"today in the bay" starts now. and a very good tuesday morning now. thanks so much for joining us, i'm laura garcia-cannon. >> i'm sam brock. a bit of a roller coaster week. >> the roller coaster is not over, sam. it has been at the top of the roller coaster to start out the week and today we go right back down and that doesn't mean we're done with this ride yet. let's look at those temperatures now. right at about 60 degrees and heading into the 70s and 80s. the north bay up to 83 degrees and the peninsula a high of 79 degrees. it will be heating back up by the end of the week. i'll show you that coming up in a few minutes. let's check in now with mike. >> kari, a live look here at the bay bridge toll plaza which has absolutely no backup. we'll look at your approach on the map and a crash on the upper east shore freeway. a big rig on the shoulder and possib

possibly another vehicle clearing from lanes. this is the slow that we see and at 14th a clocher for the off ramp and the flares are a distraction with a temporary traffic break. that is going to be slow likely all morning because of police activity. >> mike, thank you. let's get to that right now. an update a suspect killed by alameda county deputies in san leandro shot someone else early in the evening. deputies started chasing the suspect after that suspect carjacked someone in oakland. he tried to carjack a second person in san leandro. the second time he was unsuccessful. he reportedly fired at deputies who shot back killing the suspect. carjacking victim was taken to the hospital. that person's condition is unknown. stay with us as the story continues to development throughout the morning. when we're not on the air, you can always check for updates on all of our digital platforms. pushing her baby in the stroller and an unsettling crime

that has a community on edge today. >> "today in the bay" kris sanchez live and now police have a suspect sketch of that suspect involved here. >> yeah, they do. it was a pretty brazen attack, given the fact that the suspect appeared to wait until that mother was tending to her crying baby to attack. it happened on the 3100 block of middle field road as the woman was pushing her baby stroller along the sidewalk it was around dusk. so still daylight. not quite 7:00 in the evening. palo alto police. the mother went tasoothe her crying innocent in the stroller, the suspect came up from behind and grabbed her purse from her shoulder and punched her in the head and ran off. several witnesses tried to trail that suspect and followed him but lost him. they describe the suspect as a stalky man in his 20s. the suspect may have a full beard but no mustache.

wearing a sweatshirt with a hood pulled over a baseball cap. palo alto police hope someone can put this robber behind bars. they don't know if he will be a repeat offender, but no other robberies with this description so far in palo alto. >> thank you very much, kris. well, now, a developing story that we're following this morning. >> yeah, we're asking president obama here for help and money for resources, as well. that valley fire that has absolutely obliterated multiple communities in the north bay. right now, continuing to do so as we try to find out what the latest is here. >> the governor is actually asking president obama for federal aid and they need it quite quickly. as you see, little remains for so many people that some are just barely being allowed to get back into their homes. our stephanie chuang is live up by the valley fire with more on this developing story. steph?

>> yeah, laura, sam, there are still 3,100 homes that are threatened. so many people are stuck in limbo. but there has been help here at the calistoga evacuation center here. the napa county fairgrounds. some other food. the governor is seeking long-term help by declaring the valley fire a major disaster. the fourth most destructive fire in california history, killing three people. hurting four firefighters and leaving thousands homeless. brown says fires in california have burned three times the acreage from last year and the state has already given more than $200 million in emergency wildfire fight oing in the last two years. so, funds are stretched very thin. and the amount of help valley fire victims need is very great. destroyed almost 1,000 utility poles, as well as water system and help people repair and replace housing and disaster case management and legal services and, of course,

temporary housing. a very difficult situation as so many will likely have to live pretty far away from home in the meantime. now, to help with the transition, there has been a shift. there are much fewer tents here in calistoga and a shift to the middletown evacuation center that is new. the thought is to help people rebuild by being closer to home. but still a long way to go and hopefully they're hoping the president will respond very soon. live here in calistoga, "today in the bay." it is 5:05. three workers at a sunnyvale charter school out of a job this morning. spark charter school fired them, though administrator will not say why. all three employees were assistants at the school. one is jonathan chow who is in jail on charges he sexually assaulted an 8-year-old girl. the school claims it didn't know until after chow's arrest and almost none of the school's employees had been fingerprinted nor had background checks. the school board said it has since collected background checks on all its employees in

the county will begin reviewing them today. the suspect in that sexual assault spoke exclusive to nbc bay area. jonathan chow told us in a jailhouse interview that he tried to communicate with his alleged victim. chow said he wrote a letter to the 8-year-old girl that he is accused of sexually assaulting. he would not say what he wrote and made it very clear he did not want to comment on anything that could compromise his court case. chow wants to emphasize he wants to keep the media attention away from his family. >> judge me for what i have done and do not drag my family into this. i have done what my family has done. >> that's reporter robert honda talking to him. he told robert he is aware of reports based on court documents that say he has confessed. chow declined to comment and said he would wait for his case to play out in court. happening today, santa clara leaders could decide on a partial alcohol ban at levi stadium. >> chuck, this comes after a

flight was caught on camera following last monday's game and a series of violent episodes at levi's. >> the incident gave a black eye, really. gave a black eye to the city of santa clara. right now they are trying to remedy this. now, across the nfl most stadiums stop serving alcohol at the end of the third quarter. levi stadium, however, may be considering ending that at the end of halftime. the move comes after the drunken brawl that you mentioned was captured on videotape. it happened september 14th at a niners/vikings game that was captured on video that went viral banning alcohol sales after half-time is not the only option being considered. >> looking at monitoring the patrons as they enter into levi stadium to see how drunk they are and if they're too drunk, they're not allowed in. a lot of what's happening is that they're tailgating to the

extreme. and by the time they get into the stadium, they're even well past where they really should be. >> i think it should send a strong mesnl that we're not going to tolerate this bad behavior at levi stadium and we'll go after you and prosecute you and if you are a holder, we'll revoke your licenses. >> levi stadium wouldn't be the first to cut alcohol sales at the end of halftime. that's been the policy at metlife stadium, where the new york jets play. in san diego at qualcomm stadium, alcohol sales are reduced from a two beer limit to a one beer limit and into the third quarter. the stadium authority board will meet to discuss this and the city council also meets tonight at 7:00 p.m. live in santa clara, i'm chuck coppalo. >> usually football a sign of the fall. doesn't feel that fall-like right now. >> when can we light our pumpkin scented candles, kari? >> you can probably do that

"today in the bay" tracie potts joining us live from the white house where the the pope is going to meet with president obama later today. tracie, good morning. >> he is meeting with the president formally tomorrow. but they will see each other face-to-face later today. the president is headed out to joint base andrews to meet pope francis on the tarmac as soon as he arrives here in the united states. barricades are going up. streets are shutting down. tens of thousands will greet pope francis at the white house. at the basilica and at the u.s. capitol where he'll address congress on thursday. >> everybody is excited and everybody is thrilled. everybody is so proud. >> he is literally taking the church out to the people. >> they're coming from all over. this bus left chicago. >> nice walking shoes. i'm just excited to sit in the sun all day long just to wait to

is offering a new version of its apple watch software this morning. >> caught mcgrew, this is a software they had to delay because of the bug. >> they got it fixed, laura. early this morning the company started offering that update. it makes the device faster, allowing some programs to actually live on the watch. run natively instead of depending on the phone. this should make the watch a bit faster. a kid in massachusetts has saved up money from a summer job to buy an apple watch may have saved his own life. he was playing around with the hard heart beat app and discovered after football practice his heart rate was way out of norm and went to the hospital and diagnosed with. the watch saved his life. he got a call from tim cook, too. let's check the news before the bell and landon dowdy live at cnbc world headquarters. good morning, landon. >> hey, scott. good morning to you.

wall street looks to give back some of monday's gains. stocks close sesaw trading as investors shook off a two-day slump sparked by last week's decision not to raise interest rates. some top fed officials are still making the case for rate hike this year. fed chair yellen may offer more insight when she speaks on thursday. the dow raising yesterday to 16510 and the nasdaq up just 1 to 4828. scott, back over to you. tech crunch disrupt continues today in san francisco. this is a gathering of developers and venture capitalists and led to intere interesting young companies getting attention. last year i was a bit critical of the winner. they took home that big check. helps you manage other apps for dry cleaning deliveries and getting your food delivered and your pets walked and that kind of thing. in other words, things that most people do themselves. that one was maybe too much a sign of the times in san francisco. these apps are now about what

your mother used to do for you and that kind of stuff. also disrupted the center of one of the funniest bits ever on hbo's "silicon valley." >> and, also, like you said -- >> i'm hoping it's not a pampering app. changes our world, not something that delivers your dry cleaning. >> nothing to do with babies. >> they change a lot. >> that would be a great app if it could change babies. that would be an awesome app. >> change diapers. literally. >> a change in the forecast today. >> yes, dramatic change today. it was so hot yesterday. in the past few days. so, at least for now, we are done with that. and you really once we look at this forecast what we have coming our way. as we take a live look now at the bay bridge, we have a few clouds that are back this morning and, also, getting a live look now at soma.

we see the clouds from the light that shines up into the clouds from the city. well, it is now 60 degrees. so, we do see those clouds back this morning. something we haven't seen the past few days and it's in the lower 60s for the east bay. and we also have more of an onshore flow today. so, northwesterly and the wind is picking up as we go into the afternoon and a breezy ocean breeze brings back our natural air conditioning and keeps our temperatures from warming up too rapidly today. we start out at 61 degrees at 7:00. at 10:00, 69 degrees. so, a slow warm up but still nice and warm as we go into the afternoon. highs reaching into the 70s and low 80s. and this is what we had to deal with the past couple of days. high pressure over the region. it kept those temperatures near 100 degrees inland. but today the onshore flow increases and the morning clouds and fog expected and as the marine layer deepens over the next couple of days, there will be a cooling trend ahead.

but it will not last long. by friday our temperatures going back up into the 80s and 90s. saturday, also pretty warm. but sunday will be the coolest day of the weekend. as we come back down to 69 degrees in san francisco. the east bay will be at 80 degrees. so, sunday the best day this weekend. let's check in now with mike. >> i still think saturday is the best day because, well, anyway. looking over here towards the bay bridge. the backup mild right now. it's that we see should a strong flow of traffic starting to build over the next 15 minutes here. the map will show you no big concerns but we did have a big rig over on the right shoulder and little slowing past the scene for westbound 80. the north bay over here and across the richmond san rafael bridge. all morning that closure for east 14 street north of 238 and right after the split. the castro valley wide and those flares likely causing dthis distraction and close for the early commute as you approach

exclusive ... =laura/2shot= it's football season again - at 5:23. now to an investigative unit exclusive. it is football season, again. with the second season under way, under lights at 49ers levi stadium. nbc investigative unit has uncovered questions about the stadium's impact on public safety. >> senior investigative reporter steven stock has been looking into this issue for almost a year now. steven? >> morning, guys. we discovered at night the around levi stadium can create a safety hazard, at least according to some pilots. this is video from the cockpit of one local pilot in the skies over levi stadium during the thursday night football game on september 3rd. you can see the scoreboard light up so brightly. the light actually overrides the camera's ability to handle it. there it goes. the light filled the cockpit and the pilot who took the video told us there was no mistaking it. corporate pilot and captain actually had a more serious issue with the bright lights back on march 26th. they were blinded while trying

to land on runway 1-1 right and the co-pilot had to get medical attention after landing safely. we also want uncovered another five formal complaints filed anonymously by pilots in 2014. with nasa's safety aviation reporting system. all of those complaints were related to these lights and safety concerns associated with them. now, the faa acknowledges getting these complaints saying most of them were related to scoreboard and testing that scoreboard. the faa says the stadium operators have agreed not to test the scoreboard without advance notice going forward. but otherwise the faa admits no action has been taken to actually dim the lights, shield the lights or change the intensity of the scoreboard. you can see our entire full story and the full response from the faa, as well as the response from the san francisco 49ers. it's all on our website, just go to nbcbayarea.com.

back to you guys. >> thank you. turning to decision 2016. once ahead in the polls in battleground state but now scott walker out of the race. the wisconsin governor announced last night he is ending his campaign for the republican presidential nomination. walker was one of the last candidates to enter the race. he said more republican presidential candidates should quit and, "clear the field" so someone can take down frontrunner donald trump. walker isn't the only one taking shots at trump. gop presidential hopeful carly fiorina brought her campaign to late-night television appearing with jimmy fallon. >> donald trump has recently said that he wants, vladimir putin saying he wants to meet with trump when he comes here and sit down and have a conversation with him. you met putin. >> two of them have a lot in common, actually. but we'll just leave it at that. >> fiorina is now second to trump and the latest gop presidential polls. with all that coming up now,

this was a really brazen attack and it seemed until the suspect waited unit ilthe mother was tending to her crying baby to attack. happened on the 3100 block of middlefield road. the mother was pushing the baby stroller right around dusk and not quite in the evening. as the mother bent to soothe her crying infant, the suspect came up from behind and grabbed her purse on her shoeulder and made off with her purse. they made it to luma verde avenue and lost him. they describe that suspect as a stalky, hispanic man in his 20s between 5'3" and 5'6" tall. the suspect may have a full beard, but mustache. now, palo alto are certainly hoping someone will look at that sketch and if they recognize anything and give them a call, no other robberies with this

same suspect description. but police if it happened once, it could certainly happen, again. in palo alto, kris sanchez. 5:32 right now. san francisco city leaders taking a stand against sexual assault on college campuses. police chief of san francisco and ucsf and the district attorney all going to join other leaders to announce coordinated efforts to combat sexual assaults on campuses in the city. the event is going to take place at the university of san francisco. one of the campuses that pushed to educate students on how to prevent such attacks. it is 5:33. the teenager accused of sexually assaulting and murdering maddy middleton has pled not guilty. outside of the court maddy's father spoke publicly for the first time. >> i want people to remember she was about love. and she would want me to love, also. she wouldn't want me to hate. >> her father shared his

thoughts about 15-year-old adrian gonzalez. maddy's neighbor in a santa cruz apartment complex. gonzalez is accused of killing the 8-year-old girl. someone yelled murderer as g gonzalez waus being escorted out. a shootout with two suspects in the middle of a tarparking l. happened right off of highway 1. a few miles from monterey. investigators say two police officers were serving search warrants to two suspects when the suspects allegedly started shooting. police fired back, killing both shooters. the officer suffered minor injuries in the process. now, to a developing story at 5:34. more than 1,000 families homeless in a matter of minutes. now, governor brown is asking the white house for help. hundreds of people are still living in tents from the valley fires. they have got no where else to go. >> in the bay, stephanie chuang joins us live.

stop spread of the fire and 1,200 homes destroyed and so many displaced. >> a lot of them. thousands of them homeless are stuck in limbo not knowing what to do in order to really rebuild right now. some are camped out here still at the evacuation center in calis calistoga. asking president obama to clear a major disaster to get money for these victims. this is the fourth largest, most destructive fire in state history. in the letter the governor summed up the numbers three dead and even more presumed dead. four firefighters hurt and thousands of people homeless. people like maria vazquez who says she was paying $700 a month for her family and now the cheapest rent she can find is $2,500. >> i don't have any help now. very hard for me to find five person. >> the governor pointed to the need for temporary housing for

hundreds of people and families like maria. and like a long distance from home in lake county. the fire also destroyed 1,000 utility poles and cutting power to so many people and drinking water systems completely damaged and destroyed. people still trying to figure out how to get back on their feet and one way to resume their lives as normal is to get the kids back in class. the hope is to get schools back on track in middletown by the end of this week or by monday. stephanie chuang "today in the bay." now to an nbc bay area follow up. a controversial plan to import coal through the port of oakland raising questions about safety in the east bay. hundreds of people packed a public hearing at city hall in oakland last night. construction workers say allowing coal at a new bulk terminal they will build is good for the economy. but environmentalists say coal has serious health impacts. former mayor jean klein joined the debate to say logistic

solutions did not mention coal exports during the execution. a claim supporters of the plan disagree with. >> always been described as a bulk commodity terminal. if you google bulk commodities, you'll see coal. >> the fastest way to provide jobs for the construction workers that were dragged here, the fastest way is to build to the original plans, not to export toxing coal. >> the city council asked the staff to do more research and report back in october. negative health impacts they might explore emergency action to stop the export of coal from the port. happening today, we've seen some rowdy behavior at levi stadium and now santa clara leaders could limit how long fans buy alcohol. >> this comes after a fight, another one caught on camera following last monday's game. >> that's right, laura and sam. good morning. santa clara is learning what a lot of other cities in the nfl had to learn.

large-scale crowd control with the super bowl coming here early next year. council members want to fix this thing early. tonight, sports authority board or the stadium authority board with council member is a part of that will meet to discuss whether to stop serving alcohol at the end of half-time. that comes after a fight at levi stadium erupted september 14th. the video went viral and also prompted council members to consider banning people from coming into the stadium who may be intoxicated. >> we clean this up and really make it shine for super bowl. next february we want them to have a great reputation in this entire bay area. and make sure that people know when they come to levi stadium, they're coming to a safe, family friendly environment. >> i just don't really know if that is going to solve everything. reason being, we're dealing with a very small amount of fans that are misbehaving. >> it may not be an all or

in their carseats... it will soon be the law in california. =vo= keep those toddlers rear facing in their car seats will soon be law in california. governor jerry brown signed a bill yesterday that requires children younger than 2 be strapped into rear facing car seats current requirement is for kids under 1 year to be rear facing, although pediatrician have recommended age 2 for several years. rear-facing car seats protect the head and spine of a child that are in a crash. the law takes effect at the start of 2017. partial victory for the city of berkeley in its new cell phone warning requirement. the law has been on hold ever since it took effect in june. it requires cell phone retailers to provide a warning about possible radiation exposure. the industry is vigorously fighting berkeley in requesting an injunction. yesterday a federal judge ruled the law can take effect, but the

judge did require berkeley taremove a statement in the warning suggesting the radiation risk is greater for children. hillary clinton planning on proposing a plan today to help make prescription drugs more affordable. her plan would cap out of pocket costs, kill tax breaks for direct consumer advertising and encourage development and use of cheaper generic drugs. yesterday clinton tweeted a link to a "new york times" article about steep drug prices calling the situation "outrageous." her comments led to a plunge in shares of biootech and drug companies. here's a sample of what clinton hopes to stop. under fire this morning. raising the price of a drug that fights complications of hiv and cancer by 5,000%. company bought the drug from impact laboratories in august and raised the price from $13.50 to $750 a tablet. the company says it's putting the extra mun into developing better treatments with fewer

area homes is dead. the bay area air quality management district dropped the proposal this week after so much public outcry. the world would have barred bay area homes from being sold or rented unless open hearth fireplaces were replaced with cleaner, wood burning devices. instead, the district will provide subsidies who choose to reor retrofit their fireplaces. if your tap water is a little odd these days and you live in the east bay, no cause for alarm. that's what they're telling the bay area news group. water customers in central contra costa county this week are complaining about a funny taste and smell in their tap water said to be from the drought. the water is safe, but some of it is coming from a different source. backup supplies from the sacramento river are beinged to the normal sierra mix and customers may notice the difference for a while. new this morning, a bay area wildlife rescue group says it is being overwhelmed right now by

starving sea birds and warmer ocean waters could fwhee culprit here. the international bird rescue center is caring for more than 250 common birds that are found exhausted and malnourished in recent weeks. that center sees fewer than ten of these birds around this time every single year. as we said, 250 right now. scientists think warmer ocean waters might be causing fish to swim a little deeper, putting out of reach of diving sea birds. the rescue center says its resources are already stretched so thin and donations and volunteers are always welcome in their efforts. >> so many different things. air conditioning, no doubt. in the bay area were running yesterday. >> today we can give them a little bit a rest, especially for the morning and then late evening. you may crank it on just for a little while this afternoon. it will still be warm and as we take a live look right now at san jose. it is comfortable to start out the day. a few have started to move back in and as we go into the next few days, it will be cooler to

start and then warming up. we're still on the roller coaster and we're not done with this ride just yet. it's now 60 degrees in san francisco and 63 degrees in the south bay. today highs will be in the 70s and 80s. doesn't this look so much better than 90s and 100 degrees. 71 degrees today in san francisco. the 78. east bay 79 degrees and the tri-valley will see those highs today reaching into the mid-80s. also for the north and south bay in the mid-80s. and stronger onshore flow will make it feel much more comfortable. that is what we can expect through the afternoon, as well, and into the start of the day tomorrow. morning clouds and also some fog near the coast. as we go hour by hour in san jose, it will be 61 degrees at 7:00. stepping out the door not bad. and then a slow warm up and those temperatures. with the stronger ocean breeze, it does keep those temperatures warming up too rapidly as we go into the day.

we had high pressure was just off to the east of us. it was fighting back that onflow and that will be coming to an end now that high pressure continues to move away from us. and will allow for the morning clouds and fog, as well as the onshore flow and as the marine layer deepens, meaning we'll have a lot more humeumidity abo the surface and creating those clouds. a cooling trend will be ahead, especially for san francisco. the next couple of days will be in the low 70s and then look at what happens by friday. we jump up to 82 degrees but then another push of some cooler air makes it in in time for saturday, as well as sunday. a look at all the microclimates, warm to start out the weekend and then sunday will be the coolest kday of the weekend. let's check in now with mike. >> it's tuesday, we expect a stronger volume of traffic to hit about now. 880 past the coliseum. no surprises and traffic speed for this portion of the nimitz. we have that build and slowing through san lorenzo.

stock with more on what he's uncovered. steefen? >> good morning, guys. we discovered at night the lights around levi stadium can create a safety hazard, at least according to some pilots. this is video from the cockpit of one local pilot in the skies over levi stadium during the thursday night football game on september 3rd. you can see the scoreboard light up so brightly. there it goes. the light filled the cockpit and the pilot who took the video told us there was no mistaking it. corporate pilot christina korwici and her captain had an on march 26th. they were blinded while trying to land runway 1-2 right and the co-pilot even had to get medical attention after landing safely. we also uncovered another five formal complaints filed anonymously by pilots in 2014 with nasa's safety aviation reporting system.

let's see how the traffic is moving now with mike. >> we are starting in the south bay because two crashes in the same area. looks like everything is off to the shoulder but the one at tully we have one lane blocked right now and sounds like they have trouble moving that car. that means a backup starting to form for north 101 and 87 also slowing into downtown and seeing the build for the south bay. the rest of your bay looks pretty standard as far as that flow. the tri-valley and 880 through hayward getting over to hayward and oakland. we have this slowing as you approach 14th street. east 14th the auoff ramp is clod because of sheriff deputy activity and we have the freeway open and the flares are a distraction and the reason why it's closed, we'll hand it back to the desk. laura? breaking news we're covering this morn, mike. a suspect killed by alameda deputies in san leandro carjacked and shot someone earlier in the night.
