easy drive towards the bay bridge, as well. the metering lights are on at the toll plaza. the flashing lights might be visible and might be slowing around university. we see the slowing, that might be the reason. we'll head back to you guys. >> we like clarity here in the morning. new details now and an all-clear for a roanoke peninsula hotel after a suspicious smell brought a hazardous material scare. we brought this to you as breaking news last night and between then and now we know 12 people ended up in the hospital. >> bob redell live at the westin tell in palo alto. are investigators any closer to identifying what that smell was? >> not so far, sam and kris. the palo alto fire department does not know what caused the suspicious smell, but they are confident that the hotel is safe. hazmat team responded around

10:30 last night. guests started complaining about an irritant in the air. whatever the smell and whatever the odor was it got so bad that 12 people ended up in the hospital while the rest of the guests were asked to shelter in place. >> leaving for dinner tonight probably around 9:00 p.m. a couple guests refused to check in and caused a little bit of commotion and kind of ignored it until we drove back from dinner and saw all this craziness going on and now we're waiting to get our stuff back to check into a different hotel. >> again, the fire department has cleared the scene. they cleared it around midnight last night. the hotel is safe and we expect, based on what we've heard from the fire department, that the 12 people transported to the hospital will be okay. reporting live here in palo alto, bob redell. >> thank you very much. a cross country drug scandal leading right back to the bay area. san francisco dentist under arrest accused of smuggling and selling marijuana across the

coast. >> stephanie chuang is live in our san francisco newsroom. this man was arrested after his own son was busted for the same thing. >> almost a year ago to the day, actually. this week the father now behind bars in new york, also serving time where his son is serving time for being busted last year for something very similar also in new york. now, take a look. 63-year-old jerome weitz is accused of being part of a sizable marijuana selling and smuggling operation. according to court documents new york detectives have been tracking two other men for illegally selling marijuana going back to april and arresting both of them monday. now, police say one of their cell phones had text message exchanges with weitz setting up a place and time to sell some of this. prosecutors say weitz had at least ten pounds of marijuana in 11 vacuum sealed plastic bags and more than $10,000 of cash on

him when they arrested him in a new york city apartment monday afternoon. he is the founder of mission dental health. according to the website, which also says he's been practicing in the mission since 1975. the site used to feature a video with weitz talking directly to marijuana smokers and encouraging them to see a dentist often and more. the caption reads at the bottom of the page, we want patients to know how important it is to seek regular dental checkups if the patient smokes marijuana. you can see it's a black, empty link now on that pace. weitz has been charged with two counts. one for conspiracy in the fourth degree and one for criminal sale of marijuana. live here in our san francisco newsroom, stephanie chuang. 6:04 right now. one man is in the hospital and another in jail after a fist fight in a quiet san jose neighborhood turn under to a stabbing. this happened just after 7:00 last night near the corner of

mohave drive in the valley of san za. police say the men were fighting in the street when one man stabbed the other several times. that victim is expected to recover, but we still don't know why the fight broke out in the first place. we now know the name of the man was shot and killed at a house party in santa clara this past weekend, but we still don't know why he was shot and killed. investigators identified the victim as this man, mario hernandez. a 22-year-old who moved here from mexico just two months ago. police have said the shooting was not random. they have not said much about a suspect. the attack happened on glade drive near crystal drive, less than a block from wilcox high school. his death is the first homicide in the city of santa clara since 2011. the fight is not over between a roanoke park man and a police officer. this comes after a two-month internal investigation started by a viral video. you might have seen it. the city attorney says the officer seen right here getting out of the patrol car and pulling out his gun did not do

anything wrong. the officer said he was in the area to check on parking violations, but things quickly escalated between him and the roanoke park man. all of this took place in july. the man's lawyer filed a claim against the city yesterday calling the encounter harassment. >> the actions of the officer were so egregious that we felt that we had to look into it. >> the lawyer expects that claim to get rejected by the city since the investigation is closed. if this happens, he plans to file a lawsuit on his client's behalf. a new lawsuit contends that a woman who was a carjacking suspect and shot and killed by emorivilly emoryville police was not facing the officers when she was killed. even though police said otherwise. officers shot yvette henderson in february. they say she tried to carjack three drivers before then pointing her gun at officers. her family is now suing for

damages citing the coroner's report saying that henderson was shot only in the back and in the side. the family's attorney claims henderson never even raised a gun and he believes surveillance video exists that will strengthen their case. 6:07 right now strengthening oakland's police force. they're soon going to have 35 new members graduating from the police academy at 10:00 this morning during a ceremony at the scottish rights center. 18 college graduates, seven women and several bilingual officers. also happening today, what may be a make or break day in a bitter contract dispute involving teachers in san lorenzo. locked in a contract stalemate with the teachers union there. reporters last week broke up a school board meeting to air their concerns and both sides will meet for mediation. teachers say if an agreement is not reached, a strike may be their only alternative. water shaming, again, in the

east bay. new list of water wasters is out and there are some notable names on that list. east bay mud released it. suriyakumar sits atop that list. he used more than 9600 gallons a day, which would represent 38 times the use of an average customer. other notable names on the list, former ceo of safeway, steven burd was fourth after using 7,200 gallons and number 42 on the list, former warriors star adonal foyle. from the basketball court to the court of public opinion for mr. foyle. >> that is a difficult thing, but they certainly can turn off the tap. we'll turn on the on sunday, though. we'll get a little bit of rain then. right, kari? >> we can see rain moving across the bay area. you let the lawn die and water the trees and that's it. as we look at the microclimates right now. in the upper 40s in the east

bay. we've got some mid-50s in the peninsula and san francisco. as we take a closer look at the south bay, it's in the upper 40s in many spots and we're at 51 degrees in morgue on hill is 56 degrees. so, a cool start to tday in the north bay. a look at all the microclimates warming up quickly under a lot of sunshine today. 82 degrees in cupertino and palo alto 79 degrees and expect a high of 71 degrees while napa tops out at 86 and oak oland 79 and livermore 87 degrees. very warm for the end of october. and we'll have a front that will knock us back into some much cooler than average temperatures and some rain. i'll detail that coming up a little bit later. let's check in now with mike coming up with where you may be slowing down on the roads. >> east shore freeway is one where we expect some slowing and have a little worse issue here. this is the silhouette for university. the overcrossing there. right there you can see the reflection off of the car.

they just turn lights off. it's on the shoulder right-hand side west 80 at university. that's a bad spot and tough to see. again out of lanes causing a little detraction and more slowing. we'll look at your map. one eastbound, as well, not presenting any problem. that westbound slowing past the scene and see it building up from golden gate field. ing up san pablo another crash in the middle of the roadway trying to get over to the shoulder quickly and looks like everything should be fine in the next couple of minutes. another distraction, more slowing for the upper east shore. the rest of fremont moves well. northbound through san jose, everything looking really good and that crash at great america parkway. we talked about that crash. 880 through the area picking up the volumeilatal south of the crash, but traffic seems to be getting through just fine. back to you. >> mike, thank you very much. a follow up. now turns out repairs to that gaping sinkhole on union city could continue for a while.

privacy advocates are pushing for the courts to insist that the nsa and other spy agencies do now what they'll be required to do later and the court so far has said no. several news outlets are reporting that t-mobile will announce next month that it's dropping data charges for netflix and other streaming services. in other words, watch all the netflix you want over cellular. pink is the new orange is the new black. don't do it now, wait for the announceme announcement, if it comes at all. on the face of this, this sounds great. if you have a data provider who is favoring other services over another, though, allowing free data from itunes and the net neutrality movement. now, cell phone companies are covered by net newal tr neutral. there are dragons here. it sounds great. watch all the netflix you want you want. if t-mobile will give preference

to somebody, that really violates the spirit of data. >> and then you bring the fcc into the mix, again. it takes 7 1/2 years to resolve and we're all confused in the process. >> meanwhile a lot of netflix. >> but you do get that. >> missed out on some other stuff, though. the 10-year-old boy attacked by a shark in hawaii terrifying, life threatening moments. the boy was body bording on wednesday when that shark bit his leg. nearby swimmers were able to bring him to shore and quickly wrap his thigh. the boy says he was scared but the pain, he says, wasn't that bad bad. >> then it just started kicking in. and i was calling for help and then the guy -- >> a warning signs are now posted that beach. life guards say that this is the first shark attack at that beach in nearly 50 years.

again. 72 degrees at 12:00. and a lot of sun with some breezy winds making it into the mid-70s by this afternoon. we've been talking a lot about rain and how desperately we need it. and here is the reason why. in san francisco, even though we did have some days of some low clouds, we didn't get anything measured at the airport or downtown. and the normal amount is close an inch for the amount of rain we should get in the month of october. and for the year, we're down nearly 12.5 inches. san jose, on average, we get about 0.75 and we only measured 0.03. and then as you head over to the north bay, in santa rosa, we've also been really dry. only making 0.09 and you should get close to two inches of rain for the year. we're lacking 17 inches of rain and as we go into the weekend, this high pressure will be moving away. but temperatures will be building today and tomorrow.

by sunday, the cold front starts to drop in. out ahead of that, some scattered showers and unfortunately with each run of the computer models it dries out that front. at least we could see some snow showers in the sierra and elevations 5,000 feet and above. in the futurecast. let's get a closer look at when we could start to see that rain moving in by 5:00 friday afternoon. it could linger into monday, which is great news. hopefully we see light amounts of rain for a long period of time. looking at the forecast. we will continue to have warm temperatures today and tomorrow. let's get a look at the commute with mike. >> slower spots, especially over here at the bay bridge and the approach. heads up, folks, if that's where you're headed. backup and metering lights and east shore freeway. look at that. we have some slowing west 80 at university. the car was pulled over to the shoulder blacked out. lights are out. tougher to see.

it was a big distraction and thingerizing themselves out and they may have cleared that car in the last few minutes. another crash west 80 at san pablo and looks like it made its way over to the shoelder and now maybe two cars there doing some paperwork and slowing for the east shore all the way to the berkeley curve. that's kind of the worst of it for the east bay. slowing through hayward and a crash for southbound 880. looks like it's not presenting much of a problem. heading over there we'll show that in a second and want to show you the rest of the south bay. a crash at great america parkway and crash east 237 and that san mateo bridge will end with that live look. southbound does move well to 101. thank you, mike. forces a plane to make an unscheduled landing, again. the disturbing statements he allegedly made that had some other passengers fearing for their lives. new this morning, a man is undergoing a psychiatric evaluation for causing a disturbance on a flight bound for philadelphia. it was a flight that had to be divert phoenix. but here's the interesting part, people onboard say that the man was walking around the first class cabin ranting about the september 11th terror attacks adding he would be famous. >> he was angry, swearing and talking about the government and that he was mad at the government and he has plans and

"today in the bay" tracie potts live in washington, d.c. tracie, supporters say this will stabilize the government, but opponents say this deal is really a political gimmick. >> exactly. several of those opponents came off the campaign trail to spend part of their night an hour and a half for ted cruz and an hour and a half for rand paul on the

senate floor trying to oppose this before it eventually got passed. the vinyl vote was 63-35. the house already passed it and it's a done deal headed to the president's desk. just this morning, a statement from president obama applauding democrats and republicans for working together to get this done. but is spending more $80 billion worth of cuts rolled back and borrowing more at the same time really a good plan? now, which part of the opposition here. nevertheless, it's moving forward but not the end of the story. the budget is a plan for how you're going spend the money, but, actually, doling out the cash appropriations, that's a different process and 12 appropriations bills that congress wants to pass before the end of the year. so, not quite over. >> just when we thought we had closure. thank you very much, tracie potts live from washington this morning. new details now on an unnerving situation at a well-known peninsula hotel. a suspicious smell sent people

and mouth and thought they were being a little bit ridiculous. apparently a bigger issue than i thought it was. >> firefighters eventually cleared the scene around midnight last night. based on what we're hearing from the fire department, we have every indication that those 12 people will be okay. reporting live here in palo alto, bob redell. >> good they're healthy and okay. 6:34 right now. uc berkeley police investigating a report that at least one person might have been drugged at a campus fraternity. they're asking anyone with information to contact police and anyone who thinks they might have been drugged should go see a doctor immediately. police are not revealing where the report came from or even which fraternity is under investigation right now. busted in the big apple. this morning a bay area dentist is accused of being one of the leaders in a cross country drug smuggling ring. >> "today in the bay" stephanie chuang joining us from the newsroom there but we hear a

family practice, but the exact same thing that happened to his son, as well. >> that's right. about a year ago, almost a year to the day, now, this time around it's the 63-year-old dentist and it goes back to april this undercover sort of investigation tracking two other men. police say then they were able to bust the san francisco dentist for what they say was illegal marijuana sales. take a look, this is jerome weitz. according to court documents, the 63-year-old was arrested for his role in new york shipping from california. detectives say he had been exchanging texts with a dealer he sold marijuana to setting up a time and a place to exchange some of this. take a look at what police say weitz had on him. ten pounds of marijuana in 11 vacuum sealed bags and $10,000 in cash on him. when they arrested monday afternoon. now, weitz is the founder and leader of mission health,

say that person got it from eating contaminated food at the restaurant. six counties have now reported 90 cases in total. 94 of those have been confirmed by a lab. the investigation is still not over. happening today, we will find out if our shorter showers and our brown lawns are making a difference. the state water board is set to release water conservation for september. the good news is, the government says it appears that californians have met the target for a fourth sconsecutive month. all californians use 25% less water or be in for a personal visit by local water officials. meantime, water officials are warning californians to not be distracted from water saving by the promise of a rainy el nino winter. >> kris, check this out, when it comes to water one hit or miss proposition by new technology being developed by bay area

lunchtime outside, 71 and 74 degrees by 1:00. and the winds start to pick up as we go through the day. after hitting the upper 70s. talking about that rain this weekend. in san francisco, here's a look at how much you've measured so far. not a drop. now, the average amount for the month of october is an inch or close to an inch. and for the year, we're down 12 1/2 inches of rain. now, let's head over to san jose where the average amount of rain for the month is 0.75. this is how much we've measured, 0.03. and we're down 7 inches for the year for average. and, of course, the most extreme for the north where you do get a little more rain, we've only gotten about 0.09 and you should be closer to an 1.75 and for the year you're down 17 inches. of course, with this drought going on for serveral years, its more extreme when you look at how much rain we're lacking. as we head into the weekend,

we're looking forward to a slight chance of rain. with every run of the computer models, kind of dries out our chance of showers. hopefully turns out a little more robust than what we're seeing on the models. what does look promising is that we could see some snow showers in the sierra, especially as we head into monday at elevations at 500 feet and above. that looks good into next week as far as the bay area and how much rain we could see. we start to see the clouds moving in on saturday. light rain moving into the north bay by the afternoon hours and this is what it could look like on the radar heading into monday. so, the rain may linger into the start of the week after having temperatures that are well above average for today and tomorrow. halloween is looking very warm, but dry. and then temperatures drop off quite a bit on sunday with more clouds and some rain moving in. now, mike has a look at what's happening in the south bay. really a slow go there. >> kari, very unexpectedly slow

for folks on 237. things are sort of settling down throughout the south bay. we are seeing thatual build for all of your freeways and sees gentle, gradual growth to the commute. in the 50s for the worst part. we are looking at that big slow down that has sorted itself out for westbound 237. slow all the way in towards sunnyvale and the crash at lawrence expressway cleared and that is causing a big backup for a few minutes and now only taken ten for the speeds to start to recover. again, indicating a light friday throw of traffic. tri-valley no problem. slowing through hayward and over here walnut creek and crash north 680 and that sorted itself out, as well. the bay bridge with the metering lights. take a live look there and show you nothing unusual here and past 880 towards west grand and berkeley 101 through san rafael. you have some company but nevada to the golden gate bridge is great. back to you. >> thank you, mike. we now know who the man was

who was kill in a house party in santa clara this past weekend and he had just come to the u.s. two ago. investigators still won't say why the victim, 22-year-old mario hernandez was shot, but they do say the shooting was not random. the attack happened on glade drive near crystal drive, less than a block from wilcox high school. hernandez's death is the first homicide in santa clara since 2011. the fight is not over between a man and an officer. this coming after a two-month long investigation started by a viral video that you've probably seen. city attorney says the officer seen here. the officer said he was in the area to check on parking violations. things did escalate quickly between him and the man who recorded the incident on his phone. the assault took place back in july. the man's lawyer has since filed a claim against the city. he did so yesterday calling the encounter harassment. >> the actions of the officer

country. >> "today in the bay" stephanie chuang live in our san francisco newsroom. we're not talking about a case of medical marijuana here. >> no, we're not, kris and sam. new york police undercover investigation and a san francisco dentist accused of illegally selling thousands of dollars worth of marijuana. according to court documents, police arrested 63-year-old jerome weitz monday afternoon in a new york participate. he is accused of being a marijuana supplier shipping from california. weitz had ten pounds of marijuana and 11 vacuum sealed plastic bags and more than $10,000 cash on him at the time of the arrest. weitz is the founder at mission dental health in the city. the website also says he's been practicing in the mission since 1975 and on the site there used to be a video targeting marijuana smokers and encouraging them to see a dentist frequently. now, almost a year ago to the day, weitz's son, joshua, was
