costs and lost jobs. but the fate of sb 350
