through those doors and testify about his decision not to charge hillary clinton criminally in connection with her e-mail practices. we'll have more on that in a moment. >> be watching that very closely. first our top story, deadly police shootings sparking outrage and protest. the latest last night in minnesota. the aftermath captured in graphic video and streamed live on facebook by the man's girlfriend. melissa colorado from our nbc affiliate in minneapolis has the latest for us this morning. melissa, good morning. >> reporter: good morning. what started out as a routine traffic stop ended up in a deadly encounter wednesday night. family members are now identifying the victim at 32-year-old philando castile. we want to warn our viewers, the video you're about to watch may be disturbing. police are investigating the shooting death of a minnesota man after shocking cell phone video going viral overnight. the video not verified by nbc news appears to show the moments

following the shooting as it was streaming live on facebook. >> stay with me. we got pulled over for a busted taillight in the back. >> reporter: a blood soaked man identified by family members as 32-year-old philando castile is seen slumped next to his girlfriend and moaning in pain, suffering from an apparent gunshot wound. the man's girlfriend describing how it all unfolded. >> he's licensed. he's licensed to carry. he was trying to get out his i.d. and his wallet out of his pocket and he let the officer know that he was -- he had a firearm and he was reaching for his wallet. >> reporter: a uniformed police officer is seen holding a pistol outside of the car yelling that castile should have kept his hands visible. >> i told him not to reach for it! i told him to get his hand off of it. >> you told him to get his i.d., sir. you told him to get his driver's license. please don't tell me he's dead. please don't tell my boyfriend just went like that. >> keep your hands where they

are. >> yes, i will, sir. i'll keep my hands where they are. please, officer, don't tell me that you just did this to him. you shot four bullets into him, sir. he was just getting his license and registration, sir. >> get the female passenger out. >> ma'am exit the car with your hands up. let me see your hands. exit now. keep them up. keep them up. >> reporter: authorities say st. anthony police were conducting a traffic stop for an alleged broken taillight when the officer fired at least once at the man driving the vehicle. >> the initial traffic stop was initiated by a primary officer and then a backup officer responded. i do not know anything about the facebook video at this time. that was live streaming. i haven't seen the video. >> reporter: overnight a crowd of about 50 to 60 people gathered outside of the governor's mansion in st. paul chanting in protest. >> this is completely unacceptable. somebody say enough is enough. >> reporter: there's now about five to six dozen protesters

standing outside of the governor's mansion. i spoke to st. paul police chief, he said the city will accommodate these protesters and will shut down this road right in front of the governor's mansion. as for governor mark dayton, we're told he is still inside the residence. guys, back to you. >> melissa colorado, thank you. new protests in baton rouge, louisiana, overnight over a deadly police shooting there. new video of that incident coming out as the justice department launches its own investigation. nbc's gabe gutierrez is in baton rouge for us. gabe, good morning. >> reporter: good morning. less than 36 hours after the incident the department of justice became involved and is now leading the investigation. state authorities as well will be looking at surveillance video from this convenience store plus body cameras, that police say became dislodged during the incident. this morning after the death of alton sterling, the outrage is mounting but the protests are peaceful. >> some people say we couldn't come out here without burning up our own building, without

flipping over cars. but this is not ferguson. >> reporter: baton rouge police say early tuesday a 911 caller said someone matching sterling's description threatened him with a gun outside a convenience store. it's not clear exactly what happened before the cell phone started recording but police say when two officers arrived, they confronted sterling. the officers tackling and wrestling him to the ground. seconds later -- >> shots fired. shots fired. >> horrifying. >> reporter: abdul muflahi said he shot his own video and owns the store. he said that sterling recently started carrying a gun for protection and had been selling cds outside his store for years. >> reporter: at any point did you see mr. sterling reach for that gun or threaten the officers with that gun? >> no. no. they were on top of him. >> reporter: his video appears to show an officer pull an object from sterling's pocket although police have not said what that object is. >> there's a lot that we do not understand. like you, i am demanding answers.

>> reporter: so is the aunt who helped raise him. >> they sat down and watched my child die. >> reporter: sterling's 15-year-old son grief stricken. >> i for one will not rest and will not allow y'all to sweep him in the dirt. >> reporter: sterling's name has has now become the latest hashtag in the national heated debate over excessive force. to his family, he was much more than that. the two officers involved have been placed on paid administrative leave. as is standard practice in these type of cases. they were three and four-year veterans of the force. willy and savannah? >> gabe gutierrez in baton rouge this morning. thanks, gabe. also this morning the fbi director james comey testimony is just getting under way. that's a live picture. we'll hear from the chairman of the house committee holding that hearing in just a moment. but first nbc's hali jackson life on the hill for us this morning.

good morning to you. >> reporter: hi, savannah, good morning on this very busy day from washington. and just moments ago, we heard representatives chaffetz ask director comey in his opening statements what he considers a double standard. comey in the hot seat after explaining his reasoning not to prosecute hillary clinton because of that e-mail controversy, a decision backed up by attorney general loretta lynch. the justice department's investigation of the e-mail is now over, but for republicans it's not going anywhere. many of them, including donald trump, sensing political opportunity and ready to pounce. >> crooked hillary. crooked. so crooked. >> reporter: donald trump trying to stay on message in ohio and focus on hillary clinton's e-mail controversy -- >> lie! dirty, rotten, liar. >> reporter: the gop aiming fire at her and at fbi director james comey, who will testify today in a congressional hearing called

that'sly. >> the fbi director pointed out that hillary clinton broke the law. >> we have seen nothing but stonewalling and dishonesty from secretary clinton on this issue. >> reporter: house speaker paul ryan now arguing clinton should not get the classified breachings all presidential nominees receive. his democratic counterpart -- >> the secretary said she made a mistake. wouldn't do it again. he said there's not enough here to prosecute anything. i think that's that. >> reporter: political pushback as donald trump pushes back against new controversy of his own. his now deleted tweet showing what appears to be a jewish star of david on top of hundred dollar bills, an image some found anti-semitic. >> oh, there's money behind it. they're profiling. they're profiling, not us. why would they bring it up? >> reporter: trump tweeting overnight a similar image of a star on a "frozen" children's book as the candidate himself heats up, ranting in rare form about the press --

he did not bring up, nor was he asked about that tweet controversy we've been talking about. back to you. >> hallie jackson on the hill. thank you so much. the hearing is being held by the house committee on oversight and government reform. little earlier we spoke to its chairman republican congressman jason chaffetz. take a listen. >> before we get to the ins and outs of director comey's discuss his findings. >> we want to get into that in a moment. let me be clear because there are allegations particularly by donald trump that this is a rigged system, that hillary clinton got preferential treatment by the federal government. do you suspect that? do you agree with that?

>> that's legitimate question for the fbi director. if you listen to the fact pattern laid out by the director, i'm mystified, there seems to be a double standard. if the average joe had gone through that, they probably have handcuffs on them and probably be in jail. but if your name is clinton, if you happen to be part of the powerful and elite, there seems to be a different set of standards. certainly the department of justice is prosecuted people for far less and here hillary clinton they're just letting her go. >> mr. chairman, you said the fbi's recommendation quoting surprising and confusing. based on the facts that you heard from director comey the other day, do you believe hillary clinton committed a criminal act? >> i do believe that there's statutes on the book, there are laws on the book that were clearly broken. you cannot put classified information in a non-secure formatd. she did it for years. it put people in jeopardy. it may have been hacked. she lied and misled the american people. and the ultimate jury in this is going to be the american people. they get to make this decision.

do they want somebody so untrustworthy to be the chief executive. >> from where you're sitting, did she commit a criminal act? >> i do believe that she broke the law. and that's what we want to ask. >> let me ask you because there will be a lot of people who look at this and they'll see politics on both sides frankly and they may say, look, these are house republicans want to drag this out because they think it's politically beneficial. let me ask it this way -- if she had been indicted, would you be calling director comey before your committee to ask him his rational and his basis for that decision? >> oh, absolutely. i mean, i spoke with the fbi director. he is coming up here less than 48 hours after he made his announcement. we need to understand it. the american people should be able to see everything that the fbi sees, now that it's closed, now that the department of justice is not going to prosecute, then show the american people all the information. and if they had moved to indict her, i would have the same hearing, absolutely.

>> mr. chairman, you just heard hallie jackson recommend that hillary clinton is a democratic nominee does get briefings, should be denied access to that cia information she's been getting. do you agree with speaker ryan on that? >> i do. the fbi director conclusively saying that she's extremely careless with this. classified information is classified for a reason. it put's people's lives in dang fer you mistreat it and she has done this over a pattern of years. this is not an innocent mistake. she knows better and she misled the american people. she lied under oath to congress. you can't do that without any consequences. but in this case, she seems to just skate above it. >> just asking a tactical question, in some ways is having a hearing like this pushing it? if you listen to what director comey said, he did her no favors in that press conference. as you mentioned several times, he called her extremely careless with classified information and essentially dismantled every excuse she's offered as to why she needed a private e-mail

server. now you're having him before the committee to explain in detail why she didn't merit the criminal charge. >> well, exactly. look, the american people deserve to see this information. congress needs to see this information. because the precedent has been set, if you're not going to prosecute this case, what case are you going to prosecute? and what is the message you send to the millions of people that do have security clearances, go ahead and be lax. go ahead and let that information out and there's going to be no consequence. i think that's totally unacceptable. >> our conversation a bit earlier this morning with congressman jason chaffetz. >> there's fresh signs that bernie sanders, hillary clinton's challenger in the democratic primaries may be getting closer to endorsing his former rival. nbc's kristen welker has more on that angle. >> good morning to you. hillary clinton has been working to turn the page on her e-mail controversy, taking aim at donald trump in atlantic city and now her campaign is touting new signs of party unity. trying to move on from her on

going e-mail controversy, hillary clinton may be getting a boost from her former rival, bernie sanders telling msnbc's chris hayes -- >> we are now working with the clinton campaign. >> you're not denying the report that there are talks about a possible endorsement? >> that's correct. >> reporter: campaign sources tell nbc news sanders could endorse clinton as early as next tuesday if they remove sticking points. >> he calls himself the king of death -- and he earned that title right here in ac. >> reporter: wednesday clinton tried to turn the bright lights of atlantic city on to donald trump's business record, pointing to the now shuttered casinos dotting the boardwalk that once held trump's name. >> what he did here in atlantic city is exactly what he will do if he wins in november. it is the same scam over and over again. >> reporter: trump argued bankruptcy proceedings are common and can save jobs, firing back on fox news. >> as far as atlantaics city, for years and years i had

success. i created thousands and thousands of jobs. i left atlantic city seven years ago. i haven't been back for years. i haven't seen it. most of the hotels -- many of the hotels are bruptd. >> reporter: in 1984, trump sounded like the hotel casino and plaza could not fail. >> without question the largest and the finest gambling casino, hotel complex anywhere in the world. >> reporter: but atlantic city and the plaza hit bumps in the road. it closed in 2014, making the casino clinton's key prop. >> when this casino collapsed because of how badly he managed it, hundreds of people lost their jobs. he walked away with millions. >> reporter: dismissing the criticism, trump accused his rival of trying to change the subject away from her e-mails. >> she just wants to get off the subject of all the lies that she told to the fbi and to everybody else. >> reporter: clinton is off the trail today here at her home in d.c.

she will undoubtedly be watching what happens on capitol hill very closely. her surrogates will be out in ten states railing against donald trump's business practices and touting clinton's new plan to give small businesses enhanced legal protection. >> busy week for secretary clinton. kristen welker, thank you. one of the world's most famous traditions is off and running in pamplona, spain. thousands of thrill seekers raced down a half million course alongside fighting bulls, all part of the festival. four people were injured today. thankfully, though, none of those were life threatening. this takes place every morning for the next seven days. >> i love watching that from right here. let's bring in dylan with a first look at the forecast and the heat and humidity. >> it's affecting so many people. that's the issue with this. it's not just the heat. it is the humidity also that's making it feel like it's well above 100 degrees. we have an excessive heat warning through oklahoma, elsewhere across texas and

arkansas down into louisiana. we have heat advisories, more than 40 million people are under some sort of heat advisory. philadelphia is also under an excessive heat warning in new york city under that heat advisory as temperatures continue to soar into the 90s. we are looking at a heat wave here. oklahoma city 100 degrees but it will feel like 110. shreveport will feel like 107. this will extends into the southeast and last until sunday. the northeast, temperatures will cool off a bit and lose the humidity on sunday. charleston, west virginia, still stuck in the 90s. washington, d.c. will be in the mid 80s by the time we get into sunday.

that decision from comey bringing the year-long investigation to a close. donald trump stokes speculation over his possible pick for a running mate during a campaign rally last night in cincinnati. he was joined by newt gingrich and hinted at the former house speaker's potential role in the trump administration. >> newt has been my friend for a long time. and i'm not saying anything and i'm not telling even newt anything, but i can tell you, in one form or another, newt gingrich is going to be involved with our government. that i can tell you. okay? >> trump says he plans to reveal his vp pick just prior to the republican convention. a police officer in minnesota is on administrative leave this morning after fatally shooting a man during a traffic stop. this is video of the aftermath, the moments after the shooting live streamed on facebook by the victim's girlfriend. the shooting is now under investigation. now to some bombshell allegations being made by a popular former fox news anchor

gretchen carlson claims she was let go from the network after claning about repeated sexual harassment at work. nbc seen yore legal correspondent cynthia mcfadden is following that story for us. cynthia, good to see you. >> good to see you. >> gretchen carlson filed a lawsuit against roger ailes, one of the most popular people in media but carlson claims he pressured to have a sexual relationship with him and when she refused, carlson claims that he fired her. ailes is firing back saying the lawsuit is a retaliation for the network's decision not to renew her contract. gretchen carlson says in her newly filed lawsuit it started when she complained about how she was being treated by her "fox & friends" co-host steve doocy. in 2009, carlson said she complained about doocy saying he was belittling her on air and off. attorneys for carlson allege fox

news chief roger ailes responded by calling her a man hater and telling her she needed to learn to get along with the boys. in 2013, carlson said she was removed as a co-anchor of "fox & friends" and given her own show. in the afternoons on fox. >> a big thanks to our boss here, roger ailes for believing in me. >> reporter: in the suit, carlson accused him of ogling her in his office and asking her to turn around so he could view her posterior. carlson said she confronted ailes last september claiming he told her, i think you and i should have had a sexual relationship. adding that sometimes problems are easier to solve that way. carlson says she refused to have a sexual relationship with ailes and was fired nine months later. in a statement last evening, ailes said carlson's allegations were "offensive and defamatory

and would be defended vigorously. he also denied that she had been fired. when fox news did not commence negotiations to renew her contract, ms. carlson became aware that her career with the network was likely over and conveniently began to pursue a lawsuit. carlson hasn't always been critical of ailes writing in her book roger was razor sharp and inscrutable and we seemed to have a real connection. we should make clear that carlson's lawsuit is only against roger ailes and not fox news itself. according to lawyers representing carlson, several female former fox employees have contacted them since carlson went public yesterday with her lawsuit saying they want to discuss how women are treated at the network. the parent company of fox news 21st century fox says it stands by ailes but also has begun an internal review of the allegations. >> distinct feeling we have not

heard the end of this yet. cynthia, thank you. >> i think you're right. new questions over the death of a navy s.e.a.l. trainee in california now that the medical examiner's report has been released. nbc's joe fryer has been following this story. good morning. >> reporter: good morning. the sailor drown in may during a training exercise at the naval base here in coronado. the coroner's report says some may view this as an accident, the medical examiner is calling it a homicide. it was his first week in the grueling six-month navy s.e.a.l. training program. loveless died. at age 21. according to the medical record loveless and other trainees were swimming in fatigue and boots. medical examiner shows loveless appeared to be struggling before an instructor is seen to dunk loveless under the water and follow him around the pool for approximately five minutes on video. he continually splashes loveless and dunks him at least one additional time. eventually loveless was pulled

from the water still breathing but an hour later he was dead. the medical examiner writes it's our opinion that action and inactions of the instructors and other individuals involved were excessive and directly contributed to his death and the manner of death is best classified as homicide. >> water training is always going to be dangerous and for some it is a defining moment. and instructors don't know where different students stand. >> reporter: navy s.e.a.l. training is so demanding 80% don't make the cut. that includes kevin. >> i'm a good swimmer. i was a swimmer in high school. there was one incidence when i thought i would drown when i was in the pool. >> reporter: as for loveless's death, the navy criminal investigative service is still looking into it and says it's important to understand that homicide refers to death at the hands of another and a homicide is not inherently a crime. the instructor was removed from duty after nbc news and a

virginia pilot newspaper started asking questions about the death in may. he's on administrative duty. no charges have been filed. as for the young man that died, the medical examiner says he did have an enlarged heart and that is a possible contributing factor to his death. back to you. >> a lot of questions. joe fryer, thank you. let's turn and get a check of the weather from dylan. i believe the correct term is gross outside. is that what you use in your business? >> everything about it is gross. we also had severe weather that we're watching today and yesterday, too. we had reports more than 300 wind damage reports and look at that tree down on that car. we had wind gusts up near 60 miles per hour obviously knocking down trees and power lines falling on to these signs here. we saw home damage as well. it's kind of the similar setup that we'll see today through parts of the midwest. in the meantime, it's been all about the heavy rain. parts of north central tennessee have seen 3 to 7 inches of rain so far this morning and that heavy rain is still training over those same areas so flash

>> exactly. go to your local nursery. they are great resource. farmer's market. they'll really, really help you. >> what are we looking at here? is this perennials versus annuals conversation? >> a lot of these are perennials. plants that come back every year for us. annuals you replant every new season. they don't stay around in the garden. i like a combination of both. really great. again, plant what you love. >> how do you take care of these in the winter by the way? >> every plant has different needs in the winter depending on where you live. for example, this hydrangea if you have it in a pot, if you have it in the ground, the same kind of care for winter. before the first freeze. a lot of people have hydrangeas and love them. if you live in a place where it gets colder than 15 degrees, you want to bring the hydrangea if it's in a pot in the house.
