moments caught on tape. the boy waiving an air gun in a cleveland park. a caller to 911 alerted police. >> he's scaring the bleep bloep out of us. >> a police officer and another were arrived on a scene but were not told that it was probably a fake. they shot and killed the boy after he reached for the waste band. rice's death and other shootings sparked protest er nationwide. they asked outsiders to look into the death and in two reports released by the prosecutors, they say that the officer acted reasonably. one investigator said there could be no doubt that the death was tragic and in deed when one considers the age heart breaking and adding the belief that rice posed a threat of serious harm or death was reasonable as was the response to that perceived

threat. he could face charges and prosecutors saying that they're not drawing any conclusions in the finds of the reare port and that it's up to the grand jury for them to survive. these experts all pro police dodge the fact that they returned to him and shot him immediately. reasonable juries could could find that unjust. they're working to make sure that there's no indictment and accountab accountable. in an interview on "today" rice's mother grieved for her son. >> i am looking for justice for hi son and a change in the nation so that nobody has to go through this. >> they're looking for reports as they vins gait the case. they're blasting the local police union and saying that they refuse to help end it.

meantime in texas they're under fire after tasering a city counsel man outside of his home. turns out that one of the other men was involved in an arrest that made headlines and nbc has the stories. >> this dramatic cell phone video captures the moment that they tasers counsel man jonathan miller. authorities releasing body cam individual wrote and the incident and what happened earlier. >> it started as police questioned four men guests of miller in a routine patrol of an area that has frequent drug activity. he was try to go see what was going on with his friends and interfered with with the investigation. >> i am telling you this is her scene and to back off. >> moments later, it escalates. >> i am not saying anything, get your hands off of me. it shows his on his knees when

they tazed him. bland died in july after being pulled over for a traffic violation and then arrested. medical examiners ruled the death a suicide but the litigation is pending. it's a state treep er and the police confirmed that a female officer involve in the arrest was involved in miller's case. we have six police officers. the probability of having the same officer involved in multiple incidence is probably. i have not seen anything that cause gave me a cause of concern. >> the man that police questioned was not detained and they were under police review. this morning he is out of jail and faces charges and resisting arrest. for today sarah for nbc news.

and wine winning and the colleagues resigned and the allie stunned washington by pulling out of the race this past weekend. all eyes are on the candidate congressman ryan. it's not clear that he wants the job of uniting in a party. >> i am going catch my flight to ma make it home. >> ben carson and carly and trump are surging. trump showed no signs of leaving. >> i am all the way 100 percent. >> reporter: leaving candidates like jeb bush and chris christie struggling, and while many say that the arrest will make republican's stronger, there's a concern that it will take back the white house. >> the chaos that we're see nothing the house is bad news for the evenominees.

>> reporter: now, congress is on recess for more than a week. congressman ryan is expect today use that time to discuss with the family and friends and colleagues. there's a broad agreement that they need to name a speaker soon to retain order. >> chuck of "meet the press" this morning. what we're seeing now with the race for the speak is pulling back within the party. giver us a sense of the outsiders like trump, carson and fe carly. >> well, what you have is a bunch of the tea party and a

caucus and members of congress that's going for a little while and complaining and have not gotten anywhere. then donald trump and ben carson electroidentified and sit there and say that we have been right all along. the grass roots with us and i think that the presidential race has made the conservatives that want a little bit and want to challenge the leadership and it's had that affect. this is why it maybe impossible for republicans to find a speaker candidate that's somehow a candidate because it's in the best interest of the presidentials to bound away at the leadership. >> that's what they want to do because they're holding the strings it would appear in the race of the speaker. on the side i know that sanders is your guest this morning and shaking things up a little bit. the first debate comes on

tuesday. it's the first time that we will have all three on the same stage. the republican debates are criticized for a lake of policy and one liners. will we get another conversation on tuesday? >> yes, but i think that you're going to see some heat. it's not the personal name calling that's made some of the debates seem much more like interesting reality show theater. look sand ers and the interview with me he is ready to make a contrast with hillary clinton. he had no trouble saying what is the difference in being on one side of an issue for 25 years and being on one side of an issue for 25 hours? he is waiting to make that in an argument in a polite way. this is where it could have the fireworks. you say the other candidates. we're going to have three other

that was the scene saturday afternoon as parachute jumpers stunt and fighter planes wowed the crowds with heart stopping flips and turns. >> i'm proud to see these planes operated with this kind of power. and presence of the men that flight these planes. >> this sim oppressive. the whole neighborhood came out for this one. >> locals are welcoming the 2,000 service men and women spending the week in san francisco. they are here as we celebrate the work they do out on the sea and in the air. if you missed the air show, the next one is happening today at 12:30 p.m. california marked a historic first this weekend. it became the first state in the nation to ban the routine use of antibiotics in livestocks. factory farms relied on antibiotics to prevents illness in unsanitary conditions and to speed up growth before the animals are slaughtered.

stem fming from a domestic violence charge. he's already forced to tackle questions about whether he's learned his lesson. joe fryer reports. >> reporter: dallas cowboys star greg hardy returns to the field today after a four-game suspension. critics are ruling his pre-game comments out of bounds. hardy was accused last year of beating up his girlfriend and throwing her on a pile of guns. he now faces major backlash for his choice of words on the return to the nfl. >> i hope i come out guns blazing. >> he talked about gisele, wife of tom brady, telling reporters, have you seen his wife? i hope she comes to the game. i hope her sister comes to the game. >> it appears from mr. hardy's comments that he has not learned from his past conduct, and he has no remorse whatsoever. >> reporter: cowboys head coach scolded hardy, but owner jerry jones seemed to defense the defensive end. >> unless he looks like he's

contrite, unless he looks like that he is just absolutely whipped, he's going to get criticized. >> reporter: hardy was convicted last year of assault. he denied the allegations and appealed. the charges were dismissed when his accuser chose not to testify against him. critics question why he was welcomed back to the league with an $11 million, while ray rice, who apologized for his elevator assault, is shunned. >> that gives an alarming signal to all of us watching, and saying, did the nfl put a band aid on their problem last year? >> reporter: now, hardy returns with a spotlight shining harshly on and off the field. for "today," joe fryer, nbc news. let's turn to the weather here. out in california, dealing with heat. >> it has been very hot. record-breaking temperatures are likely again today. we have this area of high pressure, just offshore wind keeping things in the 90s across parts of california. over into yuma, arizona. 99 degrees today.

we meet one student who learned his lessons the hard way. as a defendant trying to maintain his innocence from behind bars. our chief legal correspondent has this story. good morning to you. >> good morning. i just spent time in chicago with the new law school graduate on an unusual path. jared adams says he didn't commit the crime for which he was convicted, and he was determined to prove it using his own experience in the justice system as the ultimate classroom. >> we can get started. >> reporter: for jared adams, leading a clinic on criminal justice goes beyond the professional, it's personal. when he was 17 years old, he visited a college campus with two friends, where they were accused of sexual assault. >> i maintained my innocence from the beginning because i was innocent. >> reporter: but adams count-appointed lawyer didn't offer a defense at trial. he was convicted and sentenced to 28 years in prison. >> it's as if i'm looking at myself in a courtroom, you know, while the train is coming down

the tracks. getting ready to hit me head on. >> reporter: living behind bars, a cell mate told him to stop playing basketball and fight for his freedom and justice instead. adams taught himself case law and wrote to the wisconsin innocence project. >> we got the letter from jared in time to allow us to do a federal appeal. we had powerful new evidence that had not been presented to the jury. >> reporter: after nine years in prison, adams' case finally reached the top federal court in the midwest. in a unanimous vote, the justices threw out his conviction, ruling he didn't receive an adequate defense. >> the day they overturned my conviction, i was taken to a phone room. they said, jared, you won. hearing that brought tears to my eyes. >> this is a human system. it's fallible. it's bound to make mistakes. but it also tells us that when

we make mistakes, they are catastrophic. >> reporter: with adams forcefully maintaining his innocence and refusing a plea deal, prosecutors decided not to retry him. he was free, but he was a 26-year-old man with a life paused at 17. >> when i went to prison, there was no google. there was no e-mail. there was none of this stuff. i had to figure out a way in which i could catch up with the world, to be able to have a shot at life. >> reporter: he set a lofty goal. law school in public service. >> jared adams. [ applause ] >> reporter: he earned the law degree this past spring. >> jared has his passion for using his legal education and his talents to right wrongs in society. >> reporter: his mission didn't stop there. adams won a fellowship to the court that overturned his convicti conviction. we asked former federal prosecutor if he's ever seen
