>> warm up nicely today. as we start out heading out the door now, you need to bundle up. look at these temperatures in the low 40s in the south bay and patchy frost possible there and also for the north bay where we had reports of some low visibility and some spots with temperatures in the low 30s. highs today in the mid to upper 60s. beautiful into the afternoon. and we do have some changes in time for the weekend. i'll detail that coming up in a few minutes, but let's see how things are rolling now with anthony. >> hey, good morning to you. things are moving pretty good this morning. major concerns, which are good news. things are picking up and coming through dublin. 580 westbound and you can see traffic starting to build here. no major concerns and switching over to the map. you can see what i'm talking about. the green tick marks have gone over to the yellow and green tick marks. same deal for hayward 880 into fremont, as well. across parts of the south bay, things moving pretty good and an earlier accident on 680 northbound and that's keeping things slow there. of course, 101 always slow at

this time of morning and that's starting to, as well. coming in from the san mateo, things moving pretty good. as we take you outside, no major concerns here and things moving without a problem. back over to you guys. 6:01. a gunman is dead, but why he fired his shotgun from six stories up in the air in san francisco remains a mystery. this chaotic scene all unfolded high above the ground as terrified people watched from below. now we know the story actually begins several hours earlier at a big 5 in san bruno. stephanie chuang. it appears the gunman had a bigger sort of plan, steph. >> it appears that way, laura. a lot of questions as you mentioned surrounding this, the big one, why? what was this man's motive? investigators are trying to figure that out this morning. but it all began to unfold first around 4:15 in the afternoon yesterday. witnesses reporting a man with a hand and rifle walking up the stairs at a construction site near st. luke's hospital on

cesar chavez. officers rushed to the scene and could hear shots fired as they arrived and looked up and saw the suspect a man in his late 20s dressed in coverall on top of a elevator. prompting the use of grenades before three officers opened fire killing the man. >> thanks to our security and the police department, their reaction was swift and our patients and our staff and all the contract workers here at the hospital were safe and secure throughout the incident. >> of course, that's the good news from yesterday. police chief saying about half an hour earlier, the same suspect used a handgun to rob this big 5 sporting good store in san bruno stealing a shotgun and shells. we also saw police supervising a white truck behind police tape for hours. you could see it getting towed away there last night. it's unclear, but it may be the suspect's vehicle. now, as for who this man is,

we're still waiting to find out. police say the identity won't be public until, of course, next of kin and all family has been notified. so, we may learn the identity some time today. live in our san francisco newsroom, stephanie chuang, "today in the bay." a terrifying scene and no shortage of witnesses there as that area of the mission where it happened a very busy part of san francisco. when folks heard the commotion they immediately grabbed their phones and hit record. >> a wince caught one gunshot on camera. another man saw he saw dozens fleeing as far from that building. >> the construction workers from the top of the building so they wouldn't get hit. >> i started to follow the cops. stupidly. and as soon as i turned the corner here, i heard a single g gunshot. so i stopped. cops kept going. >> at this point, just duck and cover. again, no one on the ground was actually hurt.

this construction site is well known and well funded. the $2 billion project broke ground back in september of 2011. when complete it will become the new st. luke's hospital. rightt door to had existing one. the current building will be demolished. construction is expected to be complete by 2020. an update to a story we first brought you as breaking news yesterday morning. a link between two drive-by shootings on interstate 80. the latest one happened tuesday night. the gunman opened fire on a car killing the male driver and injuring his female passenger. authorities the shooter and the victims knew each other. police right now are investigating if this shooting is connected to a one last monday on i-80 in san pablo. police say a man in his car was shot multiple times there. he is expected to survive. police believe the target in both shootings were not random. at 6:04 right now. new allegations of abuse behind

the walls of the santa claray main jail. this time by inmate who claims he was beating around the same time as michael tyree. three krexzal deputies are now charged with tyree's death. kris, we're talking about a different inmate and different guards even. >> right. but he was beaten, allegedly, around the same time and also heard the beating of michael tyree which we know ended in his death. former gang member says that he experienced and witnessed this while he was at the santa clara county jail. an attorney for reuben garcia today is expected to file suit against santa clara county and in that suit, garcia claims guards beat him on july 2nd, broke his jaw and lawyers say these are pictures of garcia more than a month later and also after a fight he had with another inmate. he admits that. garcia says he did not report the beating because he didn't want more of the same, but now feels like if he had come forward at time, things might have ended differently for this

man, michael tyree who was beaten in his cell in august. >> felt guilty because if i would have reported what would happen to me at the time, maybe mike would still be alive right now. >> garcia did tell investigators what he heard on the night that michael tyree was beaten in his cell. three correctional deputies will stand trial for his death. they are matthew farris, rafael rodriguez and jereh lubrin. a blue ribbon commission is also investigating tyree's death at the jail and other inmate claims of brutality. in his suit, garcia claims he was beaten by two different correctional. something we'll watch for as those documents are filed in court today. sam? three men who forced their way inside a family's hercules home are on the run this morning. it happened about 7::00 tuesday night on partridge drive right near interstate 80. the suspects knocked on the door

and told the resident the wrong address and then they forced their way inside. the suspects were reportedly wearing ski masks. the people who live in house say they grabbed sharp objects to try to scare the suspects off. the men got away without taking anything. a man is in jail after a bizarre showdown with san jose. police say nathan wong confronted them early yesterday morning wearing a military outfit and carrying an assault rifle. officers showed up at his townhome on baltista place after neighbors reported he was trying to get into their third floor window. he greeted officers with an assault wildfire. an officer fired at him after he lifted his gun at police. he later surrendered peacefully without anyone getting hurt. 6:07 right now. happening today a legal dispute among neighbors over a child with autism now returns to a south bay courtroom. neighbors are suing a sunnyvale family over the behavior of

their child and the parents' response to that behavior. the neighbors claim the 11-year-old boy has been violent against other children and his parents are not properly supervising him. to them, that constitutes a nuisance and they're now suing for monetary damages. this despite the fact that the family is currently not living at that home. the judge is still hoping that both sides could settle the dispute among themselves. investigators are still trying to piece together what caused a man to lose control of his big rig smashing the into this home yesterday. the driver was working in the neighborhood and somehow crashed through a gate, hit a small boat and ended up in the garage. the home, as you see there, i don't really have to tell you, but it's heavily damaged. >> not looking too good. our microclimate forecast is in full effect living up to its name because we have gaps in some of the temperatures out there. >> really chilly in the north bay and also patchy fog, maybe freezing creating icy spots on the roads.

a look now at san francisco, 46 degrees and 41 degrees now in the south bay and as we get a closer look, some spots have dipped into the mid-30s like gilroy as well as downtown and willow glen 36 degrees. expect a chilly start to the day, but feeling so much better this afternoon. 66 degrees in los gatos and 66 and embarcadero at 64 degrees. looking at mid to upper 60s, as well, for the north bay, east bay, as well as the tri-valley and a few spots may hit the 70 degree mark. i think more 70s heading into tomorrow. so, a lot more comfortable weather before the next cold front moves in. i'll detail that coming up in less than ten minutes. but let's see if there is any slow downs on the roads now with anthony. >> oh, yes, what do you think of this? that's a slow down, right? pretty bad stop and go and this is the bay bridge toll plaza. the approach has been stop and go really for about half an hour now as our sun rise to come up.

40 degrees and santa rosa is 35 and not much of wand this morning and that's the reason why we've had the low clouds, some fog and some patchy frauts, too. as we go into the day, our winds coming in from the north maybe five to ten miles per hour. don't expect it to be breezy with a calm wind, all this sunshine and our temperatures will be a little bit warmer today at 9:00 in san francisco we're at 52 degrees and 57 degrees at 10:00 or 11:00, rather. by the early afternoon hours, some low 60s there. and, once again, not very breezy with mostly clear skies tonight, we dip back into the mid-50s. here is the next weather maker. it is now producing some rain and some snow moving into oregon and moving into washington. as we into the next couple of days, that approaches the bay area. it starts out with some rain early sunday morning for the north bay and then moves else where across the bay area farther to the south, producing some snow in the sierra by sunday night. looks like we could have quite a

bit of snow there and a decent amount of rain for the bay area between sunday morning and sunday afternoon. the possibility of at least 0.3 of rain for the south bay, east bay and peninsula. and the north bay may have up to 0.5. looking good. a dry start to the weekend. expecting highs around 69 degrees tomorrow in the peninsula. 67 and temperatures will be cooler on sunday with more clouds, once again, that rain moving in. a cool shower and as we head into next week, alsoing slightly below average for this time of year. let's check in now with that morning commute with anthony. >> i will take below average and cloudy and cool and we had our fair share of warm days. let's talk about some traffic now. we don't have any major concerns. things are starting to slow from 880, san leandro all the way down dwordz ftowards fremont. no big surprises there. keep in mind, it is starting to happen right now. across parts of the south bay, we are starting to see some slowing on 101 where we usually

that forecast. >> happy friday eve as we start out with chilly temperatures this morning. bundle up as you head out the door. look at where we are now across the bay area. feeling more comfortable in san francisco and still. it's 46 degrees but the north bay is down right chilly with some patchy frost and also some fog, as well. highs today reaching the upper 60s in the north bay and the rest of the bay area also in the low to mid-60s. a few spots may hit 70 degrees. i'll show you where, but let's check in now with angany to see how it is looking in the south bay. >> we don't have any major accidents in the south bay. but in fact two of them on 280 and two of them on 101. you see this is on the northbound side of the highway. 92 inwood there the accidents there and also 101 at millbrae and past near the airport. 101 northbound and 280 northbound are slow for at least the next couple of hours as these accidents get off across the shoulder. slow down towards hayward and

same thing for the san mateo bridge getting on from the east bay, things are slow, at least from that direction. across parts of the south bay, things are starting to slow down across 101, especially. this is where we see the slowing as we take you outside. you get some brakes and seeing the typical slowing and not at all that bad. especially when you have the beautiful sunrise to look at. back over to you, sam. >> thanks, anthony. new claims of abuse and different guards the same jail. today a former inmate at the santa clara county main jail is going to file a claim saying that he was violently beaten by guards. "today in the bay" kris sanchez this comes as the jail is under fire for the alleged death of another inmate. >> these two cases are are linked in a way that is part of the investigation into the death of inmate michael tyree. reuben garcia whose attorney is expected to file suit against santa clara county today.

there was a man walking up the stairs of a construction site arm would a handgun and a rifle. the police chief says officers could actually hear shots fired as they arrived and saw the suspect, a man in his late 20s, dressed in white coveralls on top of a construction elevator. he pointed a rifle down below towards the hospital and that's when three officers shot at the man, killing him. witnesses describing the chaos that unfolded. >> we went down the south stairs and saw a man shooting a gun. shooting a long, dark shotgun. >> the police chief says about half an hour earlier, that same suspect used a handgun to rob this big 5 sporting store in san bruno. stealing a shotgun as well as shells. he also saw police supervising a white truck that you see there getting towed away. had been behind police tape for hours last night. it's unclear, but it may be the suspect's vehicle. there is also a chance we'll learn the suspect's identity some time today as investigators try to uncover his motive.

live in our san francisco newsroom, stephanie chuang, "today in the bay." 6:34 right now. the man accused of killing an ice cream east bay vendor is expected to appear in court in just a few hours. lopez shot and killed the driver of an ice cream truck early last month. it happened in east oakland neighborhood. police made that arrest on tuesday night. well, a vaping is the new smoking. "mercury news" reporting that a new palo alto city county that it is banned where tobacco is already outlawed. they still have to approve the measure. the committee also talked about new regulations on tobacco sales, but could not agree on supporting efforts to raise the legal age from buying from 18 to 21. happening today, the next step in determining what to do with a five-acre site in walnut creek.

neighbors are worried it is a new housing project. bob redell live in walnut creek with why some locals are saying, not in my backyard. >> laura, even though housing is badly needed here in the bay area, peep who live in this part of walnut creek fear that a new housing project built here at the site of the old jewish community center could ruin their neighborhood. pulte homes wants to build 53 homes on this five-acre parcel of land. add bike lanes and parking and lot it to demolish a nearby nursery and the community center which sat vacant for the past three years. the concern from neighbors is more traffic, less open space. >> add character to the place right now and it should be preserved just because a developer shows an ability to do something, doesn't mean it should be done. >> we're going to be creating a neighborhood where there wasn't a neighborhood before and people will be walking and biking and

enjoying the beautiful lush landscaping. >> one man who is opposed to the development questions whether a new project would somehow expose the area to flooding during heavy rains. tonight, the city of walnut creek will take up those concerns of nearby residents as it considers the environmental ime impact report. >> bob, thank you. staying in the east bay, students across the country are organizing marches to protest student debt today. they are calling it the million student march and one of those marches is planned to start at 2:00 this afternoon at berkeley sprawl plaza. also this afternoon, city council will march right through downtown san francisco and protesting looming cuts to staff and shrinking classes in the face of meeting new accreditation requirements. organizers say one quarter of the faculty could be at risk of losing their jobs. don't let the cooler, wet weather fool you. it is still fire season and this brush fire burning in southern

california is proof. it's happening near simi valley. the flames started last night and went from 3 to 40 acres quickly. crews do have that fire fully surrounded now this morning and luckily no homes are threatened. take a look at this, they're calling it the witch of november. casting its spell across the middle of the u.s. that's what meteorologists say that powerful, gusty storm is expected to strike the upper midwest throughout tonight and tomorrow. many states already dealing with power outages, tornado warnings due to this phenomenon. just tossing cars there. forecasters say a similar storm sank a ship on the great lakes 40 years ago. >> a mystery on the lake. >> it sounds like a tale, right? >> it does. halloween we're a couple weeks old on that, but, still, it has staying power. let's get a check of weather right now with kari hall who is down for a good mystery now and then. >> they exthe winds to kick up to near 60 miles an hour near the great lakes. here we have gentle breeze and cool temperature.

no complaints about this cold as we take a live look from mt. hamilton. a clear start to the day in oakland and sunnyvale. it's 43 degrees. napa, it's 37 and 35 degrees in santa rosa where we also have some patchy frost. highs today will be warming up nicely in the mid to upper 60s. up to 60 degrees and napa 66 degrees, oakland 67 and dublin looking at 65 degrees. over the next few days, more of the cool mornings and warm afternoons. but we do have some rain in the forecast. i'll detail that coming up in about ten minutes. let's check in now with anthony to see if there is any slow spots with that morning commute. >> oh, yes. definitely some slow spots this morning in the a couple accidents on 280 and couple accidents on 101. one at edgewood and also on 101 northbound two accidents on northbound side. one in millbrae and the other one just past that right at hillsborough.

keep in mind you'll run into some very slow going here across the peninsula over the next half hour or so. across the east bay, things slowing from hayward getting on to the san mateo bridge and take you outside and show you what it looks like. you can see for yourselfing into the foster city side, same deal. metering lights have been on since about 5:and there you can see it for yourself, stop and go, again. again, beautiful sunrise. >> yes, let's focus on the positive. slow going out there, quick action here. a livermore veteran being called a hero for saving a dog. >> this is destiny on the left and her sister, lacy. the two were driving in livermore when they say a home, they saw a home on fire. the sisters got out to make sure no one was trapped inside when destiny ran around the back she noticed the family's pet pug. she went in through a sliding glass door and grabbed the dog. she was a marine sergeant and ended up saving it. >> because our pets are part of the family, too. >> that's nice. bloomingdale's on the

sea food fest where they will inform the community on how to enjoy seafood. all of this coming about after toxins were found in bay area dungeness crabs about two weeks ago. those toxins forced the department of fish and wildlife to delay crab season still in jeopardy. this new event will take place at the end of january. from our nbc helicopter in new york. take a look, you can see a man down below shining a laser right at the chopper. it happened as the crew was flying to breaking news story in downtown brooklyn. around the same time, an nypd helicopter was also hit by a laser. both pilots track the suspects and with their help, police on the ground were able to take two men into custody. one of the men was arrested. a popular seattle tourist attraction is back open this morning. we're not talking about the space needle. the great wheel was shut down for some time yesterday after it was struck by a rogue drone. just before 5:00 yesterday, police say that a drone hit an

arm of the iconic ferris wheel. the drone then fell crashing on to a picnic table below. park managers snapped this photo. you can see the damage. it will come here in a second. witnesses say that it appeared, there you go, it appeared that drone was trying to fly through the spokes and didn't make it. luckily nobody was hurt. >> i can't figure out why somebody would fly a drone so close to other human beings. i don't get it. >> seattle police confiscated the drone and they are now looking for the owner. 6:46 right now. shares at amazon opened to another all-time high this morning. >> people like ordering online. we knew that. >> and less in less in stores is the other side of that coin, sam. particularly old-fashioned department stores macy's going the other way this morning. down 14% and another 1% today after the company said for the third quarter in a row, same-store sales were down.

people are shopping less and less at macy's each month. air bnb is suggesting its policies to ensure people renting out their homes or rooms in their homes actually live in homes and are not just opportunistic landlords. how exactly the company will do that is not clear but may start with people who rent more than one property in the same city. they point out the company was created during the recession as a way for a homeowner to make a couple extra bucks from a spare bedroom and create a less expensive way to travel. it did not anticipate a world where a whole apartment building was purchased and then taken off the housing market to rent out to out of towners. taking a look at the markets should be fairly quiet this morning as we listen to several fed officials talk about the future of interest rates. >> you have to leave the store because you might steal something. apple has apologized after three students in australia were asked

francisco and some of the warmest temperatures there because we do have some upper 30s in the north bay, as well as the east bay. let's take a closer look at the east bay where in santa rosa you have some fog, maybe freezing creating some slick spots on the roads. get out there early if you can. and in novato it's 66 degrees and napa at 36. so, after some patchy frost this morning. it will be a pleasant afternoon. and here's your lunchtime temperature as you take it outside. still some long sleeves needed the east bay. 63 degrees the south bay. 61 and in as you head home in the east bay, it's 68 degrees and also in the tri-valley. the peninsula. 66 degrees. great day for riding home with the windows down and you can turn the heater off after having it blasting this morning. another cool day and also as we head farther to the north, we are looking at some rain and some snow in the higher elevations. as that moves closer to the bay area, that should arrive early

on sunday morning. starting in the north bay and then moving else where across the bay area. as we go into the rest of the morning and early afternoon. and also bringing in another moderate snow for the sierra. so, looking at the possibility of another several inches of snow there. here we're looking at maybe 0.3, close to 0.5. some of the early runs of these computer models giving us an idea of how heavy the rain will be. looks like we could see a good soaking before we head into a cool start of next week. if you're making plans for the weekend, friday, saturday looking good. expect highs in the low 60s, but by sunday, it will be cooler with some spots not making it out of the 50s like san francisco and low 60s in the east bay. so turning much cooler with some of those showers and some clouds. let's check in now and see how the morning commute is going with anthony. >> good morning. things are looking pretty good in san jose right now. we do have some accidents starting to pop up from chp. start you off with this shot.

morning. police say the suspects knocked on the door and toldriesdant they had the wrong address before forcing their way in. the suspects were reportedly wearing ski masks. the people who live in the home say they grabbed sharp objects to scare the suspects off and then got away without taking anything. new details now on last month's deadly usair strike at a doctors without borders hospital in afghanistan. the ap reports the u.s. military team have called the strike was a half mile away and could not actually see the target. they apparently ordered that strike at the request of afghan military allies who may have resented the charity hospital because it treated taliban victims, as well as afghan forces. and would refuse patients who were armed. at least 30 people died in that strike. doctors without borders has since pulled its operations from the region. an army veteran credited with saving his patrol by tackling a suicide bomber will receive our military's highest honor today. president obama will award

gunman opened fire right in the 6:56. today we may learn why a gunman opened fire right in the middle of san francisco's busy mission district before he was eventually shot and killed by police. that chaotic scene brought the area to a standstill. >> people couldn't believe what they were watching. "today in the bay" stephanie chuang joins us live from our san francisco newsroom. this man's crime trail started ten miles away. >> thankfully ended in san francisco without anybody else getting hurt, especially in such a busy part of town. we heard many witnesses who saw and heard the chaos unfold. >> the suspect down. suspect is not moving at this time. not sure if he has been hit. >> police say it was after 4:00 yesterday afternoon when a suspect dressed in white

coveralls climbed aboard this is near st. luke's hospital in the mission. the police chief says officers could actually hear shots fired as they arrived, saw the suspect pointing a rifle down below towards the hospital and that's when three officers opened fire killing the man. the police chief says about a half hour earlier he used a handgun to rob a sporting goods store in san bruno. still a lot of questions and we may learn more about the identity and this man, this suspect as investigators work to try to uncover his motive. live in our san francisco newsroom, stephanie chuang "today in the bay." >> thank you very much. now, let's bring in "today in the bay" kris sanchez. new claim of abuse expected to be found today across the santa clara county main jail. >> this lawsuit claims the beating of a former inmate who is also an inmate who claims he heard the beating deaths of michael tyreee a month later. these are photos of reuben

garcia. after jail guards beat him and broke his jaw and after a fight he had with an inmate a day later. he didn't report the beating of the guards at the time, but he wishes he had. >> feel guilty because if would have reported what happened to me at the time, maybe michael would still be alive right now. >> garcia was in the cell next to this man, michael tyree. he heard the beating that killed him in august. his account is part of the case against the three deputies now charged with tyree's murder. by the way, these are not the same guards that are named in garcia's suit, which his attorney plans to file today. laura and sam. >> thank you very much. 6:right now. now an update on the story we first brought you yesterday morning. investigators there may be a link between two drive-by shootings on interstate 80. the latest one happened tuesday night. the chp says the gunman oep oened fire on a car killing the male driver and injuring his female passenger.
