hey, good morning, everyone. thank you for joining us. happy friday, as well. i'm scott mcgrew in for sam brock. >> i'm laura garcia-cannon. let's check in with meteorologist kari hall. little break in the storms we're seeing at least for the morning. >> before the next round of rain moving in and looks as we start to see the scattered showers moving in late tonight into the start of the day tomorrow, it gets heavy just briefly. we're tracking a few light sprinkles across the bay area this morning. and some clouds moving in out ahead of the next storm system, but it is cold as you step out the door. check out the number in the south bay. it's 38 degrees and 41 degrees in the north bay. highs today reaching into the mid to upper 50s and, once again, some rain later today. i'll detail that and we'll look ahead to the weekend coming up in a few minutes. but let's see what's happening in the tri-valley with mike. >> you mentioned some clouds moving ahead of that storm. we're seeing them on this camera. not really a problem for visibility for the drivers but of the drivers having a tougher time. we normally she that part of the

area for 580 approaching but the cloud cover affecting our view just a tad bit. areas for potential fog, but by the time you get to the dublin interchange, the skies are clear and the try is clear throughout the bay. an easy friday light right now but looking at fog back here at stockton and maybe north of san rafael. keep that in mind creeping around the bay, but so far the speeds are still at the limits. back to you. >> thank you, mike. now, to a developing story a man shot dead in the streets of san jose. the hunt continues for the gunman responsible. this happened in east san jose near the los lagos golf course. kris sanchez live overnight details. kris? >> good morning to you, scott. we were there as the last cop cars pulled away from the scene there in south san jose and we know the work to find that gunman will continue today. if san jose police know who they're looking for, they're not making that public just yet, not asking for the public's help but

points specifically with one suspect. we know one car was towed away from the scene where that one person was shot dead just before 10:00 last night. all this hand as you said near the los lagos golf course. it's a neighborhood off capital expressway. how that car is connected to the crime is yet unclear. now, the adult man who was shot died at the scene. the person who pulled the trigger did get away and this is the second homicide of the year in this city. the first was on new year's day, but the good news for san jose police and the community is that the suspect in that case has been apprehended. there were 28 people murdered in the city of san jose last year. in san jose, kris sanchez, "today in the bay." >> thank you, kris. word on san jose's first homicide of the year. police have this man in custody accused of murdering his father. investigators say maxim zhukov stabbed his father to death on

new year's day and then police say he left his father's body in a car in richmond. police don't know the motive and they're still hoping someone comes forward with more information. first heinous crimes and accusations of torture now murder charges expected. today the couple accused of killing two young children found in a storage unit will face a judge. authorities arrested 39-year-old tammy huntsman and her boyfriend 17 last month for allegedly abusing a 9-year-old girl. that investigation led officers to the bodies of 3 and 6 year olds in a storage unit in redding. the pair started abusing the children in salinas where huntsman's from. man arrested in sacramento on a terrorism charge is due in court today. the fbi identified him as 23-year-old al jaib.

he reported to have entered the u.s. in 2012 as a refugee from iraq. court documents say he traveled overseas to fight alongside terrorist organizations and also used social media to talk about fighting against the regime. a friend in sacramento who did not want to be identified defended him in an interview with nbc last night. >> maybe he would get angry at times, but he would never say like anything like related to terrorism or anything like that. >> federal agents also arrested a suspect in houston, they say, tried to provide material support to isis and lied on his citizenship application. a third arrest in milwaukee is set to be connected to the case, but not related to national security. happening today, national security officials will meet with silicon valley leaders in san jose. the attorney general, the director of the fbi and national intelligence director are all expected to meet representatives from apple and google and

facebook and microsoft, twitter and linkedin. here you see isis, the situation could get tense. the tech industry is still reeling from revelations. tapped silicon valley computers without warrant and they're wary and promoting products overseas. 5:05. happening now, powerball madness. $700 million up for grabs. it's all the largest jackpot ever. >> that could go up, right? the more people who play. >> could go up to $1 billion. >> amazing. retailer. you might recall this shop sold a powerball worth $626 million. did that man just put down $2 for a lottery ticket. no, looks like he's getting some snacks. but, anyways, we do expect that there would be a long line of people here once the sun comes up. you might realize or recall that this $700 million jackpot almost did not happen. someone in the bay area came close to winning wednesday's drawing but came up one number short. you need to get all six numbers. that ticket still worth $1.4 million. it was sold at perry's liquor store in union city. the store owners say they've seen an uptick in business since that winning ticket was announced and also enjoying a winfall for selling that winning ticket. >> i'll take 25 goes towards charity and 50% i'm not sure what i want to do. >> buy other things and become regular customers and buy a lot of oother things. if you don't have lottery, you

sdroe don't have the traffic. >> okay. so, the powerball right now is at $700 million. it's likely to dwrgrow by tomor night. the increased ticket sales makes it more likelily that there could be a win. it could grow to $1 billion if there is not a winner tomorrow night. you have better odds at quick pick. when people pick their numbers they're doing birth dates and they ignore the numbers 31 to 69. if you want to buy all winning combinations that would cost you $584 million. well, okay, i'll net $150 million. because you still have to pay for taxes. you also have keep in mind, someone else might have waning ticket and you'd be sharing with them. not a good idea. now, if it got up to $1.5 billion, maybe that's when it becomes a winning proposition.

stick around. >> for a few more hours. but i think that may be extended as this next storm system continues to approach. you don't want to do that. just standing out there on the rocks right there near the beach. that's not a good idea. as we go to the next couple of days, more active weather and this is the way it pans out as we go through the day. a few spotty showers through the morning and early afternoon. some of the heavier rain looks to arrive for the north bay. during the evening commute and then for the rest of the bay area, shortly therefore, as you head out for dinner, it may start to turn wet across the bay area. let's check in now with mike to see what's hap pg on the roadways. >> our san rafael camera shows us a clear view and clear drive right here. let's look at your maps and just north of there, we do have a smooth drive, as well. but not necessarily a clear view as you come down through petaluma and you may get a patch of fog here and there. fender bender down through vallejo and you're clear by the time you reach 780 and head down towards the carquinez bridge.

circuit breakers that halted trading on thursday. wall street could be set up for a rebound following the worst four-day start to a year ever. the u.s.ts as measured by the s&p 500 have seen more than $800 billion in value wiped out this week. in focus this morning, the monthly job's report companies hiring at a steady pace in december. unemployment is forecasted up to 4.9% and more than seven-year low. the dow points a 92 to 16514. the nasdaq falling 146. meanwhile, apple crashes out of the $100 a share club falling below that mark for the first time in more than a year. while it is still the world's most valuable company, apple has lost $200 billion in market cap in the past 12 months and investers are concerned as the reports emerge this week that apple is cutting iphone shipment due to soft demand.

as we look at san jose and low clouds that greet us and getting those new years resolutions started off right. now, we will have rain later on today, but no excuse not to get out there now as we continue to see the clouds moving in. it is cool. so, bundle up. it's 38 degrees in the east bay and south bay. peninsula at 43 degrees. let's in on the east bay. livermore, 36 degrees now there and in pleasanton, walnut creek it's 40 degrees and oakland now 45 degrees. 41 degrees in the north bay and our highs today will be topping out in the mid up toer 50s. in the castro 54 degrees and gilroy and oakland reaches 56 in danville today. 57 degrees. so, our temperatures slightly just cooler than average by just koppel of degrees in some spots. this next cold front moving in will bring us the light rain we're expecting later tonight and gets heavier as we go towards the morning.

this is the way it may pan out on the radar. the rain arrives around 7:00 for the north bay and gets more widespread and heavier as we go towards the morning. we still see some showers lingering into early saturday, but then you can get out there and enjoy saturday afternoon. rainfall totals may reach about a quarter of an inch total for most of us and fizzles out as we move into the south bay. san jose maybe a tenth of an inch. in the sierra we're looking at an additional couple inches of snow on top of the beneficial snow we had throughout the workweek. let's check in now with mike to sea happening on the roadways. >> we're looking just above the roadway here. this is our dublin camera. typically we take a further look out and we can't see that far clearly because of the low clouds drifting across. by the speeds of the cars and on the speeds on our sensors, no problem for drivers. visibility on the roadway just fine, but we're watching as the clouds drift around as the roadway rises up. touches those clouds and we'll call that fog and over towards the altamont pass.

dublin interchange, an easy drive. no problem for visibility or the drive. the north bay you might have some patchy fog up north of san rafael and over in stockton and tracy. over here we're looking at a smooth drive and the foster city and peninsula side easy, clear drive across the san mateo bridge. new accusations against the sill valley ceo. it was unethical what he was doing. claims he used while parties and gifts with a government official. now to an investigative unit

exclusive: ==scott/2shot== a bay area companyis at the center of a new lawsuit alleging now to an investigative unit exclusive. the bay area company at the center of a lawsuit alleging its former ceo committed fraud. >> now a former employee is also suggesting the company used questionable tactics to get government contracts. investigative reporter vicki nguyen has the details. >> reporter: the company is called identiv and it specializes in security technology, much of their business relies on government contracts. but according to a former employee, the company ceo now president spent company money on gifts for government officials. personal expenses and wild parties. she spoke exclusively to theive unit about her claims. ana ruggiero contends her boss instructed her to submit tens of thousands of dollars of improper expenses including a party in

las vegas. ruggjero showed us this nightclub receipt with a $10,000 drink bill. unlawful and fraudulent conduct in addition to age discrimination. her boss used identiv money to pay for travel and parties in las vegas that included a former security specialist that now works for the general and he was obtaining contracts worth millions. federal employees are not supposed to accept gifts more than $50,000 per year and required to expose all gifts but neither had records of any gifts. he had no comment and jason hart did not respond to our request for comment. identiv did not file a request, but a motion to move the case to arbitration was granted. our sources are confirming that it is under investigation at a securities exchange commission. to see our full report now, go to nbcbayarea.com.

highlighting here has low fog through the area and low clouds as we talked about. also for the north bay, anywhere north of san rafael. now to a developing story we're following at 5:30. a lot of questions surrounding the death of a man in east san jose. the deadly shooting happened there near the los lagos golf course around 9:30 last night. what do we know at this point, kris? >> we saw the last of the cars pull away from the crime scene this morning but the work to find that gunman who killed that man will continue today. san jose police, if they know exactly who they are looking for, they are not making that public just yet. but we know one car was towed away from that scene. this all happened at lone bluff way and pinto drive, a neighborhood off capital expressway in south san jose. as you mentioned, laura, near los lagos gfl course.

dramatic turn of events in san lae ndro. police say just before 8:00 last night a gunman robbed the gas station on the corner of washington and fargo avenues. people living nearby were told to stay in their homes as police searched the area. the gunman was not found in the search of the area was eventually called off. we have a follow up for you on the plane crash that killed a gilroy family. bad weather seems to be the cause of that crash. the ntsb released a preliminary report yesterday saying a storm had formed right in front of that plane before the plane went off the radar. the report says that aircraft broke apart in the air. jason and olga price and their three children all died december 21st when that plane crashed near bakersfield. they were flying from san jose to las vegas to attend a party. 5:32. an oakland truck driver recovering this morning after a near deadly delivery. jerry mattison was shot after

trying to deliver a generator to 0.co last month. he was waiting for the coliseum to open when someone tried to break in. mattison tried to fight back and that's when he was shot. >> there was no doubt that at the very beginning, i'm going to die right now. and i said, no, not this week. >> luckily the bullet went through the feet before it hit him. so, that's probably what really saved his life. >> police are still searching for the shooter. as for matson, he's recovering but says his 43-year truck driving career could be coming to an end. guilty of vand and hate crimes, a jury reached a verdict in the case of john. found guilty of 13 the words no more chinese spray painted at six locations. surveillance video helped track him down. 5:33. an alarming panic may have many immigrants keeping their kids out of school. it appears rumors are fueling

the fears of immigration raids on school sites. from our sister station telemundo 28 where parents try to ease some of their concerns. good morning, paola. >> good morning, laura. always concerned about being deported and now rumors about immigration have some undocumented families thinking about pulling their kids out of school. they haven't seen a spike in absences so far but they want to put the rumors to rest. that's why the school superintendent spoke to parents and say the school has the policy in place and never let immigrations and custom enforcement agents into school. they would have to go through a full review process. >> but if they were to show up at a school and request entrance, there's a protocol they have to follow. i ultimately have to give approval as a superintendent for that to happen. so, that's not going to happen.

>> the superintendent says if he were ever to grant immigration agents emergency access, he would notify parents first. these type of rumors, laura, are spreading nationwide after i.c.e. agents moved. for texas, north carolina and georgia, no raids in california and the message here today is clear. kids are in a safe school. so parents should send their kids to school. reporting live in san francisco, paola. san francisco celebrates ed lee's second term as mayor. the mayor will be inaugurated this morning in city hall in a ceremony starting at 11:30. governor brown expected to administer the oath but protesters plan to gather ahead of the inauguration on the steps of city hall and voice their anger over the deadly police shooting in the bay view last month. also taking the oath of

office, san francisco's newly eed sheriff. vicki hennessey will be sworn in as the 35th sheriff of san francisco and also thesty's first woman to be elected to that office. u.s. senator dianne feinstein will administer the oath. the sweari . super bowl l will cost the city of san francisco $4 million. most of the costs to transportation and police. now, the game is going to be held here in levi stadium in santa clara, but they'll host events all week long. the mayor says the cost is minor compared to the anticipated revenue from the thousands of tourists who will attend. new details and perhaps new hope for raiders fans that just want to keep the team here. here's a live look at the coliseum. will it stay the home of the raiders? new reports coming out of new york indicate that it is possible that speculation is growing and some owners may be hesitant about approving the raiders' move to los angeles. a move by the san diego chargers

the city of san francisco welcome back on this friday. as expected the warriors and city of san francisco now facing a full legal court press in an effort to build a home court. the mission bay alliance officially filed suit yesterday try to try to stop that new waterfront arena. the group claims the they did not address the environmental impact. chirp now, some who rely on the hospital fear game day traffic could come into play in an event of an emergency. >> it's going to be really a

traffic nightmare. maybe not all the time, but certainly sometimes. and the thing about medical emergencies is that they happen 365 days a year, 24 hours a day. so, i just don't see how people are going to be able to get to the hospital when they need to. >> the warriors released a statement reading in part the decision of our elected leaders bring the warriors home to san francisco will be upheld by the courts and this frivolous lawsuit. plans for a massive new development in san francisco appear to have hit a legal snag. last november san francisco supervisors approved planned for the 5m project. a massive development south of market at fifth and mission street. that would provide more than 600 new housing units. also create a new. community groups filed a lawsuit challenging the plan. city leaders fail to consider the full impact from additional traffic and ignored previous plans to convert the neighborhood.

santa clara county the first in the nation to establish a government office specifically dealing with lesbian, gay and transgender issues. in making that announcement, ken jaeger said he's proud to be at the forefront of the movement starting a week from thursday, there will be two full-time county employees dedicated to the well being of lgbt community. housing officials in san francisco trying something new to get people to stop illegally renting out their homes. they just sent letters to air bnb. they're asking them to require hosts to have city-issued registration numbers. they also want those websites to help deactivate listings that don't comply with new short-term rental laws. hoverboard may be popular, but not welcome in some colleges around the country. at least 20 universities have banned the popular scooters telling students to leave them at home. federal authorities say hoverboards are unsafe. they can cause serious injury. doesn't help matters several reports of hoverboards catching fire.

def because at 4:30 in the morning. >> not up close. >> very interesting. yeah, weather looks good. we have more rain on the way. little bit of a break now as we start out the morning and the cool air settles in, but take a look at the mist and drizzle now happening across the golden gate bridge. that may things wet. we're going to see the spotty and some spots as we go into the morning, early afternoon before the rain arrives later on this evening. as we look at the radar, not seeing much of that now. see some of the green starting to appear right along the coast and in parts of the north bay. so, little bit of wet streets in some spots, but not expecting that all across the bay. we do have temperatures now right at about 41 degrees in san jose. it's 45 in oakland and san francisco and napa it is 38 degrees. so, cool as we warm up and throughout the day. we're looking at highs in the mid up toer 50s and more clouds but the sun every now and then will peek out, especially starting out the day and more

clouds moving in tonight as this storm system moves in. and there's another one right behind that that will get us started for the workweek with some wet weather. as we go into tonight, this is the way it plays out. we go through the 7:00, 8:00, 9:00 hour with not a lot going on except for the mist and drizzle in some of the coastal areas and then tonight as you go out for dinner or heading back, we'll start to see that rain moving in. now, most of this looks to fizzle as it approaches the south bay. some of the heavier rain exed for the north bay, but still some pretty good amounts and maybe just enough for you to hear that rain tapping on the window as you sleep later tonight. rainfall totals look to be close to a tenth of an inch in san hoand then head up towards santa rosa over a quarter of an inch and in some spots approach half of an inch and not expecting as much heavy rain as we saw with the previous systems this week. the weekend system starts out wet and then by sunday nice and dry with a lot of sunshine and we're getting ready for more rain chances as we head into the

next several days. once again on monday morning and again next wednesday. for an update now for what is happening at the bay bridge toll plaza, let's check in with mike. >> that is the spot that is changing the most. the backup filling in all lanes but that is different from ten minutes ago. only gets to the left of the parking lot and it it was clear and filling in after that stalled vehicle started moving again. no updates from chp on that. over there just past the toll plaza. for the metering lights, where the meet eering lights were moving very. the incline is clear, but the backup just a little bit longer. look at your map, nothing severe. except for right there at the toll plaza. no problems on our maps as far as the speeds go but watch the north bay in novato and maybe patchy fog through that area and tri-valley. livermore out and west 580

==lau 5:55. an investigative unit exclusive. a bay area company is at the center of a new lawsuit alleging its former ceo committed fraud. now a former employee is also suggesting the company used questionable tactics to get government contracts. here's vicki nguyen with the

details. >> the company is called identiv. much of their business relies on government contracts but according to a former employee, the company's ceo now president spent company money on gifts for a government official, personal expensives and wild parties. she spoke exclusively to the party about her claims. ana ruggjero claims that her boss instructed her to submit tens of thousands of dollars for reimbursement, including a party in las vegas ruggjero showed us this nightclub receipt with a $15,000 drink bill. she is suing the company claiming she was fired for retalitation about part unlawful and fraudulent conduct. her boss used identiv money to pay for gifts, party and travel in las vegas that included a former security specialist with the u.s. marshal who now works for the general service
