coastline. temperatures not that cold. towards truckee. across the rest of the country, bitter cold. we're talking 20 degrees below zero across parts of fargo, even 5 in kansas city. 12 in chicago. those are our temperatures. yes, we are the envy of the nation as we like to call ourselves. back to the mid-50s later on this afternoon, vicky. as mentioned, we could see a brief passing shower. it's not going to be an all-day rain, but if you're outside, you may notice sprinkles coming down. that's getting you ready for our next system that arrives tonight. >> thank you, anthony. if you are just waking up and you haven't had a chance to check your powerball ticket, you didn't win the jackpot, but no one did. that means wednesday's drawing could be worth upwards of $1.3 billion. someone in the bay area did get lucky, though. they picked five numbers but not the powerball number on their ticket. it was purchased at a 7-eleven in fremont. no word yet on just how much that person wins.

>> i heard two gunshots. i've never heard something like this. and my immediate response, i was sitting right next to the door, so i just ran out. >> everyone was just laying down on the floor and yelling and started screaming and it was extremely chaotic. >> one man even tried to give the victim cpr, but he could not save him. the west oakland b.a.r.t. station is scheduled to reopen in about an hour at 8:00 p.m. the search for a missing at-risk woman will resume this morning after being suspended last night. this is video from near the lighthouse at point rays national seashore where chin zang's empty car was found. crews spent the day scouring the cliffs and water below for the uc berkeley graduate. the 22-year-old was reported missing on friday. police say she was reportedly depressed and possibly suicidal. she was last seen around 1:30 thursday morning in berkeley. zhang was scheduled to fly to

china tri morning but never showed up for her flight. a family's desperate search for their dog, an 11-month-old dog, the pet disappeared after a home burglary in the east bay. fremont police say zissy, this shih tzu, was in a closed pen friday. a burglar got into the home on ratto place through an unlocked door. when the family returned home, zizzy was gone along with jewelry and computers. she recently had surgery and just had her stitches removed last week. a mess of plastic debris is raising concern in san francisco. small pieces of plastic along a stretch of ocean beach appear to be the result of the recent storms and high surf. the golden gate national wreck area says people started reporting the trash on wednesday. but it's not easy to clean up. this debris because many of the pieces are so small. >> we are looking into it. we have had people out there kind of following it, looking to see where it's going with the tide and see if there's any indication of where it came from. but there's a lot of it, and

it's really small pieces. so it presents problems both with cleanup and then also finding out where it originated. >> officials also say there is no indication this is tied to that recent cargo container that washed ashore near baker beach last month. we are following a developing story this morning. tensions between the u.s. and north korea hit a new high. a b-52 bomber flew near the communist country today. the u.s. military says the low-level flight happened near osan, south korea, close to the border. the bomber was joined by u.s. and southern korean fighter jets. it's in response to the recent nuclear test. >> reinforce the u.s. commitment to the security of our allies and partners and demonstrate one of the many alliance capabilities available to the defense of the republic of korea. >> north korean leaders say they detonated a hydrogen bomb earlier in the week, but u.s. officials say that is not the case. they say the country tested a smaller atomic bomb. a brush with hollywood that ultimately led to his capture.

new details about the events leading up to the arrest of mexican drug lord joaquin el chapo guzman. sean penn released this photo last night. according to "rolling stone" magazine, penn and el chapo met in october during a seven-hour interview for the magazine. they dined on tacos and had he tequila during his run from mexican and u.s. authorities. the drug lord had reached out to hollywood about making a biopic of his life. authorities say they tracked cell phones and electronic communication between el chapo and filmmakers to track him down. >> a person that is used to getting so much attention not only from law enforcement, from the media, from an entire country and really an entire hemisphere. would encourage anybody to think a little more highly of themselves. >> el chapo is currently in a prop in mexico, but he may be extradited to the u.s. gun control has been in the headlines over the past week. larry gerston will join us in the second half hour to talk about president obama's announcement this week that he has executive orders now on the

let's give you a live shot out there at san hoe djose. what a difference a few minutes makes. you see a lot of fog over the hills there. that shot we were showing you earlier, you see the twinkling lights of the foothills. now it looks like some of that fog has come down. as anthony said, we're going to some drizzle and a much bigger storm in just a few days. we are learning more about two men arrested on terrorism-related charges. one was living in sacramento. the other in houston. omar left federal court in shackles on friday. he's accused of trying to travel overseas to join isis. authorities say he and oz muhammed al jayab, a 23-year-old college student living in sacramento communicated about joining the terrorist group. authorities believe al jayab actually did join the fight in syria. al hardan's wife defended her husband's loyalty to america. >> he comes to america. i love america.

my husband loves america, too. >> oz al jayab remains in the sacramento county jail. his 20-year-old brother, samir, is out of jail this morning. he's accused of trying to transport stolen property across state lines. he's scheduled to face a federal judge in wisconsin tomorrow. the chance the raiders will stay in oakland just took another hit. yesterday nfl commissioner roger goodell issued a report criticizing the current stadiums for the raiders, the rams and the chargers. he wasn't happy with the teams' proposed solutions either. he called them unsatisfactory and inadequate. oakland didn't send a formal propos proposal. instead, the mayor sent a letter asking for more time. they'll review all the proposals over the next week. any move would have to be approved by three-fourths of the league's owners. still ahead, uber giving its riders a boost. the way you can get a deep discount on your next ride. and ride wars in several big cities across the nation.

the largest cab service in san francisco warned investors about. vicky, mild temperatures this morning but lots of cloud cover and even the potential for some passing drizzle throughout the day. we're going to take you through your sunday forecast and get you into this next week. we've got three storms ahead this upcoming week. we'll see you in a bit.

your time now is 7:14. let's give you a live look at the golden gate bridge. traffic moving slowly and not a bit of fog inside. you can see the bridge clearly and it looks beautiful out there. little bicyclist in the corner with a safety helmet. i've never seen a light so bright. well the bay bridge bike path is lacking support literally. caltrans is questioning whether there's a strong enough underpinning to hold up the final portion of the path. as we take a live look at the bay bridge now, you see the final portion of the path is set to be built. the bike and pedestrian pass

will end at an observation platform. but according to "the chronicle," caltrans is now saying the support components for the observation deck may not be strong enough. right now the path stops about 1200 feet short of the island. catching a ride with uber will be cheaper. the ride-sharing company like many others faces a january slump. so it's cutting prices of its rides but only in certain cities. users in wichita, kansas, will see some of the biggest discounts, 35% for uber x rides. x rides in san francisco and the north bay will go down 10%. uber xl rides, 0% cheaper and uber x right rides in the south bay cut by 20%. the price cut, a sign of the times. there is a struggle going on in many cities over who will rule the road. car services like uber and lyft versus traditional cabs. nbc's anne thompson now with the cities at the heart of the battle. >> reporter: the hair-raising twists and turns of san francisco's crooked streets, a

favorite of tourists and movie makers. the pain compared to the collision course, yellow cabs and ride-hailing apps like uber and lyft are on in the city. >> uber became the only option because i couldn't get a cab because the service is so bad. >> reporter: the yellow cab co-op, san francisco's largest taxi company, is considering bankruptcy. in a letter to shareholders obtained by "the san francisco examiner," the company cites serious financial setbacks that analysts say include relentless competition from the app services. is this the death nell for taxi companies? >> i don't think so. i think taxis are ready to step up their game. >> reporter: the cab co-op admits it needs to improve, but despite multiple requests, it would not comment on the impact of the app services. and in a statement blames most of the debt on an unusual number of accident claims. uber would not comment specifically on the san francisco situation but did say it aims to make things easier for drivers and passengers.

cab drivers say it's making things harder for them. protests in chicago. >> every one we see here is uber. there is no more uber than taxis. >> reporter: and in new york, one taxi company claims its monthly income has been cut in half. they threaten to drive traditional taxis off the road. now some taxi companies are shifting gears and joining those new services in the race for customers by creating apps of their own. next month chicago will introduce an app allowing riders to hail any one of the city's 13,000 cabbies. such apps are in limited use in new york and san francisco. >> you thii think they'll be smarter in terms of technology, in terms of knowing where people are. >> reporter: so traditional and nontraditional rides can share the road with all its twists ahead. anne thompson, nbc news, new

york. >> that is our lombard street. let's turn our attention now to weather with anthony slaughter and a look ahead at the weekend forecast. a little drizzle today and you said maybe we'll get stronger showers during the week? >> yeah, three storms ahead. the first one arrives tonight. not a big deal. but the one wednesday, that's the one i think will be a bigger deal. even next weekend, another one. two big storms. a small one tonight and then we're getting ready for bigger ones later this upcoming week. cloud counterskies in place. as you get going outside, it's not going to be that cold. temperatures in the 40s and 50s but light showers. keep that in mind. you may hit spots of slick conditions but nothing heavy. you see the satellite and radar. we don't have much in terms of rain. a lot of that stuff is very light. not even being detected by radar. this is the one that's going to arrive tonight. bringing showers for that morning commute tomorrow. now, temperatures right now back into the 40s and 50s. very comfortable as you step outside. not that bitter cold that we've seen across parts of some of the bay area. 20s and 30s. nothing like that this upcoming

week. mid-50s. 57, your forecast in the south bay today. 56 for the peninsula. san francisco, you'll be at 55. and you'll notice a brief shower is possible in every single microclimate today. not going to be an all-day rain but from time to time, we will see showers as this next system starts to pull in. here's the storm system for tonight. there's the one for wednesday starting to come into view. then we've got one way out beyond that. three storms this upcoming week. we'll continue on that trend of rainy and rain conditions. all right. this is 4:00 this afternoon. you'll notice a little light showers popping up across parts of the east bay and north bay. you may see that across the peninsula and south bay as well. it's going to be very hit and miss throughout the day today. tonight after midnight, here comes our next system. by 3:00 we'll start to see showers across the north bay, san francisco. and then tomorrow morning, 7:00 widespread scattered rain. some of that could be heavy at times. but it's noting if to be a huge amount of rain that we're tracking for tomorrow. look at the rainfall amounts. we're only talking about maybe a quarter inch or less, and that's

for the entire bay area. the other thing we're watching is this midweek storm. this is going to move in tuesday night into wednesday. this is tuesday morning. tuesday 8:00 a.m. we'll be dry. but wednesday, 6:00 in the morning, look at that. there's that next cold front. that could produce very heavy rain for the morning commute on wednesday. even some sierra snow expected out of this one. in fact, the weather that moves through tonight, not going to produce any snow. we're talking maybe one or two inches across the sierra. here we go towards thursday night into friday. here comes another storm system. it's going to be weak. we may get light showers for the north bay. the one i'm really concerned about next weekend, this one's really good to pack a punch. that could lead to several more storms. we'll keep tracking in. meantime, let's tally up the storm systems. and you'll notice we're talking about the potential of an anch and a half to 2 1/2 ichlgs across the inland valleys. san francisco, the north bay, you could see spots that top out 2 1/2 inches to 4 inches. and again, that would come with

this system tonight, the one for wednesday, and then the once for saturday next week. so overall, the rain continues here across the bay area, the south bay, you'll see temperatures in the upper 50s near 60 on tuesday with the break in that rain. wednesday, showers come back. same for the east bay valleys. san francisco, you'll notice temperatures very similar, mid-50s today and tomorrow. showers move in. move out by tuesday. that will be our dry day. tuesday and thursday, those are your dry days. otherwise it's going to continue to rain pretty much every other day. vicky? >> we need it. thanks. official. she is speaking ex-clus i have been exclusively about her claims against identive. >> vegas parties, computer equipment and lavish celebrations, just some of the splashy purchases detailed in a lawsuit by a former executive assistant to jason hart, then ceo and current president of identive. >> trust services and trust solutions. >> reporter: she contends her boss seen her in a video instructed her to submit tens of thousands of dollars in improper expenses to identive for reimbursement including a party in vegas. she showed us this nightclub receipt with a $15,000 drink bill. >> it was unethical what he was doing. >> reporter: she's now suing the company, claiming she was fired in retaliation for her complaints about unlawful and fraudulent conduct in addition to age description. >> my role ended this year, in january of 2015. >> reporter: the lawsuit claims hart's personal expenses included five to six servers

purchased on ebay for $18,000 each. servers that were at his home and never part of identiv's system. is he also points to $3,000 in american express gift cards for rewarding employees. she said they went to his groundskeeper. >> the companies didn't benefit from that. it was his lifestyle that was being funded. >> reporter: she also alleges an improper relationship between hart and a government official. she says hart used identiv money to pay for gifts and travel for a contact in the united states government believed to have been influential in assisting identiv in obtaining contracts worth millions of dollars. >> it's a conflict of interest. you cannot intermingle with a government official. >> reporter: she says she processed a $17,000 bill that included a fourth of july pool party in 2014 at wet republic in the mgm las vegas. she showed the investigative

unit she says hart gave her for reimbursement. the bar tab, $8700 including vodka, champagne and ten more bottles of bubbly for a champagne shower. for hart, his girlfriend and john daly, an employee with the u.s. marshalls office. his linkedin profile says he served as a security specialist and this shows his name on the plane ticket and itinerary. do you think the company benefited because of government contracts because of all this wining and dining? >> at one point, jason mentioned to me, mr. bailey was an influential person in purchasing, specifically the products that we sold. >> reporter: according to the federal website that tracks government contracts, indentiv has been awarded more than $11

million since may 2011 when hart became ceo. that includes deals with the department of justice and the general services administration where john bailey now works. zh >> there's a specific statute that prohibits government employees from accepting gifts. >> reporter: john crawford is a law professor at uc hastings college of the law in san francisco. his research focuses on financial markets and institutional regulation. he points to the law that says federal employees are not allowed to accept gifts that exceed $50 a year from a single source. and all gifts must be reported including entertainment and meals. >> if you're eating food and not picking up the bill, if you're drinking drinks and not picking up the bill those are all types of in-kind gifts. >> reporter: using the freedom of information act, the investigative unit requested all of bailey's disclosures to the u.s. marshals and gsa. both agencies said they had no records of any gifts. we called john bailey for an interview. he said he had no comment and

jason hart didn't respond to in any of our requests for comment. who should be overseeing the ceo? >> the board of directors. >> crimmon attended the fourth of july party. >> reporter: he's on the identiv board of directors. the match.com founder is also the chairman of the santa clara valley water district. she says he not only partied with bailey and hart in vegas, he didn't hold back. >> in fact, he's the one that had the massages. >> reporter: her lawsuit claims he received $1900 in massages paid for by identiv. cremen did not respond for comment. how would you characterize the relationship between identiv and this government employee? >> corrupt. i mean, assuming the allegations are true, this sort of wining is and dining is clearly meant to win business. once you involve the government and taxpayer dollars, it becomes inappropriate. >> i'm risking a lot, but it's important for people to understand what happens when

there is abuse of authority. >> identiv did not file a response to her complaint, but a motion to move the case to arbitration was granted. our sources confirm the securities exchange commission is now investigating identiv. the u.s. marshals office tells us it is also looking into the allegations involving that government employee, john bailey. the board of directors issued a special committee to investigate the accusations, but their findings are private. well the bay area's largest city in one of the fastest growing airports in the country has increased the number of firefighters on duty following an nbc bay area investigation into staffing. san jose ma net that international airport now has fix full-time firefighters on duty at any one time. last year they only had four. faa rules required this move in october because of an increase in the number of larger airplanes now using sjc. but critics say it's not enough.

neighborhood. many parents are pushing instead for an open enrollment option, and they flooded a meeting yesterday to support it. the move would give families a choice. one teacher says there are fewer students because of the booming economy. >> i think enrollment is going down because of real estate trends here. that the housing market is hot here, and the price of homes is so high that young families with children can no longer afford to move into the lynbrook neighborhood in the numbers that they used to. >> a final decision is expected tuesday. nerdy and proud of it. that's what high school students in the east bay say about choosing to spend their weekend learning to code and develop apps. they're taking part in a two-day hack-a-thon at dublin high school. they're competing against each other to build the best app. most participants are boys, but the girls say they are learning valuable skills, too. >> it's also something where i get to create things and i get to have the freedom of maybe later having a high-paying job or perhaps being part of a very

been a trend setter in national issues such as environmental protection, abortion rights, and california has been a trendsetter in national issues such as environmental protection, abortion rights and children's car seats just to name a few. it's also true with the

gun-control debate where california has had a particularly prominent presence. nbc bay area political analyst larry gerston joins us now. take a moment, larry to explain what california has done when it comes to gun control, which has been a contentious issue nationwide. >> you're absolutely right. california has been a trendsetter, national leader on gun control. way back in 1989, the state legislature made california the very first state, vicky, to ban assault weapons after that terrible cleveland school massacre in sktockton. in recent years california has also legislated stamping for ownership, required safety courses for everybody who purchases a gun and also a ten had-day background check. long ago for anyone purchasing a firearm. so this year, california made concealed weapons off limits at public schools and colleges unless permitted by local administrators. so because of all of this, you know, and lots of other laws,

california ranks not only number one in gun control, according to the center to prevent gun violence, but also 42nd in gun-related deaths. so there you have it. >> wow, that's quite a correlation. >> yep. >> we talk about california being such a trendsetter in so many other areas. how do the values here in this state fit in, though, with how the rest of the nation feels? >> in a sense, quite well. for example, about 90% of californians suggest background checks. we already have them here, as we know. that's also the case for 90% of the nation. but, look. the real difference lies in the role of firearms on a personal basis. a university of chicago survey in 2013 estimated that at least -- at least 30% of americans owned guns. that's a lot. but it's also a lot different than california. according to a public policy institute report in 2013, only 20% of adults here owned the

same guns. look, what do you have here? you've got 20% here instead of 30% there. guess what, that makes it a lot easier for the legislature to make laws when they don't have as high a level of opposition. >> okay. well, last week, obviously, as many of us know, president obama talked about his ideas and his executive order across the nation for new gun-control laws. now he's asking governor brown for some advice and to talk about state data to help provide sort of a basis or background for the federal government's plan. >> yeah, yeah. and here's what happens. the state does background checks, as we know. it investigates records of mental illness. it investigates criminal history. it investigates domestic violence. if you're associated with these, any of these backgrounds, guess what? usually you're not going to have that opportunity to purchase a weapon. that's all there is to it. but the nation has no such system in place despite how well it's performed in california. >> larry, remind us why that's

the case, why there is no federal requirement for background checks. >> here it goes. 20 years ago, almost 20 years ago, at least, congress specifically prohibited -- specifically prohibited federal agencies from compiling any kind of information regarding gun-control issues. management issues. ownership issues. this issue has come up again and again including just last year after that charleston massacre. so that's why. >> so you talked about some pretty, to me, surprising statistics. 90% of californians support background checks. and you're saying that 90% of americans support background checks. if that number is so high, why is it that congress doesn't act? >> bingo question, vicky. two reasons here. first, the national rifle association has been so good, and what a lobby, you know, at persuading national legislators not to go ahead, even though 70% -- excuse me, 70% of its members actually favor background checks. and the second --

>> of the nra. >> that's right. >> okay. >> that's right, of the nra. but the second issue is more complex and so much more important, it's the issue of intensity. most of the 90% of americans in favor of background checks, they don't get worked up on this issue very often. only for a few days, you know, right after a massacre, and then it goes away. but you look at that 10% who are opposed. and they are very intense. they view gun ownership as a sacred right. so you put that together, you know, to quote that very well-known metaphor, you know what happens when the squeaky wheel goes on. it gets the oil. and that's what happens with the 10% who are so much better and so much concerned and so much aggravated about making that case. >> so it is a small but very vocal minority, obviously. >> yes, yes, and they've done well for themselves while the rest of the nation would like to see something done but just doesn't get worked up. >> well thanks, larry, for breaking down those facts and for that information. okay. stay with us. we'll be right back.

7:54, the time now. waking up to some clouds this morning. we've actually got our next system that's going to arrive tonight. here it is you can see. radar view, starting to see a little shower activity and most of this is very light through the day. so if we do see anything, it's not going to be heavy. but again, we'll see mostly cloudy skies. temperatures now back into the 40s. it's 48 in the south bay. 50 in the peninsula. 50 in san francisco as well. cool in the north bay but not cold, 43 right now. now, the clouds will be with us really all day long. and temperatures will only top out in the mid-50s. 55 for san francisco. and we will see a few passing showers not only for the bay

area but even the tri-valley. you'll see that as well with a few peeks of sunshine here and there, again, mid-50s across the entire bay area. here's our storm system for tonight. the next one, that's making its way into view that's going to arrive for wednesday. so we've got two in the short term and then another one for next weekend. so three storms in the next seven days. right now the clouds are continuing to increase. as i mentioned, we may see a brief passing shower. this is around 4:00, 5:00. you'll notice a little green. that shows light showers. and then tonight, the heavier rain approaches after midnight for the north bay. and then for tomorrow morning, most of us will wake up to showers and a few rumbles of thunder even possible across the higher elevations. mostly the santa cruz mountains and down towards monterey. the most impressive rain that we've seen really over the last seven days, not going to be a huge storm system this go 'round. so tonight's rain, only going to amount to about one-tenth of an inch, maybe a quarter inch at most. the next system that moves in for wednesday, that one could give us an ifshlg at the valley

floor and potential for higher amounts in higher elevations. wednesday morning, 6:00 heavy rain pushing back in. even say era snow expected. that moves out by thursday. then thursday night we may see a brief passing shower across the north bay. but the next system doesn't arrive until saturday. and that one could produce another inch on top of the inch we may see on wednesday. so let's tally up all three storms. tonight's rain, wednesday's rain and next weekend and you'll notice we're talking about the potential of an inch and a half, 2 1/2 inches. that's the purple shading there for our inland valleys, the north bay, the tri-valley, even the south bay. and some places near san francisco and the north bay, even the higher terrain could see up to four inches of rain with all three storm systems this upcoming week. so just get ready. more rain coming our way tonight into tomorrow. a dry day for tuesday. san francisco, again, you'll see that dry day for tuesday. the heavier rain pushes back in for wednesday. thursday, that's our other dry day. that will last into friday. saturday is when we'll see another big storm system. really today's storm, tonight's
