live to the peninsula where power has finally been restored in the san carlos neighborhood after a devastating crash involving an out of control semi. "today in the bay" starts now. all right, the calm before the political storm. we're going to get to kris in just a second. thank you for joining us on this tuesday morning. i'm sam brock. >> i'm laura garcia-cannon. >> good morning, we are getting ready for some rain heading into the weekend. today still all dry and some fairly warm temperatures. as you head out the door this morning, no weorries about dens fog as of yet but around 8:009:00 this morning fog over san francisco and temperatures starting oout in the mid-50s. today up to 67 degrees and some low 70s else where for the inland areas and i'll talk about what to expect and when that is coming up in my next microclimate forecast. let's get an update in oakland with what is going on with mike.

>> tuesday, traffic tuesday although it hasn't been quite so severe over the last couple of weeks. more traffic than we did yesterday of course as we look at the map from this live shot. more of the roadways because less fog, as kari said. that might be creeping in over in this area but later on so far no problems and slowing for 580 coming in off of 24. that is your typical pattern there. we'll move south and see slowing for southbound 880 and hayward and union city, no incidents right around the san mateo bridge and that little blip is the toll plaza starting to build towards the peninsula which is moving very well right now. big look shows you the only slow down west 580 out of the altamont more detail and i'll get update from chp. thanks a lot, mike. traffic tuesday on to super tuesday. decision 2016. the most pivotal day in the race for the white house so far. right now the polls are open and it's a mad dash across 13 states as hundreds of delegates are up for grabs. >> stay with us.

"today the bay" kris sanchez and all this activity builds tracking all the action for us. no state more crucial for both sides than the state of texas. >> texas is do or die for ted cruz. it is where he is from. if he can't win there, voters might wonder if he's strong enough for a general election. but texas is big for the democrats, too, because it is the state with the most delegates at stake today. it's pretty clear which way vermont is going to go. bernie sanders home state and he just cast his vote there this morning. spoiler alert, we think he voted for himself. even with the town support, hillary clinton leads him by ten points in the most recent nbc news survey monkey poll that just ended on sunday. very fresh there. on the republican side, donald trump is firmly ahead leading the pack by 19 points. hillary clinton leads bernie sanders in the big states. texas, georgia and sanders among younger voters. donald trump, though, is aiming

to build on his frontrunner status. all of the candidates hitting the campaign trail hard. ratcheting up the rhetoric and aside from donald trump, they all seem to be taking aim at donald trump. >> you have to get out and vote. >> a vote for donald trump tomorrow is literally a vote for hillary clinton. >> what we will see, i, is donald trump and me coming out both with a significant chunk of delegates and everyone else far behind. >> at some point, you can't just say whatever pops into your head if you want to be the president of the united states of america! >> we will defeat mr. trump because the american people understand and always have that love trumps hatred. >> so, take a look at the map. these are all the states that are in play. american samoa also going to the

polls, too and donald trump was going to run the table and not expected to win the lone star state because that is where ted cruz is from. he's polling ahead. democrat hillary clinton not going to win vermont but not a lot of voters there either. lorand sam. >> we'll check back in with kris at 6:30 and complete coverage of super tuesday all day long including a special hour-long edition of "nightly news." coverage at 7:00 this morning. happening today, the start of a wrongful death trial tied to the police shooting of a 28-year-old man two years ago in san francisco. officers shot and killed alin march of 2014. police say he refused to drop his taser, which his family argues he used in his job as a security guard. the family is now asking for financial compensation. city attorneys argue that officers believe their lives were in danger. 6:04. also happening today charges could be coming for san francisco deputies accused of

forcing inmates to fight. >> steph chuang joining us live from the newsroom. the district attorney will make that announcement formally in just a few hours. >> along with the fbi this is set for the hall of justice at 11:30 this morning. for some background, the public defender's office said it began investigating this last year after former inmate ricardo's family reached out accusing jail guards threatening to beat inmates if they refused to take part in these fights. a private investigator then interviewed five inmates and said their accounts were consistent against four deputies. according to "the chronicle" district attorney and the fbi will announce criminal charges against three people. he was fired after the allegations went public after the sheriff's department conducted its own investigation and found enough evidence for termination. the "chronicle" spoke with the

deputies union who confirmed the three deputies are being charged but he decried this as a political move by the district attorney and said that this has been "blown out of proportion." live in our san francisco newsroom, stephanie chuang "today in the bay." three south bay correctional deputies returning to court today. and they'll hear more evidence against them. yesterday was the first time that the family of michael tyree saw crime scene photos of him. accused of assaulting a mentally ill inmate. nbc bay area has obtained the final report by the investigation. among the findings the jail failed to distinguish between ordinary grievances and alleged staff misconduct. also the jail fails to report use of force allegations and management allows guards to intai intimidate inmates who file a grievance. >> i think they're probably lucky that more incidents haven't happened like the death of mr. tyree. >> we are making strides to

improve things. once we see a problem, we're trying to fix it, even before the suggestions are made and the feedback is made. >> that blue ribbon commission i mentioned is to approve operations. before the recommendations can be implemented, they have to be approved by the santa clara county board of supervisors. in the south bay and a new leader at the helm. san jose will swear in a new police chief afternoon. eddie garcia set to be formally recommended as the permanent chief at today's city council meeting. garcia sworn in as part of that ceremony. he has been acting chief since larry retired back in mid-january. garcia served as assistant chief during his tenure and joined the force when he was only 21 years old. chief garcia soon to be says his goal is to make san jose the safest large city, much like it used to be. in the meantime, february, as you might be keeping track at home had an extra day this year. not expected to help out our

snow pack. >> state surveyors are actually headed to the sierra this morning to take that monthly measurement. february was mainly dry and warm, so, we're not expecting great numbers. last month's snow pack measured 30% above normal for that time of year. >> which is a bit of a blow because we know how critical the snow pack is. >> but we are getting some more rain later this week. i don't know if it will lead to snow in the sierra, kari. >> it will lead to snow in the sierra. cold temperatures there and it has been so warm recently that the snow pack and some of oothe computer estimates are at about 85%. we need it at 150% to try to make a dent in the drought. we will keep an eye on their surveys today. temperatures now in the mid-50s as we start out and heading into the upper 60s to lower 70s. enjoy this sunshine because we are about to have some changes and wet weather moving in after tomorrow and let's get an eye on the roadway and see what's

happening as you head out with mike. >> we're looking over towards dublin and westbound we do see a good volume of traffic and the express lane is in effect and you can't tell from this shot right here. let's look at the map and talk about the stretch. greenville over towards the dublin interchange and that's been good all morning and we have the big backup and over the last few, we see the sensors turn from red to yellow and there was a stall in lanes and chp has just cleared that from their report and we assume all lanes are cleared and i didn't get that confirmation. chp says it's okay and i guess that's not a big deal any more. northbound 101 and reports of a fender bender there and should be over on the shoulder if not now maybe in a couple seconds. we see the build north of 680 and northbound 87 at kurtner and late for a tuesday. we've been seeing that as we progress towards the spring. meanwhile southbound 880 slows down towards hayward and there's

the upper east shore freewaying through richmond and again at the berkeley curve and the metering lights are on at the bay bridge and fog is not as big of an issue this morning. back to you. >> we'll be tracking that, thank you, mike. the fog very familiar around here. some recognizable parts of yosemite are gone this morning. the big changes sparking quite a bit of controversy. a historic car crash. historic car crash? we'll take a look coming up in "business and tech." i'm bob redell and back here live to san carlos with the destruction caused by an out of control semi. that story coming up. and very much in control and command the warriors, the live look at oracle arena this morning. the ws are back in town for the first time in more than two weeks. coming up, though, an apology from all-star green and the reason that super star steph curry might be sitting out tonight's showdown.

take a look at this. video of crews riding a dump truck hours after the driver lost control and crashed right into a home in san carlos. truck is long gone now, but the damage certainly still there. >> bob joining us live from the san carlos neighborhood. the power just restored to many customers in that area a few minutes ago. >> within the past 15 minutes.

142 customers without power in this neighborhood of terrino and windsor drive. fortunately the people inside that home in question were not at home at the time. they were on vacation. it's not clear if they returned yet to see what's left of their house. as you can see that house sustained major damage here. this is when a semi hauling a full load of dirt lost control at around 1:15 yesterday afternoon. it was coming down this steep hill. the 29-year-old driver did go to the hospital and expected to be okay. he told chp that his brakes failed as he came down the street. his rig picked up speed, flipped and crashed into the house and the power pole. >> the big rigs are just a common place thing. they come through here and use this as an artery, you know, to get tawhere they have to go. an easy cut through for them. >> there have been accidents on winding way because there is a lot of blind turns and people go a little too fast.

>> and back out here live, you can see the front of that semi. again, it's remarkable that the driver survived that crash. and what's unfortunate is that this is the second time a vehicle has crashed into this home. the first time was an suv. reporting live here in san carlos, redell, "today in the bay." >> we're happy to hear that no one was injured. in san francisco, inspectors are going to be at a chevron gas station to make sure that after this dramatic scene where a bus caught fire yesterday causing multiple explosions this happened that station on ninth and howard. luckily nobody was onboard that bus at the time. the driver pull under to the station after the engine on the bus started to overheat. once he was out of the vehicle, the entire 25-passenger bus was consumed by flames and then two gas pumps exploded. >> the explosion you could feel the force of that from 80 or 100 yards away. that is something the percussion

it you could feel in your chest. >> that bus had been inspected recently and the report was no issues. as for the driver, he's expected back at work later today. a google car hit a bus in mountain view a while back. the accident report was just filed. >> scott mcgrew, nobody was hurt but the car was going at a crawl. this is still a big deal, though, you're saying. >> it is a big deal. it happened on el camino real but one of google lexus suv but not the little cute car. the suv was in the far right lane when it came upon a bunch of sandbags around a storm drain. it tried to go around those storm drains as any driver would. here's the accident report. it says there was a bus coming up behind it one lane over and the computers saw that bus. the safety monitor, the human in the car saw that bus. everybody thought, you know what, that bus will slow down

and let us move around those sandbags. everybody thought that but the bus driver and the two collided at slow speeds. the reason this is significant, you could make a good argument this was the google car's fault. but never, ever, ever before did we see a car accident in which the was at fault. they have accidents but until now it was some other human's fault. maybe hitting the robot car or in the case of the san francisco accident, a human took over for the computer at the last second. he crashed the car. so, this is actually technologies very first car accident. other news the congressional hearing in front of the house judiciary committee will begin at 11:00 our time. both fbi and apple will testify as both sides urge congress to make new laws to fix that problem. at issue, of course, the iphone used by san bernardino shooter farook. should apple break it open so the fbi can read what is inside. apple should argue it shouldn't

be forced to and given an early copy of the company's testimony. apple's company will argue opening one phone puts all phones at danger and he'll tell the lawmakers listening some of you may have an iphone in your pocket. if you think about it, more inform stored on your phone than a thief could steal by breaking into your house. the only way we know how to protect that data is through strong encryption. that debate gets under way at 11:00 a.m. our time. sam and laura. >> we'll look forward to that. >> thank you. it is 6:18 right now. let's take a live look at oracle this morning. the warriors back in the bay taking on atlanta hawks tonight. tipoff set for 7:30, but not all is well with the ws super star steph curry. curry is actually questionable for tonight. he hurt his left ankle during saturday's memorable win over the thunder. he left the game, but, of cou e course, returned to make the game-winning three-pointer that shocked the basketball world. but the ankle itself forced him to sit out practice yesterday.

next several days, the seven-day forecast will be coming up at the bottom of the screen and you'll see after today, we'll have several days of at least a chance of rain in the forecast. and i'll you up to date on that. let's take it hour by hour now in san jose. by 9:00, a few high clouds overhead and temperatures reaching into the upper 60s by lunchtime and highs today in the low 70s and a beautiful afternoon. but we will start to see a chance of rain late tonight in the north bay. and then here we go into tomorrow night with the heavier rain moving in and this will make it all across the bay area by early thursday morning and even during the afternoon we could still have some scattered showers. some rain lingers into friday evening ahead of the next storm system which looks pretty heavy at this point. it starts on saturday and gets heavier as we go into sunday morning and we may also have some gusty winds along with some heavy rain, scattered showers continue into the forecast on monday, as well as early tuesday. before we have a little bit of a

break in the rain on wednesday. so, soggy days ahead. the models are showing the potential over the next seven days of getting at least 1.5 to 2.5 inches in these areas shaded in purple outside of the areas in red. we could have anywhere from 2.5 to 4 inches on the way. some major changes on the way. i'll keep you up to date on that. mike gets you out the door and to work on. >> yeah, kari, folks very eager to sit right here at the bay bridge toll plaza. folks, the metering lights are on and this is not a surprise. i was scanning thia for a crash. i don't see it on any of our cameras and we'll mark it on the map and they haven't said this all clear and all lanes are moving. a stall for upper east shore freeway and that should be cleared from the roadway quickly, but i will track that, as well. a build here. hayward and then across the san mateo bridge and slowing for the incline because that is the nature of the bridge flow.

look at the live shot and up the incline, which we could clearly see today. fog is not the issue right now. look over towards palo alto and this is what we see heading southbound a nice, easy drive past university and slowing around that shift at embark dearo.

"today" show tom costello takes a closer look at kelly's journey and what happens now. >> good morning. well, how would you like to be away from home for a year spending two-thirds of your time in a space the size aof a phone booth. orbiting 250 miles above the earth on the international space station. later today after 340 days in space, he'll finally come home. he has set an american record for longest duration in space and he has the record for the most cumulative time in space. when you add all of it together, all of his trips, 520 days in orbit. but this latest mission is heavy on the science. looking that effects of long duration space missions on the human body for potential future mars mission. and nasa is lucky because scott's near genetic duplicate, his twin brother mark is back on earth. we'll hear from mark and scott

coast. right now 45 degrees in the north and mid-50s else where. look at highs today up to 67 degrees in san francisco and 70s else where. overall, another beautiful day. but we are preparing for some rain heading into the weekend. i'll detail that coming up in a few minutes. let's get a look at what's happening on the san mateo bridge slowing down, mike. >> that's right, kari, we showed folks a slow down and along that flat section approaching the high rise reports of a disabled vehicle blocking your slow lane and now really jamming up over the last three minutes and a tow truck may have arrived and more going on there. we'll get the update from chp as we look at the map, this is a critical time for the san mateo bridge and that's what's causing all the jam. south of there the dumbarton bridge and the bay bridge metering lights are on and all the incidents and northbound build and a crash on 87 and we'll talk about that coming up. back to. right now, mike, we're talking about the subject on everyone's mind today and

secret service agent grabbed the photographer and chris morris by the neck and threw to the ground. morris says it happened when he stepped outside the media pen. secret service says it's now looking into what up to that incident. to this developing story at 6:35. the ocean overcrowd a swimmer near half moon bay happened just off of dunes beach. that's where vicious waves took over sweeping a man out to sea. emergency crews quickly launched a massive search and rescuers scouring the beach from the air and on foot for hours and the man was never found. another beach goer tried to jump in and save the swimmer and ended up getting in trouble himself. the ocean can look inviting on a sunny day, but right now the conditions are rough. >> i could see how somebody would get swept up today because the current is really strong today. so, just keeps pushing you back in and sucks you right back out. >> the coast guard is expected to decide this morning if the search resume.

tragedy here. search teams in the sierra found the body of a ski instructor more than six weeks after he disappeared at sugar bowl ski resort. the search for carson may had been suspended for several weeks due to the weather conditions that were just too dangerous. but yesterday afternoon crews used search dogs to scour that area where may's phone last pinged back in january. his body was found buried underneath five feet of snow. official os say that likely died in an avalanche. happening later today, charnels could be coming to several san francisco deputies accused of forcing inmates at the city jail to fight. >> stephanie chuang live in oour newsroom and the district attorney expected to make that announcement in just a few hours. >> that's right, laura and sam. we know there was a local investigation, as well as a federal investigation. so, the d.a. making this announcement with the fbi. so we should learn exactly what the charges are and by nature of that, how severe they are. now, the public defender's office said it began

investigating this last year after inmate ricardo garcia his family reached out accusing jail guards with beatings and mace if they refused to fight while promising them, too. according to "the chronicle" which cites sources close to the investigation, today's announcement criminal charges against eugene jones and scott new. the alleged ring leader who was fired after the sheriff department's own investigation found enough evidence for termination. "the chronicle" spoke the president of the deputy's union who confirmed the three deputies are being charged but calls the political by the d.a. adding this has been blown out of proportion. we'll learn more at the press conference set for 11:30 this morning at the hall of justice. live in our san francisco newsroom,any chuang "today in the bay." the fate of a popular east bay gun range could be decided today. the east bay regional parkricate meets today to consider closing the gun club.

bullets are that will prompt districts to consider closing the club this summer the lease expired in december and club owners are hoping for a new-year lease. taxpayers will have to cover the cost to clean up the lead. happening today in san francisco, supervisors voting on raising the tobacco age in the city. opponents argue that california law prohibits individual cities and counties from setting their own higher limits and with the national tobacco group threatening a lawsuit suspended its enforcement of a new ten-year limit. santa clara county onner hand decided not to. san francisco city unattorney said the proposed ordinance is legally sound. also a big boost this morning for san hostate, which just got its largest private individual donation and it's coming from someone who didn't even go to college. >> donated $15 million to san jose state for programs to

support students' success and she so on behalf of her late husband. the couple moved to san jose from texas in the '50s with next to nothing. they built their success by buying and managing properties in santa clara county. the big reason for that donation like san jose studies department. very generous. >> of course, get a lot offerships with $15 million. starting today, some of yosemite popular names no more. >> a trademark battle going on that involves the park's former vendor is prompting the national park service to take action some are calling unthinkable. you saw it before now being called the majestic yosemite hotel. the curry village camp ground is now going to be known as half dome village. the company that once ran those attractions said it trademarked the names and critics say the company is trying to hold the park service hostage. for the time being, temporary signs have been installed. let's check the forecast

right now. always beautiful up in yosemite, what about our neck of the woods? >> another beautiful day and we enjoyed a nice stretch of weather and you should really take advantage before we have some pouring rain moving in over the next several days. our temperatures in the low to mid-50s as you head out the door. we have 40s in parts of the east bay and north bay. it will be in the 70s for the south bay and the peninsula and degrees in san mateo and 59 degrees in at the marina and cooler in san francisco and we'll have 70 degrees in santa rosa and napa and antioch up to 74 degrees and pleasanton a high of 75. our temperatures changing along with this weather and let's get an eye on what's happening with the morning commute the slow down across the san mateo bridge. mike? >> over towards the foster city, we have cameras on both sides of the bridge and i just saw the last five minutes a burst of traffic heading over and filling all lanes coming down to the

a south bay church will open its parking lot to homeless. a temporary closed program that will allow families who live out of their cars a safe place to go. families will be screened and have their background checks

before being registered. there will be no drugs or alcohol allowed in the parking lot. church volunteers are being trained on how to help the homeless during their stay. >> we're offering them a light dinner in here, a few hours in here where they can relax. where the children can maybe do some school work. >> the bishop of san jose has asked other churches in the diocese to come up with a similar plan and the program will last until april. very nice there. big happenings today on capitol hill. apple and the fbi both set to testify in front of a house subcommittee about the controversy over the iphone used by the san bernardino shooter. >> scott mcgrew both apple and the fbi would like congress to take action. >> yeah, laura, there are really no good laws covering this question. i mean, should apple have to open that phone to law enforcement? so, both apple and the fbi said it would really be best for congress to make some kind of ruling on that. make a law or improve an existing law instead of waiting for the courts to do it. that hearing gets under way at

11:00 a.m. our time. the magistrate in the san bernardino case has told apple to help the fbi open that phone used by syed farook. it basically says you have to help the police do their job. it's pretty broad. it was also written when george washington president. apple says in this context, it's an unconstitutional order. now, unexpected plot twist. yesterday in new york city a different magistrate in a different iphone case said the act was too broad and refused to force apple to open a different phone for the fbi in a drug case. the magistrate in brooklyn doesn't have any power over the magistrate in southern california, but his argument works in both cases. he says a written in the 18th century needs to be updated and congress needs to do it. let's take a look at wall street this morning. the dow industrials gaining

so, little bit cooler than it was yesterday we're getting ready for some changes. a few spotty showers possible as we go into tomorrow night and then on thursday, as start out the day, some heavier rain moving in. it starts from the north and moves to the south and it continues into thursday afternoon. kind of some off and on rain. it won't a total wash out. heading into friday, scattered rain especially during the evening and now saturday looks pretty wet during the afternoon and it gets even heavier as we go into saturday night and early sunday. we may also have some gusty winds and the heavy rain pouring all throughout the day. and even into monday as well as tuesday before there is a brief break before the next storm system moves in. so, it looks like some major changes on the way as we head into the start of march. this is a look at the seven-day rain outlook. between now and the next seven days, we could have about 1.5 to 2.5 inches shaded in purple and that is most of the bay area and

parts of the north bay and parts of the far south bay as well as the east bay could have as much as 2.5 to 4 inches of rain. it looks like we could have a pretty good soaker as we go into the next several days and maybe even turning a corner for the month of march. i'll keep you up to date on that. let's get an update on what's happening in the north bay now for mike. >> talk about turning a corner. turn these corners right here. not so severe and see this shot much better than yesterday as kari talked about. fog is not so much the issue right now. look at the map and slowing out of novato and slow over that richmond to san rafael direction and that's westbound 580 and down the east shore freeway and the earlier crash at university should be out of the roadway. i don't see any additional slowing. for tuesday, light volume of slowing and reports of some wood that fell off of a truck and into the roadway. we'll watch to if a traffic break or clear that quickly. meanwhile west 92 a span over
