i'm kris sanchez where a family is forced from their home by a fire but saved to the quick thinking of a good samaritan. plus more breaking news. flashing lights and crime scene tapes surrounding a san francisco neighborhood as police continue their search for a killer. >> a father now on the run after he allegedly set fire to his home killing his own son. what police are telling us about a possible motive behind this unthinkable crime. today in the bay continues now. a very good morning to you. thank you for joining us. i'm laura garcia-cannon. >> i'm sam brock. they say there is no such thing as a good thing. we'll put that to a test today. we had a beautiful day yesterday. >> we start out with clouds. we'll see that clearing out with sunshine later on today. our weather on repeat for a little while.

we are in for a warming trend as we head for the holiday weekend. now it's 56 in san francisco. 47 in the north bay. a little bit cooler in spots. rain for the north bay mainly over the hills and 66 in san francisco while we have 70 in the peninsula with breezy winds. we'll look ahead to the forecast coming up. now mike is giving us an update that crash in the caldecott tunnel. >> that will affect some folks out of orinda. we'll give you a shot of the bay brim approach. slowing, but looks like speeds are improving. i'll give the update and hopefully in the next report we'll have much more detail. i expect the build to kick in about 7:00 today, 9:00.

it will be the bulk of the morning commute. >> an update to breaking news. six people inside a burning house but safe this morning courtesy of an alert passer-by who noticed smoke coming from the san jose home hours ago. >> it happened at a home not far from the intersection in north capital avenues. kris sanchez live at the scene. part of the roof's home caved in. >> right. part of the roof did come down. you can see it behind me in the home. now that home is not livable. thanks to that good samaritan and quick thinking, the family did make it out safely. all the six folks inside the home at the time, parents, kids, grandparents and the family dog made it out. the fire in the attic caused the roof to partially collapse. the family won't be able to come home for a while. the family is very emotional and

don't want to talk with us. now they will try to figure out how to move forward. they were roused by that good samaritan who did not stick around to take credit for that good deed. there is never a good time for something like this. the fire happened as the family was celebrating a new beginning. there are graduation party decorations hanging on the house. kris sanchez, today in the bay. 6:03. a gunman is on the run following a deadly shooting south of market. police tell us a man was shot and killed at 6 and minna 11:30 last night. no word on a possible motive. also in san francisco, police looking for two suspects who barged into a home last night. this happened near 27th and noriega. detectives believe the thieves followed the people home. one person suffered a minor

injury and police are searching for the suspects. for the latest developments in vallejo where police are desperately trying to track down this man. they say he is dangerous. he is suspected of killing his 5-year-old son by setting his house on fire. he used an accelerant to start the fire sunday morning. his son was trapped in the master bedroom and died. his wife and other son made it out okay but they are injured. two santa clara jail correctional deputies are facing criminal charges in connection with an alleged inmate beating last summer. they turned themselves in yesterday. each is accused in a beating last july that left an inmate severely injured. each now faces one count of felony assault. the former inmate ruben garcia says two guards gave him a

fractured jaw and other injuries. says he remains skeptical despite arrests. >> i'm not too confident about it. they are in a position where a lot of times you get swept under the rug or they take a lesser charge. >> garcia only came forward after the investigation into the beating death of michael tyree which happened last summer. three others face criminal charges in that case. investigators have a critical clue after the latest gun fire on a freeway. a road rage incident led to shots being fired sunday night in richmond off 580. no one was hit by the gun fire. they say the shooter crashed his car into a sign post and left his bumper at the scene. investigators are looking for a 2005 volvo license plate

7enk356. medical examiners identified a man who was found dead after his minivan crashed into a south bay pond last wednesday. emergency responders pro nounsd the man dead at the scene. his van crashed through a gate, went down an embankment and wound up in a pond. surveillance video showed that van driving erratically by a home just seconds before the crash. the cause of death is pending. today san francisco board of supervisors will take on the issue of sanctuary city policy again. san francisco sanctuary city policy came under scrutiny following the shooting death of kate steinly. the shooter is an undocumented immigrant. firefighters making good

progress on the metz fire near monterey county. that has torn through almost 4,000 acres of land and is up to 50% containment. the fire began sunday and cause is still under investigation. the sharks are one win away from the first trip ever to the stanley cup finals. sharks now have a 3-2 series late in the conference finals. team teal can close it out back here at home tomorrow night. puck drops at 6:00 p.m. that will be one to watch. the warriors hoping to rebound in oklahoma city after getting absolutely embarrassed by the thunder on sunday. >> it's been a while since they've been in this position.

afternoon. it will feel like it's in the low 60s and topping out to the 70s. 66 today in san francisco. heading into the weekend, it will be warming up. i'll talk about that coming up. two crashes maybe helping commuters? >> look at both sides of the coin. two crashes. some held up in the back. we have a lot of slowing out of the altamont and more slowing toward the caldecott. west 24th, that crash registered inside the caldecott tunnel. the speed sensors seem to be improving. there may be movement as that crash inside the tunnel. chp has not begin me the all-clear. i'm not going to say it's fine. b.a.r.t. coming to the area is just fine. that is a good option.

at 6:13, new details in the egyptair flight 804. human remains retrieved from the crash site suggests there was an explosion onboard that may have brought the plane down. the plane crashed thursday while on its way from cairo to paris. 66 people were onboard and presumed dead. a submarine is scouring the crash site in the mediterranean sea in hopes of finding the plane's black boxes. bill cosby back in court today for a key hearing in his criminal sex assault cases.

he faces criminal charges for allegedly drugs and assaulting the woman at his mansion in 2004. he denied similar allegations from 50 women. today's hearing will determine if prosecutors have enough evidence to send this case to trial. the head of the irs may lose his job. >> scott mcgrew. >> he might be impeached and sent to trial in the senate. it's not just for presidents, apparently. republicans in the u.s. house will consider impeaching irs commissioner john kinnon today. he wasn't even irs commissioner when all this happened. he was brought in to reform the irs. if the house impeaches him,

senate leaders said they won't convict him but even the impeachment would make history. "the new york times" says how the last time they impeached a nonpresident was just after the civil war. facebook came under fire after an article indicated some journalist chose not to run stories favoring conservative issues. wournlg says lyft will experiment with a new feature allowing you to order a carç before you need it. there is a similar service called wingz that does that. the lending club is back in the news as a chinese outfit buys a big chunk of company stock. if you bought at the bottom, you had big money to be made.

>> a new study says legos are getting more violent. the research from researchers in new zealand and england looked at various parts lego makes over the years. found 30% of lego kits have weapons in them of some sort from pirate swords to jedi light sabers. there is an excellent book if you're interested in kids and violent toys called "killing monsters." it is absolutely fascinating look into both sides of this argument because there are two sides. there may be some credence to little boys playing with violent toys having an outlet, as well. >> like playing cowboys and indians. >> little boys in particular naturally gravitate towards this and psychologically what is going on. fascinating book. >> they gravitate toward light sabres. >> i have to play every night about 5:00. now you know.

>> a shining light now in the city of san francisco. a crane hoisted the head of a 92 foot stainless steel sculpture atop its shoulders. this put the dramatic finishing touch on what is now the tallest sculpture in the city of san francisco. venus located at the housing complex on market and 8th street. that is about nine stories high. >> you can't miss that. >> a little taller than you are. >> 91 feet. >> does this statue make me look big? >> trying to live up to high expectations. our weather has been perfect start of the week. >> it is pretty nice. especially during the afternoon. we did have cool temperatures to start out the day and clouds here and there. take a look at this gorgeous shot at the golden gate bridge. we only see a few clouds

floating by in the distance. more cloud cover for parts of the south bay. let's get a look at san jose. we do see more clouds moving in this morning. still all dry. temperatures at 48 in the north bay and 56 in san francisco as we drop in on the north bay to get a closer look. napa is now at 55. novato 52. we have 50 now. as you start out this morning and mainly clear visibility. it will be in the mid 70s today for parts of the south bay. palo alto at 72. mission district expecting a high of 65 and 70s for the north bay. oakland today tops out at 58 and low 70s. get a closer look at the tri-valley and what to expect over the next five days. you can see the seven-day forecast bottom of the screen. livermore will be cooler than where we should be this time in may. 75 for tomorrow. then it starts to warm up as we

go into the holiday weekend. we'll be in the low 80s as this area of low pressure continues to move off east. it could still be enough to trigger off scattered showers and thunderstorms. we had that yesterday farther to the north. also for parts of the central valley. as that continues to move away, there will be another low dropping in that could bring in more activity for the sierra. some showers and possibly high elevation snow. not expecting much. for the coastal areas, temperatures will be warming up as that high pressure moves. in looking to the weekend forecast, it will be in the mid 80s for the north bay as you make plans to get outside. maybe you want to head to the beach. it will be in the 60s along the coast. 70s for the peninsula as well as east bay. tri-valley and south bay looking at highs that will be topping out in the lower 80s. drivers can expect more traffic heading through oakland.

a smoother drive. slowing southbound 880 because of a crash that happened in the area around the 92 interchange. waiting for chp to get there and give us more information. we talked about all these folks held up in orinda. they've been let loose. all lanes are clear heading past highway 13. farther south looking at westbound 92. that's the san mateo bridge. traffic coming off 238 and 580 and castro valley. that's where the big build is. no problems for the south bay. back to you. >> thank you very much. 6:20.

health officials are set to address battling zika virus on capitol hill. with temperatures heating up and anxiety growing over the virus, health officials are coming together to try to stop the spread of zika in the united states. centers for disease control is monitoring 279 pregnant women infected in zika who risk having babies born with birth defects because of that virus. all cases are travel related. the concern is people will get infected in the u.s. because of mosquito season coming up soon.

national football league coming under scrutiny. they planned to donate $30 million to fund brain research but a house law maker says nfl executives pulled the funding when they found out a researcher chosen for one branch was someone they considered biased. taxpayers ended up footing the bill. the nfl is denying the allegation is but reviewing the report. a shake-up at the tsa after long security lines left passengers stranded at airports. head of security operations has been replaced. kelly hogan was the subject of testimony in a house hearing looking at staff mismanagement and questionable bonus decisions. he received $90,000 in bonuses in just one year. it is yet another legal twist in a murder trial for the man accused of killing sierra lamar. next the reason the trial may never take place in a santa clara county courtroom.

dangerous. that's why they want to capture this man. this man we are talking about is the 53-year-old father of the young boy killed in this fire. a man police consider to be dangerous and they believe started sunday morning's fire at the family home on the 00 block on stella street in vallejo. fire investigator with the help of a k-9 found an accelerant. neighbors did try to put out the fire before the fire department arrived. their efforts were no match. the 5-year-old boy trapped in the master bedroom couldn't be saved. >> the mom said, my baby, my baby is back there. she came out. she was burning. >> i'm going to miss that big smile, seeing it every day. it's a hard situation to deal with. >> family tells us the boy's

mother is being treated for third degree burns. a teenage boy burned in the fire was treated and released. no sign of the man police are trying to capture for the alleged arson of his home and murder of his 5-year-old son. bob redell, today in the bay. >> tragic. thank you. 6:32 on your tuesday. the three suspects accused of murdering a millbrae father are set to appear in court today. tiffany lee was arrested for conspiracy and murder along with her current boyfriend and friend of the couple. those three killed keith green, the father of lee's children. new delays. the 4-year-old case tied to the murder of sierra lamar.ç >> in a hearing yesterday, antolin garcia-torres waived his

right to a speedy trial. among the items, defense attorneys are requesting a change of venue which would be granted and move the case to another county. >> clearly, the judge has to balance the right of mr. garcia-torres to a fair trial and also look at the facts that generally change of venue motions are not favored and they are very expensive and cumbersome. >> requests are usually granted only in exceptional cases when the judge feels an unbiased jury cannot be found. this judge scheduled a new court date three weeks from now. >> north bay police officer caught on tape pulling a gun on a man filming him is being sued. the police officer dave rodriguez is facing a federal civil rights lawsuit. you may remember this viral video from last july. he was patrolling the neighborhood when he saw the man

filming him. rodriguez drew his weapon. he eventually put his gun away and left. the man behind the camera is the person who filed that lawsuit seeking unspecified damages for physical, mental and emotional injuries. the hayward police department is facing a wrongful death lawsuit found by a bay area man who died during an arrest. it was recorded by one of the officer's body camera. james greer was pulled over for allegedly driving erratically. you can hear him explain to officers about his medical issues, a stomach hernia, knee injury. shortly thereafter, greer takes two steps back and officers tackle him down. he got shocked and concerned when he realized how many officers were on the scene. he was told to complete the so bright test. he took two steps back and questioned what was going on and quickly wrestled to the ground. i want police to be held accountable for what they've done and their part in his

death. >> officers used a taser on greer several times. he later died at a hospital. his family says officers used excessive ft. which led to his death. now we are creating a conversation. last night san francisco's new police chief held an invite-only meeting in the bayview. people are angry with the department following another deadly officer-involved shooting. acting police chief tony chaplin told the crowd that last week's shooting is still under investigation but he is working hard to fastrack body cameras. he hopes to change the use of force policies for the city. some were xwrafl to have a chance to ask questions. others say an invite-only meeting is not a good start. >> where is the community? >> genuine dialogue. i'm very hopeful but i'm not sold. >> chaplin plans to meet with the justice woods coalition and

frisco five. judge. >> cleanup under way in tracy after a 21,000 gallons of oil spill that happened when one of shell's pipelines broke near 580 in west patterson last week. some 50 crew members are on site monitoring air, water and soil conditions. they are focusing on cleaning up. shell doesn't know what caused the pipeline to break. >> demolition work on the bay bridge continues. crews are going to start lowering the third 500 foot truss span today. that is a two-day event. if i've been on the bridge recently, you probably noticed that the old bridge is almost gone. on sunday you know how busy that park can be. you can reserve a spot ahead of time for a green. >> your only patch of green. they started taking reservations. $33 for groups under 50, $325

for groups larger than 400. you have to throw down a few hundred dollars security deposit and fill out an application. reservations available 10:00 to 1:00 and 2:00 to 5:00 daily. that's a different twist on things. a lot of sunshine to keep it green before the rain. kari hall joining us. >> we are expecting warmer temperatures. that's a cool start to this week. we had cooler than average temperatures not only in the morning but afternoon. we still see clouds this morning as you step out the door. this afternoon will be a nice one. lunchtime in the low to mid 60s all across the bay area. reaching low 70s for those inland areas in the peninsula. 72 in san francisco today reaching 66. into the next few days, we'll see temperatures heating up once again. i'll detail that in less than 10 minutes. mike has a couple of notes for drivers heading toward the san mateo bridge.

>> from east bay we have more traffic flowing. peninsula we have an issue as well. here is that commute direction from the east bay westbound. over to the peninsula side, northbound 101, that's where i'm concerned with reports of a crash there sounds like a fender bender. this is a critical time for that area. no slowing just yet for 101 there. talk about the south bay and silicon valley. 85 off 87. we also have reports of sheet metal across multiple lanes. northbound side shows typical slowing. that is your commute off 87. watching south 101 for debris again. the north bay no problem. little build. nice sunshine. easy drive to the golden gate bridge.

trump reading, is hillary really protecting women? in 2008 trump himself down played the sexual assault allegations saying, "look at the trouble bill clinton got into with something that was totally unimportant, and they tried to impeach him which was nonsense." secretary clinton last night said trump is accusing her of playing the women card and added, if fighting for equal play, family leave and affordable childcare playing the women card, deal me in. bernie sanders last night at a rally called out clinton for backing out of a california debate he says both campaigns agreed to months ago. clinton's campaign says her time is better spent with california voters and focused on the general election. hillary clinton is set to arrive for an event tomorrow night. her husband bill clinton set to be here in san francisco for a fund raisers before heading down to fremont for a lunch

movies and pixar movies. >> "spotlight" amazing movie. >> better check it out. people wear fitbit on their wrist. facing heat after getting hit with a class action lawsuit. a popular heart rate tracker from the san francisco-based company are highly inaccurate. the suit is backed by research from cal polypomona which showed they miscalculated heart rates during intense workouts. they called the study biased and baseless saying it lacks scientific rigor. a misery after a web posting tied to mark zuckerberg. it appeared yesterday for zuckerberg's plans for the area surrounding his house. the past few years he purchased four neighboring properties for $30 million. on hamilton and edgewood drive. they want to tear down the

there. mid 50s as you head out the door. oakland going hour by hour will be at 59 at 8:00. a lot of clouds throughout the morning. we will get more sun as we go through the day. temperatures climb to the upper 60s and low 70s. 74 today in los gatos and palo alto. ocean beach 62. 71 in napa. dublin, a high ofç 70. as you look at the seven-day forecast, you see our temperatures will be warming up as we go into this holiday weekend. it will be cool at 52 first pitch. 59, cool and breezy weather with mostly cloudy skies. looking at the next five days, it will be slightly cooler than average for today as well as tomorrow. then on thursday, we hitting the nail on the head and warming up into the weekend with 80s expected on saturday.

a couple of pop-up showers and storms. expect more on the same today and then another area of low pressure drops. that could bring in snow showers as well as showers and thunderstorms for the sierra. a look at that weekend forecast. it will warm up. in the low 60s for san francisco. upper 60s by saturday. 80s for the north bay as well as tri-valley and south bay. peninsula and east bay will be in the 70s. looking very nice there. let's head over to mike. silicon valley build is on. >> holding steady 580 through livermore. that's where the most appreciable difference is.
