>> right now 73, 700 acres have burned, the same number i gave you yesterday morning and still 75% contained. the number of people now killed in the fire stands at three. however, a bit of good news. some of the evacuees could be headed home as early as today. >> bob redell in calistoga. many evacuees excited to find out when they can return home. >> many of them are asleep right now at the evacuation center here at the napa county fairgrounds and hoping to get news later this morning and not until later this afternoon about hidden valley because word that part of hidden valley, one of the communities inside the fire zone. that part could be reopen today. you might recall yesterday that authorities did lift the evacuation orders in napa county during a townhall meeting for evacuees here at the napa county fairgrounds. firefighters and local leaders promised residents, remember, these are people who have been displaced for five days now,

promised to return to their homes within seven days. assuming that their home is still there. cal fire wants to be the first to make sure that services are restored in their respective communities and that the fire is contained enough to ensure safety. as you have been mentioning, the valley fire is only 35% contained. >> what they're saying about safety, that's important. so, we'll get there when we get there. >> middletown, one of the communities that was hardest hit during saturday's wildfire. the water is back on there. so is the power. school districts, though, trying to figure out when to reopen those schools. reporting live here in calistoga, bob redell, today in the bay. in the meantime, deputies and cadaver dogs will continue searching for the burn zone for those today who didn't make it out. the latest victim to be identified leonard neft. his home burned down and his car

>> one reads i love 6a, no cameras. released that in a set of documents hoping to persuade the judge to keep these three jail guards behind bars as their trial goes forward. one of the tweets reads, matthew ferrous and rafael rodriguez. another from rodriguez to farris, he was surprised about me slapping him. i told him, i bet your parents never spanked you, but i will. prosecutors contend the messages were set six months before the beating death of michael tyree who was on a mental hold here. which is little comfort to the family of villa who was also beaten by the jail guards. a woman who claims she was beaten say the guards aren't getting the training that they need.

lopez to jail, even though he pleaded not guilty, lopez sanchez admits to shooting steinle to death. he says it was an accident. his attorney says lopez sanchez found the gun on the pier and somehow it went off when he picked it up. a follow up now to the south bay delayed hospital project two weeks after the county locked out construction workers. it's fired the company, turner construction, and it's suing the firm for damages. nbc bay area broke that story as the county frustration boiled over. the builders to miss several deadlines since construction began five years ago. a county spokesperson tells us the delays are costing santa clara county more than $100,000 a day. 6:06. new warnings this morning about another east bay lake that could be dangerous for people and dogs. this time, a lake in berkeley has been shut down because of blue green algae bloom. >> today in the bay stephanie chuang is in berkeley. the same kind of algae that

killed that dog over labor day. >> that's right, scott and laura. this algae can be deadly for dog. that death was one of the few dog deaths in california linked to the toxins from the algae in just the last couple of years. now, the owner that 3-year-old golden retriever, posy, had told us that her dog began foaming that mouth and eyes rolled back after the dog went swimming in sonoma county russian river labor day weekend. the dog died shortly after and russian river did test positive for the blue green algae. toxic levels have already shut down lake chabot and shinn pond and cory lakes. 2014 was actually the first year it ever recorded toxic algae blooms in its lakes. three times that year adding the drought is really what is driving up the algae growth. take a look at the notice out to the public. it is warning that there should be no bodily contact with the water, which can cause rashes and stomach problems for people.

spokane, washington, this week for the tenth annual advanced canine training course. 12 dogs took part in scenario based drills like jumping in and out of helicopters and boats. they're aggressive. new questions from government officials over the handling of dangerous toxins after a military facility threw out a test tube containing live anthrax instead of. the incident happened at an army facility in 2007. the pentagon and the cdc investigating why nobody knew about it sooner. as a result, the labs have received samples of anthrax that are still alive. now to a developing story, this morning emergency workers in chile are scrambling to get to areas hit hard. so far 12 people are confirmed dead. but crews haven't been able to get to some areas because roads are blocked or unsafe. the earthquake caused 15-foot waves in some coastal towns. triggered sugnomy advisories

for coastal california. the ocean rose less than six inches, but san francisco's emergency managers were awake through that night. they were on conference calls every two hours and they checked buoy measurements. the advisories were canceled but did remind people of the tsunami from japan that swept across the pacific and caused damage in santa cruz in 2011. now, santa cruz has tsunami warning signs posted and a plan in place. >> we can connect directly with any cell phone, whether they're a resident or a guest that's here and provide them specific information about where to go and what to do. >> officials say in the event of a tsunami it could be 72 hours before first responders could reach you, so, do plan accordingly. 6:15. new details on the deadly floods in utah. we've learned six of the seven of the hikers killed in flash floods monday were from southern california. the seventh hiker was from nevada. the group was hiking through a narrow canon in zion national park on monday when they were

trapped by a violent rain storm. park officials say they warned the group of flash flood dangers, but the group decided to go anyway. 12 other people died in the storm, including nine children. at least two people are still missing. 6:16 on your friday morning. let's get you out the door with weather and traffic. >> good morning. it's friday. we're happy and things are looking good on the roads, right, mike? >> yeah. well, it's looking good in the weather department, too. it will be heating up as we go into the weekend. so, put that in those plans. as we start out, you see the clear sunrise over the bay bridge. beautiful shot this morning and things are getting active out there as people get the weekend started and it's cool to start out. so, if you're about to step out the door, grab a jacket and you'll need it especially in the north bay. it is 48 degrees there. but 58 degrees in the peninsula. and warming up nicely today. a few degrees over yesterday. 82 degrees as well as 82 in the south bay and san francisco and

72 degrees. the heat will be ramping up t t starting tomorrow by lunchtime. and we're in the 90s to 100 degrees for the inland valleys and a lot going on this weekend, including the bike party in san jose. starts tonight at 8:00 and will be 73 degrees and then in the upper 60s by 10:00. and as you make those weekend plans, once again, you'll want to make sure you have something to cool you off. and be in the 90s to 100 degrees in the tri-valley. tomorrow in the south bay, 93 degrees and 98 degrees on sunday and also on sunday, in san francisco at golden gate park, at lunchtime at noon it will be 71 degrees and you'll be laughing out there under warm temperatures and sunshine. 80 degrees by 5:00 and not much of a breeze either. and with those hot temperatures this weekend just be mindful and drink lots of water if you're working outside. take some breaks and don't forget that sunscreen.

let's see how the commute is moving with mike. >> pretty bright at the bay bridge because the metering lights are on and let's look at your map. because we talked about an easy drive right now being friday, but looking also at a little slowing for the upper east shore and in the east bay a couple incidents i'm tracking. a stall reported highway 4 westbound at 680. an issue for concord and so far typical build there and some sort of debris down there towards the walnut creek interchange. no traffic breaks scheduled. we may have to have a traffic break for this. sounds like a crash in the middle of your freeway south 880 that is causing more backup and folks typically slow towards the san mateo bridge and getting across the peninsula, you're just fine across 92 and same thing for 84. just a little build for 101 and again later for the south bay and the peninsula back to you. >> thank you very much. happening today, super bowl l tour coming to the bay area. tour making a stop in fremont. a free showing of "remember the

video showed planned parenthood how they provide researchers with aborted fetal tissue. planned parenthood is illegally profiting from organ sales. the bills would transfer planned parenthood federal money to government-backed community health centers. the passing of the two bills could help john boehner make peace with republicans who think he hasn't confronted on planned parenthood. >> boehner's other problem avoiding a september 30th shut down. congress only has a couple weeks to agree on a spending measure and leaders from both sides are working on a compromise. tracie potts live in washington, d.c. still some potential deal breakers. >> well, that fight over planned parenthood that you were just talking about, laura, that is the biggest one. there are 40 conservative republicans who said i am not signing off on a budget. i am not signing off on that, if planned parenthood funding is included. the president, on the other

hand, has said he would veto funding if it is not included. they are trying to come to a happy medium before the september 0th deadline. here is where they are right now. top democrats nancy pelosi and harry reid went to the white house and sat down with president obama for 90 minutes and came out and said they're willing to do what they do every year. a temporary extension, but they hope republicans won't hold this up over planned parenthood. but some of them insist that the issue is so critical that they may be willing to let the government go into shutdown mode if that funding is included. so, that's where we are right now. kind of at gridlock and, as you said, john boehner is going to have to work with his party and work with nancy pelosi to try to come to some happy medium so that tens of thousands of government workers aren't out of work as of october 1st. we remember what happened back in 2013. it took them 16 days to get it done. >> i was just thinking back to that time. you were here with us, as well.

thanks for the continued updates, tracie. no rate hike. the federal reserve decided not to raise interest rates yesterday, but probably only a matter of time before they do. fed chair janet yelin said several reasons why interest rates are being kept near zero including concern over economic slow down in china and other emerging markets and really the volatility on wall street. she would also like to see wage increases and continued job growth in the u.s. and an increase in inflation. she did stress a rate hike would likely happen some time this year. new details now on a controversial high rise project in san francisco after nine hours of public input last night. the planning commission gave it the green light, according to the "san francisco chronicle" the development dubbed 5m causing a stir as the fight for affordable housing in the city continues. many worry they'll be priced out. the development of the high rise project insists that a good percentage of those units will be affordable housing.

the high cost of living could explain why home sales have been slowed down. researchers showing sales of bay areas homes and condos dropped more than 10% last month. that's compared to july. the medium price for all homes in the bay area sold in august around $650,000. coming up, simore people allowed to return home as the weather warms, the fire fight far from over. three correctional deputies accused of beating an inmate to death head back to court as we learn more new details about the case.

affected by the butte and valley fires. insurance commissioner dave jones will be in middletown. he'll be at the evacuation center to talk to evacuees. a lot of people lost everything, including the insurance papers and other necessary documents. so, moving forward is complicated. jones will talk with the local officials about how to help evacuees and then take a tour of the area, as well. we should get updated numbers on the fire now any minute. if you miss it, you can check our updates 24/7 on all of our social media platforms. three jail guards are charged with murder and assault under the guise of authority. today they could enter a plea. >> kris sanchez. this hearing comes one day after we learned more about the evidence against these men. >> what are the items of evidence supposedly against these three officers is a text that reads, i love 6a, no cameras. the district attorney's office released that text in a set of

vallejo police initially questioned their story. >> the statement that mr. quinn provided was such an incredible story, we initially had a hard time believing it. >> but in july, the fbi arrested matthew mueller for the attack and kidnapping. investigators were able to track him through a similar crime in dublin. today he will be back in court for preliminary hearing. the couple's claims against the police department seeks damages for lost wages, emotional and physical distress and humiliation. today we could hear from the 18-year-old accused of sexually assaulting an 8-year-old south bay student. police arrested jonathan chow on tuesday at the spark charter school in sunnyvale after receiving a report of the assault, chow worked at the school as the lunchtime monitor and teacher's assistant. he was book under to the santa clara county jail on felony charges. officers investigating to see if there are any other victims.

lots of customers requested the meat. not so said pet owners. 60,000 people signed a petition, others stage protests, many concerned about how the rabbits were being raised and slaughtered er slaughter slaughtered. noted animal welfare issues for rabbits caged overnight in cold weather with no access to water. the usda also sent a letter of caution to whole food rabbit farm for sending out multiple cartons of rabbit meat improperly labeled as usda inspected when they were not. rabbit advocates say the actions didn't meet its own farm animal standards of no crate, cages or tethers. >> ultimately, nbc exposed that they were not following humane standards. that there were violations in food safety. we're thrilled that whole foods has decided to stop the sale of rabbit meat. we wish it had come sooner.

there at the park with giants facing off with the diamondbacks later on this evening. right now it's cool to start. in the mid-50s and some upper 40s for the north bay. not much of a wind. the wind at about five to ten throughout most of the day. you won't really feel that much of a breeze until later on when the wind picks up from the northwest at about 15 miles per hour in a few spots. once again, about that giants game. we'll have some cool weather for that this evening with some mostly clear skies. in the mid-60s for the first pitch. winds coming in from the west at 10 to 15. by the end of the game, only 612 degrees. so, the hot weather will be kicking in heading into tomorrow as high pressure builds across the region. not much of an onshore flow and we'll have hot and hazy weather. moderate air quality and the valleys from the 90s to 100 degrees. so, a look at all those microclimates. in the 80s in the peninsula tomorrow. and then jumping up to 92 degrees on sunday. we'll see the hottest day of the week on sunday of the weekend and 100 degrees in the tri-valley on sunday.

not seeing much drama, although we see a slowing for highway 4 and the walnut creek interchange and getting towards the bay bridge and the bay bridge at the backup toll plaza because the metering lights are on here. dream force continues its activity and you'll have those road closures and a cleanup that goes on until the 20th, guys. traffic moving through the area smoothly. back to you. less parking more park. vta holding its annual parking day in downtown san jose this morning. an annual event where metered parking spaces are transformed into temporary public open spaces. the goal is to show the need for more urban space. vta is encouraging commuters to use public transit. folks can get an up close look at the new express bus. they can see how easy and comfortable riding the bus can be versus driving. couple seconds ago we got the latest numbers on the valley fire and we'll share those with you in just a minute. a long time since many of the evacuees got any good news

since yesterday morning. but progress is being made on containment. we're now at 40%. the fire has killed three people. a bit of good news this morning, as well. some evacuees could be headed home as early as today. >> that will be welcome news for them. "today in the bay" bob redell live in calistoga. some people who have been there since saturday may go home to see if they have a home at all. >> right. one thing that cal fire and fire department pointed out is when they to go back it will be safe. it is possible that part of hidden valley, that's one of the communities in the fire zone, part of hidden valley could be reopen today. yesterday authorities did lift the evacuation order in napa county and, again, they did have a town hall meeting for evacuees here at the napa county fairgrounds in calistoga.

another week for the communities to open. they want to have it reopened within seven days. but, again, another week for some of these people. at issue, of course, making sure that a fire is contained. only at 40% containment and make sure the services are restored. the town of middletown has seen its water and power back on. that was one of the communities hardest hit but other smaller communities still without power and without water and cal power wants to make sure that happens before they let those people go back home. bob redell, "today in the bay." deputies and cadaver dogs will continue searching the zone. three people confirmed dead so far. leonard neft is the latest. he was found wednesday. the other victim discovered wednesday was bruce burns and

where lake anza is off limits. >> off limits because blue green algae has been found at lake anza and it can make people sick and be deadly for dogs. you may remember just a couple weeks ago 3-year-old golden retriever named posy died after swimming in sonoma county russian river labor day weekend. russian river tested positive for this algae. it was one of several dog deaths in california linked to algae poisoning in just the last two years alone. toxic level s of blue green alge have shut down other lakes and lake chabot in castro valley and shinn pond and cory lakes. 2014 was actually the very first year it recorded toxic levels of algae blooms in its lakes. that happened three times last year adding that the drought has really driven up the algae growth because of low water levels and a lot of heat that produces a lot of the blooming algae. the test results back from lake
