"today in the bay" starts right now. >> a very good morning to you. thanks for joining us. i'm laura garcia-cannon. >> i'm sam brock. a lot to get to on this tuesday. of course that includes your weather forecast. >> is it wednesday? >> to day is wednesday and tomorrow is new year's eve. >> so nice to have laura back. >> it is. it really is. we have cold weather all across the bay area, even a little wintery mix around ukiah as light showers drop in. that dries up before it makes it in to the rest of the bay area. look at the temperatures now, in the 30s while san francisco is still in the mid 40s. today the high makes it into the mid to upper 50s once again as we take a look at the tri-valley, 54 degrees. let's check in with anthony for the commute. >> earlier we report add five-car crash, 80 eastbound.

you'll notice things moving here. you can see wide open lanes. westbound lanes starting to fill in per usual. no big surprise there. even across the east bay, looking good. as we switch to the maps, you can see what i'm talking about. lots of green from concord. smooth across the caldecott tunnel. looking good from the tri-valley down to the sunol grade. we are covering breaking news in concord this morning where crews are working quickly to put out a house fire. now investigators are looking into the cause. >> "today in the bay's" stephry chuang with the aftermath left behind. this was a serious fire, steph. >> reporter: it's serious because it gutted the house. we're here off little patch road and north third street. it dead ends so no traffic impact. it was reported, this fire at a

one-story home at around 2:35 this morning. the fire itself took maybe 20 minutes. the problem was there were downed power lines when the firefighters got here and that delayed the ability to actually go and attack the structure fire, the house fire here. so that's what they had to wait for. they had to also wait for pg&e. there was gas leak that was part of the situation according to contra costa fire. there was no one in the home. as badly damaged as the house was and completely destroyed, thankfully no one inside. apparently the tenants recently evicted. they're trying to contact those people. there were reports that there might be squatters staying in this house at the 1900 block of third street. firefighters are wrapping up at this point. we had an engine here with lights ochblt it's left already. traffic impact none because

north third street is residential and dead ends at the end of the street. live in concord, stephanie chuang, "today in the bay." >> thank you very much, steph. it is 5:03 right now. disturbing details unraveling out of fairfield where a grandmother is accused of drowning her own grand sochblt "today in the bay's" in kris sanchez has more. >> reporter: laura, fairfield police say things the grandmother herself told them led them to believe she may have drown her grandson on purpose. 51-year-old diana raines-hewes is under arrest on suspicion of murder. she's being held without bail at the solano county jail. this is the home where fairfield officers found that boy unresponsive and not breathing after drowning in a bathtub. despite efforts to revive the 4-year-old, it was too late to save his life. the home is in the 1400 block of jefferson street in fairfield. many of the 911 calls came from

neighbors as well. officers were called to that home at 10:51 in the morning, and after a day long investigation including evidence and statements from raines-hewes herself, police suspect the unthinkable, that the boy died at the hands of his grandma. one neighbor's response is exactly what you might expect. >> i think it's very, very sad. i have kids. i can't think, i can't imagine someone would do that to a grandson. >> reporter: the grandmother was reportedly babysitting the 4-year-old girl at the time. his sisters, a 1-year-old and 6-year-old were there at the time. they are now in protective custody outside the family. officer cleo says the little boy's mother has been told about what happened and tls an autopsy

scheduled for today. police did not release information about a motive, but it is very safe to say it likely won't help answer the question of how a grandmother could do such a thing. >> pretty hard to believe. 5:05, now a developing story in the south bay t. search on for a suspect involved in multiple stabbings last night in san jose. that attack happened in front of the carl's jr. on quinn by and south white road near reid hillview airport. when police arrived, they found two people stabbed, a man and a woman. police are saying it appears that the victims were attacked by several men who got away in a car. >> i went outside. he was on the ground, on the ground like he was asking for help. it's kind of serious, how this has been going lately. it's been getting crazy. >> the two victims in critical condition this morning in the hospital. police are also telling us these

stabbings could be gang related. >> a man caught on surveillance camera trying to break into an east bay home is now in jail. they've identified him as john winchester of livermore. the couple whose home he's expected of breaking into, officers arrested winchester on monday. he's facing charges of felony burglary and is being held at the fremont jail. two monday attacked on a muni bus. now san francisco police need your help finding the suspects. this happened last month near 6th and mission in the middle of the night. it all started after a confrontation with the victim. words were exchanged. then the situation escalated. you can see someone from the sfmta getting involved. the 55-year-old man managed to defend himself as the two suspects assaulted him. >> we want to send a clear message, hey, you're being watched 6789d you're being recorded. it's not cool to assault somebody on a muni bus.

fortunately the victim was not seriously hurt. if you recognize the suects, call police. french tourists, one of them 81 years old mugged at a popular tourist spot in san francisco. it happened at twin peaks monday morning. police say two men robbed the tourists of their passports, camera and money. there were three victims. the 81-year-old was shoved to the ground. he suffered cuts to the head and actually lost consciousness. the other two victims, women ages 50 and 77 suffered minor injuries. >> not great for tourism. neither is our weather right now. it continues today. >> it's very cold. all the tourists may have been expecting some warmer air. now we are starting out the morning at 30 degrees in livermore, 35 in san jose and 37 in san car rose and oakland. napa at 28 degrees. so frosty conditions in some

spots freezing. more clouds today than yesterday and staying cool. at lunch time we're at 50 degrees in the peninsula and the east bay at 48 degrees. by mid afternoon as we reach the high temperature, we'll be at about 50 degrees all across the bay. let's check in with anthony to see what's happening on the roadways. >> things looking pretty good this morning. we have the earlier accident in berkeley that's been cleared out. this is the north bay, no fog this morning coming in from san rafael. 101 southbound moving pretty good around the curve. it's cold out there. if we see any fog, there could be black ice on the roads this morning. as we switch to the maps, you'll notice the rest of the bay, looking good from fairfield to na napa. earlier the accident in berkeley, that's cleared but you can still see the residual effect. really not much. lighter than volume usual means things are getting along pretty good. across the east bay, even the south bay looking good as well. across the peninsula, no issues.

>> reporter: a republican field shrank by one. former new york governor george pataki dropped out of the race, getting less than 1% of republican voters in the latest polls. it's possible that voter data has been leaked on the internet. millions of records that show names and addresses. >> though, scott mcgrew, not your vote? >> that's something we want to say right off the top. not your vote. what we are seeing is things about your party. that was public record anyway. the first report on hacking websites, "the sacramento bee" saying there could be as many as 200 million records. the report showed up on hacking websites, but it doesn't appear the data leak was a hack. it would appear someone messed up the settings on a database. the records seem to be the same sort of records that political

third. we can't seem to find any video of sidecar. we have video of kalobios which was on the edge even therefore skelly and investors bought it. he was arrested, fired as ceo. now it's out of money. we'll continue to watch it. it looks like the logical end to a poor investment. >> a lot of people say karma came into play there. >> indeed. 5:16. now an alarming study revealing heart patients in the u.s. are exposed to more radiation than any other patients in the world. in fact, a typical american receives a 20% higher dose of radiation during nuclear stress test, a procedure that's performed on millions of people every year. researchers say it's partially because u.s. labs were less

likely to comply with the recommended dosing guidelines. while the benefits still outweigh the risks, experts say doctors should do a better job of reducing the patient's radiation exposure. the strong el nino in the pacific showing no signs of weakening, in fact quite the opposite. that's according to nasa responsible for this new satellite images. in 1997 the el nino produced large storms and flooding and other problems. researchers say the big impact from this current el nino is expected to hit us in the first few months of the new year. >> cute rain boots, too. >> fashion above all else. a lot of radar readings for you. >> yes. it will get more active. we're already starting to see a storm that will be moving in early next week. but nice, dry, quiet for now, but very cold. let's take a live look outside now as we get a view of the bay

bridge. we start out, once again, with fairly eye et conditions. another one to bundle up and allow extra time to get the frost off the windshield. we're tracking spotty light rain for the far north bay and snow for the sierra as they get ready to head out for the snow surveys later today. this may create a little bit of icy conditions as our temperatures are below freezing in the north bay. 29 there and in the east bay it's 30 degrees. as we get a closer view of the north bay, napa is at 28 degrees, fresh off a record low. we will watch the thermometer very closely as we go through this morning, too, as our temperatures fall a couple more degrees. hour by hour in san jose, we will be at 36 degrees shortly before sunrise and 38 degrees at 8:00. heading through the rest of the morning and early afternoon, we make it into the lower 50s, but our temperatures still keerl than average and looking at a high today of 56 degrees. in foster city 54 and the outer

sunset at 50 degrees today. more clouds than yesterday. napa, 53 degrees. concord 52. danville also at 52 degrees. getting ready to celebrate the new year. if you will be going to san francisco for the fireworks show, at 10:00 we're at 47 degrees, 46 degrees at 11:00. you need to bundle up. you'll be out there for several hours and you need definitely a heavier coat over your fancy dress. as we go into the weekend, closer to average with highs in the upper 50s in some spots like the south bay. then as we go into sunday, there will be scattered showers moving in. we're once again setting the stage for some wet weather early next week. we'll keep you up to date on that. let's check in with anthony. >> earlier we talked about the crash in berkeley. i want to show you what's happening approaching the maze. you can see wide open lanes not only for eastbound but also westbound directions. that's great news for east bay

what to do. passports might become required. whatever the case, they say the traveling public will be given a minimum of four months to meet any any requirements. the lane configuration on the golden gate bridge is changing again. here is a live shot of the bridge this morning. those managing the traffic flow say too many cars heading south are backing up the tunnel. they're going to add a lane. that means three lanes in each direction. it's been two lanes southbound in the afternoon in the past few months. bridgeman jers will revisit the issue to see how things are rolling along in april. a positive update on a stubborn pregnant elephant seal. we've been watching it play out in realtime. the 900-pound mammal was successfully captured and moved to her new home yesterday. she's been trying to cross highway 37 in sonoma county. crews tried to redirect her

gently into the san pablo bay. but this seal was relentless. >> we are not a 900-pound elephant seal so she's deciding to do whatever she wants. >> they eventually did trap her, sedated her and loaded her up in the back of a truck. crews took her to chimney rock at point reyes where she was released. the location has an established colony for elephant seals. we were trying to figure out why she was trying to get out of the ocean and cross on the highway. some marine experts thought she could be pregnant. we're not sure. >> she probably doesn't feel very well. that's a lot of baby in you. 5:25. this is a really disturbing story. a little boy is dead and his grandmother, of all people, in handcuffs. the disturbing details being revealed about the 4-year-old's death and why police are pointing the finger at that grandmother. >> what's left for the silver

mother has been told about what happened and there's an autopsy scheduled for today. police did not release information regarding a motive. but they say it likely will not help to answer the question of how a grandmother could do such a thing. we're also learning more details about palo alto's first deadly involved shooting in more than a decade. police say 31-year-old william raff used a fake name to report someone was threatening people at a treatment center for the mentally ill where raff was living. police say when they arrived, raff was armed with a nine-inch metal knife and when he ignored their commands to drop it, they rushed at him. the entire incident was caught on multiple dash cams. that video will be turned over to the santa clara county district attorney. some changes are coming to

county jails. that's the word from the santa clara county sheriff after a recent attack on a deputy. it's a story nbc bay area first broke to you. sheriff lori smith is working on improving staffing and jail procedure. the attack happened at the elmwood jail in milpitas on christmas day. the deputy was trying to take away contraband from an inmate when nearly a dozen inmates jumped in and brutally beat him. right now the deputy is recovering from head and hip injuries. >> i talked with him this morning at length. he's in good spirits and he's seeing a lot of specialists. >> investigators say the inmate is a suspected gang member. investigators also found a knife at the jail yesterday during a routine sweep of the facility. zblp stay away, that's what a judge ordered this castro valley woman to development denise slater caught on camera throwing coffee at a muslim man praying at lake chabos park.

slater has been charged with misdemeanor battery and a hate crime. she'll be back in court next week. in the meantime she remains on administrative leave from her job at the california department of corrections and rehabilitation. happening today, deadline set by the nfl for three different cities that includes oakland to cough up their financing plans for new stadiums. op oakland leaders say the league will have to wait. all they're offering is a five-page letter explaining their situation. no finance plan for the new stadium. the letter outlines how the raiders could have 60 acres adjacent to the coliseum to build a new stadium. but the particulars still need to be worked out. >> we have been open and honest with the nfl and the raiders about the complexity of our current situation as well as the fact that we are committed to bhaking this an open, transparent and public process that cannot be rushed. >> the letter oakland is sending

to the nfl pales in comparison to the offers by st. louis and san diego. both of those cities are offering hundreds of millions of dollars in order to keep their teams. raiders owner mark davis says it appears that oakland raiders don't want to play and the move to los angeles is moving smoothly. a ray floored is consuming parts of missouri and hundreds of homes are under water. torrential rains have caused rivers and streams to swell. the floods are so severe, the mississippi river is expected to reach nearly 15 feet above the flood stage by tomorrow. many residents who helped their waters avoid floodwaters are finding their own homes threatened. >> we still need help. we're saving my house right now. >> i understand there's other ways around not using the interstate, but a lot of those routes are lost right now as well. >> the flood is expected to turn

to the second worst on record behind missouri's devastating 1993 flood. that left 100,000 homes destroyed. happening today, the first sierra snowpack survey of the winter is going to be taken by the department of water resources. this morning's survey will take place at phillips station off highway 50. that's about 90 miles east of sacramento. the phillips snow course is one of several that's going to be measured during a ten-day window to try and figure out the water content of the snowpack which normally accounts for about 30% of the state's water when it melts. officials say last year's snowpack readings were some of the lowest on record, a very different story this year. >> they were trying to go up and it was a lot of dirt. coming from the tahoe region, it was beautiful. >> did you bring your ruler? >> no. just a lot of gloves and layers to keep warm. >> according to some of the computer estimates, the snowpack is well above normal for this date. so we are looking good.

"affluenza" teen will return to the united states after a a developing story at 5:43. the so-called affluenza teen will return to the united states after an international manhunt. >> edward lawrence joining us live from washington on what's next for the teen. >> reporter: ethan couch is expected back in the houston area to face the charges later on today. he is wanted on a probation violation. authorities say a cell phone actually helped them track him. a phone linked to him, he called to order a domino's pizza. that led mexican officials right to where he was in port vie ar toe. his mother is also under arrest. he failed to show for a meeting on december 10th for a probation meeting. he crossed the mexican border

with his mother in their pickup truck and drove some 960 miles to dry to get away. the sheriff believes the teen ran after video surfaced of him at a beer pong game. that would violate his probation if he was drinking at that party. he was convicted in 2013 of a dui after killing three people. his attorney argued he was so wealthy he didn't understand the consequences of his actions. the sheriff and the district attorney want to move this case into adult court. he was charged when he was 16 years old. now he's 18 years old. if it does not move into adult court, he could get -- and is sent to jail. he would get out of jail on his 19th birthday which is april. he could face more time in jail if he's moved to adult court. live in washington, edward lawrence, back to you. >> not a pretty picture. an actor from a popular television series out of bail following an arrest of suspicion

of possessing child pornography. he was served a search warrant yesterday. he was taken into custody at l.a. county jail before posting $20,000 bail. seaworld is challenging a ruling that bans the breeding of killer whales, they filed a lawsuit against the california coastal commission saying the commission was outside its authority. the ccc included the ban as a stipulation to approving a $100 million expansion of the orca holding tank. just last month seaworld said it will phase out orca shows next year and replace them with exhibits that feature killer whales in a more natural setting. twitter is strengthening rules against violent talk this morning. >> twitter doesn't use islamic state by name, but we know many governments have been pressuring

twitter to crack down on the group. new rules are much more specific. instead of saying no promoting violence, twitter says, you may not promote violence against or directly attack or threaten people on the basis of -- and then it goes on to list all kinds of things, race, religious, et cetera. it's the rules on the screen, the first part, no promoting violence or even just a threat that gives twitter a lot more wiggle room this morning. sidecar is no more. if you're saying to yourself, what's sidecar, then you see the problem. sidecar was a ride share company like uber or lyft but couldn't raise the funds. lyft got a quarter billion in funding last week from a saudi prince. most people know him as the money behind fox news and the "wall street journal." you've seen russell crowe very, very angry. he is furious at the airline virgin australia after baggage

day, it will get milder. another cold front sweeping through bringing spotty light showers to the far north bay. also more snow to the sierra where they're getting ready to do another survey today of the snowpack which from those computer estimates looks well above average. great news there, but not so good news here because we've had such cold weather. we are ready for a warmup. it's only 28 degrees in the north bay. as we get a close look at san francisco, we have upper 30s in the presidio. as we go into the day, it does get a little bit better. let's take it hour by hour in oakland, 37 degrees at 7:00. more clouds in the mix today than yesterday. it will still be, once again, highs in the low 50s. 54 degrees in los gatos and foster city. the castro at 52 degrees. in the north bay, more clouds there, a slight chance of a spotty shower. also in the east bay, more clouds today, too. hayward looking at 55 degrees. livermore a high of 52.

as we head to san francisco for the fireworks show, it will be very cold. you need to bundle up once again. i know we're kind of spoiled. 43 degrees will be very chilly under the clear skies, especially if you're out there for a few hours. as we go into the weekend, it will be in the mid 50s saturday. also looking dry. had been warmer in some spots. sunday, another storm system will be approaching, and that could bring us showers late sunday evening and we'll have a bigger storm system that is set to arrive early next week. our weather turning more active once again as we head into 2016. we'll keep you up to date on that. let's check in now with anthony. >> keeping you up to date on those roads. not much happening. it is the holiday week so we're seeing the lighter-than-usual volume across the bay, even across the north bay. i want to show you this shot because we're starting to see a little fog develop. i don't think it will be much in terms of how visibility will go. you can see it is starting to reduce a little bit.

we're looking at good conditions. the green means things looking good from walnut creek towards the berkeley curve. at the bay bridge toll plaza, i don't think the metering lights will be turned on. across the tri-valley, looking good as well. as we take you outside at dublin, yesterday we saw lots of fog here. no problems if you're moving through the tri-valley headed towards the rest of the east bay. >> the difference 24 hours make. an intense rescue in chile. fishermen and biche goers helped rescue this blue whale, able to pull it back into deep water after securing it with a large net. that mammal measured more than 66 feet long. 5:51. a glimmer of hope in china. rescuers used infrared cameras to pieer into a collapsed mine.

coming to u-s airports in the new year. if you're planning to it is a major security change that could be coming soon to u.s. airports in the new year. if you're planning to travel, the most common form of i.d., the driver's license, but that might not be good enough much longer. passed the real i.d. act following the september 11th attacks. the law requires states to issue more secure driver's licenses that are tougher to counterfeit. the law gaining more attention now in the wake of terrorist attacks in paris and san bernardino. >> by ensuring that there's consistency in the type of identification that's being presented at airports, they're looking to mitigate the threat of terrorism. >> 22 states and the district of columbia currently meet the standards. most others are making progress and have been granted extensions. but a few including new mexico and washington are running out of time with january deadlines. residents from those states could face more security measures at the airport. but right now the department of homeland security have not given a timeline but says it will, quote, ensure that the traveling public has ample notice, at least 120 days before any changes are made that might affect their travel. the law faces tough opposition from some states. a new passport can cost more than $150, and there are

concerns about privacy. >> the federal government has not done a good job protecting the information they're collecting. >> reporter: janelle wang, nbc bay area news. for now the tsa is going to continue to accept allstate-issued driver's licenses as the federal government figures out when it's going to start enforcing the real i.d. law and specify which states will be affected. now a massive cyber hack involving voteder records of just about every american who voted in the past few years. not clear who owned the database that was hacked. security researchers say they found voter names, addresses, states of birth. data released was mostly from california and texas voters. the california secretary of state is now investigating. we have an update on a stubborn pregnant elephant seal in the north bay. the 900-pound mammal was successfully captured and moved to her new home yesterday. she was trying to cross highway
