and a very good now thursday morning to you. thanks for joining us. i'm laura garcia-cannon. >> i'm sam brock. busy start to your day. meteorologist kari hall joins us right now. >> we're raking it on through the work weekend. still cool this morning and we're dropping down into the 30s in the north bay and our sensors are picking up on some fog in the santa rosa area. that may cause some freezing fog with our temperatures dipping near 32 degrees and we're at 46 degrees in san francisco, so milder there. we're looking at 60s all across the bay, once again today. a few spots hitting 70 degrees and i'll detail that coming up in a few minutes, but let's check in now with anthony to see how the roads are moving. >> we actually do have weather, right? let's talk about some traffic. right now the bay bridge approach, things are looking pretty good here. what's happing in dublin because we see some slowing here. today not the case. just the typical build as you

see cars streaming on in from dublin and 580 and moving without a problem westbound direction. switching over to the maps, lots of greens on the maps and things moving without a problem. livermore same deal and into the south bay, no problems here all the way through santa clara, cupertino and palo alto looking good. new details now, more allegations surfacing against a santa clara county main jail. correctional deputies beat him. in the midst of an investigation into very similar claims. "today in the bay" kris sanchez joining us in the newsroom with new details on the latest allegation to surface. >> we're talking about a different inmate and two different correctional deputies but the same kind of beating and that is what a former gang member says he experienced and witnessed at the santa clara county jail. today an attorney for reuben garcia is expected to file a suit against santa clara county.

in if, he claims that guards beat him on july 2nd and broke his jaw. his lawyer says these are pictures of garcia more than a month later and he admits after a fight with another inmate. he did not report his own beating because he didn't want more of the same, but now feels like if he had come forward, thick things might have ended differently for this man michael tyree who in august was screaming for his life. >> if i reported what would happen to me. maybe mike would still be alive right now. >> now garcia did tell investigators what he heard on the night that michael tyree was beaten to death in his cell. three correctional deputies are standing trial for his death. they are matthew farri and rafael rodriguez. also a 25-member blue ribbon commission is investigating tyree's death at the jail. he was interviewed the night that tyree was beaten in his

cell. now, garcia, by the way, that suit that is expected to be filed today names two different correctional deputies. sam and laura. >> kris, thank you. happening today, a legal dispute among neighbors with a child with autism returns to a south bay courtroom. neighbors are suing a sunnyvale family over the parents' response to that behavior. the neighbors claim the 11-year-old boy has been violent against other children and as parents are not properply supervising him. that constitutes a nuisance and now suing for monetary damages. this despite the fact that the family is not living at the home. the judge is still hoping that both sides can settle their dispute. 5:03 right now and this morning investigators are looking for a motive for a rooftop gunman that terrorized a san francisco neighborhood. this as we're learning more on just how tense the scene was as it unfolded. >> the suspect's out.

suspect is not moving at this time. >> the man climbed up several stories before firing twice. police eventually shot and killed him. "today in the bay" stephanie chuang is tracking the very latest on the investigation. quite a scene. >> yeah, it was. you saw it there and you heard it there, but we did swing by the scene earlier this morning. it was completely quiet and clear. you might imagine. but, again as you saw in that video. very different scene unfolding yesterday afternoon when the man came in with the reports of a handgun and rifle walking up the stairs at a construction site at valencia. officers rushed to the scene. they could hear shots fired as they arrived. looked up and saw the suspect, a man in his late 20s dressed in white coveralls on top of a construction elevator on the sixth floor. and police got close and then say the suspect pointed a rifle down below towards the hospital. prompting three officers to shoot at the man killing him.

>> nobody appears to be injured in this active shooter incident. officers left the construction site. it's very fortunate that nobody else was more seriously injured or killed. >> now, this story actually starts even earlier at this big 5 sporting good store in san bruno where a man armed with a handgun and shells. police say the description of that stolen shotgun matches the shotgun in san francisco. we also saw police supervising a white truck behind police tape for hours. you can see getting towed away later last night. it's unclear, but it does appear to be, perhaps, the suspect's vehicle. police say the identity of this man won't be released until family is notified, we may learn that some time today and, of course, the motive behind all that unfolded yesterday. live here in our san francisco newsroom, stephanie chuang, "today in the bay."

builder, they want to build 53 homes on this five acres of land here. the builder would also like to add bike lanes and parking and like to demolish a nursery nearby and the jewish community center that sat vacant here for the past three years. concerned of neighbor that there would be more traffic and less open space and a loss of the semi-field that is in this area. one man we heard from questions whether a new project would somehow expose the area to flooding during heavy rains. now, the jewish community center which is selling the land to pulte argues that this development would create a new neighborhood full of people and lush landscaping. tonight, the city of walnut creek will take up those concerns of nearby residents and take into consideration what pulte and the jewish community center wants to do as they consider the environmental impact report. reporting live here in walnut creek, bob redell, "today in the bay." guess what, this will come as a huge shock, but another cold start to your thursday morning. but things are on the up and up. we're talking about the

temperatures, kari. >> warm up nicely throughout the day. dress in layers. you want to make sure you wear enough layers to stay warm this morning, but peel it off this afternoons once it warms up. very nice and comfortable. here is the lunchtime temperatures in the low 60s across the bay area and a lot of sunshine warming those temperatures up quickly. may even hit 70 degrees in the north bay, while the peninsula during the drive home at 66 degrees and the tri-valley up to 68 degrees. this is what we can expect over the next couple of days, but some changes ahead for the weekend. so, i'll detail that coming up in a few minutes. let's check in now with anthony to see how the traffic is moving. >> things have been pretty good this morning. no big concerns. but one concern right now near the bay bridge approach. this is actually the opposite direction of the main flow of traffic, but, nonetheless, want to point it out coming in from 580. headed over towards 13 and the ramp there is partially blocked because of an accident. i moved the camera and want to show you what i'm looking at. you can see for yourself, not

46 degrees and the south bay 42. let's get a closer look at the south bay. morgan hill at 39 degrees and also 39 in campbell and allenrock park at 40 degrees. opening up the picture, we do see low clouds and fog across parts of the north bay starting out at 35 degrees. as we go hour by hour in livermore. look at that temperature at 6:00. now, that's normally right before sunrise. we'll see our coldest temperature and then it warms up nicely. jumping 10 or 11 degrees. every couple of hours and by lunchtime at 63 degrees. a very nice afternoon. 66 degrees at 2:00. and then once the sun sets, our temperatures dipping, once again. expect it to rise up to 70 grees today in gilroy. half moon bay 67 degrees and sunny in napa, too. 66 in pittsburg, 71 in livermore, reaching 67 degrees. there will be more cool mornings, dry afternoons, but there's some more rain in the forecast that starts to move in

on sunday. especially during the morning heading into the north bay. could be a good soaker, too, before it rolls out of here. maybe you're done by the time we start out the morning commute on monday. but some of the first runs of the computer model show us that we could have at least a half an inch of rain. so, looking good as as adding more to those rainfall totals and trying to put a dent in the drought. dry on friday and saturday. nice comfortable temperatures and much cooler on sunday. only 59 degrees in san francisco. let's get a look at that morning commute with anthony. >> we've been talking about the bay bridge toll plaza from time to time. things haven't been active here but you can see from the last frame that we talked things are starting to on in here. we want to show you the traffic maps because there was an exit ramp that was blocked because of an earlier accident. if you're trying to get on to 13 this morning, keep in mind you run into an incident. coming across the san mateo

police ended up shooting and killing a gunman who made his way all the way to the top of a building under construction with two weapons. "today in the bay" stephanie chuang joins us from our newsroom with the latest on the investigation. this froze blocks in the mission yesterday. mreep people could not believe what they were watching. >> all unfolding in front of so many people's eyes. the police chief stressing it is incredible no one else was seriously injured or killed even, especially in such a busy part of the city. and you can hear that gunshot there. busy means a lot of witnesses and this is cell phone video captured by one of them near st. luke's hospital in the mission. police say it was after 4:00 yesterday afternoon when people saw this man walking up the stairs at a construction site arm would a handgun and a rifle. the police chief says officers could actually hear shots fired as they arrived, saw the susp t suspect, a man in his late 20s

living there. thank you, stephanie. the man accused of killing an east bay ice cream vendor expected to appear in court in just a few hours. lopez shot and killed the driver of an ice cream truck early last month. this happened in an east oakland neighborhood and police made that arrest on tuesday night. three men who broke into a hercules home are on the loose this morning. happened about 7:00 tuesday night near interstate 80. police say the suspect described as wearing ski masks knocked on a door, told the resident there they had the wrong address and then forced their way in. theal who live in the home tried to fight off the intruers who drove off without taking anything. new details this morning. punched and thrown around. that's what a former inmate claims happened to him while he was on the main santa clara county jail. he says he's now suffering from permanent nerve damage and his alleged attacker a correctional deputy. kris sanchez is in the newsroom now joining us with the latest in a now string of abuse allegations.

death in his cell in august is part of the case against the three correctional deputies standing trial for his death. matthew farris, jereh lubrin and rafael. now, two correctional deputies named in the suit that garcia's lawyer will plan today, again, are different from those three correctional deputies who are now standing trial. laura? >> very interesting case. thanks so much. 5:34 right now. students are organizing a new march today in response to a racially charged incident last week at berkeley high school. one week ago, more than 1,500 students marched to protest a racist message posted on a berkeley high school computer. a 15-year-old student soon admitted to posting the message and is now facing expulsion. students today organizing a solidarity march that is supposed to begin at noon. as we're talking about marches separately, students across the country organizing

marches to protest student debt today. and they're calling it the million student march. one of those marches is planned to start at 2:00 this afternoon at berkeley plaza. also city college of california are marching through downtown san francisco. they are protesting looming cuts to ccs staff and shrinking classes in the face of meeting new accreditation requirements. organizers say one quarter of the faculty could be at risk of losing jobs. it's 5:35. happening today, the next step in determining what to do with the five acre site in walnut creek. the land at stake sits along tice valley boulevard. worried a new housing project. "today in the bay" bob redell with what city leaders will be deciding today. >> laura, tonight the city of walnut creek will consider the impact this proposed project would have on the environment. now, keep in mind, housing is badly needed in the bay area and here in walnut creek, but people

who live in this part of the town are concerned that a project that be built at the old community center site, they're afraid it could return their neighborhood. pulte homes wants to build 53 homes on this five-acre parcel of land and add bike lanes and parking and lot to demolish a nearby nursery and the community center itself which has sat vacant for the past three years. the concern amongst some neighbor, more traffic and less open space. >> we have a character to the place right now and it should be preserved just because a developer shows an ability to do something, doesn't mean it should be done. >> we're going to be creating a neighborhood whether there was such a neighborhood before and people will be walking and biking and enjoying the beautiful lush landscaping. >> those are snippets of conversation taken from a meeting just last month.

==sam/cu== on the warriors' planned waterfront new details this morning on the warriors planned waterfront arena in san francisco's mission bay. looks like the parking plan is already kicking into second gear. port of san francisco members are already looking into using two large parking lots right near the proposed arena location. the port commission yesterday approved plans to create a parking management plan. and to look at logistics behind converting those sites into space for about 1,000 cars for arena events. the next step comes on september 8th when supervisors dewhether to approve the entire arena plan. today we can learn more about what is nextt for the silver and black. a live look at 0.co coliseum, the raiders current home. today oakland's mayor is expected to give an update on the team's status after yesterday's meeting in new york. libby shaft was there trying to

convince nfl executives to keep the raiders in the bay area. the team announced they hired a heavy-hitting ceo to move back to southern california. the plan includes a $1.7 billion stadium in carson, near downtown l.a. to be shared by the raiders and chargers. now, since the announcement, mayor released this statement saying, "i felt it was a positive discussion and that we were well received by the raiders leadership and the other nfl owners." the raiders could move as early as next year. >> time is ticking. no question about that. 5:45. million dollars homes on the peninsula, purchased but left sitting dark and empty. they're called ghost houses and many people say they're damaging the neighborhood. buying homes without the intention of actually moving in. in fact, they have been using tools to do so without seeing the properties in person.

fast-moving fire. the flames first broke out last night. at just three acres, boy, did it quickly spread to 40 acres within a matter of hours. so far no homes are in danger, but the rugged terrain is making it difficult for firefighters to reach those flames. and warm, dry temperatures certainly not helping them out. november is casting its spell across the middle of the united states. that is what meteorologists are calling the powerful, gusty storm that is expected to strike the upper midwest throughout tonight and tomorrow. many states are already dealing with power outages and tornadoings due to this phenomenon. there is a tree that has been pulled over. forecasters say a similar storm sank a ship on the great lakes 40 years ago. >> that's a wicked witch then. >> of the west or of the midwest. >> of the midwest. far way from us. we're going to get a check very quickly from anthony in a second regarding lighter traffic

flows today, but, first, a quick forecast, kari. >> be prepared. don't step out the door thinking it is still summer out there because it is not and you'll definitely get a slap in the face as you feel those temperatures. let's get a live look outside now from at&t park. we have clear skies and a chilly start to the day. not much of a wind and as we go into the afternoon, temperatures do warm up quickly under all of that sunshine. but, skies are still mostly clear in the north bay, it's 34 degrees. 43 degrees in the peninsula, but as we get a closer look at the north bay, there are some spots picking up on some fog, low visibility and especially up around novato into santaa. with those temperatures in the mid to upper 30s, that fog may freeze and create some slick spots on the roads. so, just be aware of that. through the morning commute in redwood city, we're at 45 degrees. fremont 43 degrees and then it warms up. here's your lunchtime temperature. in the low 60s in oakland and in

livermore, 63 degrees. but we're not done there. we continue to see those temperatures making it into the low to mid-60s. some of us, a few spots hit 70 degrees today. so feeling much better, but here's our next weathermaker. it is going to produce some snow up around oregon and washington for today and tomorrow as it moves closer to the bay area, it arrives early sunday morning. producing some rain for the north bay and then moving across the rest of the bay area throughout the day on sunday. and also bringing some snow to the sierra. we're looking at a pretty good soaking and some of the runs of the computer model. this is one model. it shows the possibility of 0.3 around san jose and then up to 0.5 for the north bay where it rains a little bit longer. a look at the weekend forecast. highs in the 60s in san francisco on friday and then look at how it goes down into the weekend with the clouds and rain on sunday. how is it looking on the roads now, anthony? >> things are looking pretty good.
