"today in the bay" starts right now. and a good tuesday morning, thank you for joining us, i'm sam brock. >> i'm laura garcia-cannon. let's get to the forecast with meteorologist kari hall. >> clear skies and some of us are seeing some low clouds this morning. as we go into the rest of the forecast.

we will see some of the clouds starting to clear out as we go into the afternoon. a look at those temperatures now. we are in the upper 50s and near 60 degrees and in through the afternoon, expect highs to top out in the 70s and 80s all across the bay. i'll give you a closer look at the microclimate forecast and let's check in now with mike to see what's happening on the roads. >> almost all of the bay looking great right now. slowing from the overnight road crews. that's clearing. but this is starting to back up south 880 through san leandro. traffic flows down to one lane southbound towards davis and that's where we see the slowing already. we see the build up until we clear it. the allegations are shocking and today we could learn more about the allege inmate abuse happening behind the walls of sonoma county jail. >> more on the federal complaint, kris, expected to be

filed later today and some of these allegations, if true, are gut wrenching. >> want to get our hands on those documents. contain hours of alleged beating and some of which a santa rosa attorney claims was caught on video by the very guard accused of that brutality. these are the claims from sonoma county inmates allegedly mailed to a bay area lawyer via letters. he is the one that is filing a federal complaint on behalf of some of them today. those alleged beatings allegedly happened on may 28th of this year according to a press release sent to us by the santa rosa criminal defense and civil rights attorney. now, at a press conference today, he is expected to elaborate on those letters that he says he received from more than 20 inmates. one inmate claims on may 28th he was thrown to the ground, cuffed and beaten and that guards, some of them dressed all in black

used tasers on him and locked him in isolation for two daze naked and covered in his own feces. reading in part that we have that for you, as well. the correctional deputy responding to the actions of a seeming lly coordinated mass disturbance inmates house a segregated administration. between the time that we received this information from the filing attorney and this morning we have not been able to independently confirm these details for us. we are working on that and we will be at the press conference scheduled for 11:00 this morning, in the meantime, making a lot of phone calls. laura? >> we know we'll be busy on that. interesting. developing story in the north bay for a popular hiking trail is now a crime scene this morning. deputies say a hiker's body was found last night with a gunshot

wound. it happened in fairfax. deputies say a dog was also found near the body, but the dog is okay. so far the victim's identity is not being released. the trail and the surrounding area will be closed today as the investigation continues. laura, the search is on right now for a missing tech worker last seen near livermore. 31-year-old worked for sales force and he was on an outing with co-workers friday night. those co-workers tell investigators they were on a lake in a boat when that boat started taking on water. none of the eight people onboard were wearing life jackets at the time. >> at some point the boat started taking on water and everyone jumped out of the boat to swim to shore and when everyone got to shore that's when they realized one of their party was missing. >> this happened four days ago friday night. teams have searched the lake for four days with no success. according to her linkedin page started working a sales force back in april.

company management issued a statement saying it is aware of the investigation and the thoughts of the company are with his family. it is a controversial a law as there is. allowing doctors to help terminally ill people in their own lives. governor brown signed it into law yesterday. allow doctors to prescribe lethal drugs to patients who expect talive six months or less. the bay area woman gained international attention when she moved to oregon last year to take advantage of that state's right to die law. the california law will take effect next year. but there are some key requirements that must be met. patients must have approval from two doctors. they must have six months or less to live and swallow the medication themselves. they must also have the mental capacity to make mental decisions. improving emergency response. santa clara county supervisors will discuss replacing troubled

ambulance services. city and fire departments across the county give input during a board of supervisors meeting. struggled with finances since it reorganized under bankruptcy in 2013. no plan can work unless fire departments can improve their response time, particularly san jose. requires firefighters to get to a call in under eight minutes. right now the county says  firefighters are missing that mark 30% of the time. it's 4:36. early on a tuesday morning. let's check the forecast. nice start to our day, kari. >> nice start and it will have a nice finish, too. we are in for another beautiful day. kind of like yesterday with all of that sunshine and still the comfortable temperatures. but we will have a few more clouds this morning, especially as we get things started. it's 58 degrees in oakland and 60 degrees in sunnyvale and san jose. highs today in the low 80s in the south bay. the peninsula in the 70s. but still 67 degrees in half moon bay and the embarcadero and

santa rosa up to 82 degrees today. and the tri-valley near 80 degrees. let's check in with mike who has a slow down in the east bay. >> kari, the same area, but the opposite side. this time this is 880 oakland. the opposite side of the roadway. at 9 you're jamming up and folks moved to the left lanes. all the way down towards davis street and that is causing our backup on this map. there is a build. starting to build as you're heading down towards into san lea in,l leandro. the rest of your bay is clear, guys. >> thank you, mike. coming up next, could it get any worse for flood victims? in short, yes. the storms have subsided but the flooding remains. a live report from south carolina where people are trying to cope with rivers of water. ==laura/2shot== people are

being told to stay home -- as floodwaters consume south carolina this morning. while the deadly a developing story this morning. people are being told to stay home as flood waters consume south carolina this morning. while the deadly storm has come and gone the threat is far from over. >> dave wagoner joins us live in columbia which is seeing some of the worst of it. and, dave, much of the state is under water right now. maybe the water hasn't even crested yet. >> yeah. that's true. in some areas, you're right. 18 dams have been breached so far statewide. nine in the midlands. that's the columbia area. they're trying it in some places

to do these controlled breaches to try to release some of the pressure. to give you an idea of where i am right here, we're in an area called forest drive, a major thoroughfare. they have closed the road and closed the bridge behind me. been a dangerous few days. 11 people dead in south carolina. two in north carolina, who have been killed. residents have been forced to flee, really, at a moment's notice. at this point, more than 500 roads and bridges remain closed. bridges are washed out all around the area here. there is very little clean water. more than 40,000 people are without clean water this morning and many people spent the night in shelters. the curfew is canceled at about 6:00 eastern time here, but they are suggesting that people stay off the roads if at all possible because there are just too many obstacles and too many to get around. classes are canceled for students. more than 30,000 students are

does this feel to anyone else like the summer just woo whooshed on by. >> are you missing it, sam? i could bring it back. >> where did it go? >> it's coming this weekend. if you're ready. >> it's been nice and cool, though. i've enjoyed it. yeah, warmer weather moving in in time for the weekend. as we take a live look now at san jose. we're starting out with mostly clear skies, but we will start to see some clouds moving in, even to the south bay as we head towards sunrise. expect that for a few hours and then it clears out to give us another sunny afternoon. as we start out now, it's in the 50s and 60s. we're at 53 degrees in the north bay and 62 degrees in san francisco. here's a look at all the highs today. 78 degrees in the east bay. the peninsula 76 degrees.

and san francisco up to 68 degrees. as we go hour-by-hour in oakland, still clear at 6:00. but you see the clouds with us through most of the morning as temperatures warm up into the mid-60s. eventually the highs making it into the low 70s today. and a bright, sunny afternoon with the light wind coming in. and, of course, it's fleet week. air practice happens today. it will be 67 degrees in san francisco this weekend. some of the big air shows going on and it will be in the lower 70s and mostly sunny skies. we had a nice, cool start to the week all because of an area of low pressure that has been slow to move. we will have patchy, coastal fog this morning and some clouds. but by the end of the week, we've been talking about summer coming back. here's the reason why. high pressure will be building and it will also warm up our temperatures between wednesday and friday. so, this weekend, that's when summer will be back with highs in the low 90s. the peninsula will be up 25085 degrees and 92 degrees in the

tri-valley. you see the temperatures coming down a few degrees as we head into sunday with more clouds moving in across the bay. mike's got a traffic heads up for you if you're about to head out the door. >> that's right. 880 is stopped right now right behind me southbound at 98. a traffic break has been going on for three, four minutes now and they have that construction crew. you see that just south of there at 98. looked like this morning what they're doing is stop all the traffic and get that cleared quicker than yesterday, which was kind of a painful clearing. we'll look for that. san leandro boulevard. take you on the other side of the coliseum and eastbound 580 is your alternate. san leandro boulevard is a better route. hopefully that clears in the next few minutes. slow through livermore and overnight road crew clearing there and the rest of your bay is at speed, guys. send it right back to you. >> we'll take it right from here. thank you very much, mike. fedex is raidsing its fuel surcharge for the second time this year and, what do you know,

just in time for the holidays. >> how will that affect you? for more on that and the rest of inn the news before the bell, we turn to landon dowdy. >> hey, sam and laura, good morning to you. the markets will look to extend their winning ways following monday's big rally and futures are lower ahead of the open. stocks surged adding to friday's gain having the best day in nearly a month. the nasdaq managing to close out of correction territory and has been down more than 10% from recent highs. look for data today on the trade deficit and earnings from pepsico. the dow rising to 16776. the nasdaq up 73 to 4781. fedex is raising its fuel surcharge for the second time this year. the move effective november 2nd was quietly announced and comes as retailers and shippers are gearing up for the holiday shopping season. while gas and debt fuel prices have dropped in the past year, fedex says the increase is in response to heavier packages and a rise in residential deliveries

which use more fuel. microsoft is holding an event in new york city today to unveil new products. the company is expected to show off new smartphones that run windows 10. also expected to unveil a new surface pro tablet with a bigger screen. a wearable fitness device and more information on its virtual reality headset. developers will get their hands on next year. just in time for the holidays. guys, back over to you. >> we should call yours the holiday report. every day you're giving us great ideas. >> thanks, landon. nurses planning to walk off the job this morning in contra costa county. the regional medical center and several clinics are going on strike today. among their complaints is staffing. they say that there is not enough nurses to safely treat all patients. this morning the nurses will march to the contra costa county board of supervisors meeting to make their point. south bay phallfal faculty

jose state. dozens of faculty will march through campus this afternoon. the entire faculty is holding a strike authorization vote this month. asking for fairness for faculty, students and staff. nevada is paying up for dumping patients on the streets of san francisco. you may recall a nevada psychiatric hospital sent dozens of patients to san francisco with a one-way bus ticket. yesterday, nevada agreed to pay $400,000 to settle the case. city of san francisco filed a lawsuit back in 2013. the suit claimed that nevada hospital sent 500 patients to california. 24 of them to the city. the patients were told to call 911 once they got there. an investigative unit exclusive. they signed up to serve our country, but this morning the question is, has our country served them? >> several members of the california national guards say that answer is no. they talked with nbc bay area

chief investigative area about the guard failure to process critical paperwork delaying their claims for benefits. >> good morning. imagine serving our country putting your life on the lines earning medals and accommodat n accommodations. now imagine needing help because you were injured in the line of duty. imagine having your calls for help sit on hold for months and in some cases more than four years. that's exactly what happened to members of the california national guard. we talked with several and we conducted a deep dig in the data provided by the california guard. the official term is a line of duty investigation. it could open the door from the military's version of disability ben fits. we found as recent as 2013, the california guard had 1,300 overdue and incomplete lod investigations. a number that led the nation. our analysis also found during the past six years, 73% of all completed lod investigations were late. not meeting the military's own required time line.

well, what will the weather hold for us today? >> you just winked at me, which means something is good in the work. check in with meteorologist kari hall. >> it will be a great day, we'll have some great weather. we'll be in the 80s in the south bay today. san jose up to 82 degrees and palo alto 79 degrees and 78 degrees in napa and oakland 74. we will have more clouds than yesterday. and in some spots, we will have some slightly cooler temperatures. we're getting ready for a heat up later this week. let's check in with mike who is keeping an eye on the east bay. >> we'll talk about the two worst places by the bay. first one south of the coliseum between 98th. look at that. those folks are stuck and everyone else is bailing off of the freeway and getting over to san leandro as they clear the

crew. we'll look at the map and that's causing the big jam up to davis street. meanwhile, the rest of the bay moves smoothly for the speed sensors but a crash 92 westbound we'll take a look. these folks will see the transition to 101 closed for the time being because of the crash over there. mike, back to you. >> thank you very much. the city of san jose is reportedly going to go back to the drawing board to come up with a workable plan for ride sharing companies who are operating or like to operate at maneta airport. a big sticking point keeping the new ride sharing pilot program from actually taking flight. the city of san jose is requiring federal background checks and involving extra scrutiny like fingerprinting. sources tell the murk until that issue is ironed out, ride sharing companies likely won't be jumping onboard. san jose airport the only major bay area without a plan in place for companies like uber and lyft. a noisy issue will now

reportedly be decided by voters. some residents are tired of the sound of leaf blowers. they had been debating a ban not only for parks and commercial areas, but for homes. not just gas powered blowers but electric, as well. yesterday the council decided to reject the ban and, instead, make it a ballot measure some time next year. putting away the fine china for a second. fuplay mignon served on a paper plate. the reality for restaurants in fort bragg. they declared a water emergency last week. under that area's new rule, residents can't water their lawns or landscape at all. okay. and restaurants and hotels have to start using disposable plates, cups and flatware to cut back on dishwashing. fort bragg officials say the primary water source has gotten so low that ocean water has started seeping into the pipes.
