hillary clinton's tough talk as she breaks with president obama on his talk with asia and a move critics are calling a major flip-flop on her part. andrea, good morning to you. >> reporter: good morning, savannah. hillary clinton has split from the president, coming out against his new deal on asia. and today clinton is also proposing tough new wall street regulation, putting her closer to bernie sanders and going far beyond anything that the white house has supported. with the nomination in the balance, what's happened to the team of rivals? barack obama's former secretary of state has now broken with her former boss, opposing his high priority trade treaty with asia, even before she had read it. >> what i know about it as of today, i am not in favor of what i have learned about it.

i don't have the text, we don't yet have all the details. i don't believe it's going to meet the high bar i have set. >> republicans immediately cried flip flop as secretary clinton called the treaty the gold standard in trade agreements, although before the details were negotiated. the move neutralizes bernie sanders, a long-time opponent. >> i'm glad that she reached that conclusion. this is a conclusion that i reached from day one. >> and it puts joe biden on the spot. if he reasons, he'll have to choose between organized labor and the president. the trade decision is clinton's most dramatic break from obama. this includes coming out against the keystone pipeline, going far beyond the president on gun laws and criticizing the white house for deporting so many undocumented immigrants. as joe biden weighs whether to run, there's no criticism of a biden ad set to run next week. >> by focusing on my sons, i found my redemption.

this morning the south carolina is back in the bulls eye. battered coasts damaged by 22 inches of rain are now preparing for record amounts of floodwater flowing from the interior down to the ocean. >> we want to you understand that we've got another wave coming that we just need to be careful of. >> reporter: officials say 62 dams around columbia are still at risk, but the national guard has been dropping sandbags the size of boulders into the river to hold back the water. homeowners near the beaver creek dam are relieved. >> i think like this is something that's going to be able to be managed from here on out. >> reporter: as the water reseeds, stories of heroism and bravery are surfacing. >> i went down in the water. >> reporter: clara and her grandson clung to a cross after her car skidded into a ditch near a church. he took this video and they waited five hours until rescuers finally pulled them to safety. the national guard has deployed

more troops to the impacted areas. 5,000 are expected to be deployed into those areas by friday. 17 of south carolina's 46 counties are declared national disasters, which means the victims can get federal aid. >> kerrey sanders, thank you. >> we are learning more about oregon and what the first officers on the scene were facing. police sergeant and the detective were justified in using force when they ran toward snyder hall and shot chris harper mercer as he stood in the doorway firing at them with a handgun. >> the gunman didn't injure any additional students once they arrived on the seen.

with doctors without borders international president to apologize and embassy press his condolences. despite the gesture, doctors without borders is not demanding the attacks to be dropped as a possible war crimes. >> the top republicans gather to choose their candidate for speaker of the house. mccarthy currently serve as house majority leader. more conservative members are pushing florida's danem webster, utility tau's jason chaffetz is also running. the full vote will take place before the house on october 29th. >> a tanker truck flipped over a guardrail on the new jersey turnpike and burst into flames. >> it felt like i was starting to burn my arm and my leg being as close as i was. >> reporter: a thick, black

cloud of smoke rose from new jersey turnpike wednesday afternoon as kevin howard tried to save the man inside the burning tanker truck. >> i wand to get the guy out but being a tanker and as big as the explosion was, you can see where i got was as closed as you could get. >> the dash board howard on howard's truck caught the whole accident on tape. he says a pile of mattresses on top of a van broke loose and vehicles swerved to avoid them, including the truck's driver, before missing a small suv and flipping offer a guardrail. the tanker burst into flames. howard tried to run to the diver's aid but the heat from the driver was too intense. >> i got a good luck at the cab and whatever was left was already gone. >> police later pronounced the driver dead at the scene.

>> whether he intended to or not, he saved those people's in front of him lives. >> thankfully no other reports of injuries but absolutely fright i don't know. >> and another video show as 17-year-old girl rolling out of a moving car. police are hoping the video will help police. you see the back door open and tumble out of that car. she said she was walking to school when the driver lured her into that vehicle and then attacked her. the victim bailed out when she got that chance. it unkno it's unknown if the teen-ager knew her attacker. >> and a worker was left

dangling off a bridge over a ship's canal. the man was in some kind of a harness. crews opened up a manhole and eventually lifted that man to safety. no word on how he got there. and on a much lighter note, the chicago cubs are moving on to the next round of the playoffs after a big win over pittsburgh in the national league wild card game that had plenty of fireworks. rookie kyle schwarber hit a two-run homer. and the cubs go on to win it. gathered outside wrigley field in chicago to celebrate the win,

this afternoon. now it's right at about 60 degrees or approaching 60 degrees with highs today mostly in the 80s for the inner bay as well as parts of the knnorth ba. san francisco at 72 degrees and the tri-valley, a high of 90 degrees this afternoon. mike? we're looking toward a crash in san jose, at the impact. we don't see the two motorcycles there, trust me. look at that different flow of traffic. it's somewhere at the interchange. you're jammed northbound 280 coming into the area. looks like southbound north 880 is see the traffic slowing. that's a tough south bay drive. we're looking at a slow southbound drive for hayward into fremont and building toward the peninsula. the upper east shore slow, same thing for concord.

7:30 on this thursday morning, 8th of october, 2015. it's a pretty fall day here on rockefeller plaza. thank you for starting your morning with us. >> let's see what's making headlines this morning. hillary clinton made a break with the white house, saying she opposes the new pacific trade deal between the u.s. and 11 other nations. as secretary of state, clinton had supported the deal. president obama has called the head of doctors without borders to personally apologize for the u.s. bombing of its hospital in afghanistan. at least 22 patients and staff were killed in that attack six days ago. and the coast guard has stopped searching for survivors from the cargo ship that sank

off the bahamas during hurricane joaquin. the cargo ship had 33 crew members on board. coming up, the newest powerball winner already gave up her day job. maybe she can learn how other winners before her spent their money. >> i liked to hear about that. but let's begin this half hour with the magazine. if you pick up "people" magazine, you'll notice a different headline. they have a call to action of sorts. stephanie gosk has more on that story. >> good morning. the mass shooting as an oregon community college last week has reignited the debate over one of the most contentious policy issues of our generation, gun violence. president obama will travel there on friday to visit with families of the victims. but the trip has angered locals who say obama is not welcome, using his visit to gain support for his gun control agenda.

now, "people" launched itself into the debate as well. >> reporter: "people" magazine has a message for the people, rise up, reach out and tell congress to do something. >> one thing is very, very clear, and that is as a country, we are not doing enough about gun violence. >> reporter: "people" posted and published the contact information for all 535 voting members of the senate and the house, along with this fact. over 10,000 people have been killed this year alone by guns. editor jess indicational says the idea was inspired by possible's speech following the shooting in roseburg, oregon. >> somehow, this has become routine. >> i was watching president obama give his speech, and when he got up to speech, i rolled my eyes and i thought, oh, here he is again. there has been nothing done about the last mass shooting. >> reporter: indication kagel says this is nothing about an agenda. >> i think any time you try to start a conversation, some people take it as, you want to take away my guns, or you want to take away my liberties. i was careful not to take a side.

>> reporter: the sides are already well staked out, echos over and over on the campaign trail this week. >> the idea that you need more guns to stop people who are committing mass shootings is not only illogical but offensive. >> name a case where gun rights being restricted out of washington would have changed the course of any of those cases. >> reporter: kagel says he's tired of the rhetoric. >> let's hold our representatives' feet to the fire and let them know these routine responses are just not going to cut it anymore. >> reporter: like it or not, "people"'s call to action has thrown the magazine into the political fray. on social media, there was vows to cancel subscriptions. proof when it comes to guns, everything is political. >> inaction on capitol hill after a mass shooting is what many have come to expect. to overcome political realty? >> stephanie gosk, thank you very much. now a story getting buzz after jessica mendoza was the first female to call a major league baseball game. this morning, an atlanta radio host is apologizing for remarks he made about her. even show she's a gold medalist and one of the best to play the game, it seems one man is not ready to hear her call a game. this morning mike bell is in hot water for his tweeted comments about espn's jessica mendoza. she was calling the game against the yankees and the astros -- bell making a reference to a sexist comment used in the 2004 film "anchorman." >> you're watching ron burgundy and [ bleep ] mcgee. >> about a male-dominated 1970s television broadcast culture, he sent a tweet, yes, tell us, t mcgee, when you're up there hitting a softball, do you see

95-mile-an-hour cutters? bell continued arguing on twitter saying, you guys are telling me there isn't a more qualified baseball player espn can use than a softball player? give me a break. the falcons expressed their disappointment on wednesday tweeting, embarrassed by mike bell's comments given he's on our flagship statement. disappointing. by wednesday, his radio station has allegedly suspended him. he released a statement saying, in part, i want to take this opportunity to say to jessica what i said was dumb and hurtful, and i apologize for putting that garbage on twitter. there's no place for that kind of stuff on our show. this has been a real eye-opening experience. mendoza, 34, a former softball outfielder, won gold and silver medals for the u.s. team at the athens and beijing olympics. after working her way up through the espn ranks she began in

suspects arrested in connection with the deadly a very good thursday morning to you. it's 8:55. three suspects arrested in connection with a deadly shooting of a hiker in north bay are expected to be booked later today. surveillance video shows two of the three who authorities arrested yesterday in oregon. they're identified and all believed to have been in fairfax shortly before steve carter was shot to death monday on a hiking trail. investigators used gps to locate carter's stolen car in portland. california's historic drought appears to be playing tricks on this year's halloween pumpkin. you'll find them smaller in size and number. they've been forced to grow them out of the state this year where the weather has been wetter.
