the east bay getting in on some wet weather as we get a look now at what's happening. some heavy downpours in a few spots and we've seen this streaming across the bay area the past few hours. looks like it will stay with us for a little while longer, through at least the morning and maybe early afternoon. we see light rain moving across parts of the north bay and we still have lots more where that came from. we will have more in the microclimate forecast. let's check in now with anthony to see how this rain may impact the roads. >> it is wet outside. this spot from san jose, you can see the sheen on the ground. it is wet and damp and, of course, we haven't seen rain like this, at least, well, since back in the winter beginning of the year. keep it in mind. it will be a little bit wet out there as that oil rises to the surface. south bay, no problem. same deal for the east bay. back to you guys. >> thank you, anthony. five more correctional deputies in the south bay on

leave this morning. more fallout from an investigation of the santa clara county jail. >> bob redell live in san jose with more on what we do know. bob? >> the santa clara county sheriff's office put three deputies on paid leave for the death of michael tyree that took place back in august. he was mentally ill. this was the alleged beating death and the three deputies face murder charges on. now, we learned that sheriff smith put another deputies on paid leave but she won't say why. the "mercury news" says none are in trouble for excessive force against inmates. sheriff smith also told the paper that her office is investigating in as many as 100 other complaints filed against her deputies against tyree's death death four weeks ago.

no definitive cause of death for another inmate. 33-year-old walter roches who was discovered dead in his cell on monday. no foul play or acute injury and could be weeks before an exact cause of death is determined. reporting live here outside the main jail in downtown san jose, bob redell. >> thank you very much. millions of californians with suspended licenses may have a chance now to get their license reinstated. governor brown signed a law back in june providing amnesty for those with unpaid tickets that starts today. here's how the whole system works. if your ticket fine was due by january 21 and you failed to make a payment after june 24th of this year, you could get a 50% to 80% discount on the remaining payment. plus your driver's license would be reinstated. for many, that opens the door to more opportunity. >> a driver's license can't get

to work. they lose their job. they can't get another job. so they can't pay the debt back. >> but if you owe money to a victim or you have a misdemeanor or a felony warrant or the ticket is stemming from a dui, you're not eligible for this program. the amnesty program is going to last through march of 2017. santa clara county is considering replacing its troubled ambulance provider world metro. while this goes on, cities and fire departments across the county say they want to be at the table providing input about any new contract. but the county says no plan will work unless the san jose fire department includes its response times. the department standard requires firefighters to get into a call under eight minutes. right now firefighters missing the mark 30% of the time. >> only having 70% responsive time puts the citizens of san jose at risk. and that's not good. >> firefighters say they need

more boots on the ground to improve their response time. the county says the board of supervisors will listen to all the sides at a meeting next week. our investigative unit has been looking into ambulance wait times over the last year. if you want to see the latest report head to nbcbayarea.com. a gift from the sky right now. two daze in a row. who knows. i mean, we could keep this streak going, kari. >> let's keep it going because we really do need it. so far the rain is measured in about 01 of an inch. we get a look at what's happening especially as you head over towards the south bay and east bay this morning. the rain continues to come down and we may see more where that came from. we had some measurements around gilroy up to about a quarter of an inch and then as you edup towards san jose, about 0.5. so, still not really measuring that much. if we continue to see this moisture streaming through, may have some more totals in the

bay bridge right now. and things are starting to out smoothly, even though there may be some slick spots on the road. you know when it rains, we get that oil rising to the top of the roads. so that may make things slippery. just be mindful that you have to slow it down as you head out. now most of the rain has shifted off towards the east, but there is that possibility that we could see more of that rain moving into the bay area as we go, once again, through the rest of the morning and early afternoon before a lot of this starts to shift off to the east. and temperatures start out this morning in the 60s and that's what we will see as we go into the afternoon just the very slow rise in those temperatures. and still some more of that rain in the forecast as we go through today. so, be sure to keep that umbrella somewhere close by. a look at the futurecast and what we are expecting as we go through the rest of the day. now, the rain that we are seeing now kind of shifts off to the east. and there will be more rain developing as we go into the afternoon. here we are by 9:00, another round of rain moving through san jose.

and it could be very heavy. also for most of the south bay moving over towards the east bay, not a lot over towards san francisco and then farther to the north. and then we'll see some clearing as we go into tonight. some of the rainfall totals still, once again, at about 0.01 for union city and almost a quarter of an inch for livermore and xloes close to half an in i jose. temperatures only in the 60s and 70s in the bay area with a chance of rain throughout the morning and east bay highs in the 70s and union city 68 degrees and pleasanton 68 degrees, yes, because we will still see some rounds of rain moving through. let's check in now with anthony and see how things are going on the roads. >> oh, 68 degrees in the middle of what is fall now. still, it's still summer for the bay area. we know how that feels like. the roadways are still a little wet. keep in mind as kari mentioned. see things moving smoothly here. no issues and traffic is starting to build.

china's slow economy and earningi earnings could weigh on the market. stocks ending sharply higher on wednesday with the dow rising to 16284. the nasdaq up 102 to 4620. twitter is reportedly expected to name co-founder jack dorsy as its permanent ceo possibly as soon as today. dorsy serving as interim ceo since july. he will also continue to run square, the digital payment company that is expected to file for an ipo this month. this would be dorsy's second go around as twitter ceo. he was fired from the job in 2008. microsoft is said to open its first flagship store in new york city. the five-level store located on fifth avenue several blocks from apple store in manhattan. including an answer desk for technical help and repairs and a community theater where customers can continue to use microsoft products. back over to you.

>> thank you very much. in under the wire. democrats and republicans approved a spending bill late last night before the midnight deadline. the bill will keep the government open for at least a couple months. for a while it wasn't clear if the bill will pass as both sides disagreed over funding of planned parenthood. but the bill was passed with no cuts to the company. it finances the government through december 11th when democrats and republicans might face off in another shut down slow down. >> laura, it is yet another scandal for the secret service this morning. this time it's reaching all the way to the top levels of that agency's leadership. a new report finding that the secret service assistant director ordered a leak of information to embarrass utah congressman jason shafs. it was reportedly in retaliation for the republicans aggressive investigation into the agency's misconduct. the secret service is now apologizing for improperly accessing agency records. three more women are coming

forward and accusing comedian bill cosby of sexually assaulting them. attorney gloria allred introduced the woman during a news conference in los angeles yesterday. the women claim they were drugged. >> when i came to, again, i saw two other naked people in the room by the bed. bill was sitting on the side of the bed and i had blocked out, again. >> after a while, mr. cosby touching me and rubbing my leg. the next thing i remember, i was walking, waking up in my car. >> bill told me to close my eyes and to use my imagination and then and then he tried to kiss me like a boyfriend would. so, i pushed him away and i said, what are you doing? >> the women cannot take legal action against cosby because of the statute of limitations on sexual assaults.

making its way towards the east coast right now. hurricane joaquin has a lot of people talking. >> especially back there on the east coast. kari has a look at the forecast. >> yes, it is huge as it continues to move over towards the bahamas. this is a very large storm and it has blown up to a category 3 status as we've gone through the overnight hours. now the wind speeds up to 120 miles an hour. and while we're celebrating

rain, well, they really don't need it, especially when it's been so wet and then you have the possibility of hurricane moving in. here's a look at the track as we go into early next week. all eyes will be on this system for the east coast. let's check in now with anthony to see what is hang here at home. >> wow. hopefully not a repeat of what we saw for sandy. get out, people, get out. talk about what is happening here across the south bay. things are looking good. i want to take you across the east bay, as well. just show you a broad stroke of what's happening. no accidents you can pick out for yourself where things are going on. continue to have a little construction in san leeaandro a things looking good. even for a dry day we don't get away with the few accidents, but, hey, we'll take it on a rainy day. people outside right now need to take note of this. get ready for a curfew in a popular san jose neighborhood. the grand staircase the one on communication hill will soon be regulated like a park can be.

police can send people home after hours. that site is a hot spot for runners and athletes during the day. but by night neighbors say the steps are plagued with drugs and alcohol abuse. right now, staircase is public and it's open 24 hours like a street would be, but a new bill signed by governor brown this week allows san jose to classify it as a park or a trail. >> the hope is that they're going to use that power to be able to come here and say, okay, look, nighttime, we need to shut this place down. >> the city staff is recommending the steps be open from sunrise to about an hour after sunset. city council is expected to make that decision on curfew hours in january. it is 4:56. teaming up to help victims of the valley fire. together they'll build 4,000 boxes to help victims pick through what is left of their burned down homes. in the meantime, the wine

community raised $70,000 for the victims of the valley fire at a benefit last night. there was plenty of wine, food, entertainment and a silent auction. people from all over the bay area came. >> well, the cars are lined around the block and it's a blessing. we see a lot of neighbors and we see a lot of friends from san francisco, san jose and palo alto and napa valley. >> our hope is to rally some energy and emphasis to these communities over the long time so they know they're not entirely alone when they're rebuilding. >> more than 1,200 homes were destroyed in the fire. great to see the communities coming out to help. >> if the wine means the donations are flowing a little more, too. that's a good thing. digging yourself out of a hole filled with unpaid traffic tickets. if you let those fines lapse and maybe lost your license, a new amnesty period kicks off today. and finding justice. following the death of two inmates at the santa clara
