falling from an overpass on 880. the roadway disaster that was nearly "life-or-dth a chunk of chain link fence falling from the overpass of i-80. it was life or death firefighter a bunch of drivers. >> a medical emergency. at least 30 people sickened in the baby a sanitary stumble. the only problem, the seller was actually a squatter. let's check the forecast. will it be warm again? >> it certainly will be. we'll have a lot more sunshine. a little more different as we head farther into the workweek. it's now 55 in the east bay. the south, 50s. we stayed in the 70s across most of the bay area and expect 85 degrees in the north bay while san francisco tops out at 74 degrees. i'll talk more about the microclimates and a look at the rest of the workweek coming up. mike, good morning. what's happening? >> we're looking from the coliseum toward 98. the hov lanes were open this morning. they were able to finish the striping work. we'll check that. there's also another issue. i know you guys are following up on a report. we're looking at a smooth drive for the freeway itself.

the approach toward the bay bridge. no big problems. construction on 680. a little slowing out of the ultima. the best of you, close to the speed limit. i'll send it back to you for a couple of traffic stories. >> back open after a fatal crash shut it down overnight. the chp said at least two cars hit a person trying to walk across the freeway just south of third street. it happened just before 11:00 last night and the pedestrian was pronounced dead on scene. no word on why he or she was walking on the highway. new video. crews busy trying to fix an overpass of oakland after sections came crashing down on interstate 8850. last night during the evening debris fell causing at least six cars to crash. one of them even caught fire. two were rushed to the hospital with minor injuries. crews finally cleared that mess

after several hours. now to a developing story. dozens of people falling violently ill and a southeast restaurant is to blame. >> anybody who went to morisco's needs to get checked out. more than 30 got sick. here's the thing. the bacteria they got is so highly contagious there could be more cases stemming from the original worker. that person may not know they are sick. the people who got sick may get others sick as well. if you've been here it might look familiar. it's brightly painted. has a big murrow. and it's gotten a pretty decent rating from its customers until this weekend. it's been shut down by the health department. andres is one of those sick

enough to land in the hospital. he spent a week in intensive care. he got shigella. it's a disease people get when they don't wash their hands after going to the bathroom. he was not the only one who got it. >> she said it was like a hollywood movie down there with all the patients coming in. >> it causes high fever, pain, and cramping. also vomiting and diarrhea. it's mariscos san juan on fourth street in san jose. the restaurant is now closed. its license is suspended. the symptoms can reappear more severely later. if you ate there, had lunch there, you're not feeling well gorks to your doctor and get checked for shigella. by the way, we'll show you the

report from the health department in the next half hour. 4:34 right now. warning in berkeley after police say a man tried to lure three girls into his van. it happened on college avenue and webster not far from the cal campus. the girls were walking to the middle school when the driver pulled over and yelled for them to get into a van. he chased them on foot until they started screaming. the van is described as dark green or blue. the suspect around 30 years old. shaking in the east bay, still a flurry of quiearthquake. it hit just before 3:30 afternoon. there was no reported damage. people there are still pretty shaken up. there have now been more than 200 quakes in that area in the last week and 45 quake yesterday

jeremiah kay ler who told them he was going to buy the property, even providing documents as proof. but when the property manager sold up, police found out taylor wasn't telling the truth and the property manager also noticed something different inside. >> there were several paintings located on the wall of this home. >> he was selling the art you see here inside of the mansion valued at more than $300,000. he sold 11 pieces of art through social media and pawn shops. the mansion was purchased by cnet founder in 2007 who fell for bankruptcy in 2013. myer is in debt including these paintings for nearly 6 million dollars. as for the property, police say no one has lived there for years. a neighbor saw some activity.

little bit warmer too. san francisco, as we go hour by hour, we start out at 7:00. it's 58 degrees. we're up to 70 degrees by 1:00 and then briefly staying in the low 70s. a more comfortable day in san francisco, 80 in palo alto and pacifica up to 70 degrees. pittsburgh, 87. pleasantton reaching 85 degrees. we're in for a warming trend as high pressure begins to build. then as we go into friday, there'll be a weakening cold front passing by the area. we'll be watching another system in behind that that may bring us some showers heading into the start of next week. the weekend forecast, it is looking nice with highs in the 70s and 80s. temperatures about average for this time of year. san francisco on sunday, 69 degrees. peninsula will be in the mid-70s heading toward the end of the weekend. let's check in with mike warming

and earnings from yahoo! and chipotle. they're closing off higher. the nasdaq 18 to 4,905. united continental naming general council naming him. the news marks the second ceo shakeup since early september. that's when jeff resigned from united. united reports quarterly earnings on thursday. and amazon planning to hire 20,000 more seasonal workers this year than last year. the e-commerce giant said it's creating 100,000 jobs for the holiday season to meet increased customer demand. that's in addition to the new

full-time positions. back over to you. >> right around the corner. >> thank you, landon. an investigation under way this morning about how a teenager was able to hack cia director john brennan's personal e-mail account. the hacker said he swiped brennan's contact list, social security number, even his own application for security clearance. no classified information was stolen. the teen told the "new york post" that he describes himself as an american high school student who's not muslim. ohio is the latest state to postpone any lethal injections for its death row inmates. nbc news has learned it will delay all executions until at least 2017. the last time ohio executed someone in 2014, that inmate appeared to gasp for air, leading to a change in the drug serum. long-time bay area marijuana

supporter celebrating a key ruling in a landmark legal case. the federal judge ordered the department of justice to stop enforcement of federal pot laws against what are otherwise legal dispensaries. in a ruling the judge lifted an injunction. the club's founder is elated because the ruling ends her 16-year-long legal battle. she's now vowing to reopen and her attorney now says the decision was a long-time coming. >> the law is clear. there will be no funds expended with interfering with california state medical marijuana law. >> in the hearing the federal judge decided it's not enforcen't in states where it's legal like california. that's because last year they defunded it and otherwise complied with state laws. 4:50.

let's get a look at the forecast for today. it's going to feel springlike. temperatures in the 70s. >> yesterday was winter-like. looks kind of cool, especially when the wind started to pick up during the evening hours. but now as we go hour by hour in livermore, a cool start to the day. it will be 60 degrees.

look how quickly these temperatures warm up. up to 62 at 9:00 and up to 79 degrees at 1:00 and jumping into the low to mid-80s. tonight the temperatures dropping back to 65 degrees at 11:00. let's check in now with mike taking us to the south bay? >> that's right, kari. look at that. a nice easy dry. 101, a very clear flow. that's the volume around the bay. i want to show you the map. i am tracking a crash to the bottom of the map, reports that a deer was hit right here south of highway 17. there may be a lane blocked by activity. i'll track that. no injury to the driver. the deer was hit and the deer is not doing well, as i understand. unfortunate news. the rest of the bay is moving smoothly. no problems toward the bay bridge or the north bay. it's just getting a few more cars. back to you. >> mike, thank you. a gas leak in the south bayh kept pg&e crews busy.

they struck a gas line. it happened around 4:00 between alma den and cherry lane expressway. there were no evacuations or injuries reported. 4:55. an aggressive amount of mosquitos is prompting another round of fog spray. the district will be treating an area not far from interstate 680. it comes after west nile virus was found in a group of mosquitos and a chicken in martinez. they'll do it from 6:30 to 11:00 tonight. several local football legends are going be in san francisco for a major party announcement ahead of super bowl 50 at levi's stadium. they're going to be on hand at st. anthony's foundation to announce the annual party with a purpose event. that event which features top

chefs from around the country as well as current and former nfl stars is a charity fund-raiser for food banks across the country. it takes place on february 6th or is better known as super bowl eve. >> nfl is hosting a public hearing to discuss relocating the team. the meeting is next thursday as the paramount theater in oakland. similar meetings will be housed because both the rams and chargers are also considering moving to l.a. they're considering a deal to allow them to share a new stadium in the city of carson. the nfl has final approval on any move. >> talking about all these festivities, that's not so festive in the area. president obama made good on his promise on a 14-year-old
