night. >> i'm going to miss her so much. i don't understand why she got into that car. i know she got in the car to come home. >> after the accident another witness says another car described as a dark colored acura sped away from the crash. police tell me they are still looking for the car. tonight the parents of the victims are focused in talking to the driver of the dark colored acura. police also haven't named the driver in the crash that killed three teenagers. reporting live in san jose, mary anne favreau. bay area news. >> thank you very much. new details in the investigation of an american hero stabbed. police released these sketches of the suspects they are looking for. they say they were likely involved in the stabbing of spencer stone. the brawl was caught on video.

happened last week outside a bar in sacramento. stone was stabbed a number of times. he's out of the hospital recovering. spencer stone,le you wille remember one of the three people that helped stop a possible terror attack on a paris-bound train last august. the three men received france's highest honor and a hero's welcome home in sacramento. an 11-year-old east bay girl the home tonight thanks to the quick thinking of a school employee. police say the workers saw the attempted kidnapping and used her car to block the suspect from driving away friday morning around 7:30 on g street near sutter elementary in antioch. the suspect, santiago salazar tried to lure the victim into the car. wh enthat didn't work the suspect grabbed the girl by the wrist and pulled her in. the school worker saw what was happening and used her car to block salazar's car. he faces kidnapping charges. >> finally back home tonight dozens of people at a

retirementle home on the peninsula are being allowed back in. we brought you breaking news about a fire at this burling game retirement home where close to 300 people live. they were forced to flee the building after a small fire left the facility without fire. christie smith is there. it's been a long 24 hours for some people. they needed that electricity. they had to get out. >> they are making real progress tonight. the ceo said already they have re admitted 32 patients tonight. they are being transported back to the burling game long term care center after they were relocated. in all 70 patients had to leave. mostly elderly or with compromised med kalt conditions. yesterday in the basement it was away from patients. it did cut power to the skilled nursing facility.

about 270 patients. no one was injured. there was concern initially that they would all have to be relocated. the power was restored and most were able to stay. tonight a sense of relief from patients and staff. >> it's hard work. but we love it. come back, gets back to normal. it's been good. we are excited to have it back. >> he says the backup generators did work as they were supposed to. a number of agencies have come in and deemed it safe. he tells me they are expecting three or four more patients tonight with more returning tomorrow. reporting live in burling game, christie smith, nbc bay area news. >> thanks. a founding member of the grateful dead is battling bladder cancer. the 75-year-old bass player said he was diagnosed this month and he's getting treatment in

spending that day preparing for the next big one. the 6.9 quake back in 1989. 63 people died. most when the freeway collapsed in oakland causing millions of damage. it halted the world series. dozens showed up at fort mason in san francisco. seismologists say there is a 99% chance of one or more magnitude 6.7 or greater quakes in california over the next 30 years. there is a 7% chance of an 8.0. emergency crews say they want to be ready. >> our fist responders, our police, fire and government were overwhelmed. a lot of citizens juaned to help. the fire department said why not train people to help us when things come up. 29 people have gone through the training. >> the quake lasted just 15 seconds. it also caused a section of the

upper deck of the bay bridge to fall. >> they braved shark infested waters and came out without a scratch. this shark feeding frenzy was caught on camera near alcatraz. the attack was on people's minds as they jumped into the waters. the swim went off witut a hitch. not even a glimpse of a shark fence. good news there. we did catch up with athletes at the finish line. >> i knew i wasn't going to die today. >> everybody was worried about the sharks. >> i was more concerned about making a swim. that was my challenge. >> forget the sharks. let me get to the finish line. the oldest athlete to finish this race by eight years did it with the help of his son, juice, and cookies. his son's name isn't juice.

workers on the front lines of industries that affect our safety and federal laws protect them from retaliation when they blow the whistle on serious problems. >> the critics say the government is leaving whibs high and dry. vicky nene has been investigating the issue for months and is here with data that shows all of the details. >> the federal whistleblower protection program is full of reports from workers across the nation who say they have been fired for raising red flags. the majority of the reports get dismissed. now we are seeing for the first time how often the government finds in favor of whistleblowers. >> from airlines to pipelines. they are workers who speak up when systems break down for whistleblowers who get fired for raising red flags about safety issues or illegal activities.

it's called the whistleblower protection program. it's run by osha. >> whistleblowers don't have a chance when they suggest it at this agency. >> he testified before congress and helped pass national whistleblower laws. now he helps defend employees against retaliation. >> the program has been so counter productive i view it as a trojan horse. it's an agency we warn about. >> i was told by my supervisor, just conduct an interview. >> before you knew any of the facts? >> correct. >> darryl whitman spoke out to the investigative unit this year. he said supervisors pressured to close cases and dismissed complaints even when he found they had merit. ocho cinco found cases thad merit less than 3% of the time.

>> is it acceptable to you? >> no. >> now we have learned it's not just region 9. the investigative unit crunched the numbers. they found some 2004 to 2014 the agency awarded merit to cases less than 2% of the time. 22% of cases resulted in settlements. osha calls those favorable. the numbers show osha dismissed 59% of the cases. the majority of complaints it investigated. we found in 7 of the 22 industries protected by whistleblower laws, osha didn't issue a single merit finding. our investigation also found whistleblowers have to wait a long time for answers. osha is supposed to complete investigations in 90 days or less but 71% of cases failed to meet the deadline. t a case has increased from 98 days in 2004 to 378 days

the statue in monterrey was decapitated on thursday. not clear when the vandalism took place. the museum is closed tuesday and wednesday. the statue has been there since 1891. the california missions which cera helped found cut the ancestors off of languages and cultures and enslaved those who converted to christianity. >> there is a new electric vehicle hitting city streets. scoot has a network of scooters throughout the city. now the company is adding tiny cars. they call them quads. customers can drive them, buy them and be billed from the time they use with a phone app. >> we now have the opportunity to offer other kinds of small electric vehicles they can use to get around the city and do what they need to do. you can pick up a friend, go to the grocery store. we have four wheels an it will be a lot of fun. >> could be so useful in the city as well.
