been an issue the last couple days. we see slowing like we did monday and tuesday heading over toward the maze. that's the only slowing we see in the east bay. look at that. nice smooth flow. a build by the tri-valley and south of here peninsula and south bay moving just fine at speed as you would expect. back to you. >> thank you very much, mike. overnight police question a person of interest who they think may have had something to do with the death of a woman right in the heart of san francisco. >> it happened not too far from a popular tourist destination. "today in the bay's" bob redell live with the very latest. >> reporter: laura and sam, police here at san francisco police headquarters do tell us that they did as you mention take a person of interest into custody. they have been interviewing this person at their station in the tenderloin. around 8:00 last night that officers responded to a call of a possible shooting. this was on the 100 block of mason off market. in a residential building. when they arrived they found this woman who had been shot in the upper body.

police performed cpr to try to keep her alive. unfortunately she died at the scene. again, they did take into custody one person of interest. police have not indicated yet what the motive might have been and whether this was targeted or random killing. they did say they might be releasing more information later this morning. reporting live in san francisco, bob redell, "today in the bay." >> thank you very much, bob. police in berkeley reopened a couple roads that were closed overnight for a shooting investigation. happened close to malcolm x elementary school near russell and california streets. they say someone fired several shots about 8:30 last night and someone was taken to the hospital but we've not been told about the victim's condition this morning. for a while people were told to stay inside while police searched for a suspect. that order has since been lifted. new details and a new clue in the desperate search for a killer. this surveillance video shows people who might know something about the well known workshop instructor shot to death on a

popular hiking trail in fairfax. >> stephanie chuang is live in fairfax this morning. police are calling those people persons of interest in this killing. >> reporter: they are. here at the trail you can see the crime scene tape is gone but there's a note posted by the marin county sheriff's office asking for the public's help in searching for these three persons of interest. they were around here 6:00 monday night when the deadly shooting happened. surveillance video in fairfax shows two of them, a man wearing a white hat with what appears to be a california bear on it and a woman with dreadlocks. now, deputies do not release images of the third person of interest but a man wearing a brightly colored t-shirt. the victim, 67-year-old steve carter was a well known instructor. he had recently come to say in marin county with friends along with his wife because she was getting breast cancer treatment here. search and rescue crews scoured the area in the open space looking for more evidence yesterday. a scene that shocked regular

hikers here. >> i grew up in the area. i remember the trail side killer and that kind of period where it was sort of frightening to go out in the woods. that was sort of the same feeling i had. >> reporter: this is a picture of what the victim's car looks like. 2003 silver volkswagen jetta hatchback with california license plate 6ppg662. investigators believe that it was taken by the killer or killers and say if you see the car or the persons of interest, give them a call. stay away because the people in the car may be armed and dangerous. carter was found along this trail about 100 yards down from where we are still holding onto a leash from his dog who was shot and is at last check still in critical condition. live here in fairfax, stephanie chuang, "today in the bay." >> the whole sequence of events heartbreaking there. thank you very much. many questions this morning about what led to the death of a

local construction worker in san jose. he was at a new housing site near bruce way in san jose yesterday afternoon. he apparently was struck in the head by an excavator. deputies say it appears to be an accident. coroner's office has not released the name of the victim and cal osha is investigating the work site. a cloud of dust leading to a cloud of controversy. people who live nearby say it's a health concern. >> "today in the bay" kris sanchez is live this morning. neighbors want to know what's in the pile and how soon will it go away? >> reporter: believe it or not, this is supposed to be a pumpkin patch at some point in the not too distance future. instead of a sea of orange pumpkins there are blue tarps and piles of debris and as you said the people who live here want to know what's in it. samtrans owns this land. there are old sewer and water

pipes from a nearby project under those blue tarps and head of the east san carlos neighborhood association said winds picked up and blew dust into the neighborhood. some of the people live here tell nbc bay area they've been coughing and wheezing and the association president says he has a hand tremor he didn't have before. >> i saw basically what was a brown plume of dust coming into our neighborhood. the air smelled terrible. we've been told the materials have been tested by an outside agency but we haven't gotten results back as to what's in the land yet. >> reporter: so who dumped the debris here? according to samtrans it was a contractor. while the city has not responded to our request directly, the vice mayor did say there's no indication the debris poses a

public health threat. perhaps adding insult to injury for the neighbors here, these piles they can't even be moved until the city knows what's in them. the dump wasn't accept the debris. kris sanchez, "today in the bay." >> quite dangerous there. thank you. it's 5:07. people who live near a proposed bay area green cement plant will have a chance to offer their input on a plan tonight. a company base d in ireland wans to place an environmentally favorable concrete facility. it would be built at the site of a former flour processing plant. tonight's meeting is held at the john f. kennedy library in vallejo. a ship to blame for a dead whale found in fremont but it's not clear if that's what killed the whale. the carcass washed ashore at

coyote hills regional park two weeks ago. the mammal had a spine abnormality making the whale susceptible to running into a ship. the exact cause of death whether starvation or illness is unknown. it's the eighth whale stranded in the bay area just this year. one of the worst fires in state history is fully contained. the valley fire was fully surrounded yesterday. they were mopping up hot spots in the containment zone. the fire burned more than 76,000 acres in lake, sonoma and napa counties. four people were killed and nearly 2,000 structures destroyed. more than 1,200 of those were homes. it will be harder to find parking at a bay area weekend hot spot now. on tuesday the marin county board of supervisors approved severe parking restrictions. hundreds of cars park along the shoulder of the road on the weekends making it treacherous for people trying to pass. starting in 30 days, shoulder

category 2. over the next couple of days it makes a run for the northeast and by the end of the week it is right off the coast of oregon but will not make landfall over the cold waters it will continue to weaken. this may be spreading rain toward oregon. as we look at futurecast, we see what radar and satellite can look like over the next couple of days. we see rain moving into the northwest. they look at quite a bit of wet weather for the weekend. we're hoping some of this could make it into at least northern california but it looks like it stays away at this time and even into the start of next week all dry weather as we get ready for columbus day. it will be heating up by friday. we'll have warm temperatures. temperatures coming back down as we head toward the end of the weekend. >> we'll show you san rafael and a smooth drive here and easy flow of traffic. we'll look to the bay bridge where we have cash lanes starting backup.

trip. police say she was struck in the head. no word on any suspects. the numbers are bleak. the san jose police department needs recruits but the response so far very lackluster. only 10 cadets are joining this latest academy class. 13 cadets enrolled in total but three have dropped out. the last class only graduated 18 recruits. the vacancy rate for the department right now sits at an all-time high. san jose's police department is trying to a ing ting to rebuild. later today, santa clara county will take applications for the blue ribbon commission. 25-member commission will create a top to bottom evaluation of the county's jail after three correctional deputies were charged in the death of an inmate back in august. families of inmates that say they were abused at sonoma county jail are detailing what they say were heinous beatings.

a federal lawsuit on behalf of those inmates was filed against the sheriff's department this week. the suit claims the abuse took place for five hours during one day back in may. inmates say the deputies wore ski masks and black clothing and allegedly went cell to cell kicking and punching them. the mother of one of those inmates recounted what her son said happened. >> the deputy said if he heard one thing from me that they would come back and beat me. >> the sheriff's department is denying the allegations saying the correctional deputies were responding to a coordinated mass disturbance by inmates. the lawsuit is seeking unspecified damages. the search for a missing tech worker is now temporarily suspended. his family and his co-workers fearing the worst. he was last seen near livermore on friday when he disappeared during a work outing for sales force. the boat he was in capsized.

neither he nor his co-workers were wearing life vests at the time. after four unsuccessful days, search crews say they need a break. no word on when that search is set to resume. new video of a close call and a miscalculation by one north bay homeowner that forced his neighbors to have to evacua evacuate. a man started cutting down a tree last night before it came down all of the way he realized it was headed in the wrong direction right toward power lines. the crews managed to redirect the tree and bring it down safely. neighbors only returned to their home late last night. is it toxic? that's what residents want to know after dust from a dump site floated into a nearby neighborhood. >> what's it like out there? any smells? what exactly is behind you?

american women worked in factories and shipyards during world war ii. >> this is a big day. important. inequities have burdened women forever and slowly being resolved. >> no question it's an issue on the national front as well. starting on january the 1st, employers must prove that a man's higher pay is based on factors other than gender and it protects workers from retaliation if they ask how much other people make and it makes it easier for workers to sue. many believe that california's work is just getting started in ending gender inequality in the workforce. state senators are going to travel from sacramento to hear about the barriers that women typically face and the policy changes that might improve the situation.

supporters point out that 40% of working mothers are now the sole source of family income across california. at last a definitive turnaround on a troubling statistics causing concern in marin county for years. the latest numbers find marin county recorded 130 breast cancer cases for every 100,000 women in 2012. that's 31% lower than 2001 when it was 188 cases. at that time those were the highest rates anywhere in california. researchers cite a change in behavior as a possible explanation. >> in 2003, the women's health initiative published results saying hormone therapy was dangerous. we saw breast cancer rates drop very rapidly not only in marin county but in other parts of the country. >> the cancer prevention institute has been tracking breast cancer rates since 1988

and as you may already be aware, october is breast cancer awareness month. ovary transplant after a cancer diagnosis could preserve the fertility of female patients. researchers followed 41 women who had ovarian tissue removed, stored and transplanted back in. no tumors developed in the transplanted tissues. no more breaks for the banks. wall street's major players may lose protections that shield them from major class action lawsuits. if you read the small print on financial agreements, you are signing away your right to sue. arbitration is still allowed but critics accuse financial companies of sidestepping the courts. later today the protection bureau will propose new rules preventing customers from

signing away those rights. supporters expect stiff opposition to that plan. >> rough seas on the stock market but this morning a bay area company will jump in with an ipo. >> markets have not been kind so far to new companies. >> no. pure storage out of mountain view will most likely start trading today on the new york stock exchange. the company makes data storage devices. the stock price last night at $17 a share. only 19 tech companies have gone publicly at all this year. fitbit trading well over 36. shopify doubling. here's the rest of them, sunrun trades at 11. etsy is a disaster. bill gates joined a funding

round to impossible foods. they show this picture on their website of what appears to be a delicious cheeseburger apparently made from plants. this is not the first time gates invested in such a thing. he's also been an investor in hampton creek. it's making mayonnaise and cookie dough out of vegetables. we'll see what they can do with this. it's not so much a vegan or vegetarian thing as it is a sustainable thing. it's easier to grow plants than to grow cows. >> with the drought recently, it's tough in the state of california. >> tough everywhere. >> good observation there. thank you very much, scott. when is the last time you went to chuck e cheese? soon it will be for moms as well. the chain is hoping to win over millennial moms by testing cappuccinos and expanding its beer and wine options. they added gluten free pizza, thinner crust. the average child wants to visit

let's go hour by hour in livermore. we will see the clouds at least to start at 6:00. we're at 58 degrees. we go from the 50s quickly into the 60s and then into the 70s. you see how those temperatures are jumping by every couple of hours by about ten degrees and by 2:00 we're going to stay in the 80s and we'll stay there for a few hours before we see the clear skies and then clouds rolling back in later on this evening. a look at all of the microclimates. still nice and comfortable. average for the beginning of october. gilroy, 84 degrees. redwood city, 78 degrees. and also a lot of sunshine in napa. 79 degrees. hayward, 76. livermore today will be topping out at 83 degrees. it's fleet week and we've got a lot going on there from today 69 degrees in san francisco. air practice starts tomorrow from 2:00 to 4:00. it will be in the lower 70s and by friday the parade of ships low 70s and also we keep those 70s heading into the weekend.
