slowing as you approach the crash. bottom of your screen we have two reports of a car fire. i think it's the same incident where someone was confused as to where they were. you may have one lane blocked. smoke coming from the vehicle. i don't see slowing countercommute or northbound for the commute. >> an update to breaking news. hundreds of pages of court documents released, 500 in all. we obtained a case file revealing troubling new details about brock turner's past and what the judge knew. he is the former stanford swimmer whose controversial sentencing after sexually assaulting a woman is causing outrage coast to coast. >> look at that stack. a lot of information there, including contradictions about what brock turner says.

he said he wanted to hook up with girls at this party. these documents show a different story what happened then and before. they show turner engaged in that drug use. turner wrote, coming from a small town in ohio, i never really experienced celebrating or partying that involved alcohol. he says he was influenced by the party culture of the stanford swim team. evidence tells a different story. the documents refer to video of him using a bong. some other points we found in the document, turner said he only wanted to hook up with girls, not rape anyone. he initially tried to forcibly kiss his victim that night, but

she pushed him away. that's when he followed her outside. on the house floor, peninsula congresswoman jackie speier showed outrage to this ordeal. >> rape is one of the most violent crimes a person can commit, not as mr. turner's father said, "20 minutes of action." >> when questioned, turner initially told investigators he never took off his pants when he was with the victim. this morning the calls for judge aaron persky to resign are growing. today the group ultraviolet will deliver to the california commission on judicial performance a petition with 1 million signatures demanding the judge be removed from the bench. i just got the probation report. in that probation report, she says she questioned or interviewed the victim in this case and she told the probation officer that instead of

incarceration for brock turner, she preferred treatment. we are getting to that right now. i'm trying to dig deeper. it said turner showed immense remorse and depression. we'll get to the meat of it. >> you mentioned the item about the judge and recall, those signatures are symbolic because the judge can only be removed by a recall vote of the santa clara county voters, but this is affecting his job in his courtroom, right? there were a couple of jurors who refused to be seated on jury? >> some jurors flatly refused because of this case in particular. >> people are speaking out not just here in the bay area or in just this country but all over the world. thank you very much. at 6:05, a major shake-up for the oakland police department. chief sean whent will resign

today after 19 years with the opd. >> bob redell is live in oakland this morning. this move comes amid sexual assault allegations against the department and how they were handled. >> correct. chief whent, a 19-year veteran of the oakland police department steps down after just two years as the top cop. chief whent has yet to say why he chose to resign. he does so after recent allegation of sexual misconduct involving some of his officers and an underage woman. a federal judge was so displeased with how internal affairs was handling the investigation, he appointed an independent monitor to take over. mayor libbey schaaf is grateful to chief sean whent for his dedication and service and said his decision to resign is a personal choice she respects. at a 9:00 a.m. news conference the mayor it expected to address chief whent's resignation and

introduce interim chief ben farrell on loan from b.a.r.t. all three major police departments have seen their chiefs leave in 2016. you had opd, started earlier with san jose police department. he is now the chief of police in tracy and last month gregg suhr was forced to resign as police chief of san francisco. shaking in southern california. update to breaking news. plenty of rattled nerves in southern california for a moderate 5.2 earthquake struck overnight. this happened 20 miles south of rancho mirage. shortly after 1:00 in the morning. that shaking could be felt from san diego to los angeles. there are no reports of any

damage or injuries, but several aftershocks struck the area. we are watching this story closely and will bring you updates as soon as we get them. the hunt is on for two men who pointed a gun at a teenage boy then stole his puppy. it happened near dayton elementary school monday night. the 14-year-old was out for a walk on dayton avenue around 8:30 when two men pulled up in a car right next to him. the passenger got out and tried to snatch the teenager's 3-month-old german shepard from him. the boy would not let go of his dog maya. the driver got out and threatened him with a gun. >> the kid fearing for his life did the right thing to do. he had to give up his dog. the two men made it away in a small car. >> the men were in a light colored car. investigators are asking for witnesses to come forward. a high school wrestling coach accused of molesting a 14-year-old girl. 34-year-old was arrested on

charges of committing a lewd act with a teen. this happened last month. he is a coach at independent high school and part of the school's wrestling club. the victim is a member of that club. this morning, final preparations are under way in kentucky for the funeral of muhammed ali. it will happen later today at a basketball arena in louisville. thousands are expected to attend and tickets for today's funeral were all gone within an hour yesterday. a muslim ceremony was held yesterday. bill clinton, billy crystal, bryant gumbel all expected to deliver eulogies today. muhammed ali died a week ago today. he was 74. warriors are looking to bounce back from this embarrassing blowout in game three of the nba finals. game four tonight in cleveland. there is a watch party in oakland. that sold out. fans can gather across the bay

>> damian, you've been looking through 500 pages that doesn't make the judge look good. >> adds fuel to the fire. we found a lot of information, 471 pages worth of evidence and exhibits here. nbc bay area news reported about brock turner's drug use in the past. we are seeing the pictures. some of those pictures are troubling. they appear to show turner engaged in that drug use and in a letter to the judge, turner wrote, coming from a small town in ohio, i had never really experienced celebrating or partying that involved alcohol and said he was influenced by the party culture of the stanford swim team. evidence in his own cell phone tell a different story. he had several text messages from high school referring to drinking, smoking weed and dropping acid. the documents referred to a video of him using a bong. the documents show turner had

really remorseful he put the victim through this ordeal because of his own actions. he tells the probation officer she prefers treatment to incarceration. >> one thing we keep hearing from everyone involved in this case, especially through the letters, brock turner did not seem remorseful, certainly not during the trial. that's the conclusion of the probation officer. >> whatever the probation officer wrote is contradicted by the d.a. they say this is a serious crime which should include six years in prison. >> these were three unanimous votes by the jury on sexual assault charges. the parameters for sentencing are up to 10 years in prison, talking three years, three months in jail with good behavior could be out by september 2nd.

>> this is not over. >> thank you. >> the oakland chief of police resigned effective immediately. this comes in a sexual misconduct case and how the department investigated it. this morning oakland mayor libbey schaaf is expected to introduce whent's interim replacement. we'll have a live record at 6:57. oakland police officers saved two girls from what could have been live sex trafficking. officers found a teenage girl in a home in oakland, 65th street off san pablo avenue. that young teenager told police she had been kidnapped.

police took that girl to safety and we have now learned that investigation led to the rescue of two more girls from that same home. police have two suspects in custody, a man and woman both in their 20s. a palo alto man facing charges over parking. the 52-year-old was arrested late last month. he parked in two spots and when a man asked him to move he allegedly went off. the victim who is indian said he started yelling racial slurs, throwing punches and broke his phone. police say he rammed his car into that man's vehicle then drove off. two witnesses saw the thing happen and called police. a series of burglaries in palo alto have police concerned there. two gas stations, a dry cleaner

and ice cream shop for hit. in each case the suspect breaks into the business, steals cash from the register then takes off. detectives are trying to figure out whether this suspect is linked to other burglaries in nearby peninsula cities. this next story might be hard to believe but rents are coming down in the bay area. building of apartment buildings should push rents down. rent fell 7% in san francisco last month. the average dropping from $4,200 to just under $4,000 a month. in oakland, rents are down about 5%. the study was done by apartment rental site abado.com. it is official b.a.r.t. will ask you for billions of dollars in the november general election. the b.a.r.t. board of directors just approved a $3.5 billion

airstrikes against the taliban in afghanistan. it u.s. military now has the authority to carry out air strikes against the taliban in afghanistan. it comes after many months of debate on this topic. the decision was made as violence continues to escalate in afghanistan. u.s. commanders can now strike the taliban and better support

and assist afghan forces when needed. more than 9,000 u.s. troops remain in that country. they are still not involved in direct combat. a developing story now. more people are being told to leave their homes in arizona as a wildfire there continues to grow. the fire is burning in yarnell about 90 miles north of phoenix. it started on wednesday and more than 300 homes are under evacuation orders. about 5,000 acres are burned so far. there is very little containment. so far there are no reports of any homes or structures being damaged. the fire though is burning in the same area where 19 firefighters were killed during a wildfire three years ago. gun rights advocates are voicing more than simple displeasure over a decision that's upholding restrictions on carrying a concealed gun in california. federal appeals court justices ruled 7-4 sheriffs can require people to provide compelling reasons or good cause before being allowed to carry a

concealed firearm. nra said the ruling will leave people "defenseless." a lawyer for the plaintiff believes the decision contradicts second amendment rights. >> looking at all the evidence, having more guns in public places makes us less safe, not more. >> supporters disagree saying the ruling will help better protect the public. it's possible the case will end up in the u.s. supreme court. brain scanning technique can help doctors predict how concussion patients will recover. they detect damage to the nerve fibers on 39 people with a mild brain injury. those who showed abnormally high movement of water molecules throughout the area had better cognitive function a year later than patients with no movement. experts say identifying higher risk patients can ensure they get the appropriate treatment. very important one in
