the land of brainiac. everyone is a brainiac around here. it will hummab blble you very q. good morning, kari. >> a cooler day across the bay area with more clouds moving in and a little bit of some sprinkles going on south of the south bay. well, in our area we are in the lower 50 er 50s in the north ba 62 degrees in the peninsula and highs today in the 70s thanks to all those clouds and a few peeks of sun here and there and san francisco reaching 68 degrees and 78 degrees in the south bay. i'll detail those temperatures and what to expect as we head into the weekend. that's coming up in just a few minutes. let's check in now with mike to see how the roads are moving. >> let's look over here. beautiful shot of this tower eastbound coming out of san francisco and in past the treasure island exit. one lane blocked and overnight road crew there and traffic flows smoothly in to and out of the city. same on the speed sensors across from oakland into san francisco. remember the giants play the

dodgers and trying to keep that streak alive after a tough one. we're looking over here towards the rest of the bay and smooth drive through san ramon and looks like they cleared from the northbound side and slow from 580 and a disabled vehicle at greenville, guys? questions this morning at the santa clara county jail after another inmate died inside his cell. >> "today in the bay" stephanie chuang joining us live outside the jail. charges came out of the first incident. what do we know about what happened with this inmate? >> waiting to find out more details later this morning. we do know it was a male inmate found by a deputy yesterday morning unresponsive in his cell. jail is staff then gave the man first aid until firefighters and paramedics arrived. he was pronounced dead 30 minutes later. what killed him is still unknown. this is, though, the second

inmate death at this jail in about a month. 31-year-old michael tyree a mentally ill inmate was found dead august 27. they are 27-year-old matthew farris jereh lubrin and rafael rodriguez. now, two of those deputies posted $1.5 million bail before this weekend the third farris has a property bond hearing set for this afternoon. all three are set to enter a plea in about two weeks. again, we're waiting to learn more details from the sheriff's office about the identity of this most recent inmate who died here. live in san jose, stephanie chuang "today in the bay." 5:02. new this morning two men shot dead in richmond last night. now police are trying to piece together what happened. police say shot spotter recorded

four gunshots near san pablo avenue. when police got there, they found two men shot to death. so far police do not have a motive or suspect in mind. anyone with information is urged to call police. also new this morning, crews made quick work of an overnight brush fire in hayward. that fire started just before 3:30 near the corner of middle lane and hisperian boulevard. took a small crew of firefighters less than 20 minutes to put out that fire and make sure it did not flare up, again. the cause, meantime, still under investigation but nobody was hurt. federal prosecutors say they have new evidence proving that accused china town gang leader arranged a murder nearly a decade ago. chow already faces charges in a money laundering and political corruption case bthat ended the career of lee. chow arranged the murder in 2006. he led a rival fraternal

organization in china town. chow's attorney dispute these latest allegations. 5:03 and a follow up now. a hayward school superintendent is apologizing for his behavior at a school board meeting earlier this month. two board of trustees filed police reports after superintendent stan dobbs allegedly shouted, cursed and even became physically threatening. in a letter he offered his regrets about his behavior and an explanation. he says he had an emergency  medical procedure earlier that day and had been advised by his doctor to take the rest of the day off. the letter reads in part, "while i rested for several hours i felt okay and determined not to miss a school board meeting. i should have followed my doctor's orders." not clear if any disciplinary action will be taken against dobbs. investigative unit exclusive that affects hundreds of thousands of students across the bay area. when schools decide it is appropriate to call police on

their students. >> some children are winding up with criminal records they cannot erase for what some described as childish behavior. looked into this and joins us with more. >> we uncovered a trend in the bay area where kids are being criminalized for minor misbehavior. to find out how often the schools called the police on their students we collected from 20 of the largest school districts across the bay area. black students and students with disabilities were referred to police at disproportionately higher rates than other children. officers at schools can give a child a juvenile citation, equivalent to an arrest and goes on a child's criminal record. legal advocates tell us this is done for routine misbehavior like talking back to a teacher or pushing together student. we dig deeper and also investigate one bay area school district that had a practice of calling police on its students at a rate higher than nearly

area. the fellows receive a $625,000 grant for their work in their respective career fields. among the winner christopher ray and others include uc berkeley chemist and social scientist desmond and basil twist, a native of san francisco. >> complex and diverse. kind of just as we are here. all different kinds of jobs represented in that field. >> very impressive. >> absolutely. we also are always impressed with our forecast because typically it's nice from one day to the next. i don't think this is a departure. >> a lot of clouds moving in and that will keep our temperatures down a few more degrees today than yesterday. we also are tracking a few light sprinkles that are moving across monterey and over towards the central valley and not move into the bay area. unfortunately i don't think we'll see much of that. temperatures cooler than average reaching 78 degrees in san jose and palo alto 75 degrees and the

night to approve a spending bill and void a government shutdown. looks like that could happen without any cuts to planned parenthood. yesterday, republican leaders decided not to draw president obama into a veto fight over funding for planned parenthood and, instead, push through a stop gap bill that would keep federal services running for a little while longer. the senate will likely pass that bill today. the house will take a look at it tomorrow. today's session comes less than a week after john boehner announced his resignation. does not guarantee the bill will pass, but make it easier for boehner to compromise with democrats. but not all republicans are very happy about it. "today in the bay" tracie potts live in washington this morning. this is really a critical vote as it comes to several people look to actually replace boehner at the head of the house. >> exactly. it looks like california's kevin mccarthy is the leading candidate for house speaker at this point. there's another florida congressman who has announced that he's interestinged, but

mccarthy already in that number two spot is a very likely candidate. later today, all the republicans are getting together in the basement of the capitol, literally, for a closed door meeting to talk about what they're looking for and how they want to go forward and maybe even get an election date out of them because we don't have one at this point. this budget battle that you just talked about and the planned parenthood battle that has been part of that, all of it has really helped to fracture the party. along with a number of other issues. conservative republicans versus moderate republicans. mccarthy said in a letter that he wants to pull them all together. we'll see if he gets the opportunity to do that once we find out when that election will be held. >> it will be interesting to see central valley guy there. thank you very much. at the united nations today president obama will host a summit on how to get rid of isis but vladimir putin will not be there. he is back in moscow this morning after a tense meeting with president obama, putin described their one-on-one

meeting that they had. he said it was very constructive, surprisingly open. he says they have a solid ground to work on, but the two still have very different ideas about syria's role in defeating the islamic state. >> translator: we think it is an enormous mistake to refuse to cooperate with the syrian government and its armed forces. >> he thinks we are an out of control arrogant super power. he likes to take us down a peg. doesn't mean they won't cooperate on certain issues. >> they did agree that the military should talk tew void conflict. let's stay in the political world now to de2016. vice president joe biden has not announced plans to run for the white house. but a new poll shows if he did, biden would find himself in the top spot a new nbc news/"wall street journal" poll say 25% of americans have a positive impression of biden while only 28% have a negative impression. that's better than current top

candidates from both parts a. biden would outperform clinton clinton in a head-to-head general election. right now voters say they would back hillary clinton over trump by ten points, but the former secretary of state would be statistically tied with carly fiorina, ben carson and jeb bush. that poll says that biden would fair better beating all the gop candidates besting donald trump by 19 points. well, still no announcement from biden but donald trump will be on "today" show later this morning. we'll talk about the tax plan that he just unveiled yesterday as well as the u.s./russia showdown at the u.n. and recent attacks he made on marco rubio. that's coming up on "today" show starting right after "today in the bay" at 7:00 a.m. a mega star duo now set to make a bay area appearance. president obama is going to visit san francisco next month for a political fund-raiser so joining him at the warfield on october 10th hip-hop superstar kanye west. maybe west will take some notes

mixed u.s. economic data. reports on home prices and consumer confidence. the dow falling 312 points to 16,001. the nasdaq down 142 to 4543. the automaker will tap into connectivity in its cars. mary barra says it plans to add more self-driving features and enable services through smart phone app. you can use an pp to import preferences such as seat positions and mirrors. amazon has rolled out a program in its hometown of seattle to offer one-hour delivery using a network of independent contractors. the "wall street journal" says under the service amazon flex people sign up for shifts through smartphone app and alert when they should pick up packages. >> we're totally testing this theory out. one hour. we can get coffee on national coffee day. we can order video games, anything. world is at our disposal.

>> sit around and play games and drink coffee. >> it's kind of what i do. >> you feel me here. >> my map tell the kids they look like video games. i tell them i play video games and drink coffee and watch tv. >> hang out with your friends. >> just chat. >> pass out at the sofa. >> and you get paid for it. >> off the sofa outside today what is in store, kari? >> it is cooler and more clouds. maybe you can leave the sunglasses at home. only see the sun peeking out every now and then. from san bruno mountain you can see there is some fog starting out the day and it is cool. so, maybe some long sleeves as we get the day started. and take a look at this seven-day forecast that's coming up at the bottom of the screen. we will have some comfortable weather for the next few days and as you step out the door now, it's only 52 degrees in the north bay and 60 degrees in the south bay. look for highs today most in the 60s and 70s. 70 degrees in the east bay and

the peninsula at 75 degrees and a cool evening out at at&t park, once again, at first pitch we're at 64 degrees. dropping back to 61 degrees and a breezy westerly wind at about 10 to 15 miles per hour. as i take you hour-by-hour in oakland, we still have the clouds through 9:00 in the morning and then you start to see a little bit of sun by 10:00 or 11:00. temperatures are in the mid-60s. into the afternoon, we'll see that once again continuing with highs briefly hitting 70 degrees. and then dropping back into the 60s. so, the next couple of days we have this disturbance sitting just off shore bringing in those mid and high-level clouds and a stronger onshore flow to make our temperatures slightly cooler. and the temperature outlook for the next couple of days in the tri-valley go from the lower 80s even some upper 70s on thursday. and then it jumps right back up as we head into the end of the week into the weekend. in the 80s and 90s in the tri-valley. looking at all the microclimates on friday.

it will be pretty warm with, some spots hitting 90 degrees. on saturday looking a little bit better no 90s there and by sunday it will be the coolest day of the weekend. we'll have mostly 70s and 80s across the bay area. let's see how the roads are moving now with mike. >> we're just getting started with the build. the south bay we should see a burst of traffic kicking in for 101 soon and the sharks play the canucks tonight. downtown and a pedestrian route at sap pavilion. we have your build over here livermore 580 out of the altamont and typical pattern there. let's give you shots of the bay bridge. we have the cash lanes that are starting their backup and this is standard. it will really start to kick in over the next ten minutes and see the metering lights just after 5:30 and look towards the san mateo bridge and westbound, again, your commute with the taillights with no delays. the foster city side.

alert messages displayed on freeway signs and on your phone when a chil most of us have seen the amber alert messages displayed on freeway signs and on your phone when a child is missing. now that same technology will be used to find hit and run drivers. part of a new law just signed by governor brown. candace winn reports on the new yellow alert. >> i have my moments. i think about him a lot. >> reporter: hard to say whether a state yellow alert system would help find the driver that killed craig robinson's brother. but he says it might help future cases. >> i couldn't believe the number of cases outside of roger's that i just hear about. why is this happening? >> reporter: last wednesday his brother collapsed while walking across a street in park west. a car hit him and the driver did not stop. >> the problem was is he took off. he shouldn't have done that.

>> reporter: as a result of other fatal hit and runs statewide, governor jerry brown signed assembly bill 8 monday a bill allowing law enforcement agencies to issue a yellow alert if a person was killed or suffered a serious injury due to a hit and run accident. the agency would need specific information about the suspect or the suspect vehicle. the alert would be activated within a specific approved area, presumably around where the accident happened. >> i think it's a very good tool. i mean, we have the amber alert. >> reporter: a chp spokesperson tells nbc 7 the yellow alert system seems like a good tool, but these cases will still be extremely difficult to solve. he said usually there is very little information to go on after the accident. often they don't have a vehicle description or a license plate number. also, even if the suspect car is found, how do you prove who drove it? still, state officials believe the new system will make our streets safer. craig robinson hopes so, too.

>> you can get somebody to, you know, say, well, i just saw that car and it looks like the car you described. please get on it. >> hopefully can make a differen difference. in addition to freeway signs alerts may be seen on the television or the radio. the bill is exed to go into effect january 1st. paul walker's daughter is suing porsche. saying her father burned to death because the car was poorly built. the "fast and furious" actor was killed two years ago in a fiery crash in southern california. investigators concluded that high speeds and not mechanical failure led to that accident. at 5:26, coming up, inmate found dead inside his cell at the santa clara county main jail. this as three correctional deputies face charges in the death of an inmate last month. plus, two double homicides in two east bay communities.

new questions this morning about the already troubled santa clara county jail after the death of another inmate. >> stephanie chuang live in san jose with the very latest for us. >> notifying family and only after that will we learn details of this inmate. who he was and then likely take a little more time to learn how he died as investigations are conducted. but, a sheriff sergeant that a deputy found the inmate unresponsive in his cell about 10:30 yesterday morning and then half an hour later after first aid and cpr were given he was pronounced dead. this is the second inmate death here at this jail in about a month. michael tyree was dead in his cell on august 27th. he had been bebars for drug and theft charges. three correctional officers have been accused of killing tyree. 27-year-old matthew farris, jereh lubrin and rafaele.

two of those deputies have posted the $1.5 million bail and farris is set for a property bond hearing this afternoon. all three are set to be back in court for a plea hearing in just about two weeks. but, tyree's death has led to some changes. santa clara county supervisors since that time have unaninously voted to approve a new oversight committee and to expand camera surveillance systems at the two south bay jails. live here in san jose, stephanie chuang, "today in the bay." new this morning two men shot dead in richmond and now police trying to piece together what happened. that shot spotter recorded four gunshots around 8:30 on natalie court near san pablo avenue. when police got there, they found two men shot to death. so far police do not have a motive or a suspect in mind. but anyone with information is urged to call police. it is 5:32. in the meantime, deputies are investigating another double homicide this morning.

this one in castro valley. alameda county deputies got a call to check on a couple after one of the victims did not show up for an appointment. investigators are questioning a person they believe is related to the couple. that person was in the home when deputies actually arrived. two bay area men facing a a accusations they met through social media. over the weekend sheriff detectives arrested 25-year-old jose molina for lewd acts near skyline boulevard. the two met on facebook and last week former youth basketball coach julio ortiz was arrested for sexually assaulting a 14-year-old at a rest stop near interstate 280. the two of them communicated online, as well. investigators say they this should be a wake-up call to parents. >> we want to stress that parents need to stress what social media sites their kids

are using and who they're talking to. >> ortiz is set to be in court for a haerg this afternoon. a group of bay area lawyers making harsh accusations against berkeley's police force. release data later today that the group is proof of racial profiling and police stops in that city. the group has criticized berkeley's police department in the past, particularly for its response to the black lives matter protest that happened earlier in the year. dog sitter caught on video abusing dogs is expected to be in court today. linda leback is facing misdemeanor charges. prosecutors claim she was running an unlicensed service in her home. show her grabbing a small dog by itser and throwing it to the ground several times. for the first time, researchers found that africanized killer bees are in the bay area. researchers found killer bees in lafayette. the bee sting is no more lethal and their behavior usually no

more aggressive than their european honey bee relatives. africanized bees on occasion do kill. >> if you disturb a hive or a nest in which case they're easier to disturb and much more aggressive and persistent when disturbed. >> if swarmed, experts say run and keep running. they will eventually stop. experts emphasize such a attacks are very rare. now, on to the swarm of candidates and decision 2016. democratic presidential candidate hillary clinton continuing her trip here in the bay area today. this is video of her motorcade arriving at her first stop yesterday which was a reception in saratoga. today the former secretary of state will attend a fund-raising breakfast in san francisco. yesterday she went to an event in marin county as well as a third fund-raiser. happening today, tesla's latest vehicle rolls out of the

factory. deliver the first model x from its factory in fremont today. the all electric suv feature falcon wing doors that open vertically. the battery is lasting 50 miles per hcharge. sell for $80,000, slightly more than the model s sedan. >> you put those falcon wings on anything and all of a sudden it becomes pretty cool. >> even a minivan. >> even a minivan with triplets insidep. not everyone is pleased about the changing character. last night people lined up at city hall to voice their opinions about the latest development proposal. this one would go on marshal street near the historic courthouse. but many in the community say it's not a good fit for the area. >> we're not asking people to stop the growth. we just want to make sure that it's too fast, too soon. >> we are paying the price, literally, to do decent development on a regular basis. >> so, here's the bone of

contention. residents say that increasing traffic is going to happen and it's only going to get worse as development continues. last night the city council in redwood city decided to continue ksing the marshal street proposal. in the meantime in san francisco recently evicted seniors will get to sit down with the city's top prosecutors. many were forced from their homes vethe ellis act evictions. one group filed complaints back in may and hope to take legal action. the group and its supporters plan to a rally and address the media ahead of that meeting today at the hall of justice. san francisco mayor ed lee planning to put the brakes on a law giving cyclists more legal leeway at intersections. the law is what supporters call the idaho stop law because it was first enacted in idaho. it allows cyclists to treat stop signs like yield signs and red lights like stop signs. city supervisor john avalos introduced that legislation this month in response to the recent tug of war involving police and

cyclists. mayor lee is already warning the board to pect a veto if it approves that law. it is 5:37. took over the desk at the "daily show" promising to carry on the legacy of jon stewart. he got some pretty big laughs when he had a conversation with a correspondent about john boehner. >> this is john boehner. i mean, whoever takes job will fall flat on their face in front of the entire nation. >> yeah, i get how you're feeling. taking over for john is hard. >> i don't know about that. i can hear everybody saying, jon, please come back. >> jon stewart stepped down as the host after 16 years of lampooning politics and the media. retained much of his staff, music and the format. that's pretty big shoes to fill. >> he's a young guy, too. how old do eye think he is? >> i don't know. i'll look it up. >> when jon stewart started out

he was the same rage aage and l what happened. 5:38 right now and the footprint for your day. let's get a quick check of the temperatures with kari. >> start out around 60 degrees for most of the bay area. clouds in there, too. some fog, as well. especially near the coast that will have a hard time clearing out as we go through the day. look at gilroy, up to 79 degrees and half moon bay 65 degrees and 66 degrees in the financial district and also 66 in sausalito. in oakland, 70 degrees in dublin today reaching 85 degrees. so more clouds today and then we'll have more of this cool weather tomorrow before it heats up and time for the weekend. i'll show you all of that coming up in a few minutes. but if you're heading into san francisco, you may encounter some problems there. let's check in now with mike. >> this may affect the bay bridge traffic. south 101 at ceasar chavez. only the left lane blocked and

the bad news they don't know how long it will take to clear that. chp telling us over here. the big rig and another suv and also in lanes right now ask slowing on the approach. use southbound 280 to get out of the city, if you can. if you're coming off the bay bridge, that will meet you into congestion and the metering lights, of course, are on and traffic tuesday. we're expecting a bigume of traffic there. so far in the east bay, just your typical build for highway 4 westbound and 580 coming through livermore and nothing dramatic for hayward as well as north 101 through san jose and quick live look to show you the volume of traffic bursting on the scene here. that should kick in, again, about 6:30. coming up, we're running out of water here, but nasa has an out of this world idea about where we might find more. >> drought solution outside of this planet. a live look outside right now. san francisco, the bay bridge all lit up. folks getting ready to start off their work day.
