accusations a political ploy. in a statement he says, quote, the facts are clear. this is a tax on distributors who can pass on that tax by increasing the cost of any grocery item. nbc bay area news begins with breaking news. >> right now at 6:00, breaking developments out of france where we now know at least two americans including a child are among the dead. killed in this chilling attack. the driver behind the wheel of this big rig loaded with weapons and explosives plowed through a crowd in nice killing more than 80 people and injuring dozens more. >> he was just mowing people down. and so i can't even tell you how many people i saw die. >> thousands, including people from the bay area we spoke to had gathered along the water's edge to celebrate france's independence day a-day that quickly turned into one filled with horror and heartbreak.

another tragic start here on a friday morning. good morning. thank you for joining us. i'm sam brock. >> i'm kris sanchez in for laura garcia-cannon. we're going to have the latest developments out of france including new information on who the suspect might be. but we do want to get a check of weather with kari first. >> good morning. it will still be a very warm day, effort inland areas. we still catch a brauk along the coast with some fog. we see that right now as we get a view of san francisco. it's 55 degrees there as you head out the door. highs today reaching 66 with some mid 80s in the east bay. the peninsula, 79 degrees. still hitting the 90s in the south bay. as well as the tri-valley while the north bay today not as hot with a high of 87 degrees. coming up in a fuel minutes we'll talk more about what to expect this weekend. heading over to mike now with a view of what's happening as you head out the door this morning. >> we still have a slow, unexpectedly slow drive this friday. berkeley curve. we have this backup now. things are holding steady at the curve. i just saw a tow truck heading over towards treasure island

from the toll plaza itself. from the berkeley curve to the bay bridge toll plaza, metering lights, and clear up to the crash scene where we have two vehicles that have been to be clear. i saw a tow truck. at least one. two have to be cleared from lanes. the rest of your bay moves very smoothly, guys. back to you. an update now to breaking news out of france. within the last few hours we learned a father and his son from texas are among the dozens of people killed when a driver plowed through a crowd in nice yesterday. family members confirmed that sean copeland and his 11-year-old son are among the dead. in a statement from the family it said, quote, we are heartbroken and in shock over the loss. in the distance you can hear the gunfire that ultimately stopped the truck driver that plowed through hundreds of people there in nice. this is new video in to our newsroom this morning showing

the moment that police fired into the cab of that truck killing the driver. here's the latest information from the scene. we mentioned the father and son from texas but they are among 84 people confirmed dead including those two americans. dozens of other people are hurt. many of them critical. 50 of them were children. just moments ago authorities identify the suspect as a tune in additi tunesian man living in niece. sara luka said she brought her 6-year-old son to learn about the culture there. sharon katsuda talked to them this morning and they were very involved with french culture. good morning, sharon. >> reporter: hello, kris. i'm sorry. i'm having difficulty hearing you this morning on my audio. but basically, yes, you're right. we did just get off the phone with the mom of a walnut creek family who witnessed the attacks. sara luka said she brought her

6-year-old daughter and her 8-year-old son to france to learn more about the culture. their family was enrolled in a french school here in the bay area. she says the chaos broke out after the fireworks. >> start hearing the shooting and the truck drove into the people. and then everybody just start running, as did we. i grabbed my little daughter, you know, to rush as much as we can. you see all of these people just crying and screaming. >> reporter: luka said she was doing her best to protect her kids as they were running back to their hotel room trying to make it safely back to the hotel. and back here live you can see signs of support. this building right behind me showing the colors of france and showing their support for france and the victims over there. we also talked to a livermore

family, a couple who also witnessed the attacks and we'll have that story coming up in about half an hour. reporting live in san francisco, i'm sharon katsuda, "today in the bay." >> sharon, thank you. the u.s. consulate general in marseille issued a warning in nice to use caution and monitor local news for updates. france has been under emergency since the november attacks in paris there are no travel warnings in effect. president obama released this statement late last night. quote, i have directed my team to be in touch with french officials, and we have offered any assistance that they may need to investigate this attack and bring those responsible to justice. because of the terror attack or the suspected terror attack in nice, france, donald trump will not announce his running mate. he will delay the announcement in honor of the people who died there. indiana governor mike pence is waking up this morning at a

trump golf course after taking a private jet to new jersey. sources confirm that he is donald trump's choice for vice president. though donald trump says he hasn't made that final decision. our latest nbc news/wall street poll shows that hillary clinton has a healthy lead in colorado, virginia, north carolina, and in florida. meantime, hillary clinton will meet with virginia senator tim kaine in the battleground state as they did yesterday as well. experts say he is a top choice for her. but clinton's vice presidential announcement is not expected until after the republicans begin their convention next week. more details now on mike pence's background. he has served as a congressman for more than a decade. before becoming governor of indiana three years ago, socially on conservative and born again evangelical

christian. biggest controversy was last year when he signed a so-called freedom of religious law with open discrimination of the lbgt community. in the end that law travel boycotts in san francisco and the indiana legislature amended the law in the end. while we're talking about donald trump, some of his supporters are suing the city of san jose. suing mayor liccardliccardo, the chief and dozens of others after violence ee vial erupted. 14 people say they were assaulted, intimidated and threadened by proes thors. the trump supporters say san jose police failed to protect them. the mayor is responding saying, quote, the ludicrous accusation that i somehow directed the police department to stand down at that rally is utterly false. in fact, i have no authority to issue such an order. we are following breaking news here at home this morning as well. this time out of los altos hill

where's a firefighter is recovering after a battling a house fire. crews were called around 2:30 to a two alarm fire. this at vacant house that was under construction. so no residents were harmed. however, the firefighter was taken to the hospital where the firefighter is being evaluated for minor injuries. the cause of the fire is now under investigation. also breaking overnight. this in oakland. police say the four people are recovering right now after a quadruple shooting. it happened around sock last night on 7th street and peralta only a few blocks away from the b.a.r.t. station. three men and one woman were shot and all of them were transported to nearby hospitals. so far, no update on the victims' conditions. police are also saying nothing about possible suspects or even a motive. happening today in san francisco, a rally to kick huh the campaign to recall mayor ed lee. that's happening at 10:00 this morning at city hall in just four hours. legal paperwork was filed last

>> two suspects con netted to tuesday's armed robbery in windsor is now being connected to a string of crimes up and down california. sergei and ivan morales are facing charge of attempted murder and armed robbery after shooting and robbing an armored car guard earlier this week. but now they say those suspects are also connected to other crimes that includes a carjacking of a victim who was playing pokemon go in sacramento. investigators say they're happy to see these suspects off the streets. >> we feel very good about our role and what happened and the town of windsor. obviously our community did a fantastic job of writing us with information from what they saw. >> investigators say the suspects could eventually face more charges in other counties as well. it is a 6:14. controversy in mountain view this morning over proposed rent

control. >> critics of rent control point out a discourages new construction but, scott mcgrew, they don't care about that. >> this may be on the ballot in mountain view. voters are going to vote their best interests, right? nothing wrong with that. this is pure economics. rent caps are a form of price control. price control discourages new supply. new construction. why would you build housing in mountain view if there are limits to how much the owner of the building could charge? now, as you point out, sam, if you already rent in mountain view you don't care about future apartments, you care about your apartment now, right? all the construction we've seen in the city of mountain view for instance along evelyn of knew, result of higher rent. rent caps only cap rent, not house prices. if there are rent caps in mountain view, if those are voted in, logically fewer apartments will be built, more homes will be built that faye vors people who can afford expensive homes, hurts people with lower income who want apartments. silicon valley speaking out

there will be some high levels of ozone. they advise you to take some public transportation or bike or walk to work if you can. try to reduce the amount of ozone but if you have breathing problems you should most likely limit your time outdoors during the hottest hours of the day. in san francisco, we will see the high of 66 degrees. 77 in palo alto. and 88 in san jose. still some low to mid 90s in parts of the east bay. the ocean breeze does keep those temperatures cooler right along the coast. but we'll all get some relief this weekend as this cold front, this area of low pressure drops in. may even produce some scattered showers near redding by saturday into sunday. for us we're in for some cooler than average temperatures. for san francisco, so it stays once again cool and foggy along the coastline. slightly cooler than average and this weekend is looking nice with a high of 90 still in the tri-valley tomorrow. coming down to 85 with some mid 60s in san francisco. and the north bay will be up to 83 degrees on sunday. i'll have another look at the

forecast coming up. mike is watching the benefits of a lighter friday commute. >> kari, for the most part in the bay seeing just in general the benefit of the light friday commute, also seeing as we look for recovery over here. earlier crash south 880, 92 is off on the shoulder. it's a distraction. big rig involved. minor slowing there. second crash at industrial isn't causing any slowing at all. and that's also out of lanes. over here the bay bridge is now seeing good recovery after a big backup and a horrible look at the start of your commute. things are clearing up. we'll give you two live looks. we have the backup at the toll plaza. things are moving visibly much better here and you don't trust me on that let's look back over to berkeley curve where we had the backup coming off the berkeley curve and heading down out of berkeley and in towards the bay bridge. the east shore freeway moves well. berkeley curve itself moving good from our emeryville camera. the backup is moving well. unless you're carpooling and then you have a little slowing. that's a bummer. golden gate bridge, issue.

two years after the deaths of two workers at a san francisco granite company the owner of the company is now facing criminal charges. in february of 2014 two workers died at the galaxy granite company. the men were removing granite slabs from a shipping container when some of the slabs gave way. san francisco distribute attorney says the owner of the company will be arraigned today on involuntary manslaughter charges accuse of violating safety procedures by failing to assess potential hazards and conducting improper training. nbc bay area responds the working hard to solve your consumer problems. >> chris chmura is here to look at the cases with we have closed this week.

area families who witnessed firsthand this terror. good morning on this friday. i'm sam brock. >> i'm kris sanchez. much more coming out of nice this morning, in just a moment, but first, a look at our weather here at home. >> it will be a nice day across the bay area. we start out with some sunshine in spots and low clouds and fog near the coastline and also into the north bay. it's in the upper 50s and 66 degrees will be the high in san francisco. 84 degrees in the east bay. and 90 in the south bay. still some areas getting pretty warm in the north bay, expect a high of 87 degrees. not as hot as yesterday. but that will be the trend as we head into the weekend as we continue to see more on these temperatures coming down from the 90s and back into the 70s and 80s as normal for this time of year. breezy wind in san francisco feeling nice at 66 today and dropping into the low to mid 60s for the weekend. we will talk about what more to expect over the next few days. that's coming up in a few

minutes. heading over to mike now to see quite a few disturbances. >> that's right. first start with silicon valley. i was looking with our san jose camera. thought i put it in the request but i did not. my fault. just a tiny bit slower. friday night for the bay but just off of 680 we have work with a gas line repair. damian on the scene, we'll let him handle that alum rock is closed right now. meanwhile, move over here toward the approach and san mateo bridge. the bridge is fine and the overnight road work from 7:00 to 5:00 this morning. that cleared. but we'll have that road work continuing on the and tomorrow night as they're doing that repair for that big pothole. and over here southbound 880 recovers kind of holds steady at a slower drive past the scene as you approach that 92 intercha e interchange. the bay bridge, two earlier crashes at treasure island. both cleared. second one caused a big backup and metering lights are on as a

result. good improvement as you come off the berkeley curve and approaching the area. no problem for the east shore freeway and the rest of the maze moves well. as we look at the rest of your commute and we see friday light as you would expect, there's the upper east shore freeway and, again, that's the biggest slow down is hayward heading down towards the san mateo bridge but it's clear once you get on the span. back to you. now an update to breaking news out of france. within the last few hours we learned that a father and a son, you see them here, they were among the dozens of people killed when a driver plowed through a crowd in nice yesterday. they are from the austin area in texas. family members confirm sean copeland and his 11-year-old son did not survive that terror attack. in a statement from the family, it said, quote, we are heartbroken and in shock over the loss. of the truck, killing the driver in that white panel truck. here's the latest information from the scene. at least 84 people are confirmed dead. again, including those two americans. dozens more are hurt and many of them critically. just minutes ago france's president said 50 people are, quote, between life and death which means this death toll right now is extremely fluid. again, you are looking at thousands of people who are out on the promenade in nice last night celebrating bastille day. obviously a day acknowledging french independence. fireworks, celebration, quickly turning into horror. now, just moments ago authorities identified the suspect as a tunisian man living in the city. we are working to learn more. today another fallen dallas police officer will be laid to rest. the funeral for 40-year-old michael krol takes place later this morning. one of five officers ambushed

last week. he served with the dallas police department for nine years. his burial will take place at a ceremony in south field, michigan. san francisco police officers are expected to be in attendance. also being laid to rest today alton terming, the man who was shot and killed by a police officer in baton rouge last week. cellphone video of the incident sparked outrage and protests including the one in dallas last thursday that turned into a sniper event. the funeral service is scheduled for this morning at southern university of baton rouge. reports say reverend al sharpton is among the people who are expected to speak. here at home, the family of jahi mcmath will soon have the chance to court to prove that she is still alive. doctors declared mcmath brain dead after a botched tons s tonsillectomy in 2013. the family sued for negligence. as long as mcmath is considered legally dead, the limits on

awards are much lower if she's alive the hospital has to pay much more. the appeals court this week ordered the case back to trial court to better term the validity of the declaration. the hearing is scheduled for october. a live look now at the golden gate bridge this morning as we have new details about a plan to install suicide nets. despite the extra costs now associated with it officials say they are moving for ward with that plan to install the nets. original fally they were estimated to cost $76 million. but then the bidding started and the two bids submitted were way above that. the low bid came in at $142 million. the high bid was $174 million. about 100 million more than they estimated. bridge officials say that installation could be delayed but they're still moving forward with the plan. last year 33 people ended their lives by jumping off of the golden gate bridge.

we were expecting momentous announcement today, donald trump will not say who his running mate is this morning as promised. the republican presumptive nominee is delaying the announcement because of the tragedy in france. >> we think we have some inkling of who he is going to select. several news agencies are reporting that trump is going to pick indiana governor mike pence. tracie, despite all the reports, trump says he still has not made up his mind. >> yeah, he said that in an interview there's some confusion about that. our folks who work with the campaign said that when he started hearing those reports early in the day yesterday he was irritated by it. he had not talked to pence yet even though pence was flying to new jersey on a private jet overnighting at a trump golf course. theoretically in anticipation of this announcement this morning. but then trump said he had not made a final decision. and then one of his top advisers said today he thinks trump has decided who that person is going to be and that we will know before the convention starts on monday. so a bit up in the air.

meantime, new polling is showing that trump is behind in some key states, colorado, virginia, north carolina, and florida with hillary clinton holding leads beyond the margin of error in all of those states in our nbc/"wall street journal" marist poll. so we wait to see when trump is going to make this announcement, if, in fact, it's going to be indiana governor mike pence to help him pull in some of those conservatives and especially voters from swing states. back to you. >> all right, the crystal ball predictions of politics always risky business. thank you very much, tracie potts. >> admirable that he put off the announcement given the events of today. >> certainly the appropriate thing. no question. meteorologist kari hall is here with a look at a forecast that might find you ooh'ing and aw'ing this week. >> we still have a "spare the air" alert in effect effort east bay where the ozone levels will be the highest. limit your time outdoors during the hottest hours of the day as

we see our temperatures that will be reaching into the low to mid 90s. at least we're not talking about triple digits here wide spread as this -- like we had yesterday. and it will be up to 88 degrees in san jose. 72 in oakland. 85 degrees as you head up towards santa rosa while san francisco stays at a nice and cool 66 degrees. heading into the next ten minutes i'll talk about what to expect this weekend as those temperatures come down. mike calls out hayward as your toughest drive right now. >> that's right, kari. not necessarily your slowest but the toughest because it's friday. we expect an easy drive around the bay. just easing into the morning commute for the south bay. san jose. in towards silicon valley. here hayward southbound 880 continues a tougher drive and off the freeway heading toward the loop. very slow for city streets. the crash on the shoulder involving a big rig and there may be a second crash between 238 and 92. that's the only thing we're tracking at this section of the map. move up toward the baio oh sorry, slower drive alternate

happening now, going on 17 hours and stretch of a busy south bay road has been shut down since yesterday afternoon. crews were finally able to cap a gas line after about 14 hours but they're still on scene repairing the road. >> "today in the bay" damian is live at the scene. damian, people are going to be relieved the road is open but they have to be frustrated that it took so long. >> reporter: yeah, it's unknown why it took them so long to cap that gas leak. they're still here on the scene. even though they have opened one lane on the eastbound direction of alum rock avenue they also opened the off-ramp off of highway 680.

so lots of relief for drivers and commuters here on the alum rock avenue side of san jose. fire crews remained on stand by because at the scene in case there was a leak that resulted in a fire. no one was evacuated but nearby apartment complexes were ordered to shelter in place and that lasted most of the afternoon and night. the alum rock avenue exit off highway 680 was closed. the chp estimated 7:00 to 8:00 a.m. opening but early by about 25 minutes or so. pg&e tells us this morning that crews have stopped that flow of gas at about 3:15 this morning. but they will remain out here again throughout the rest of the morning to make some more repairs. the other concern overnight were the people who live near the gas leak. >> out here there is two apartment -- two senior living complexes and one apartment complex. they are effected. what we're doing is telling them to shelter in place, stay at home, close their windows, close

their doors, and stay in there. >> reporter: this is part of the area where they have sfent the last year making way for an express bus lane. they had to reroute some of those routes throughout the night because of this leak. but again, this leak was caused by pg&e crews performing routine maintenance. again, it took them about 14 hours to cap this leak. the good news, the off-ramp is open and alum rock avenue, except for one lane, is also open. live in san jose, i'm damian trujillo, "today in the bay." a follow up now. governor brown is being blamed for the delay in adding cameras along contra costa county freeways where there's been 20 shooting gains november. it's been more than 30 days since 12 county mayors asked the state for funding for new surveillance along the freeways. hercules mayor dan romero tells us the governor is yet to take any action. >> what i want to know is how many cameras is it going to take to cover the interstate eight did and highway 4?

91 in gilroy. palo alto, 77. mid 60s in the mission district. while san rafael, 84. oakland at 72. and pleasanton, a high of 97 degrees. seven-day forecast at the bottom of the screen shows temperatures won't be in the triple digits. in fact, some cooler airdrops in from the north as this cool front continues to spread, nice onshore flow. some scattered showers farther to the north but we are going to stay dry throughout the weekend. so cool and foggy along the coast. even slightly cooler than average in san francisco. we had about 66 degrees but we'll be at 64 degrees on monday. so still once again, nice and cool. and then as we get a look at all the microclimates for this weekend's forecast, the tri-valley will still be pretty warm tomorrow. up to 90 degrees. and then on sunday, dropping back to 85. we'll also see that elsewhere for the inland valleys. let's head over to mike now seeing reports of three reports of slowing for the key spots in our commute. >> three key spots, kari.

but only three. the rest of the spots are green. so we'll just point out the orange and red spots i guess on the map. we'll show you the south bay northbound 101, 87, and 85 jut starting to see the slow down. we have seen this slowing north 101 at capital expressway for 20 to 25 minutes. that is your morning commute for silicon valley. that will build a bit. right now looking at that friday night drive. southbound 880 is holding steady. slowing down from san leandro down to the crash scene still on the shoulder with activity there but no lanes are blocked at 92. folks are shifting right toward that activity because they're shifting right to make their move to the san mateo bridge. that is clear. esperion boulevard an alternate. now we're seeing slowing for the east shore freeway. we had crashes at treasure island that caused the initial backup. from the emeryville camera we see the berkeley curve itself as cleared up. the backup we saw earlier is all clear. once you get to west granite, that's where the stack-up starts
