joining us on "today in the bay" i am sam brock. we'll get to those in just a second. first, kari hall monitoring some green on the radar as we get into the middle of the week. good morning. >> that rain is reaching towards the bay area. don't be surprised if we have light showers coming down as we go into this afternoon. but right now, it's just mostly cloudy across the bay area and temperatures that are in the upper 50s to lower 60s expect highs today in the upper 60s to about 79 degrees in the south bay while the peninsula tops out at 73 degrees. i'll talk more about what to expect today and as far as the rain, we'll check in now with mike. we were tracking some fog yesterday in the north bay. how is it looking now? >> yesterday you were talking about low clouds drifting and that is not affecting the visibility on this shot. we had fog making it tough to see this drive. we'll show you san rafael as well as the map for the north

bay and in towards san francisco. over here, this side of the bay, that's where the cald. nine earthquakes monitored in the past seven hours near san ramon. the biggest one just over 3.0. stephan stephanie chuang joining us. sipetists ha s have to be lo this. >> we are talking about a lot of numbers here. the latest one, a small one hitting just about 30 minutes ago. smaller than a magnitude 2.0. more than 200 earthquakes, though, in the tri-valley area in the last couple of weeks.

our newsroom seismograph captured some activity. most of them very minor. most around magnitude 2.0. not big earthquakes or anything like that. three of them did measure around magnitude 3.0. they hit around the same stretch of time this morning around 1:45 in the morning, 2:00 in the morning, as well as 2:30 in the morning. most of the time we're talking about a time people are sleeping. this is actevty from the fault line that runs through san ramon, dublin and down through san jose and gilroy. we also have our nbc bay area maps and you can check it out online and datas that comes from the geological survey. 19 in the last 24 hours and experts say there is a 63% chance of at least one magnitude 6.7 or greater quake walking the bay area in the next 30 years, but the likelihood of it happening along the fault line

has been put at just 7%. the bottom line, yes, a string of quakes, but it does not mean a precursor to a larger quake in the area. new data points to greater likelihoods, one that is magnitude 8.0 and greater and we'll have more on that coming up in the next half hour. live here in san ramon, stephanie chuang, "today in the bay." an active situation because we just monitored a tenth earthquake there. more on that to come throughout the morning. a story developing this morning, in just a couple of hours crews will resume their search for maszing fisherman. marin county search teams spent hours on the water yesterday in foggy conditions looking for three men who ended up in the water when something went wrong on their 14-foot aluminum boat. crews did rescue one survivor who washed up on to the rocks. they also recovered one man's body. a third person still missing.

signs warned boaters of dangerous conditions there. >> this area is a hazardous area to people who are novices and even more experienced people because of the fact that the swell comes up from a deep water ocean up on to a sandbar and it builds rapidly and there is a surf break there. >> rescuers say no one on the boat was wearing a life jacket that time of that accident. one man right now under arrest in what appears to be a deadly case of domestic violence. late last night san jose police arrested hugo castro who is now facing murder charges. earlier yesterday officers found the body of a woman inside her apartment on south third street in san jose. she had been stabbed multiple times. investigators say the victim once dated castro. the entire situation has left neighbors unnerved and shaken. >> we've seen a lot of crazy stuff because you're in the middle of downtown san jose. this is as far extreme as i've ever seen it get.

>> last night police did not announce the name of the victim saying family members have not yet been identified. 5:04. berkeley poised to take a big step in beefing up housing safety. city rental housing codes and inspections process this after coming in the wake of last june's balcony collapse that killed six irish exchange students. that proposal seeks to create a citywide housing inspection program and priorities the areas most at risk and perhaps allow confidential complaints. that meeting coming as the president in the bay area and mrapting a tree honoring the students killed in the deadly balkaens collapse. we'll closely follow that and bring you the rest of the trip. meantime back here at home we're tracking rain to start your forecast for the week, kari. >> it is right on track. we're seeing light showers just off shore and we may begin with

some sprinkles throughout late morning, early afternoon. but now we are starting out the day with some dry conditions. most of that rain making it here late tonight and early tomorrow. and it's in the upper 50s to lower 60s as you step out. expect highs mostly in the 70s and 80s today. a lot of clouds, a few peeks of sunshine and, once again, a chance of some very hit or miss light rain as we go through the day in napa, 79. fremont 72 and livermore up to 83 degrees. and we'll detail that rain and how much we can see coming up and also taking a look athead the weekend. but mike taking us to the bay bridge toll plaza. >> always interested in the weekend, kari. bay bridge toll plaza moves very smoothly and a little build for the volume of cars coming in. let's look at your maps. we don't see any problems. for any of the speed sensors still have your overnight road crew and getting off into san francisco and remember oracle continues and howard closed between third and fourth and

activity in the area. throughout your bay an easy flow of traffic and the only slowing out of the altamont pass. i'm watching 101 northbound san martin, gilroy and all at speed through 101. but there is going to be a change there. the metering lights on green for the last week, but kris sanchez is out there in gilroy and how are things o s out there now? >> we've watched them go from green to red and exciting to catch them in the moment. we've seen drivers driving through and the light cycling through from red to yellow and not sure why that person was on yellow instead of on green. but this is something that folks will have to get used to. they have been tapping their brakes and you see one more, no, but the big orange fluorescent construction signs have been up for a while now warning drivers that commutes through this direction that the metering lights would be working fully

operating at regular speed by today the 27th of october. so, they have been getting used to it. we have seen some folks tapping on their brakes and what not. let's give you an idea of what we're talking about. caltrans says you'll see growing pains. highway 101 in north and south directions at monterey road in gilroy. that may be the biggest bottleneck on to the 101, highway 85 interchange in south san jose. 17 metering lights in between. caltrans tells us that they expect eventually as people get used to this, that their commutes could be cut anywhere from 2.5 to 7 minutes but a bit of a bottleneck in the beginning down south county and ilgoy where folks might wait about three minutes. take a look at the graphic here.

where you can expect for them to be on northbound from 5:00 in the morning to:00 in the morning. southbound from 3:00 in the afternoon to 7:00 and monday through thursday, all know get away friday on friday. so, the metering lights will turn on about a half hour early and get started at 2:30. caltrans is counting on this $18 million project to try to eleaveiate soalleviate some of e conch conches we'll have to see if colleagues get to work a little earlier today. >> we are creatures of habit, kris, some adjustment there's. red and green on the road and red and blue on the campaign trail. coming up next, trump is slipping. why the republican frontrunner looking more vulnerable than ever ahead of tomorrow's debate. the senate takes on a really tough hacking bill and we have home movies. stick around for that. golden state warriors

morning. donald trump always talking about his numbers. look at my numbers. now they're slipping. >> his numbers are slipping and not just in iowa, as of just about an hour ago, we got results from the latest "new york times" cbs poll that shows for the first time dr. ben carson in the lead nationally among republicans. up by four points over donald trump. so, yes, heading into this debate tomorrow. he has a problem, not just an iowa problem any more. that problem is ben carson. a third poll now showed dr. ben carson on top in iowa with 32% support. double digits over donald trump. carson's team says his message is resonating with iowa voters. >> they are very well aware of the fact that he is a man of strong faith, strong character and a man of strong convictions. >> carson's team says he won't attack at tomorrow night's debate but he won't back down either. >> trump who said he was shocked

by the iowa numbers downplays their significance. >> there was one poll and a second poll and small polls. >> reporter: ted cruz is also seeing a surge ahead of tomorrow's debate. at 10% and just picked up two key endorsements. >> we're seeing conservatives uniting behind this campaign. >> reporter: jeb bush is trying to figure out what went wrong. flashing the expense meeting with donors and refocusing his campaign on fixing washington and national security. now, while a lot of things may not be going as jeb bush planned, one area where he's doing very well is among latino voters. the latest poll shows that he is the preferred republican candidate among latinos where as for donald trump, three out of four have nationative view of him. >> they won't forget about marco rubio. thank you very much, tracie potts. new this morning, the congress and the white house agreeing on a breakthrough budget deal. lawmakers posted a draft of that bill just before midnight.

a house vote may come as soon as tomorrow. that tentative deal would extend the u.s. debt limit through 2017 and set government funding levels for the next two years. the agreement would squash the routine threat of a government shutdown. that senate will also take up a controversial anti-hacking law. a law, scott mcgrew, that many tech companies oppose. >> follows an old pattern, sam, washington comes up with an idea and silicon valley rallies against it and this has worked in the past. we shut down several efforts before. this one on its faith doesn't sound so bad. helps and encourages tech companies to coordinate with each other and the government to fight hacking. company a warns company b about a new type of attack so that company b doesn't have to figure it out all on its own. that is, obviously a simplification. but the disagreement is in the details. given the government's track record is probable

yesterday via private jet from a jeweler in beverly hills. the warriors co-owners will present the rings to the players and coaches in a pregame ceremony. coach steve kerr will attend the ceremony, but he won't be coaching the game. still recovering from back surgery. the team says there is no timeline on his return. luke walton lead the team against the new orleans pelicans. even though this is his first regular season game as a head coach, he says he's not nervous. >> as the staff getting ready for this, thinking that he wouldn't be back. when he first took, you know, stepped away, my gut told me he would be back by the start of the season. but, my gut was wrong. >> and would you believe tickets are still available. you can go to warriors.com and everyone who comes tonight will

don't be surprised if you feel a sprinkle and have to turn on the windshield wipers later on today but it will a while before some of that weather starts to work its way inland. it's now right around 60 degrees in san francisco and livermore. 59 degrees in concord and let's take it hour by hour in livermore because our temperatures will still be fairly warm today even with mostly cloudy skies and a light wind as we go into tonight, we're dropping back into the 60s by midnight. now, some of our high-resolution models show some rain as we go into this afternoon. and it looks like it will take a while before that rain starts to work its way from the clouds and keep it from evaporating before it hits the ground. but as it does so, it's kind of moistening up the atmosphere and priming us some for heavier rain as we go into early tomorrow. we could have a wet evening commute, as well as a morning commute heading into tomorrow and a possibility of a quarter inch of rain for the north bay ask some lesser amounts as you head off to the south and east.

at least we're talking about some measurable rain here, mike. how is it looking on the roads? >> with everything dry, looking really good the dublin area and looking a lot clearer than it was yesterday when we had fog and low clouds for this shot. look at your map. see some slowing, as well. this is, remember, yesterday was monday. that's how the week works. slowing into livermore and no problem for that dublin interchange or tri-valley right now. zoom out and show you the rest of the bay looking very pleasant from san martin and gilroy and metering lights on for 101 and haven't seen any change to the flow of traffic. debris around the san mateo bridge. a quick look at the bay bridge toll plaza shows you we have the cash payers starting to wait. >> thank you very much. we'll be right back with more news. we're learning more about the

. good morning to you. thank you for joining us. >> a damp week here heading into wednesday. kari has been watching that radar. some coming into the area. >> the rain is reaching closer to the bay area, but most of it still well off shore and we may even have some light sprinkles as we go into the afternoon. so, looking forward to some rain and higher chance of rain heading into tonight as well as early tomorrow. 60 in san francisco and the east bay. expect the highs today in the 70s in the south bay. some upper 70s there and mostly cloudy with a chance of a quick shower or passing as we go, once again, into this afternoon. so, i'll detail that coming pup let's check in now with mike. >> we just heard about a crash. this is north 101. i was going to show a slow down

really slamming down because north of this shot, though not visible of this camera and north 101 at mckie and that's where reports of a motorcycle that got had to a crash there. the driver reported up and walking around. there are some injuries reported, if the driver is up and walking around, that is better than we often see for the motorcycle accidents in this area. southbound a little slowing and we'll check on that in a few minutes. another fender bender reported around the bay bridge toll plaza and nothing but any activity out of the ordinary for the approaches and the toll plaza itself. i don't see the crash, but the backup as this rush is on and second delay from the metering lights. back to you. all new this morning, the number just keeps climbing, now 11 quakes in the last eight hours near san ramon. >> "today in the bay" stephanie chuang and this is among hundreds that have been hitting there lately. >> that's right, hundreds in the

tri-valley area. if you look at the last 24 hours alone, 21 and growing, striking this area. as you can just take a look at our newsroom seismograph captures most recent activity. but three of them did measure around a 3, all hitting around 1:45 and 2:30 this morning. now, take a look at our nbc bay area map. activity is from the fault line which runs through san ramon and pleasanton and hollister. experts say a 63% chance ofnitude 6.7 or greater quake causing widespread damage somewhere in the bay area in the next 30 years. the likelihood of it happening is pretty small. 7%. now, this year i want to point new studies supported by the usgs that shows the calaveras and haywad fault could happen

together. a magnitude 7.3. overall the likelihood of an 8.0 or greater in the next 30 years in the state went up from 4.7 to 7 since the last report coming out. the bottom line is the small quakes does not mean a precursor for a big one, but i spoke with folks here at the starbucks getting up early saying while they're not worried, it is a great sign to say, you know, we have to get ready just in case. live here in san ramon, stephanie chuang. good reminder for all of us. new this morning, authorities will not arrest a boy accused of stabbing and killing his stepfather in fairfield. happened two days ago. police say the boy used a knife while trying to step his stepfather from beating his mother. the man had a history of domestic violence and multiple calls to that home in the past. new details in the racketeering and solicitation of

chow. not going to seek the death penalty against the former gangster. he is accused of ordering the murder of his predecessor in 2006. if convicted, chow would face life in prison. he was one of 29 people arrested last year in a racketeering sting. among the other defendants former state senator yee who pleaded guilty to lesser charges this past summer. 5:33. investigators revealing more about a deadly shooting outside a livermore cvs over the weekend. police say the two men shot are from the central valley. the shooting happened saturday outside a pharmacy on first street. one of the men died and the other in critical in the hospital. the main suspect is this man jason brown. he may be connected to one othered is in fresno. he's still on the run anded to be sxarmd dangerous. a high-profile case now on hold. these three drifters were back

in court on murder charges yesterday. but they did not enter pleas. that's because one of them still doesn't have a public defendaer. the three are accused of killing two people a hiker in marin county and a backpacker in san francisco earlier in the month. this morning, a look at the man who jumped off the bay bridge to ditch police. officers say they found him carrying a knife in san francisco's marina district saturday morning. he then jump under to a running police suv and drove off. he ditched that suv on the bridge and jumped 30 feet from the upper deck to lower deck. a police officer also jumped to make the arrest. neither was hurt. the man is facing several hit and run drug charges. five mistakes within six months. that's too many. a company is getting criticized after several ruptured gas lines in one of the bay area's most c iconic neighborhoods.

today city leaders will ask for a public hearing to fire the general contractor. somebody says the gas lines were not properly markd, but the city workers aren't buying it. >> after you made the mistake of the first gas leak, wouldn't you do something different if you're not sure if the maps are okay? >> the project should have only taken five weeks. 5:35 right now. some vils visuals coming in fr gulf coast. stranding people in the process. you see the cars covered in water. rescue teams yesterday had to save 21 school children all captured on these still photos when their school bus got swamped in east baton rouge. nobody was hurt. that storm left some people stranded inside of their homes. others had just abandoned their cars. the storm is basically the remnants of hurricane patricia which rolled through mexico and texas. so much rain there. many in the bay area hope this week's promise of rain is a sign

of things to come. crews in the south bay are doing flood prevention work ahead of the coming winter. teams are using escoivators and doing it not so much for the week's rain but for a wet winter if el nino's forecasts come to fruition. >> our goal is to repair an erosion that happened on this bank as well as a bank over there and we're repairing by replacing rocks as well as adding soil on top of the rocks to hopefully prevent it from happening again. >> santa clara water district is spending $100 million on flood protection projects. crews are also removings and debris that may cause flooding. i even notice on social media so many people looking into a arbrists to improve their trees and what not. >> a lot of water. kari hall you're the optimist,

wearing green right now. a show of support. >> a show of support for green on the rar ddar. a lot of clouds and our highest chance of rain comes late tonight and early tomorrow. but we'll see a lot of clouds throughout the day. highs up to 78 degrees in san jose. palo alto 7 degrees and 79 in napa and oakland 74 and livermore looking at a high of 83 degrees. we'll talk more about that rain and how much to expect and a look ahead to the halloween forecast coming up. you don't want to miss that. let's check in now with mike. a look at the bay bridge. >> hope it's not spooky. over here bay bridge well lit and well advised. if you're going to the bay bridge, the metering lights are on and there is the fill frin the toll plaza. no surprises on the approach as we look at your map, the speed sensors show a nice smooth flow until you get to the tail end. the east shore free way moves well. highway 4 through ant yauk.

little slowing. the only really orange and red spot into livermore and more slowing into the dublin interchange. the rest of your bay on either side of the bay and including the south bay, a smooth flow of traffic. north 101 and that crash still blocks one, maybe two lanes and a live look in the next report. a little slowing for 101 coming up through san martin. might be a little better today. kris sanchez you're down there in gilroy why it might get a little different for folks. >> you san martin on ramp and you see the metering lights are cycling through from red to green and turn yellow and on back and so forth. drivers are going to have to get used to this. this is the first full day, but they have known that it was coming. the orange signs announcing that today is the day. have been up for a while. caltrans says eventually the metering lights should cut the commute from here on north by

anywhere from 2:30 to 7 minutes and maybe enough time to get a cup of coffee. highway lights are cycling on 101 from monterey road down in gilroy to the 101 interchange with highway 85 in south san jose. 17 metering lights in between. caltrans told us that they expect the biggest growing pains at the onramp in gilroy. that a busy one. folks might have to wait three minutes at that metering lights. flashing on northbound 101 from 5:00 in the morning to 9:00 in the morning and southbound from 3:00 in the afternoon and 7:00 in the evening on monday through thursday but just in time for get away friday, the metering lights will turn on a half hour early. cal trans is counting on this $18 million traffic and metering program to cut down on the commute. maybe make things a little

evaluation for the woman accused of driving her car into oklahoma state's a judge now ordered a psychological evaluation for the woman accused of driving her plane into oklahoma state's homecoming parade this weekend. that crash killed four people, including a 2-year-old boy. the 25-year-old suspect made her first court appearance through a video monitor. she is facing four counts of second degree murder and suspicion of driving under the influence. the suspect's friends and family say they're baffled over what

led up to that horrific crash. >> do you believe that your daughter deliberately drove into that? >> no, i do not. >> why? >> because she's not just that kind of a person. >> can't wrap my mind around that. if she was in such a bad state, why didn't i see that? >> the suspect's attorney says that he does not believe alcohol or drugs were involved. her family does say she does have a history of mental illness. a legal victory for sex offender fighting a statewide program meant to protect children at halloween. the program is called operation boo. it requires california's registered sex offenders to place opt out signs on their door on halloween. a federal judge ruled that requirement is unconstitutional. the state department of corrections decided not to enforce operation this year. more stores are opening earlier and earlier to kick off the holiday shopping season

which, by the way, is right around the corner. one is bucking the trend. outdoor retailer rei announced it will close its doors on black friday and instead pay all of its 12,000 employees to take the day off, get your tents and go outside and do some camping. rei is also inviting the nation to join in by choosing to quote opt outside to reconnect with family and friends this holiday. walmart the latest company wanting to test out drones for delivering goods. walmart is asking the faa for aer a waiver to test drones outside. oil prices will force it to cut costs. >> scott mcgrew, hometown company chevron may say the same thing. >> oil has fallen below $50 a barrel and there are several factors as to why making a lot of oil out of north dakota. the dollar is strong, oil is priced in dollars.

this was part of the reason chevron laid off employees last quat qua quarter. the san ramon company will and it is hard to generate a lot of sympathy for big oil when they don't make a lot of money, but a lot of puramifications and not just for local jobs. if oil stays around the $50 level economists say saudi arabia's government will run out of money within five years. that will destabilize the country. ing of, you may have seen the report that global warming would make it so hot it would be lethal to be outside in the persian gulf by the end of the century. another concern of low oil prices discourages people from thinking about green energy. why spend money on an electric car when gas costs 2 buck and change. low oil prices generally mean low airfares. southwest offering $9 fares to las vegas.
