>> i'm sam brock. just smelling it, what do you guys smell right now? >> garlic? >> not yet. >> morning. >> early morning, certainly. >> yes. >> coffee. >> yeah, it is going to be another day of hot temperatures and a very light wind. we're getting ready for temperatures to go up a degree or two in some spots. as we get a look outside right now, 62 degrees in the south bay. north bay, 51 degrees. and 63 in the tri-valley. there we will still be hitting the triple digits. 90s in the north and south bay and 85 in the peninsula with some morning clouds and fog. we will talk more about the hot weekend ahead and the gilroy garlic festival. that's coming up. heading over to mike now. we have a crash in sunnyvale. >> this is video from the scene. 237 matilda avenue on-ramp is where the crash ended up having the closure. this should reopen in a few. but the car over on its roof. there were five people in this

vehicle. one died as a result of the crash. the other four, minor injuries. look at this major crash. it only involved this one vehicle. this is the third morning in a row that we start our broad crash with a deadly crash. down in the south bay. east 237, matilda. on-ramp is closed. freeway is open. be careful out there. we are following breaking news out of san diego this morning. one officer dead. another seriously injured after gunmen opened fire. happened about 11:00 last night in the city southcrest area. police are releasing few detales about what led up to the violence but they say it happened shortly after the officers conducted a stop. we now know one suspect in that shooting is in custody but police are still on the hunt for a second suspect and a manhunt under way president the injured officer was rushed to the hospital and unz gone surgery. also hear that officer is expected to survive. we'll of course be following the

breaking news all morning and bring you the latest updates as soon as we get them. to a deadly shooting in san jose. "today in the bay's" sharon katsuda is following that story for us. san jose pd is not releasing a lot of information except that one person was killed late last night. the city's 29th homicide. what are you learning out there? >> reporter: that's right, sam. we have many investigators here still on scene. overnight they pulled in the investigative truck to look at what's going on at the scene behind us. police responded to a call late last night around 10:00 on a report of a person shot. they discovered an adult male suffering from at least one gunshot wound. he died at the scene. at this hour investigators are combing through that white mercedes on willow street. police are looking into a motive and have not released information on suspects. there have been no arrests. so a shooter or shooters are still out there. and back here live, you can see that right now the investigator,

they're using a blue transparent tarp to take a look at something near the white mercedes. we saw this development within the last 15, 20 minutes. still actively combing through the scene and collecting evidence. so the shooter, again, is still out there. again, as you said, this is the 29th homicide in san jose. there was a deadly stab that took place just a couple blocks away on sunday. reporting live in san jose, i'm sharon katsuda, "today in the bay." >> thank you, sharon. at 4:34, to democratic national convention comes to a close with a dropping of hundreds of balloons followed by a big night of celebration. a lot of smiles there. also followed historic moment in american politics. hillary clinton accepting the democratic party's nomination for presidential candidate. it's the first for a major political party. >> and so, my friends, it is with humility, determination, and boundless confidence in america's promise that i accept

follows her wherever she goes. happening today, the man accused of killing sierra lamar will be in court. trial is supposed to start on monday. today he's scheduled to appear for a pretrial hearing. the judge is expected to hear motions on some of the evidence that may or may not be presented during the trial. 15-year-old sierra lamar disappeared in 2012 while on her way to school in morgan hill. her body has never been found. it's been a week long effort to try to contain but now finally a glimmer of hope. firefighters are making some progress on that massive wildfire that's burning in monterrey county. the soberanes fire is 15% contained. also learning the fire's prompted the closure of six state parks all along the central coast. at least through august 6th. but fire has grown to 29,000 acres in total. 41 homes have been destroyed. that is the latest count. cal fire has identified the bulldozer operator who died

fighting the fire as robert reagan from fresno county. all right. we shift gears for a second. gilroy garlic festival kicks off today. annual event. festivities are starting a bit later this morning. >> more than 100,000 people expected to attend that three-day events. the champions of charity cookoff takes place. south bay first responders trying to win $3,000 for charity of choice. as usual, plenty of garlicky food, live demonstrations, and a lot of family fun throughout the weekend. >> garlicky, new adjective out there. coming up right now, a peek at the weekend forecast. kari hall is checking that out for you. >> it will be another hot day, another "spare the air" alert with the air most unhealthy in the east bay. we'll talk about the went direction, the hot temperatures, and a look ahead coming up in a few minutes. we're also looking outside toward the san mateo bridge. look at this. a smooth flow of traffic.

killing chandra levy is soon going to be released from prison. this is a crime that captivated the country 15 years ago. prosecutors say they're dropping all charges against ingmar guandique. in 2010 they convicted him of murdering levy but that verdict was later overturned. levy was from modesto work for dc as an intern and romantically linked to then congressman gary condit of modesto. prosecutors had hoped to retry guandique. yesterday's news stunned levy's mother. >> basically emotional day. that's why i've not been answering phone calls or anything from anywhere. i just -- it's kind of like puts you back to the level of grief that you originally had. >> the gary condit's attorney released a statement that said in part, quote, the failure of authorities to bring formal closure to this tragedy after 15 years is very disappointing but in no way alters the fact that mr. condit was long ago

completely exonerated by authorities. a high honor by the navy for late san francisco supervisor harvey milk. milk not only came away from the navy family, he served as an officer during the 1950s. here's a photo of him during his servi service. this morning the navy is naming a ship or milk. the vessel seen here provides the port for other ships at sea. milk was assassinated after becoming the first openly gay politician in california. giants have lost 10 of last 12 games. last night they beat the giants at at&t park. >> but some help is on the way. here come the re-enforcements. giants had a very savvy move before the trade deadline and i quired eduardo nunez from the twins in exchange for a minor league pitcher. nunez is going to help the banged up infield that's been hit hard by injuries this year. he can also play the outfield. so very versatile there. coming up next, the giants have their answer for quick

74 as we get ready for the sun to set. monterrey bay will be a nice place to cool off with some 60s along the coastline this weekend. and santa cruz will stay in the low to mid 70s. looking at the seven-day forecast, san francisco, we will have 60s there this weekend. after seeing a high today of 71 degrees. still some 80s and 90s for the inland areas. all throughout next week. as we head back over to mike, he has an update with what's happening in sunnyvale. >> that's right, kari, where we had the early morning deadly crash and had the on-ramp

closed. i say had because that crash has cleared. the on-ramp was the only thing effected. we do have the traffic flowing on 237 eastbound which was moving smoothly. no more distraction by the flashing lights. again, this is the third morning where we've had a deadly crash this time of day and be careful out there, folks. just a word of i don't want to have to report those. that's the worst part of my job. let's go to foster city and the san mateo bridge. westbound it's a commute direction. eastbound the flashing lights blocking off your slow lane. typical construction overnight heading off the high rise. the bay bridge, no problem as far as lanes blocked. even see the clouds clear the span but they are there in the distance and low visibility on the north side of the golden gate bridge. no backup at the bay bridge toll plaza. guys, back to you. new criminal charges are expected to be announced later today stemming from the water crisis in flint, michigan. back in april michigan's

attorney general filed charges against three state and city workers he said played key roles in the crisis. he also promised more criminal charges would come. those charges will be outlined during a news conference scheduled for later this morning. the water crisis in flint started two years ago when corrosive water ate through the city's pipelines causing lead to seep into the drinking water. mexican drug lord convicted of killing an american drug agent is being released from prison. ernesto kidnapped, tortured and killed the agent in 1985. now 86 years old he has nine years remaining on his 40-year sentence. he will serve the rest of his sentence under house arrest. the drug lord was a founder of the la hara cartel. pope francis met with several survivors of the auschwitz survivors in poland. one by one he shook hands and bent over to kiss each elderly

take a look at this. a pretty spectacular site on the big island of hawaii. the hat lava attracting a lot of spectators. lava is six miles and made its way to the pacific ocean. it is not considered to be
