temperatures down. it will be hot but at least a nice cool start to this tuesday morning. it's 55 in the east bay, 56 degrees in san francisco. the rest of the day, it would be in the mid-90s in the south bay as well as the tri valley. low 80s for the peninsula. we'll talk about the holt weather that continues through the week, coming up in a few minutes. mike is tracking overnight work zones. they're picking up. that's right, kari, they're picking up the cones. over here in fremont, they just left the screen here, the flashing lights. that's typical for the commute area, as we look at your map just before 5:00. we see no real slowing around this area. in fact we have no major crashes. i do want to zoom in and focus on coming up later on this morning, starting at 9:45 leaving los gatos, there will be a motorcade traveling north coming off santa cruz avenue in los gatos, traveling north, basically parallel to highway
5:01 am
17, coming up toward 280, north of 280, stevens creek east to san carlos avenue, and over to s.a.p. center, because of the procession ending up at s.a.p. center. there will be a lot of crowds gathering here. folks, if you're heading to the memorial, we urge you to take mass transit because of all of the traffic expected. throughout the course of the morning bob redell is at the s.a.p. details, he'll have more details momentarily. meantime, new this morning, one man is under arrest after a security scare in brussels. a busy shopping area went under lockdown. authorities say a man's belt only contained salt. the shopping area remains under tight security. for the second time in a week, an investigator with the alameda county da has been placed on leave.
5:02 am
in this case, according to a source in the department, the issue centers around racist texts. an insider tells nbc bay area the man is accused of receiving the texts and not reporting them. acting assistant chief david downing is now the new leader of the oakland police department. the city has gone through three chiefs in the last two weeks. >> we've been working hard to rebuild the bond between the community and the police. seeing this level of dysfunction undermines that. >> another da's office investigators was placed on leave last week in connection with the sexual assault case. a new way to put pressure on a judge under the microscope. starting today, bay area drivers will see a visible reminder of the efforts to recall judge aaron persky, the judge who presided over the sexual assault
5:03 am
case concerning the former stanford swimmer brock turner. a digital billboard is going up on highway 92 in hayward. a stanford law professor leading efforts to recall the judge says the billboard reflects the community's anger. >> we don't believe in special sentences for privileged stanford athletes. we think that whoever you are, whether you're at stanford or whether you're an elite athlete, you should be subject to the same law as everyone else. >> ultraviolet is the advocacy group paying for the sign. it says 1.2 million people at this point have signed the group's petition to remove persky from the bench. but legal experts stress the judge's sentence was well within legal guidelines. the anger following brock turner's sentencing is not going away anytime soon. there's more backlash after someone created a brock turner family support facebook page. >> it already has more than 6,000 likes. the page's administrators claim to be turner's parents, saying their son is the real victim.
5:04 am
but turner's attorney tells us the family is not involved in any way. the mother of one of the victims of the berkeley balcony collapse will attend a hearing in sacramento today. state lawmakers are considering a new bill in light of the tragedy. ashley is one of six people who died last year when the balcony they were standing on gave way. today a senate policy committee will consider a bill that calls for increasing oversight on contractors. jackie donahoe is attending the hearing but it's not clear if she will testify. developing us in right now out of southern california. this morning, baking and burning. right now there are not one but two fires burning out of control in the san gabriel mountain. combined, the flames have scorched seven square miles. now there are concerns those fires could merge into one massive fire, making matters much worse. annette arreola from our sister
5:05 am
station in los angeles, knbc, joins us live from there. what can you tell us? >> reporter: sam, good morning. hello, everybody. let me step out of the way so folks up north can see what's going on in the southland. we know that firefighters have been working nonstop throughout the night, battling these flames that continue to burn here along the foothills above several communities in the city of duarte. firefighters are delivering a one-two punch on the ground and by air. we've seen several choppers making water drops along with fire retardant drops, hoping to halt the blaze before it reaches any structures. these fast moving fires have been burning through thousands and thousands of acres of dry vegetation. the reservoir fire broke out yesterday around 11:00 in the morning off of highway 39, just north of azusa. a fatal car crash sparking the fire. 90 minutes later, a second blaze
5:06 am
broke out near the duarte and asouza border, this being called the fish fire. one of the biggest concerns firefighters have, as you mentioned, is that these two fires may merge. that would of course cause them to have to pour in extra resources. we know the fish fire has burned 3,000 acres. the reservoir fire scorching 1500 acres right now. both fires zero percent contained. we'll be out here keeping an eye on the situation, on any new developments. of course we'll keep you posted. live this morning from duarty, california, annette arreola. back to you. meantime, here in the bay area, another warm one as well. take the bus or bike to work today if you can. all the hot weather is creating unhealthy smog levels. maybe you don't want to bike, then. live pictures from our san bernardino camera. everyone is asked to help cut down on some of the harmful

5:08 am
work. i'm not saying they were late, they just don't open them typically until now. the map shows no problems on the approach on the maze. top of your screen, benicia bridge has a fender bender. i'll get more details, that just showed up on our map. inbound, westbound 5, to the right, you see slowing out of the altamonte. nothing unusual here. on a spare the air day like today, in the south bay, no problems. no problems to mass transit, caltrain is a go. >> hello, b.a.r.t.! >> mike showing some love there. what do you know, gridlock over gun issues, four measures at the nation's capitol. the finger pointing after four key measures fail until the

this place. >> the way to defeat tragedies at home is by defeating terrorism overseas. >> reporter: will this become an issue in the presidential campaign? gun control advocates are disappointed by hopeful. >> the tide is turning. these people are on the wrong side of history. >> reporter: after the failed votes, hillary clinton tweeted "enough," with the names of orlando's victims. >> what i am going to tell 49 grieving families? >> reporter: no word from donald trump. he's now saying security guards, not patrons, should have had guns at orlando. another killing spree that sparked a lot of debate in washington but no action. reaction from the nra, the national rifle association, says what happened on the senate floor, they call it embarrassing, all about politics, they say. by the way, this was the first time this year that we saw all 100 senators back here in washington voting. >> they came, they just didn't
5:14 am
actually pass anything. tracie potts live from d.c., thank you very much. the political world right now is still reeling this morning from a major shake-up within the donald trump campaign. two high level staffers are out. campaign manager cory lewandowski was fired yesterday. michael cacaputo, a senior trum adviser, resigned after posting a tweet celebrating lewandowski's firing. there are reports trump's children wanted lewandowski replaced. trump's poll numbers are slipping. hillary clinton will make the case today that donald trump is unfit to manage the u.s. economy. she will give a speech in ohio. aides say she will detail why she says trump's economic ideas will likely, quote, drive us off a cliff. clinton says his proposals will lead to lost jobs and lost savings. she is expected to go after the

5:16 am
we'll have more on that in a second. but finishing up politics, trump says he will replace yellen as head of the fed because she's not a republican. he'll also call for an audit of the federal reserve. let's get to landon dowdy and wall street's reaction. good morning. >> reporter: scott, good morning. wall street could add to monday's rise in futures. investors are reacting to the "stay" camp gaining momentum in the uk. a "leave" vote could spark a global selloff on uncertainty over the economic impact. like you said, fed chair janet yellen will be speaking today at congress. scott, back over to you. >> landon, thank you. sam and laurie, you know malcolm gladwell, author of "the
5:17 am
tipping point." he's launched a podcast, ten episodes released, one every week. it's topping the podcast chart. the first episode explains why hillary clinton will probably be the first president, but electing a female president does not necessarily mean we will have more female presidents in the near future. >> have you started listening? >> i did, just one episode so far. it's very interesting. >> i think malcolm is awesome. he uses data and trends to unearth things people may not have guessed. why does he think hillary clinton will not lead to more female presidents? >> the psychology of allowing yourself to vote for a woman allows you to the no vote for a woman in the future. he uses australia, which had a
5:18 am
female prime minister, as an example of why people who don't really want a woman president, they say, okay, one. >> they check the box. >> even if there's a great candidate in the future. >> it's awful, but it's human psychology. >> thank you. do you need a new home? how about this one? this is a long island, new york home. it just went on the market. it is the a.mityville horror house, based on a true murder story. in 1974, a man killed his parents, two brothers, and two sisters in that home. then another family moved in, only to move out in a month, claiming weird things would happen there. interested? what do you think, sam? price tag, $850,000. >> that's probably why i'm not interested. i saw "the conjuring 2" this
5:19 am
weekend. have you seen it? >> i've seen the first one. >> did the first one talk about the amityville house? >> i don't think so. >> the second one starts right off there, you see this demon that's basically possessing the basement of this house. it pops up and scares the life out of you. i was jumping out of my seat. so no, i appreciate the offer. >> the price needs to be a lot lower. like $2. >> also i'm thinking, already if you sit in front of me in the movies, if you're jumping out of your seat, i'm not seeing anything. >> i won't sit in front of you at horror movies. you can't put a price on a good night's sleep or on a nice cool day. >> you might want to be heading to the movies today to find a place to cool off, as we continue with high heat across the bay area. a live look outside over san jose. as the sun rises, clear skies. the days are getting longer. yesterday was the longest day of
