"today in the bay" starts right now. and a good monday morning. thank you for joining us. starting your workweek out right here. i'm sam brock. >> here we go on a monday. i'm laura garcia cannon. first we take you outside this morning. a live look at san jose, where some overnight sprinkles linger this morning. >> meteorologist kari hall monitoring the situation. what can folks expect this morning? >> you hey have to turn on the wind shield wipers with the mist and drizzle happening in some parts of the bay area. we've had it here in san jose and the streets are wet too. so you may want to head out earlier than normal. we're in the low 60s across most of the bay. the north bay now at 53 degrees, and look at these highs this afternoon. very comfortable in some spots, cooler than average for the middle of october, and highs today will be in the 70s, but then it warms up as we head through the week. so i'll detail that coming up in the full microclimate forecast. let's check in now with mike. any better in dublin yet?

>> kari, the live shot from time to time sees traffic moving better like now. westbound 580, approaching to saya hara. an overnight road crew past this camera shot, but you see trees in your way. this is starting to move better as far as speeds go, but more traffic out of the altamont. we should see great improvement. easy drive, cash payers pausing. move through, and then in the south bay, a smooth drive. as kari talks about, i use my windshield wipers. back to you. >> mike, thank you. new this morning, a fight between passengers caused a flight to turn around. >> kris sanchez joins us now. this escalated quickly. >> reporter: the flight attendants told the captain. the san francisco-bound flight initially arrived at sfo about three hours ago, minus one passenger. we have a look at the plane as it landed. that was from a passenger there

who also spoke with an nbc crew at l.a.x. she says it seemed to start when that woman reclined her seat, and the man sitting behind her got upset and started to choke her. the woman screamed for help and flight attendants rushed over. the captain called air traffic control to declare an emergency. >> the flight attendant just called. evidently we've got two passengers that are in a physical altercation. we need to get turned around and back to l.a.x. >> when that flight landed, the fbi was waiting, along with a string of lapd police cars. according to the fbi, quote, an individual was detained for questioning following the return of the southwest aircraft flight. two l.a.x. faced allegations of an assault, involving a fellow passenger. no arrest has been made at this time. southwest airlines says the crew responded very quickly to separate the passengers, and to land that plane safely. the passengers, all but the one who is still in l.a., they were

switched -- switched planes and arrived in san francisco about five hours after their due time. but certainly we're going to be talking about today, because we all fly. we all recline our seats. well, maybe most of us. >> look behind you. >> what is it about how we treat each other inside a plane that just completely gets changed around? thank you very much, kris. a trip in the bay area took a disturbing turn. this after a boater spotted a body in the san francisco bay. >> yeah, "today in the bay's" stephanie chuang, what do we know about the investigation going on? >> reporter: well laura, very early in the investigation. what we do know, the body was that of a man found floating in the waters here in the bay between alcatraz and angel island. here too, this fire station the embarcadero, a rescue crew broughted body, 3:30. half an hour after the boater spotted this body.

san francisco firefighters as well as police working together with the coast guard to retrieve the body from the water. since then, the medical examiner is the one that has had the body, of course, trying to figure out a lot of things here. we don't know who this man was, d how he died. so top of mind here for the medical examiner. we're hoping to get answers later today on this investigation. right here in san francisco, stephanie chuang, "today in the bay." >> 5:04. a san jose student died after water polo practice at the pool. ryan harriman was taken off life support saturday. university police found harriman unconscious during a water polo club team practice tuesday. his team posted this testimonial to facebook, saying, rest in peace to our teammate, friend and brother. he never missed a practice and was one of the most dedicated members of our team. he brought a positive attitude and made us smile at every

opportunity. authorities still don't know what the 24-year-old to lose consciousness. happening today, the voting process begins to decide whether university employees will go on strike. that vote coming after several efforts to get a 5% pay raise. union members say the current 2% offer, not enough for teachers to sustain a career. rallies are expected to be held at many of the 23 csu campuses, including here in the bay area. that vote will run through the end of october. also happening today, keeping bicyclists safe. construction for san francisco's first raised bike lane gets under way. it will run for two blocks on eastbound market between goth and 12th streeted, bob redell is there. how are the lanes supposed to work? >> reporter: the idea, this would discourage drivers from veering into the bike lanes. so you already have the existing green bike lanes. now you're looking westbound on market, we're between 12th and

goth. and what muni and the san francisco works department will do, start raising that green section of bike lane, not all the way up to the curb, halfway up the curb, and the idea, if you're driving down the road, naturally you'll see the raised section and as a driver, wouldn't veer into the rain, making it safer for the 3,000 bicyclists who ride into the city every day for their jobs and what not. and then it also encourages bicyclists to stay off the sidewalk, because now they'll feel like they have a safer venue to get in and out of the city. >> all the streets in san francisco are different. and that's why it's important to have a really good tool box of design to provide protection for people riding bikes. you have green lanes, you have physically protected bike lanes. and now san francisco will have raised bike lanes for people riding bikes. >> reporter: so again, right now what muni and the public works department have going to do, just going to raise the bike lanes for two blocks on

eastbound market between 12th and guff. they'll see how this goes, do a study. the idea is to double the number of regular bike lanes in the city over the next three years. reporting live in san francisco, bob redell, "today in the bay." >> thank you, bob. want to check the forecast now with kari, because you may notice some wet roads out there. >> yeah, i can see it a little bit in bob's live shot there, a little bit of some sheen on the roads. so you may want to be careful as you head out for work. and we have been able to pick up on just a little bit of this, really not picking up on much on the radar. but you may have to turn on the windshield wipers, and some light rain this morning as our temperatures start out in the low to mid 60s. here's a look at where we're going this afternoon. expect a high of 76 degrees in san jose. redwood city, 73 degrees. castro at 71 degrees. and in napa today, 78 degrees. hayward, 70 degrees. and livermore today, topping out

if you buy a drone, you probably have to register it. today the federal government expected to announce new drone owners after hundreds of instances where pilots spotted drones close to major airports. earlier this year, a bay area pilot reported that one drone actually hit his plane. if the announcement comes today as expected, anyone buying a new drone would have to register it with the department of transportation. reaction over that mandate is mixed. >> i don't want other people to know i have this one. and where i fly it. and how long i fly it. >> i'm an airplane pilot. i fly single engine land, and those are aircraft are already -- and drones are flying aircraft as well. >> if a drone should get lost, the registry could help find the owner. a 49ers win. >> their second win of the year. but fantasy football leagues

flying defense. >> take a time-out. draft kings and fan duel, are under investigation, as you know, by a squad of law enforcement from the fbi to states attorneys general n. nevada, the state gaming board ruled they were not supposed to operate in the state at all, ruling fantasy football is gambling. the ruling only affects nevada, but is significant because of that legal distinction between gambling and games of skill. slot machines are gambling, poker is skill. this is why generally you can't play a slot machine in california, you can enter a poker tournament. this news is a little old, but i wanted to make sure we didn't forget to mention it. back on friday, a court ruled google's effort to scan the world's books was legal. this ends the battle between google and book publishers that dates back to 2005. google had wanted to digittize all the world's books so you

and then tickets go on sale tonight for december 18th. i know. i lost interest in "star wars" after the next three -- i was so hopelessly confused. i think i'll watch this one, though. >> this coming from the guy who owns a darth vader suit. >> i do not. but i did when i was 10. >> heavy breathing in the newsroom. >> hearing laura do that was worth it. rescue crews in the philippines scramble to go reach hundreds trapped in their flooded homes stranded on top of rooftops as a slow-moving typhoon slams the islands. nine dead, but officials warn entire neighborhoods are in danger of being swept away by mudslides. parts of the philippines under 3 feet of water and 20,000 people are in shelters. the storm is not expected to move out until tomorrow or wednesday. >> really tough to see. having a tough time getting the elderly and children out to safety. which wish them well there.

in our neck of the woods, not to that extent but rain out there. >> it's good to get the rain a little bit at a time. because that's what we have been experiencing over the weekend. we had a little bit of some showers. people just cheering when it started sprinkling and then it stopped. now as you look outside, we do have some sprinkles this morning. and still some cloudy skies. but that will clear up today. things drying out as the winds increase this afternoon. the winds really are going to be an issue, especially along the coast. and also in the hills. as we take a look at the current temperatures now, 64 degrees in livermore. sunnyvale at 62 degrees. and a nice calm wind for most of us. still a breeze across the bridges and going over the bay. and into the afternoon, look at the wind forecast. these are the numbers. the wind speeds in miles per hour. and the air will show the direction coming from the northwest. up to 20. these are sustained winds. we will have some higher gusts and more of the same tomorrow,

too. and with mostly cloudy skies. we will see that as we go through the morning. and as we take it hour by hour in san jose, in the mid 60s. and some low 70s today. it's going to be really nice with a high of 76 degrees. palo alto, 75 degrees. the embarcadero up to 68 degrees. 73 in sausalito, and hayward, 70 degrees. dublin today reaching 75 degrees. in the tri valley, we will have temperatures slightly above average today. we should be at 76 degrees in livermore. we're up to 78 today. and then tomorrow we're up to 83. you see the warming trend for the middle of the week. and we will continue that as we go into the weekend. some warmer days ahead not only in the tri valley but across the bay. won't be until friday when we have a weakening cold front to knock this heat back and cool us off in time for the weekend. i'll keep you up to date and another look at the forecast in a few minutes. let's check in with mike. a slow down going on? >> yeah, kari.

crashed right into a lexus dealership. this happened at the lexus take a look at this. a car crashed right into a lexus dealership in san jose yesterday. the black jeep drove over the sidewalk, it flipped and slammed into the front of several brand-new cars. the driver of the jeep was hurt in the crash. luckily, no one else was hurt. >> probably had some insurance on those cars. 5:24. dozens of people and three teenagers died in a street racing crash last week. >> a woman turned her grief into giving. from the streets to the grave after her son was murdered two years ago. last night, they organized a vigil for the 15-year-olds.

is early in the investigation. what we do know, what you mentioned. the body of a man floating in the water and that it was an unfortunate boater who spotted this body in the water. somewhere between alcatraz and angel island. and a rescue crew brought that body here along the embarcadero to the fire station, around 3:30 in the afternoon yesterday. it was first called in. a rescue crew had to retrieve the body working with multiple agencies with san francisco firefighters as well as police working with the u.s. coast guard to get the body out of the water and here. since yesterday, the body has been with the medical examiner, working on the identification, who was this man, how did he die, and how long was the body in the water. all very important questions. we're hoping to get answers to later today. live here in san francisco, stephanie chuang, "today in the bay." >> thank you very much. new details now on a crash that sent a car flying into the ocean off the santa cruz wharf. police now say one man is dead,

another in critical condition. you're looking at some of the rescue video there. that video shot by a santa cruz sentinel reporter, showing rescue divers freeing one man from the submerged vehicle saturday night. this as people looked on. police say it's not clear what caused the car at that drive off the wharf. witnesses say the driver was moving aggressively, whipping through lanes and nearly striking pedestrians. they also said they watched as the white cadillac swerveded to avoid another car before hitting a guardrail and plunging off the wharf. happening today, a procedural hearing in the federal racketeering trial against ciao, charged with running a gang. facing multiple charges that play include soliciting murder. today's hearing is supposed to involve disclosure of identities of undercover fbi agents who may testify against ciao when the

covering living dwellings, including apartment complexes throughout town. e cigarettes and marijuana will also be considered in today's meeting. sonoma has never changed its smoking restrictions ever since the statewide ban in restaurants and clubs took effect two decades ago. happening today, a new era for bicycle riders in san francisco begins. construction for the city's first raised bike rain gets under way. >> it's going to run for two blocks on eastbound market between goth and 12th streets. b bob redell is there now. it's supposed to keep bicyclists safe. >> reporter: 3,000 bicyclists come into san francisco especially on market, as you mentioned, between goth and 12th street. muni and the public works department will raise this green bike lane you see here. they'll raise it just probably halfway between the street level and curb.

so still shorter than the curb. and as you head back into the auto lane, it will taper off. the raised bike lane would be built over existing bike lanes, not lead to the loss of parking spots. the idea is to make travel safer by discouraging drivers from veering into the bike lanes, muni and the city hopes it will discourage bicyclists from using the sidewalk. >> market is a great place to demonstrate this project, because it will help the agency working on it figure out how to roll these out on streets across the city. >> reporter: muni will study the project before building more raised lanes. the city has already committed to doubling the number of regular bike lanes over the next three years. reporting live here in san francisco, bob redell, "today in the bay." >> thanks, bob. sunday area communities are preparing for the possibility of intense winter weather. forecasts of the el nino have

the san francisco creek joint powers authority clearing debris from major south bay creeks. the agency is also launching a website it hopes can provide faster and more detailed flood information with as much as twice the advanced warning as current online services. people who live in san francisco could have to pony up some tax dollars as city leaders are looking at ways to offset rising bay waters. a new report by more than 100 bay area scientists and 17 government agencies says that san francisco's infrastructure would be at risk in the coming years because of climate change. the report says the looming threat of rising seas, surging tides and extreme storms could lead to a tax measure aimed at combatting potential dangers. experts say money could be used to restore 54,000 acres of wetlands around the bay, which would help knock down waves and reduce flooding. 5:38. in southern california, crews free dozens of stranded cars after massive flooding. progress is being made,

especially on state route 58, one of the hardest roads hit. state officials say as of yesterday, only two big rigs and five cars were still trapped in that mud. at one point, there were more than 100 vehicles stuck. officials hope to have the road back open by thursday at the latest. and if more rains come, geologists say the hillsides are stable so another mudslide should not happen. >> just a sea of mud as we look at the cars covered up, top bottom. a sprinkle of rain and more over the weekend, kari. >> more than an inch in parts of north bay, well north of the bay area. as we take a look at what's happening out there now, it's in the mid 60s as you step out the door in livermore and napa at 53 degrees. here's a look at those highs this afternoon. it is going to be a nice one. the light rain we're feeling this morning will be clearing out. a mixture of sun and clouds in saratoga, high of 75. 73 in redwood city.

the marina, 64. low 70s in the castro. and the napa, 78 degrees. oakland, 74 and pleasanton, 79 degrees. over the next few days, temperatures will be heating up. i'll talk about that, and we'll even look ahead to the weekend coming up just a little bit later. let's check in now with mike to see what's happening with the morning commute. >> the bay bridge, already slow. that's what we have. the bay bridge metering lights on and the back-up predictable. your map, two updates for this span. the metering lights on at the bay bridge, and chp says south 101 should move smoothly through sausali sausalito, no problems across the golden gate bridge. a typical pattern for the tri valley, as well. and same for the northbound 101 through san jose. a note for south bay drivers coming up from the santa cruz mountains. north 17 at the summit reports of a single car spin-out usually means slick roadways.

well, the clock everyone knows is big ben, could go silent if millions of dollars in repairs are not made soon. some british politicians are concerned about the state of disrepair of the world's most famous clock and its signature bells. the price tag ranges from $7.5 million to almost $45 million for complete refurbishing. it's been 31 years since its last overhaul. the biggest problems for the 156-year-old clock tower, cracks in the masonry. >> members of parliament showing up late for their next meeting. 5:44 now. national school bus safety week and safety experts have an unnerving new static for parents. a new recent survey revealed on average more than 78,000 drivers

illegally pass school buses in a single day. that figure adds up to 14 million violations over the span of one school year. experts maintain that riding a school bus remains the safest way to transport a child to and from school. >> they're big yellow vehicles, they're conspicuous, easy to see and they're high. they've got all the kids up high, out of the crash zone. it is the way to get kids to school if you want them to arrive safely. >> there is still a push for features like longer stop arms and mounted cameras outside and inside the bus to encourage safe driving by everyone. 5:45. we all know that any of us could become victims of identity theft. but new numbers out this morning suggest not enough people are doing enough to stop it. a report released by bankrate.com find 46% of americans have either been a victim of identity theft or know someone who was. the study also found 77% of

americans are frightened of identity theft, but many are not taking necessary precautions to protect themselves from it. nearly half say they're not checking their credit reports regularly, and they continue to do their banking in other sensitive business on unsecured wi-fi networks. from cyber theft to plane old fashioned theft. a new study tracking teens and young adults finds roughly one in six admit to having stolen something in the past year. however, there's hope for these young thieves. the study published in the journal of economic behavior and organization found that it's just a temporary phase for most. likely because they eventually decide the risks of stealing outweigh the benefits. a federal appeals court this week will assess how much a 30-year-old hacking law applies to password sharing. the case involves a southern california recruiter who repealed part of his conviction for hacking his former workplace while working at another firm. now that worker wants to appeal a separate part of the case involving the sharing of passwords to retrieve

information. supporters say the government's case is modeled after an outdated anti hacking law that should be modified. here's a question for startups. is it just a terrible time to take your company public or an awful time? >> those two things sound pretty similar, scott mccrew. >> the worst of times. the ipo market has been very rough, very few companies have dared try t. the latest was first data last week, sound like a silicon valley company, in fact they're out of georgia. this stock did not do well in its first day of trading, which has been true of most of the ipos. ferrari is scheduled to ipo this week. it will trade on the new york stokes. ferrari is spinning out of chrysler, and yeah, chrysler owns ferrari. it stillactually will own a portia of portion of it. you can always buy a share and say while you don't have a ferrari, you are part owner of the company. china says its growth continues to slow.

view of the bay bridge, wet in some spots. and temperatures are very mild. feels humid, too. especially with that mist flying through the air. some of us have measured a little bit of rain in sports parts of the south bay. a quarter of an inch overnight. so great to finally get some wet weather across the bay area. and it will be breezy heading out the door. winds continue to pick up as we go through the day, especially along the coast. and also advisories for the north bay hills, where it will be drying out, the winds increasing. these are sustained winds, up to 24 miles per hour in santa rosa later on this evening. we'll be breezy again tomorrow. so as we take it hour by hour in san francisco, a lot of clouds this morning. we start to see the sun peeking out right around lunch time. 68 degrees by 2:00. and this afternoon, some mostly sunny skies and staying clear into the night. warmer days ahead. we're getting ready for this high pressure to build. it fights back that on shore
