good thursday morning. a busy one. thank you for joining us. i'm sam brock. >> i'm laura garcia-cannon. some rain on the way. >> it will hit the north bay starting this morning, then moving into the rest of the bay area by lunch time. right now though it is all dry out there as we start out in the upper 40s. once again the rain moving in. grab the umbrella before you head out. highs today will be in the lower 60s for the peninsula, 56 degrees in the east bay and the north bay up to 59 degrees, cool, chilly and windy. i'll talk about the winds, the rain and when it moves in and out. that's all coming up in the microclimate forecast. l let's see where we're slowing down. >> we are checking the span now, there's the incline back at the speed you would expect, a little slowing on the san francisco side of treasure island. a couple of flashing lights. still a crew clearing over towards the san francisco side after they cleared some debris on the road. but all lanes are clear.

no back-up at the toll plaza. a smooth drive on the approaches, just the slowing you saw heading in toward the westbound san francisco side. northbound 880, a crash at maria boulevard in san leandro. it is a concern off of 238. that crash is off to the shoulder, we'll track any updates through chp. south bay and peninsula is still at speed. continuing our coverage no you of the massacre in san bernadino. a neighborhood still on lockdown as a community wakes up to shock and disarray. this after two heavily armed shooters opened fire on an employee holiday party yesterday. >> what we know so far -- 14 people are dead, 17 others wounded this morning. hours after the attack, two suspects, a man and his wife, were killed in gun battle with police. they've been identified as 28-year-old syed farook, and 27-year-old tashfeen malik.

>> right now there are still three very active scenes. the inland regional center where the shooting happened, the roadway where the two suspects were shot and killed by police, and a nearby home where a police search continues. >> we have team coverage on the investigation from the scene of the massacre to national reaction this morning. first let's go straight to "today in the bay's" peggy bunker live in san bernadino with new details on the suspects. good morning, peggy. >> reporter: good morning to you, laura and sam. as you just mentioned, so many different active scenes all around the city san bernadino. when we arrived here last night police were on the lookout for what witnesses say were three different shooters. we now that there were just two shooters, a married couple. syed farook, 28 years old, and his wife, 27-year-old tashfeen malik. syed farook was an employee here for five years as a health inspector. the county had rented out that room as part of a holz pariday .

witnesses say he left the party angry and when he returned, he and his wife were armed to the hilt, wearing military style clothing. they had assault rifles on them. that's when they unleashed these bullets on 14 people, killing 14, injuring 17. and then the search began looking for them. that black suv later pulled over on the side of the road on san bernadino avenue. the entire area completely shut down as police looked to make sure that they were the only ones looking for explosives or any kind of bombs. also being searched -- the redlands neighborhood where they lived. listen to what neighbors said when police descended there. >> it is shocking to me. i live 2 1/2 blocks from here. to think that these people lived in this neighborhood so close to me and this happens. >> reporter: they say they were using those flash bangs there. there were cars that police apparently were breaking into just to make sure there were no

explosives left behind. shocking to learn this morning that the couple left behind their 6-month-old baby girl, allegedly with her grandmother, to come here and commit this assault. once again still a very active scene here. police have been working throughout the night get being more details. we are doing the same. we'll bring you the latest from the scene. back to you. >> peggy, thank you. as you can imagine, shockwaves going from california now to washington, d.c. let's turn to "today in the bay's" kris sanchez with reaction from politicians on this latest massacre. >> it is already sparking another debate over gun control but likely a debate that will go no with are. in this country there have been more mass shootings than there have been days in this year. in fact the shooting in san bernardino last year was not the first mass shooting of the day. >> i would like to have a brief moment of silence. >> yesterday's session of congress began with a moment of silence but there are likely be

little talk about gun legislation because of a big budget deadline looming. president obama's response that people who would not be allowed to fly by the tsa could go into a gun store and fly a weapon, adding that there is no way to prevent all mass shootings but that common sense gun laws would make it harder for suspects to carry out a mass shooting like we saw at san bernardino. this mike huckabee. he questioned how it happened, while california senator dianne feinstein answers frankly saying it is because lawmakers and congress have a "debilitating fear of upsetting the national rifle association, the nra." >> one, a mentally unstable person. two, a gun-free zone. and those seem to be the common denominators. >> until americans wake up and say, look, we've had enough. congress, do something to stop this, we are stuck with people who are driven by what the nra thinks.

>> feinstein says she's been pushing for stricter gun control laws since she was mayor of san francisco back in the '80s and that things have gotten worse and not better. there has been a lot of shows of support and requests for prayer on social media from republicans and democrats alike. a lot of folks saying though that prayer is not going to fix this. we're going to continue to follow the political fallout throughout the morning. >> you know this conversation just continues after each episode of this sort of massacre. this is a live look right now of the inland regional center where this massacre took place yesterday. this is from our helicopter, our chopper down in l.a., knbc. again that is still a very active scene there. it is a facility that cares for people with developmental disabilities. that was the site of yesterday's massacre. we'll continue to update the story throughout the course of the newscast and the day, both on air and online. just head to nbcbayarea.com for

the latest breaking details. we have a team of reporters in san bernardino where we'll anchor the coverage from our evening newscast. breaking this news -- morni morning, guilty of murder. >> oscar pistorius after previously being charged with manslaughter, an appeals judge has reversed that. what's next? >> oscar pistorius, the paralympic superstar, known as the blade runner, could be sent back to a south african jail cell for many, many years over the past several hours, a south african appeals court overturned a lower court's conviction of pistorius on the lesser charge of manslaughter and instead convicted the double amputee paralympian of murder from shooting his girlfriend reeve steenkamp. >> the convicted are set aside and replaced with the following,

guilty of murder with the accused having had criminal intent. >> reeve steenkamp's mother let out an audible sigh in the courtroom when the judge announced the decision. the appeals court found that the lower court made a "fundamental error" in convicting pistorius of manslaughter. prosecution has argued pistorius shot steenkamp during an argument. pistorius has said he thought he was shooting at an intruder behind a door in his home and this morning's ruling the appeals court says pistorius should have known someone could be killed if he fired his gun regardless of who was behind that door. the case now goes back to a lower court for sentencing to take place. most likely next year. pistorius could face a minimum 15 years in jail. his current manslaughter sentence is five years in jail but he was released in october after serving less than one year. the rest of that sentence could be served out under house arrest. >> pretty good news this morning. >> a long process for the families involved as well. 5:08 right now.

officers are on paid leave this morning. the five san francisco police officers are on paid leave this morning. they shot and killed an armed man in the city's bay view district yesterday. "today in the bay's" stephanie trong is live in our newsroom. >> caught on camera by a passenger on a muni bus again in the city's bay view district. in the video you can hear some people talking to the suspect.

you could hear someone tell the suspect to "just drop it." in this video posted on instagram, it captures the moment san francisco police officers shot and killed a man they say was holding a knife. five officers opened fire on the man around 4:30 yesterday afternoon about half-an-hour after a different man told police he had been stabbed. police found and cornered a man matching the given description ordering him to drop a knife. the chief says the officer shot a bean bag gun but that the suspect got back up and headed toward one officer. >> one of the officers cut off his path. he went towards the officer and that officer and four other officers fired. >> reporter: the chief says the suspect was holding a kitchen knife about six to eight inches long. police have not identified that man, only saying that he was in his 20s. internal affairs and the d.a.'s office are both conducting separate investigations into this shooting. meantime, that stabbing victim who reported his injuries to police is expected to survive.

live in our san francisco newsroom, stephanie traun, "today in the bay." technology proving to be a useful tool in tracking crime. since equipping patrol cars with automatic license plate readers about six months ago, alameda police have recovered about 28 stolen vehicles. it's helped officers arrest at least a dozen people for theft, drugs and other possible crimes. the technology can scan hundreds of license plates per minute on moving and parked cars. it can also capture photos of the plate and its gps coordinates. it is 5:15. new labels are coming to your food. >> but will you be able to read them? that's the question scott mcgrew tries to answer. >> it is a debate between environmentalists and food manufacturers on the other. on wednesday a food manufacturers's group announced what it calls smart labels in the form of qr codes. these new labels will tell you more information about what

you're eating beyond the federally mandated nutrition labels that are on the left that you've become accustomed to. things like potential allergies, perhaps even if the food has been genetically modified. but, you can imagine the problem. you can't read them unless you have a smartphone and you have to bother to do it. critics complain not only can those who might need the information most, like the poor and elderly, not have smartphones, if they did, they probably wouldn't know what to do with a qr code. hershey's is one of the very first that will start this with this qr code. you'll be able to scan it and learn more. to the food manufacturers, this is proper labeling. food labeling came into focus as genetically modified foods started to enter the market. gm salmon was just approved but you are not going to know you're eating it because the u.s. does not have a mandatory gm labeling law. let's check the rest of the news before the bell.

landon down yowdy is live at cn headquarters. >> the market hooks a rebound today. stocks fell yesterday following comments from fed chair janet yellen who says she's looking forward to an interest rate hike which would be testament to the u.s. economy's recovery from the recession. oil prices are edging higher today after tumbling yesterday on data showing u.s. crude stockpiles rose unexpectedly last week adding to concerns about a supply glut. we get data today on unemployment and the services sector. the nasdaq lost 33 to 5,123. >> just when you thought gas couldn't get cheaper. all right. thanks. say you left a concert, you call your uber, you and everybody else. how do you know which is your uber? how about a colored light? uber says it will test this idea in seattle to see if it is effective. you choose your color. your uber lights up that color.

conditions. a look at the, it's no you coming up at the bottom of the screen. here's what you can expect as we head out. we are seeing on the radar some of the rain rolling farther to the north. not in the baird y area yet buts system is moving closer and with that, winds will increase, clouds roll in and showers by mid morning. there's some pockets of some heavy rain in there but this looks like it could fizzle out some as it moves in closer. a lot of yell lows and reds here showing some intense rain as it is offshore. but then as it moves inland and into the north bay, we're seeing more of the greens there indicating the moderate rainfall and it starts at about 10:00 in morning, moving into san francisco and the coastal areas as well. then it spreads into the south bay. a lot of that rain weakening and it becomes more scattered. it won't be a solid rain like we saw recently. as it moves off to the east, it will kind of become more scattered once again, not expecting any storms.

snow in the sierra once again that could continue at least until tonight. so the rain futurecast shows that we could have some rainfall totals anywhere from an inch in the north bay where, once again, it will be heavier, then it weakens and moves to the south. we are being llooking at maybe one-tenth of an inch. at times sustained winds along the coast up to 43 miles an hour in inland areas, some gusty winds at 30 miles an hour. yeah, that's enough to flip that umbrella inside out. keep that in mind with the gusty winds and the rain. be prepared for it all. i'll have a look at the weekend forecast coming up. but let's see what's going down now with mike. >> some spots are slowing down. folks heading to the san mateo bridge, you're fine if you're heading to the peninsula side, west 92, the peninsula at speed. east bay side, the hayward city side, traffic is building coming off of 880. not in you have to slow the censors but the slowing northbound 880 away from the san

killed during a shoot out with police about a half-mile away from the original shooting scene. a neighborhood still on edge this morning in redlands where investigators continue to search for anything that may help them understand how and why it happened. we have team coverage on the investigation from the scene of the massacre. first let's go to "today" in the bay's peggy bunker live in san bernardino with new details on the suspects. peggy? >> reporter: good morning, laura. here at the inland regional center, still very, very busy but another neighborhood, the redlands neighborhood that you mentioned, also on complete lockdown this morning, that's been an active scene all night long. neighbors in that area are still on lockdown. police are still looking for any sort of crime detail. we also talked to a lot of neighbors that lived in that area. they say they are completely shocked by the situation. on wednesday afternoon police raided a home in redlands that

public records show belonged to the farook family. a married couple in their late 20s. police say they lived in this home with the farook family. it was from this address that they pursued the suv that left the redlands flabd. that's when they were shot and killed inside the suv but also the bomb squad staying behind to see if there are any cars nearby in that neighborhood that perhaps needed to be detonated or any devices left behind by the two suspects. so they were investigating cars, looking in trunks. the s.w.a.t. truck was there breaking apart windows just to be on the safe side. neighbors who lived in the area say they just couldn't believe what they were seeing. >> cops were just coming like quickly. then they all got out and started to shoot. so then i put my car in reverse, stop right there and put my head down because they were shooting. >> someone ran wearing

camouflage with orange shirt. >> reporter: of course that's one of the interesting details. that's one of the interesting details there, that police are looking at now, the fact that the couple was here attending the holiday party and they left and some say it was just about 30 minutes later they were back wearing the assault style clothing armed with rifles. so how much premeditation was involved in this is something that police are very much looking into today. we'll continue to follow those details and check in with you here in a little bit. >> thanks so much, peggy. >> now reverberations from yesterday's tragedy in washington. let's turn to "today in the bay's" kris sanchez with reaction from politicians on this latest massacre. it is already sparking a conversation over gun control and what many call an epidemic of mass shootings. >> in this country, sam, there have been more mass shootings than days in the year if you consider a mass shooting in which four or more people were shot. in fact the shooting in san bernardino wasn't the first mass

olympic star oscar pistorius has been found guilty of murdering his girlfriend back in 2013. >> this comes after he was previously charged with manslaughter. >> laura and sam, overnight in a south african appeals court, they over turned that manslaughter conviction and instead convicted oscar pistorius of murder. murder of his girlfriend, reeve steenkamp. the five-judge panel ruled that the paralympic all-star never offered an acceptable explanation for why he shot and killed steenkamp on valentine's day in 2013. pistorius has argued that he thought he was shooting at an intruder behind a door in his home. the judges say that, regardless of who he thought was behind the door, he should have known that someone could be killed. the prosecution has argued pistorius shot steenkamp during an argument. pistorius now faces up to 15 years in jail for this murder conviction. sentencing is expected some time next year. he's already serving a five-year sentence for the initial

manslaughter conviction. less than a year was spent in a jail cell before early release in october. now the rest of that sentence is to be served under house arrest. pistorius, double amputee, known as the played runner, shot to fame during the london olympics in 2012 as he competed against other able-bodied runners. laura? sam? >> bob, thank you very much. now back home, five san francisco police officers on paid leave this morning. they shot and killed an armed man in the city's bay view district yesterday, all captured on camera. stephanie, someone actually caught it on their cell phone in a muni bus stasing by. >> yeah, someone did, sam. imagine a deadly shooting unfolding in front of people's eyes and it was caught on camera by one passenger in the bay view district ending with this. you can hear that gunfire in the video posted on instagram

capturing the moment five different san francisco police officers who sort of half-circled the suspect opened fire killing the man who they say refused to drop a knife. this was around 4:30 yesterday afternoon. the police chief says officers found and confronted this man after a different man told police he'd been stabbed. the chief describes how officers ordered the success mekt to drop the six to eight-inch kitchen knife and then used non-lethal weapons. >> they deployed the standard bean bag gun several times striking suspect. he did not drop the weapon. supervisors from bay view station were reminding officers at the scene to attempt to create time and distance. however, this suspect had already demonstrated by committed a felony aggravated assault that he was a danger to others so he could not be allowed to move away from the scene. >> reporter: the chief adds the five officers fired their guns when the man started to move toward one officers. police have not i.d.'d the suspect killed, only that he was in his 20s. the stabbing victim is expected

to recover. investigations are being conducted. you saw one piece of video. police chief adds he would like more video submitted to investigators as this is very early on in the investigation. it is 5:39. san francisco supervisors today take up a proposal aimed at preventing gun theft. it comes following high-profile cases like the murder of a tourist with a gun stolen from a federal agent and revelations that hundreds of guns have been lost or stolen recently by bay area law enforcement. but the legislation is being expanded now much broader in scope. it would require anyone with a gun in the car to lock it in the trunk or if the car doesn't have a trunk, the gun would need to be put in a lockbox. coming up right now on 5:40 on your thursday. scooting along for the week. it is going to be a wet end to it. >> it's good to see this rain moving in especially with those pockets of heavy downpours but it looks like some of the rain as it moves in tort north bay

have written a letter to the group that oversees uc and cal state admissions saying, how about you accept a computer science course, a tough one, as a math course? that way smart kids who are buckling down to get into that uc school might be more likely to take a computer science course which currently they see as an elective. janet yellen spoke yesterday in one of the most important speeches we will hear. this is one of the last big speeches she will make before what we expect will be a rate hike 12 days from now. the first rate hike in a decade and she says she's looking forward to it. she said that even before she saw tomorrow's jobs numbers. nobody -- not the president, not the head of the fed -- gets to see the jobs numbers early. the first civilian to see them is cnbc's hampton pearson, he passes them on to us. we tell them to you 5:30 tomorrow morning. the fed looks at two things generally when deciding to move

rates. number of americans employed. the more it goes up, the more likely the hike. and inflation. the more that goes up, the more likely the hike. yellen will before congress this morning as well. congress wants to talk to the chinese manufacturers of vtech computers. that's the company that got hit by hackers late last week. millions of children's names, birthdays and photographs were leaked. the biggest hack of children in history and congress wants to get some answers. >> parents do, too. >> the fact we are even talking about a child information hack is crazy. >> talking about millions and millions. >> thank you. we'll be watching a meeting in santa rosa later today where a decision could be made about opening up crab season. that's where the latest test results are expected to be released at a state hearing. crab season was supposed to kick off two weeks ago but state leaders suspended it after finding toxins in the crustaceans along our coastline. the toxins are caused by red algae blooms which were unusually large this year due to

abnormally high ocean temperatures. eating toxic crabs can make people very sick, even leading to death. happening today -- state wide training to prepare for this winter's el nino storms. more than 200 members of the california conservation corps from 13 different locations in california will be honing their techniques and filling sandbags and protecting levees from erosion. crews from san jose and napa are expected to attend the training, all part after flood preparedness exercise so crews can better respond to such emergencies throughout the state. >> isn't that where you go running sometimes? >> right now we are taking in the scenery of rain. >> we always saline yo but it's the season so we're heading into that -- it's not just one storm. but we are starting out with some rain as we take a live look outside now in san jose. we are starting out with some dry roads but that may not be the case if you have to head out

around lunch time. some rain will be moving through but for now it is looking good and mostly cloudy skies starting to roll in out ahead of this system. the heaviest rain now is still offshore and moving across extreme northern california, moving into eureka. but we've also had a few of those showers developing farther to the east. we'll be watching that possibly moving in to the santa rosa as we go into the next couple of hours. the showers arriving by mid morning. here we are at 7:00. it's so far to the north and it is really heavy. but look what happens as it moves into the north bay. in santa rosa we aren't seeing those bright yellows and reds. this system will continue to weaken as it moves into san francisco, the peninsula, as well as the east bay. moves into san jose by late morning, early afternoon and still a few light, spotty showers possible of after that main line rolls through. then it moves into the sierra

and starts to produce quite a bit of snow there. that will continue as we go into tonight as well as early tomorrow. rain futurecast shows as least one-tenth inch for the south bay but look at how those amounts increase as we head to the north. that's where the heaviest rain falls, possibly up to an inch or close to an inch of rain around ukiah. we are all looking at highs in the upper 50s to lower 60s and the temperatures will be dropping after the rain rolls through so we'll be reaching that high temperature early. if you're moving over to the sierra, if you're traveling that way, we are looking at the winter storm warnings in effect. a lot of snow expected, possibly up to 14 inches for the higher elevations. looking good there. let's check in with mike and see if it looks good on the roads. >> if you're lucky enough to be heading to the sierra, you'll have to bring those chains if you need them. interstate 80, goes to the sierra but it also goes across the bay bridge.

expanded now much broader in scope. two require anyone with a gun in a car to lock it inside of a truck, or if the car doesn't have a trunk -- the gun would have to be locked inside of a lockbox. a controversial plan to build a new $240 million jail in san francisco is moving forward. many people, including san francisco district attorney protested the move arguing the city should spend money to cut incarceration and crime rates instead. city leaders say a new facility is needed because conditions in the current jails are seismically unsafe. right now at 6:00 -- disturbing ydistur disturbing new information out of san bernardino. what the suspects did with their 6-month-old daughter moments before killing more than a dozen people. >> that was probably a flash bang. >> flash bangs keeping a neighborhood on edge as heavily armed law enforcement and road blocks scour the home where those suspects lived. plus, a reversal in the case
