"today in the bay" starts now. and a very good morning to you, thanks so much for joining us, i'm laura garcia-cannon. >> i'm sam brock. referring to the mudslides. we'll get to that in a second. what were rain totals like yesterday and what does today hold? >> we had men meiny daily rainfall records set and today it is much cooler behind that front and clear skies. 40 degrees in the north bay and 49 degrees in the east bay and the peninsula. look for highs today mainly in the upper 60s, but hitting 70 degrees in the north bay and in the tri-valley a high of 70 degrees, as well. i'll detail what to expect through the rest of the week and the next chance of rain in the forecast. let's check in with mike to see how it looks for the morning commute. >> the dry roadways helping folks out. no longer the backup for the cash lanes and everybody is open

for business this morning and moving well. we'll look at your map and show no more of that green highlighting across the bay and just the green speed sensors and that means the speed limit over here for the east shore as well as the north bay and move the map out. looking over here towards the tri-valley and little slowing out of the altamont and over towards livermore. nothing like livermore's big d rig. the poll is election day. only a few hours away from the start of voting and several key measures are up for debate including one that has protesters. but kris sanchez keeping track of what you need to know before you cast your vote today. kris snrx. >> san francisco is the hot bed for this particular election and a lot of it is related to mayor ed lee. now, he is on the ballot, along with five other candidateswanti. political analyst predict that he will easily win a second

term. now, the district 3 supervisor race, though, really may say more on how voters feel about mayor ed lee because he is backing julie christiansen and former supervisor peskin. mayor lee has taken a strong position on air b & b measure which would restrict short-term rentals to 70 days a year instead of the current 90. prop a broadly supported affordable housing measure which is a $310 million bond to build low income and middle income affordable housing. san francisco mayor or sheriff will find out if his support for the city's sanctuary policy might cost him his job. he is running against a former intern shar intern sheriff and also business owner john robinson. you're saying, i don't live in san francisco.

san mateo county is making history today with the first all mail-in election and an effort to increase voter turnout so voters can drop them off if they don't want to mail them in. you can go to your local city or town hall. registered voters can still vote in person at the san mateo county elections office or at the county clerk's office in redwood city. if you are a santa clara county resident and, gosh, it seems really quiet, that is because it is. it is a consolidated election and only people registered in the city of los gp aaltos. you can find election news for where you live on our website, nbcbayarea.com. >> definitely got your hands full today, kris. thank you very much. coming up in the next half hour, a big election day in other parts of the country. live to washington with a preview of ballot measures across the u.s. that could have

a large impact nationally. for complete election coverage as kris just mentioned check out nbcbayarea.com. san francisco leaders are poised to pass tough new gun sale laws. supervisors are holding a final vote on a new law, in fact, that requires use of any gun or ammunition sale. the problem is san francisco's last gun store recently shut its doors for good citing regulations. supervisors say the new law is aimed at any gun store that may open down the road. laura, still a lot of mystery surrounding an apparent freeway shooting that left a man critically injured. police first got that call a little after 4:00 p.m. yesterday on westbound interstate 80 in san pablo. officers found a man inside of a bullet riddled car stopped on the shoulder of the road. traffic backed up and police and the chp investigated.

>> hard to say what could have happened at this point. so many options that you just don't know what could have been out there. a break in traffic and a million witnesses? we just don't know at this point. >> investigators right now don't have a lot to go on. they're still not sure if it was a case of road rage, targeted shooting or random act of violence. talked about a pretty big storm that hit the bay area and now moved out. we'll get to that in just a moment. new this morning, actually stopped and then assaulted. scary moments unfold for uc berkeley students who just learned the latest report of the sexual assault there. it happened outside the beverly cle clary dorm. do police know what led up to this? >> you know what, it's interesting, they didn't get the report directly from the student and the victim, but this is what they do know from one of the people who live around here. that in the end tried to get physical and force his way into a dorm here where a female student lives.

this, apparently, happened after the female student got off the bus. this is a week ago from last night. so, monday night, october 26th. police say the man unfamiliar to her started to follow this female student and talk to her and she ignored him as he walked to the dorm and that's roughly two blocks away. went to the front door and the man grabbed the woman's arm and shirt and trying to intimidate her to letting him inside. but someone else opened the door and that's when police say the man took off. there is no suspect description. again, to be very clear, police say the victim has not reported this incident. done by a. cassecurity authority which would include people like parking enforcement, staff, faculty and residential adviser. this assault taking a place a week before campus police issued this warning and what isn't clear is why it took a week. on a related note, cal was one of four california universities audited by the state on how it

handled sexual assault and violent support. when conclusion from the june 24th summary that the university do not sufficiently train on responding and reporting to appropriate officials. since then resources for students adding 24/7 confidential care advocates and that's to provide free help for victims or survivors on resources, on their rights and on different options for reporting. live here at the cal transtephanie chuang. >> another chilling attack there. thank you, stephanie. san francisco police looking for this man seen here in a surveillance video. investigators say he beat up 560-year-old man outside of a coffee shop in san francisco. the victim ultimately died from his injuries. this happened on october 1 and investigators believe the suspect was looking at construction jobs in the city on that day. the storm is moving out, but the mess is still here.

mudslides slam livermore, hillsides causing dangerous conditions for drivers leaving many to wonder if this is a sneak peek of what el nino could bring. bob redell live in livermore. >> fortunately, laura, for commuters who move from central valley here to livermore and paterson path as you can see behind me is reopened. this is one of the vital thur ofares. they use this windy, two-lane road to come into livermore. this is after mud poured on to this windy, two-lane road during yesterday's heavy rain storm. stranding at least one driver, alameda county public works department brought in heavy equipment to remove the mess. >> part of them we can handle and once the hail started and the lightning started we had to close the road for safety reasons.

>> again, paterson pass reopened. this is in the hills southeast of livermore. that's where another mudslide closed that road. you might recall that area burned this summer and left the hill side bare and susceptible to erosion, especially during heavy rain. not just a problem here in livermore, but in the rest of the bay area, as well. take a look at this map from the california geological survey. the red of the area on the map, the greater the threat of a mudslide and, unfortunately, as you can see in that map a lot of red. here are a not so obvious warning about a mudslide. something you want to keep in mind as we enter what is a rainy season. courtesy of the usgs. see unusually wet ground that could be an indication of the broken water pipe or a spring that is under ground that has sprung because of shifting ground. something you want to keep an eye on. if you notice that your fence lines are offset if you live out here in the rural area or live on a hill and you notice that

your windows and doors are starting to sink. again, maybe some not so obvious signs that the area you're in susceptible or prone to a mudslide. bob redell, "today in the bay." want to check in with kari right now who did get a good amount of rain and now it feels like fall out there. >> it does. temperatures in the upper 30s in the north bay in napa. it's 45 degrees in concord and san jose at 48 degrees. definitely a jacket needed today. you may keep it on all afternoon with the highs only making it into the mid-60s. we'll see 60s all across the bay area with a few spots hitting the low 70s. like santa rosa, as well as livermore. reaching 71 degrees. but the gusty winds will also help dry out the ground and we'll continue to dry out through the rest of the week. we'll have another chance of rain in the forecast. i'll detail that coming up a little bit later. let's see how the commute is moving now with mike. >> this live picture right here of the brightly lit, because of

the american public is with more now on decision 2016 a new poll indicating how frustrated the american public is with washington insiders. our nbc/"wall street journal" poll has ben carson jumping to the largest lead so far. 29% of possible voters. carson is followed by fellow washington outsider donald trump at 23% and, as you can see, the candidates with years of political experience continuing to fall farther behind. >> what you're seeing right now is the conservative and the outsider wing has really taken charge of the energy of the

party. >> on the democratic side, our poll shows that hillary clinton has solidified her lead over person bernie sanders up from 25% earlier this month to a 31% voter approval, i guess, or voter interest right now. the fate of the controversial keystone pipeline suddenly in limbo after a surprise shift in strategy. the company wants to build the pipeline from canada to texas hassed the u.s. government to temporarily suspend its application. the company made the request in by time to sort out a dispute with the state of nebraska over the planned pipeline route. it's believed the company will wait out the results of next year's election before forging ahead with its own effort. emission scandal involving volkswagen is growing. the company is denying new allegations that it installed a emissions cheating software on another one of its diesel powered engines. wv installed on 2014 to 2016 cars with 6 cylinder diesel

engines. volkswagen admitted to cheating to 4 cylinder models. 10,000 cars sold in the u.s. the original scandals included 11 million cars sold worldwide. those engines went into porsche and audi cars. volkswagen owns those cars. >> scott mcgrew continuing our coverage. >> sam, that may not be the worst of it. volkswagen is really on the hook because of the testimony from its executives. what if, what if they did not tell the truth, the whole truth and nothing but the truth to congress? they already lied to customers. we know that. but the new worry this morning for the company is what if they were untruthful to the united states congress? vw testified only a very few engineers knew about the cheating, but that's getting harder and harder to believe as this scandal grows. san francisco-based fitbit is saying all kinds of happy things

this morning. not afraid of the amwatch. selling more and more fitness trackers. things are great. and then the company announced it would sell more stock the follow up offering and investors hate that. shares of the company get value because there are a limited number of them. i have a share, you want a, you have to buy it from me, but when a company up new shares out of thin air, that's a sad day for i investors and fitbit is down about 7%. good morning, landon. >> hey, scott, good morning to you. stocks start out november with a decent is rammy, but markets could pull back today. the dow closing in the black for the year as investors react to several corporate deals and economic data and earnings. look for it today on factory orders. the dow rising 165 points to 17828. the nasdaq up 73. scott, back over to you.

but we can actually talk about enough cooler weather following the storm. >> it feels like fall, finally. our temperatures have actually been cooler than where we should be for the beginning of november and we'll see those temperatures inching up gradually over the next couple of days. live look san jose, mostly clear skies and grab a jacket before you head out. it is cool. and i even have to turn on the heater, this morning, inside the house. you may crank that up in the car, as well. looking at how much rainfall we had yesterday in san ho. the daily rainfall record was about 0.3. the official measurement at the airport was over an inch of rain and during the month of november, on average, we get about an inch and a half. san francisco, we did not set a daily rainfall record, but we were very close. and the month during the entire month of november, we normally get about three inches of rain and in livermore, wow. we really had a lot there. the numbering down will be

almost an inch and a half. the daily record was 0.75 and during the month, on average, hit close to 2 inches of rain. a lot of rain there. feeling much cooler in the upper 30s in the north bay. hour by hour in oakland. 48 degrees at 7:00. we see those temperatures slowly warming up as we go through the day making it to the low to mid-60s and with the breezy wind, with all the sunshine, it will feel cool throughout the day. so, long sleeves definitely a necessity. what people ask most of the time after a rain, when is it going to rain, again? looks like another chance on sunday and that's where we're picking up with this green here on the computer model that may linger into early monday, but the temperature trend keep it comfortable as we go through the week with highs trending into the lower 70s. let's see how the commute is rolling now with mike. >> this shot yesterday was soupy and actually sparsely populated because of that crash at the altamont. today not the case, drier and moving very well but getting some company. let's look at the map and show

you there is nothing holding you up out of the altamont. camera spot over here you have slowing as folks make their way over towards the dublin interchange. remember, also, this is tuesday. we expect a bigger volume of traffic and that seems to be what we're seeing for 580. here 101 and traffic there still so light that it was able to get to the shoulder quickly. a little backup, nonetheless. the rest of your bay moves smoothly and bay bridge toll plaza cash lanes just starting to stack up a bit and see this change over the next ten minutes, guys. coming up, we investigate technology that could solve a water crisis.

5:24 right now. we may be facing record rain storms and washouts with the coming of el nino, but no matter how much it rains before we're in a water crisis. now experts are calling on california to change how we approach water. senior investigative reporter traveled halfway around the world to the country of israel to investigate solutions to california's water crisis. >> well, good morning, guys. we discovered that the problem with our drought isn't so much a lack of rain, but our own water policies. so, we went to where they already solved the water crisis. the country of israel halfway around the world where about ten years ago they faced the

range. a crash near the off ramp towards the oakland road off ramp there. 13th. watch for the slowing on the approach. we see it now. the activity should be completely off to the shoulder in the next couple of minutes and that burst of traffic combined with that activity really bad timing over there. the rest of your bay, an easy drive. bay bridge toll plaza those metering lights should be on in the next couple of seconds. back to you. >> when it counts, thank you, mike. also happening today, it is election day. those here and across the country. team country on the ballot measures that could have the biggest impact. kris sanchez taking a closer look at races here at home. >> first, let's go to tracie potts live in washington with the measures that could have a trickle effect across the country and here's one that generated plenty of conversation in california, marijuana also a hot topic, for one state in particular today. >> exactly. actually two states, but you're probably talking about ohio because if they pass this measure, it will be the first state in the midwest to legalize

marijuana. boy, it's been a hot issue there, you're right about that, sam. they spent millions of dollars and people for and against it. the polls in ohio seem to suggest that people are more in favor than not. the supporters say it will raise over $500,000 in rev nigh for things like public safety and health. colorado the other state where marijuana is already legal, what to do with the tax revenue that was raised from that $60 million in taxes and the state keep that or divvy that some other way. we're looking at guber nuatorial races across the country. in kentucky whether they can hold on and democrats have been down since president obama has been in office and lots of people wonder if this has any effect on 2016. we're also looking at another ballot measure that is going on. ohio has some new districting with campaign financing and school funding and down in texas whether or not people who serve in texas as public officials

air b and b's headquarters and at least dozens of messages tied. affordable housing units are essentially being turn under to hotel rooms. if passed, the proposition would limit the number of rental days. air b & b who is funding the fight against prop f says it forces neighbors to spy on each other. a lot of props on san's ballot today. another one of them, also housing related, is prop i which would regulate luxury housing construction in san francisco's very popular mission district. it's called a moratorium. essentially, if passed, it would free high-end or market rate housing construction and any project larger than five units for at least 18 months. it would also preserve land specifically to be used for affordable housing. forcing long-time residents out of that neighborhood. san francisco voters also weighing a development measure that may transform nearby mission rock. proposition d is backed by the

that's when the man took off. this reportedly started around 10:30 monday night of last week after the student got off a bus near durant avenue and campus police say the man unfamiliar to this student started to follow her and talked to her and she ignored him as she walked two blocks to her dorm. no suspect description. in fact, the victim hasn't even reported this directly to police. this information came from as security authority which would include people like parking enforcement, staff, faculty, residential adviser. campus police issued a warning last night. this is a week after this report assault happened and it's unclear why it took this week. on a related note, cal was one of four california universities audited by the state in how it handledual harassment and violence. the june 24th summary said theversity did not train faculty and staff on responding and reporting these incidents, in particular calling up coaches

this is another area shut down by mudslides this morning. as you can see, this road is open for the morning commute. a windy, two-lane road that connects commuters and the headlights heading westbound into livermore. but several hours ago this was shut down while the alameda county public works department tried to clear the roadway of mud that slid on to the pavement during yesterday's afternoon heavy rain and then this was the scene a few miles southeast of here where debris shut down tesla road. it was still shut down and at the time it did cut off one woman from her home. >> i am just coming home from work and the road closed. i live right here. this is from all the fire. i'm used to it. >> and you might recall, as i was telling you, over the summer that area of carnegie park off burns left the hillside bare

and, of course, susceptible to erosion which happened yesterday during the rain storms as we enter the start of a wet, rainy system. this is from the california geological surray and it shows the bay area and it's redder the area is, that means the area is more susceptible or greater risk for a landslide and that map is showing a lot of red. reporting live here in livermore, bob redell "today in the bay." >> everything gets to dry out today but certainly does feel like fall in the air. >> it is cool didn't feel historic in terms of our rainfall yesterday. but when you look at the numbers, a 1 before the rain tot totals. >> we have the most rain on that day in many spots like los gatos an in 1.5 and in san jose, over an inch of rain and also in lafayette. so, that was the most 24-hour rainfall totals that we had in

271 days. it dries out today, feels cooler. feels like fall after a morning start in the 40s in many spots we're only going to see those highs in the mid-60s and a few spots hitting the low 70s like santa rosa, as well, as well livermore. let's check in now with mike and still looking slow in the south bay. >> we had the crash and the bulk of it the commute starting right now for san jose. don't be in a rush for 101 northbound, it will slow you down. not a major injury crash. minor injuries at most just north of that camera shot and that might affect the off ramp, as well. the crash activity possibly sticking out to the slow lane with chp there, quite a distraction. that's 101. the rest of the south moves just fine, guys. this is the area and paterson is open. fender bender at greenville, but not a major issue and jump you over towards the bay bridge the onlier spot with congestion because the metering lights are now on, guys. back to you.

this is just an experiment in the bay area. other news this morning, speaking of deliveries, amazon says it will expand its leave for new parents. new moms 20 weeks and dads will get six weeks. compared to other companies, that's not huge. google offers dads 12 weeks and netflix offers unlimited but amazon is its own special case. it's never been particularly googly. jeff basos says he's not running a country club. amazon and facebook could soon pass over a $300 billion value. that will put them in a club with apple, microsoft and alphabet. one good stock rally for facebook would probably do it. it passed $250 billion in july. the fastest climb to that value for any company in history. digital the maker of candy crush was just sold to activision for $6 billion. that sounds like a lot of money but celebrating its ipo.

shares opened at $22 and change but just bought the whole company for 18 bucks a share. candy crush still makes money for the company, but we've seen this over and over, sam and laura. companies based on one game. zinga and king and candy crush tend to disappoint investors in the long run. $6 billion is a lot of money, but it's not what the company was worth on its own ipo. >> have you ever played that game? >> i have not played candy crush. >> have not either. have you? >> not part of this obsession. angry birds, all worth it. >> flying pigs. where is your money going? people in san jose will have a n tool to keep tabs on the spending. a reporter that tracks san za finances. say you want to see how much money is being spent on the police department or parks maintenance. now, you'll be able to find it easily online. the program will be available through the city's open data portal empowered.

great news. we'll dry out for the next few days with cool temperatures. a look at the outlook for san francisco. staying in the mid-60s, slightly cooler than average even as we head into the weekend and a look at that weekend forecast. this is what you can plan for. highs in the 70s across most of the bay area. in the trivalley, 75 degrees on friday. and also into the rest of the weekend, sunday, it's 74 degrees. and, once again, we'll be watching out to see if we could have some more rain moving into the bay area by sunday night into monday. and now let's check in with mike to see how it looks as you head out the door. >> kari, the bay bridge looks like this. this is not surprising compared to yesterday. it's drier. that's good stuff. metering lights and tuesday with what it is, look at your map. expect a big volume of traffic and we are seeing in some patches slowing coming off of the maze and down the berkeley curve. that's more than yesterday where things eased in because of that rain, as well. you noticed the green, the censors are green and we don't have the road sensor showing us

side of the world, israel, to investigate solutions to california's water crisis. steven? >> well, good morning, guys. we discovered that the problem with our drought isn't so much a lack of rain, but our own water policies. so, we went to where they've already solved a water crisis. the country of israel halfway around the world where about ten years ago they faced a situation similar to the crisis that california faces now. israel's government changed its entire approach to water. and worked with citizens to change their attitudes towards water, as well. israel leaders told me they started thinking about water like it was a national emergency. kind of like fighting the war on terrorism. now about a decade later, israel has more water than it can use. the country even sells the extra water to its former enemies, jordan and the palestinians. we spent the last three months learning what israel can teach california about overcoming our

the commute is moving now with mike. >> well, kari, we'll show you here, this slow drive right here. 101 just north of 680 and moved the camera up a bit. somewhere on the approach north 101 and 680 reports of a crash moving to the center divide. we'll show you on the map, that's coming up through here at this congestion point and the other crash on the shoulder and possibly the slow lane at oakland road and a new issue and maybe a stall north 87 and something is going on causing more slow down and the build is on gently for the rest of the south bay, but, again, tuesday will hit pretty hard getting closer to 630. south 680 moving smoothly and now three vehicles reported in the middle lane as you hit vargas. that will be an issue if they don't clear that quickly, we'll get an update from chp. typical build and pattern there as you pass by the san mateo bridge. upper east shore we have a stall or and then clear by the time you geet goldene
