milpitas we have a little traffic picking up. a major lawsuit will be announced by the city of san francisco. if reports are accurate, the for-profit academy of art university is in the city crosshairs. >> city attorney dennis herera scheduled a news conference for 10:30 this morning. "the chronicle" is reporting herera is about to target the academy of art massive real estate holdings saying the college has been unlawfully chipping away at san francisco's housing with 22 buildings under its ownership. they are calling this lawsuit premature and unnecessary claiming herera has some axe to grind. steph chuang will have a live report with much more information at 5:30 this morning. >> attorneys for former 49 star dennis stubblefield are expected to reveal more evidence which

they say prove his innocent. they say he sexually assaulted a developmentally disabled woman last year after she interviewed for a job. >> a crime with long-term consequences for a local charity. this coming after carjackers of a meals on wheels delivery truck led police on a wild chase that ultimately led that truck to crash. >> kris sanchez live in fremont where the truck was stationed with more of the impact having on the charity and the people it serves. >> good morning. meals on wheels, an elder care going with plan b and plan c but wondering how long they have to rent or borrow vehicles to delivers hundreds of meals to seniors across the silicon valley. this is how the meals on wheels truck ended up on interstate 580 yesterday morning about a half hour from where we are in fremont today. no one was hurt and no food was

wasted. the meals on wheels truck was empty when the accused carjackers crashed it after stealing it. volunteers and workers just finished unloading those coolers of food. when they saw that man and woman trying to carjack that truck, they begged them not to. >> our volunteer said, please don't take this vehicle. it's for seniors. we serve food. >> that truck costs about $45,000 which we don't have. >> that is a lot of money for a charity. one volunteer set up a crowd funding page to pay those tens of thousands of dollars in rental fees and repairs they expect. so far they've only raised about 2% of their goal. perhaps people just don't know they can help. the two carjacking suspects were arrested and are charged with evading police and carjacking. we'll let you know when they

head to court. kris sanchez, "today in the bay." >> 5:04. a millbrae father missing more than a week. his family is desperate for answers. the sheriff's department is asking for help to find him. friends and family held a vigil for 27-year-old keith green yesterday. he disappeared without a trace last week. he was last seen leaving his apartment heading to a restaurant. he left his wallet and car at home. his cell phone was found a day later in golden gate park. last night friends and family held a vigil for green. >> there is a very strong possibility he was wearing a pair of nike type shoes. they were so fluorescent, i figured they would glow in the dark. he loved his shoes. >> he has two beautiful daughters and he would never, ever walk away from them. >> investigators are calling green's disappearance suspicious. if you have information contact the san mateo sheriff's office.

>> the three so-called drifters accused of killing two people are going to be in court today. this is the first time they will all appear together since one took a plea deal and agreed to testify against the other two. sean angold pled guilty and is working with prosecutors to convictç the other two. they are charged with murdering a canadian tourist and a hiker last year. san francisco police need your help tracking down a man accused of attacking a woman yesterday morning. you could see him in the surveillance video. he was wearing a brown jacket. it happened at webster and buchanan street. the victim said the man followed her a few blocks before the attack. she escaped without injuries. the suspect was last seen running towards city hall. san francisco mayor ed lee said he is not going to fire police chief greg suhr.

he spoke to hunger strikers by phone. their effort to get the police chief fired is in its 16th day. five people are living on chicken broth, coconut water and vitamins. they want the mayor to fire the chief over police shootings. firing the police chief is not an easy change. >> it takes three to six months to get a new chief. that means all our time is diverted from that to finding a new chief. then you've got to find one onboard with the changes you want to see happen. >> a doctor says their bodies are starved for protein and it starts breaking down muscles including the heart. it is 5:07. take a look at that forecast. rain in the works for us yet again. >> more scattered showers. hard to pinpoint a timing and placement of the rain. you just want to be prepared as a slow-moving, widespread low

capitol hill, the man who is going to be in charge of that convention when trump gets nominated, ryan isn't backing trump so far, telling cnn he's just not there. that he wants to expects he will but right now can't throw his weight behind donald trump, the presumptive nominee for his party. that is a pretty big deal. there are concerns about pulling together members of the party now that the former bush presidents said they are not coming to the convention. john mccain said they'll campaign for trump but he's not coming to the convention either. illinois's governor and others pulling out of the convention. is trump going to be able to pull everyone together? what will it take? it's his controversial positions on some things like trade and immigration that have some republicans not quite there, as ryan puts it, in terms of supporting him. he's got millions of voters, what about the party leadership?

temperatures are now in the mid to upper 50s. futurecast shows rain starting to rotate in and giving us scattered showers throughout this 10:00 or 11:00 hour this morning. then it starts moving farther off to the south. heavy downpours in a few spots. not everyone will see that. it does taper down tonight. we'll have another round of rain moving through tomorrow. may not be as widespread and heavy, but still scattered rain in the forecast that may interrupt those saturday plans. looking now at the rainfall estimates, this computer model puts down about 1/4 inch for most of us with some spots getting more. there will be a shift in the pattern. this area of low pressure slow to move will slowly start to shift off to the east. still rain in the forecast for the first part of the weekend. then the second half of the weekend, high pressure moves in.

another wild and dangerous car chase in southern california. this must rank as one of the most brutal. you see the suspect's car there first weaving in and out of cars and smashing into car after car on freeways that span at least two counties. the driver is wanted for attempted murder and eventually did wreck that car. he held officers at bay for a while shutting down the freeway. look how far that goes back. creating a monumental backup into last night's evening commute. after hours, officers with a special response team finally were able to apprehend him and take him into custody. new details on a story we broke out yesterday. we know the identity of the man who refused to come down from the top of the vta train in san jose. >> he was up there so long. 25-year-old kyle lucently came down about 1:00 yesterday afternoon, nearly 12 hours after it all started. lewis said he wanted to ruin

everyone's morning. deputies say he's on probation for a nonviolent offense but is now facing an additional misdemeanor charge of disrupting a vta line. he could face up to a year in jail and a $10,000 fine. 5:25 on your friday morning. a technical glitch in oakland could have caused serious problems for public safety. fortunately, the communications system is working this morning. the dispatch system crashed just before 3:00 yesterday afternoon. oakland's radio system also crashed forcing city officials to jump on the backup system for about 30 to 40 minutes. back in 20 12shgs oakland had a communications meltdown while president obama was in town. they are some of the most medically complex kids in the bay area who need specialized care. when they are able to leave the hospital and go home, families are finding resources aren't there for them. this mother says her local

hospital promised to send nurses to care for her son. two throat surgeries force him to eat through a feeding tube. the hospital had no one to send blaming a lack of pediatric home care in her area. nursing agencies are turning down patients. parents are trying to figure out what to do. >> to have been in the hospital for so long, then come home and feel so isolated and feel like nobody is looking out for you or nobody is thinking about you is just heartbreaking. tonight at 11:00, the extreme measures another family had to take to find home nurses for their sick daughter. the investigative unit takes the struggle to the head of the department responsible for helping millions of disabled californians. if you have 2. >> terry: give us a call.

40 buildings, this is one of them. today san francisco is set to file a lawsuit accusing the school of illegally converting 22 of the buildings from former apartment and hotel properties into mostly student housing without going through the proper city channels. this is according to the "chronicle" which says a decades-long back and forth between the city has been going on between that and the country's largest for-profit art school, including hundreds of thousands of dollars in fines unpaid by the school. city attorney dennis herera complains that the converted student housing is exacerbating the scarce supply of affordable housing and this may have been the school's way of dealing with an enrollment bm of 5,000 students in 1992 to more than 18,000 at one point they want them to pay potentially tens of millions of dollars in penalties, in addition to restoring the buildings to residential use. what remains to be seen how much was affordable housing before.

the school's attorney told "the chronicle" the university spent $8 million during nine years putting together an environmental impact report that had to be done before these properties can even be legalized. a report the attorney says should be done by july 1st. that also remains to be seen. we should be hearing more details after the press conference held by the city attorney at 10:30 this morning at city hall. live in san francisco, stephanie chuang, "today in the bay." >> it is 5:33. breaking news, the latest jobs numbers came down within the last couple of minutes. let's hand things over to scott mcgrew with a break down of those numbers. >> we are looking okay. 160,000 jobs added in the month of april. that is not quite what we were looking for because the numbers up until now have been plus 200,000 for quite some time. the momentum we had coming into 2016 may be lost just a bit.

the unemployment rate stays steady at 5%. when you look at this in a political view, and these days have to look at these things in a political view, it's a solid number for the administration as that unemployment rate stays low. back to you. >> thank you. volunteers are launching a fund-raising effort to repair a meals on wheels truck that was carjacked and ended in a police chase and a crash. a man and woman carjacked that meals on wheels truck at a distribution center. the pair then led police on a 15-mile-long chase that ended with a crash on interstate 580. the truck lying on its side. officers did arrest those suspects. >> before they left our volunteer said, please don't take this vehicle, it's for

seniors, we serve food. >> that truck costs about 45,000, which we don't have. >> that truck is now out of commission. volunteers are borrowing and renting other vehicles to deliver 400 meals to seniors a day. a historic but unsettling find at a construction site in west berkeley. a second set of partial human remains has been found there. it was at a site under development. they are believed to be those from an indian. it was the main native american tribe in the area. they've all been removed under the supervision of a tribal leader for burial elsewhere. crime of opportunity in the south bay. this shows a man and woman getting into a car that is not theirs. they are walking into unlocked cars in campbell. police say in total, three unlocked cars were targeted.

the couple got off with cash, iphone and paperwork from two of the cars and the pair has not been caught. have you seen this woman snl if so police want to hear from you. she was caught on camera monday stealing a package from a home on richmond street. she left an empty decoy box on the porch in its place. she was driving a gmc pick-up truck. we mentioned there is a broken gas main causing major issues in palo alto this morning. san hill road and it happened last night. both lanes between whiskey hill are closed down as bg&e is trying to repair that situation. they said it's going to take time because the gas main broke 11 feet under ground. officials say there is no danger to the community and that service is not going to be disrupted. a 74-year-old woman is badly burned, two other people also injured following a fire in bethlehem towers in santa rosa.

the fire broke out on the sixth floor of a high rise apartment building 4:00 yesterday morning. firefighters contained it to one apartment but had to evacuate other floors. they found the 74-year-old woman in a stairwell. she suffered severe burns over 75% of her body. the cause of the fire remains under investigation. firefighter hurt but more than a dozen people back in their homes after a fire in san leandro. part of a window came crashing down on a firefighter. a spokesperson says he had a head injury and was taken to the hospital. about 15 surrounding buildings on liberty street had to be evacuated. it appears to have started in a shed next to the home. cause under investigation. you can't say the public hasn't been warned. there is an effort to try to get an earthquake warning system here in california following a gathering of seismologists we told you about yesterday. one made a very ominous

prediction. research finds the san andreas fault line in southern california is locked and loaded for a major earthquake. they say there is every indication the bay area is in line for a destructive earthquake any time soon. state senator jerry hill from san mateo is pushing for an early warning system. he's written legislation that would set aside $23 million in state money to accomplish that goal. >> they will detect any shaking that begins and transmit that to california and give a person who has a smart phone or siren or on tv a warning. >> the big question is that system will be reliable? pg&e and b.a.r.t. are plugged into the sensors. experts worry about giving people a false sense of security noting this is not an exact science yet and a good system detecting earthquakes could be a year away. there is a science when it comes to forecasting the

weather. warning us of rain. >> also not an exact science figuring out when and where we will see this rain. it's producing scattered showers across california. as we take a look outside now, it's 7:00 in the east bay. it's nice and cool to start but then as we go into the day, more of those cooler than average temperatures into the upper 60s for the south bay. 63 for san francisco and the north bay up to 67. times of rain today also for tomorrow as well. that may change some of those weekend plans. i'll talk about that coming up in less than ten minutes. mike, you're tracking a slowdown through fremont? >> right now we are seeing not much of a shift for places like the san mateo bridge. another bridge that has had a big change. that shift in fremont was a lot of slowing north bound heading up toward mission. no reported delays and it has

lyft. the car would be driven by robots. most state laws say an autonomous car have to have a human at the wheel to take over. gm bought a san francisco-based company developing sensors for automated cars. while we don't know which city lyft will introduce these robot taxis to we are leaning to san francisco. there are all kinds of jobs that can and will be automated. robots are taking over for long shoremen saying ports an incredible amount of money. the pacific maritime association says the average long shoreman on the west coast makes $98,000. supervisors make $200,000. >> we just got the latest jobs number from the labor department. the american economy added 160,000 jobs in the month of april. unemployment rate is at 5%. is there a lawsuit in san francisco federal court over

facebook's ability to tag you. people in illinois say facebook's ability to do this runs afoul of their state laws about biometric data. california has no laws about this. you're agreeing to go by california law but a san francisco federal court said they are going to let the court case go forward based on illinois law. to me, this is the most important part of the case. we've got to find some state that will use the law because we are going to serve 50 states and each one has a different law. obviously, it should be california law. that's where facebook is. courts say they will let this go forward based on illinois law. >> and it's used around the world. >> you would think facebook would tailor that agreement to illinois law. >> you agree one way or the other. i think facebook has a pretty strong case.

>> that will be possible again today because we have this slow-moving same storm system moving through the bay area. it's giving us at time some rain. it poured heavily at my house yesterday. then i drove a half mile up the road and it hadn't rained. that's the kind of weather we are seeing. now look at those cloudy skies over the south bay. we will get some peeks of sun. now those temperatures are in the mid 50s. it's 54. let's drop in on the south bay 55 in silver creek valley. le san martin starts out at 56. it feels mild. we see a lot of the clouds moving in. this line of rain is over the sierra. it's moving off toward the west. this is what we can expect as we go into later on this morning and early afternoon. futurecast shows there will be more coverage of rain. this is what the radar could look like. we see the yellows and reds that

indicate more heavy rain. as it moves into parts of the bay area san francisco moving out of the north bay into the south bay and east bay there could be rain moving in. it continues into the evening before much of this activity tapers off and will do it again tomorrow. we could get about 0.1 inch. if we get up to 0.25 inch in a few spots, that could be what we normally get during the entire month of may. we'll be keeping tabs on that. let's head over to mike keeping an eye on what's happening on the roadways. >> pretty typical friday. for this shot, san jose live northbound 101, an easy drive. as far as speeds go, get you oriented to the big look at the bay. no real problem. showing a little slowing right

one of the victims was just 15 years old. the penalty phase of the trial will begin next week. later today, the public will get a chance to remember, honor and say good-bye to prince. a public memorial will be held at the los angeles city hall area later today. several celebrities have been invited to perform and prince died last month. this is all in his honor and memory. the cause of his death remains under investigation. just this week we learned a bay area doctor was called to help treat prince's drug addiction. investigative unit exclusive. there is a turf war reaching a tipping point. bikers want more access to trails but hikers say that would endanger their safety. >> vicky nguyen is here with a look at the numbers. >> the trail at mt. tam can get crowded. bikers are looking for a place

to avoid cars and hikers want a place to enjoy nature without worrying about bikes. neither side can expect much an enforcement. at issue a half mile stretch of the easy grade trail. they want access for bikers saying they need to get to the popular mountain theater without having to compete with cars on narrow, windyç roads. hikers say there is enough speeding on trails where bikers are allowed. according to a bikers where self-report speeds up to 21 miles per hour despite the 15 mile-an-hour speed limit. in the last two years, rangers issued 26 tickets to mountain bikers. none for speeding. bikers argue they are at risk. officer were called out to 20 bicycle accidents from january 2014 to april 2016. see our full report at nbcbayarea.com and click on investigations. >> if you have a tip for investigative unit, give us a
