somethi sometimes. >> welcome back. i'm laura garcia-cannon. my fall boots are asking when they can come out. >> what can come out? >> my fall boots. flip-flops still. >> we'll have warm weather as we take a look at these numbers now. 54 degrees as you step out the door in the north bay and all clear skies across the bay area. it's 64 degrees in the peninsula and looking at the highs today, it will be up to 88 degrees in the peninsula and east bay. san francisco up to 82 degrees and 94 in the north bay. we'll take a closer look at these numbers coming up in a few minutes. let's check in now with mike taking us to the bay bridge. >> a few folks waiting and a few cash payers on either side. not unusual. let's get to the maps. should be cleared up in the next few at the bay bridge toll plaza. no delays getting there. 580 stretched just east of grand and overnight road crews there and we've seen the last few mornings with some slowing right before they pick up. a big rig over on the shoulder.

and no slowing there or really for the bay. back to you. a disturbing find in the south bay has investigators searching for more clues. stumble upon a human skull and now authorities are trying to figure out who it belongs to. >> bob has more on what they're finding out. good morning, bob. >> laura and sam, you can see santa clara county sheriff department is keeping people out of the discovery site, but a hiker discovered this skull yesterday morning and sherry's way. this is in unincorporated los gatos. they have brought in cadaver dogs to search the area and see if there are more remains. deputies are certain it is a human skull and they can't tell if it belongs to a man, woman or child. investigators are, obviously,

looking into if it's connected with past missing or murder cases and one case they're looking into is the disturbance of morgan hill and lemar who has been missing for three years now. >> it's a tragic event and we hope it is is so we can give clocher to closure to the family. we don't know right now. all we have is a human skull. >> investigators are also not ruling out the possibility that it could be part of a native american burial site. reporting live here in unincorporated los gatos, bob redell. the three correctional deputies accused in the beating death of an inmate are scheduled to enter a plea. the three men who work as guards allegedly beat and killed michael tyree in late august. tyree who was mentally ill was supposed to be moved to a mental

health program before the incident. two of the three are out on obail. all three are on paid administrative leave. if convicted of the charges, the guards could face life in prison. back in the bay area to face homicide charges. three drifters accused of a wild crime spree, including killing two people arrived in marin county last night. the trio was arrested in por portland last week. they're expected in court tomorrow. marin county prosecutors say if convicted all three suspects will face life in prison or death. a whale watching trip turn under to a rescue mission when a nearby fishing boat overturned. a san francisco whale tours boat carrying 72 passengers went out on the bay on saturday when the coast guard radios to help with a rescue near the fair lawn islands. the fog was too thick for a

coast fward helicopter. the captain quickly answered the call to raced to the accident two miles away. when they arrived the crew spotted two men clinging to the bottom of a capsized boat. >> i was just so happy to see that boat. it was like god sent him there. >> we aggressively powered through. the swell was large. up to 18 feet and the visibility was reduced. >> captain nazar was able to get close to the boat and pull those members, crew members, i should say, helped pull the two survivors to safety. third man, 83-year-old pat booker did not survive. the coast guard is now investigating that accident. now to the latest developments on a fast-moving wildfire to our south. so far 200 acres scorched near hollister and san banino county and no containment updates this morning. the flames erupted around 4:00 yesterday afternoon and quickly spreading. so far no injuries and no homes are threatened, but we'll keep

our eye on that one. >> so hot in the south bay yesterday, probably didn't help. let's check the forecast for today. >> not only will it be hotter today, we'll also have light, variable winds. that could cause the fire to become more erratic and change direction. we are going to start out the morning with more of a northerly wind and then shifts more from the southwest as we go into the afternoon. winds won't be that strong, though. that may be good news. the winds at ten miles throughout the day. look in the highs in the upper 90s in gilroy and dolores heights today up to 82 and 96 in santa rosa and 97 today in livermore. i'll have more on these numbers and a look at the weekend forecast coming up. let's check in now with mike. >> hey, folks a very easy drive right now as you would expect. here's the high rise coming over to the foster city side and behind me the flat section, easy, light drive. we show you a couple slow

hate to tell you this is always a bad omen. tell us what. >> it is going to be hotter today. >> but a cool down is coming. >> yes, we do have some great news in that forecast, including a couple of shots of rain as we go into the rest of the week. let's take a live look outside right now. in san jose, it's all clear. and nice, school start to the morning despite the heat that we had yesterday and expecting the temperatures to ramp up, once again. it's a little warmer than where we should be to start out the morning. already 65 in livermore and sun sunnyvale 64 degrees and napa starts out at 54 degrees. we will see a few clouds around san francisco and moving into the inner bay and then as we go into the rest of the morning, all of that clears out. still some fog hugging the coast and that will keep those temperatures nice and cool for the immediate coastline. but we will still have some very hot temperatures ramping up inland with a lack of wind. as we take a look at the bigger

picture, i'm showing you the satellite this morning because i'm watching the swirl of clouds. that is well far to the south and to the west. but this could impact our weather as we head into tomorrow afternoon. and as well as thursday. computer models showing an increase in humidity and few spotty showers possible and then heading into the weekend, another system will be moving in. a cold front that could bring us another chance of rain. now, as we look at how much rain the models are expecting for us, doesn't look like a whole lot. maybe 0.05 and napa 0.06 and then pretty much trace amounts for the bay area. as we head into the weekend, some spotty showers. possibly some thunderstorms and at least temperatures will be coming down. mostly 70s and some low 80s on saturday and sunday very nice with highs in the 70s. up to 82 degrees in the tri-valley. let's check in now with mike to see what's happening with the commute. >> good morning, kari.

the dow extending its winning streak to seven days. earning season really gets under way today with big names such as johnson & johnson and intel reporting the dow rising 17 points and the nasdaq up 8 to 4838. oil prices have been falling sharply for more than a year, but some energy companies are doing everything to avoid having to lay off workers. "wall street journal" reports they are trimming other personnel costs cutting wages as across the board. avoid the massive worker shortages. and investors may be toasting a big merger today. has agreed to be bought by rival anheuser-busch for $104 billion, although it has two weeks to accept a formal bid. the deal could face major scrutiny from regulators in the u.s. where sab has 25% through its joint venture in miller coors. sam and laura, back over to you.

>> all the american beers merge together. >> that's a big conglomerate. >> thank you very much. 4:48 right now. federal laws are supposed to protect workers on the front lines when they raise red flags about issues. >> but the government retaliates against whistle blowers and drags out their cases. vicki wynn reviewed the national data showing what happens when people blow the whistle. >> good morning. we looked that complaints that came in for the past ten years to the federal whistle blower program and seeing for the first time when the government finds in favor of workers who report concerns about public health and safety. not often. we learned fewer than 2% of the cases osha investigates actually result in a positive finding of merit for the whistleblower. 22% of cases resulted in settlements osha calls those outcomes favorable. but we talked with more than a dozen people who say osha unfairly dismissed their

theunit@nbcbayarea.com. we are learning more about what might have caused a major travel glitch for u.s. airlines. it was likely caused by outdated technology. the glitch led to widespread frustration around the nation. so far southwest is only providing few details about the source of the problem, but workers say the failed software has since been fixed. this may not sound very playboyesque but no more to nude photos in its magazines. founder steve hefner is making what he calls a radical move. 5.5 million subscribers back in 1975. today the number is 800,000. the company admits it cannot keep up with all the online competition. the redesign will be unveiled next march with a more pg-13 look which will still showcase women in provocative poses. still have a playmate of the month, but men read this magazine for the articles.

we've been checking in on our live camera from las vegas here. the political win at work out of the democratic debate, but some wins, like actual winds here in the bay area to start off your tuesday morning. >> live look at vegas this morning. the lights are always on in sin city, right? let's check the forecast now. >> it's going to be hot here. it is going to feel like vegas outside. as we take a look at the livermore hour by hour. starts out nice and comfortable at 5:00 and then look at how those temperatures climb as we go through the day. you probably don't even want to take lunch outside when it's in the low 90s out there.

and then trending into the mid 90s by this afternoon. now, we're watching the temperature here in livermore because the record today, 98 degrees. we're expecting 96 and very close to setting the new record. in the tri-valley mike now takes us to dublin. >> higher temperatures and cool it down a bit because it's not there yet. for the peak of the morning commute, 580 westbound and look at your map and you do see a little dip for the speed sensors right at the dublin interchange. a little tap of the brakes and no drama out of the altamont. everything moves really well. and the crash in fremont cleared from the chp report. no delays here. an event at the coliseum. warriors play tonight and i'll hand it to you for that stuff. >> warriors play their first preseason home game in oakland and team's future home that is grabbing the headlines this morning. the warriors officially purchased a 12-acre of land
