a suspected arsonist under arrest in breaking now at 4:30, a suspected arsonist under arrest in connection to a raging wildfire that has already wiped out almost 200 homes and businesses and is stilt burning out of control. a deadly shooting in the south bay. one killed. the clues police have this morning. and in rio, hoping to turn things around. why team usa was kept off the top of the medal stands on monday. but first, to breaking news. a story we've been following since saturday. a man is now behind bars this morning facing 17 charges for allegedly setting the devastating clayton fire sand several more. the clayton fire continues to ravage communities, wiping out dozens of homes and forcing thousands of people to flee. >> governor brown has delaird a state of maernlg for lake county. 4,000 acres have burned and 200 homes and businesses are destroyed. "today in the bay's" pete suratos is live with the man accuse of sparking this fire. good morning, pete. >> reporter: good morning. we're near quarter horse lane here in lower lake. i'm going the step out of the shot and show you guys what some of these communities lk like following this fire. last night we had a big break in the case where authorities arresting a potential suspect. >> we were able to arrest him on 17 counts of arson.

>> that was the reaction of 200 homeowners last night when cal fire announced the arrest of damon for starting the fire. he was arrested on 17 counts of arson. 40-year-old clearlake man is described as authorities as is serial arsonist and cal fire explained last night why it was important to get the man off the streets. >> the suspect is in jail tonight. and that's what is important. so thank you. >> it's not much comfort when you don't know if your house is still there. >> of course there was the winds and how temperatures that played a key role in the clayton fire picking up over the weekend. now this man was booked at the lake county jail yesterday and scheduled for a court arraignment tomorrow. they did not comment on what led them to pashilk and we'll have

more on this big development in the case coming up in the next hour. live the lower lake, pete suratos for "today in the bay." as he just mentioned, wind playing a critical role yesterday in fanning the flames. let's check in right now with kari hall and what we're expecting in that lower lake area today, kari. >> we will still see winds changing direction as we go into the day. starting out this morning we have the highest humidity and coolest temperatures but in clearlake it's still 69 degrees. we're expecting the highs today to reach over 100 degrees. we start out with winds starting in from the east. coming in from the east. then we will see more of a northerly wind through the day and wind gusts could top at about 20 to 25 miles an hour. that will just fan the flames. you see with that wind direction it also carries more of that smoke into parts of the north bay. so air quality will be quite poor today. for the rest of the bay area, we will start out with some morning low clouds. temperatures in the 50s and low

60s. and highs once again very hot reaching into the low 90s in the tri-valley. san francisco up to 66 degrees. i'll have a look at the complete microclimate forecast a little bit later. thank you very much. one person has died an another is seriously injured after a shooting in east san jose. police say that two victims arrived in the same car at about 6:00 p.m. at regional medical center. investigators later determined that shooting likely happened near north white and mckee roads. one of the men who arrived at the hospital died there. the other is expected to survive. now right now police do not have any more information about a suspect or a vehicle description. at 4:34. new fears in hayward this morning after a fifth homicide in less than two weeks. the most recent killing happened sunday. that's when investigators say a man was stabbed on cottonwood avenue. all five deaths have been within blocks of each other east of interstate 880. police have made arrests in two

homicides. police have not made arrests in the other three cases and still trying to determine if they are cob nekted. new questions about safety at san francisco's westfield shopping center after an unsolved homicide and now a recent robbery i side that mall. everything fra gal cia's body was found inside the shopping center last wednesday morning as we reported. now police say two days later three men beat and robbed a 20-year-old man in a mall bathroom. westfield center management says it's taking the investigation and security matters very seriously. it is the highest profile police job in the bay area and getting it is no easy task. last night the san francisco city commission held the first of five community meetings to help them in a search for permanent chief of police. it comes just days after acting police chief tony chaplain announced he wants the role permanently. chaplain was named interim chief in may. the same day chief greg sir was forced out.

now to the latest from rio this morning. for the first time since the games began team usa was denied the gold medal on the stand on monday. today the americans led by gymnast simone biles hope to retake the top spot as the gymnastics wrap up in rio. jay gray has all the top highlights from the games. >> reporter: the flip and the slip for simone biles leaves her holding on for bronze on the balance beam. she makes lori fernandez won silver. allyson felix is the most decorated female track athlete after we were kept off the top of the medal stand when miller from the bahamas took a dive at the finish line. >> probably heard my mom screaming. i was thinking, okay, i had to have won the case. >> emma coburn made history, the first american woman to medal in the steeplechase. she grabbed the bronze. track and field continues today with usain bolt back in action in the 200. he says that's his favorite

some evacuees are now trying to get back to their flood developing in louisiana, some evacuees are now trying to get back to their flood-damaged homes in and around baton rouge as you see so many folks having to be put in boats and moved around what is essentially a city under water right now where there are at least seven confirmed storm-related deaths at this point. that number obviously could change. more than 12,000 people are in shelters. >> 20,000 people have been rescued since friday in what's being called some of the worth flooding the state has ever seen. while there's currently a break in the rainfall there water

levels are still rising and some rivers and creeks have spilled over those banks. so people are going to have a long road to recovery there. >> i guess we have seen something like 25 inches of rain between friday and sunday in that part of louisiana. >> and it's still raining. this is not a hurricane or a tropical system. this is just one of the run of the mill, you know, cold fronts that just kind of stalled out and it's still dumping rain there. they're expecting at least another half a foot of rain. we'll talk about that. let's get a live look outside at rio. beautiful start to this day. keep in mind it's four hours ahead so it is 8:46 right now. and it is absolutely gorgeous as you get a look at that. let's get a look at the forecast over the next several days. as we get ready to wrap up the games there. a lot of people will be heading home. and we will have some rain toward the end of the week. also for the weekend, as some of the games will be ending on saturday and then the closing ceremony on sunday.

also as a lot of people head back home and getting on that plane it may still be raining there. once again we talked about what's happening across parts of the gulf course. and there's still rain trained in so they're expecting another day of some heavy rainfall there. as we head back home we are now with temperatures in the mid to upper 50s as you head out the door. and school is starting in gilroy today. one of the many spots where we will have school starting this week. it will be a hot one. even though it's cool now and the kids need a jacket. later on today not so much. even in morgan hill, 92 degrees. some low 90s for most of the inland areas. oakland today, 73 degrees. and 66 degrees in san francisco. and the wind direction will be switching things up today. coming in from the north to start. and then more onshore as we go into the evening. that will help cool us off. but our wind speeds at about 10 to 15 miles an hour. and going throughout the next several days in san francisco, no major changes in the temperatures there. staying in the 60s. but then we will see our highs

in the 90s starting to come down just a little bit in time for the weekend. we still keep the sunshine on this weekend. we'll be up to 88 degrees and a little bit better as we start next week. heading over to mike now he's been tracking a closure through oakland. >> just as we came to set. one last update and looks like it's clear. better news. the closure was eastbound 580 just past highway 13. you still see a little slowing there. there was an overnight crash. repaired some of the rail on the side there. i think that's been done over there. no problems as far as lanes. so far as i know. i'll keep monitoring that for updates over the next few minutes. nice smooth drive toward the bridge from berkeley and the bay bridge. no backup at the toll plaza. i do want to talk about also our view from the emeryville camera where we had construction going away from the span around the bridge. see flashing lights. just cleared that right lane. better news heading up card the

carquinez bridge. kind of fade out just above street level. that's fine nor driving. you're clear. back to you. >> sounds good. thanks so much, mike. it's 4:49. curfew apparently brought some peace to milwaukee overnight. the city has been overwhelmed by protests after a black man was shot and killed by a black police officer on saturday. the officer claims the suspect was on with the semi automatic weapon. shooting was captured by the officer's body camera but that footage has not been released. city leaders implemented the 10:00 p.m. curfew last night for anyone 18 years old or younger. major concerns this morning out of mexico where 16 people were kidnapped from an upscale restaurant in a popular pacific tourist city in paurt tovar a nw mexico. they arrived in two pickup trucks on monday morning and proceeded to carry out the

kidnappi kidnapping. tourists were not among the victims. investigators are going over security footage to track down leads. decision 2016 now. battleground states will again be the focus for hillary clinton and donald trump today. clinton will campaign in pennsylvania. trump in wisconsin. >> polls indicate that hillary clinton holds an 11-point lead in pennsylvania but donald trump is said to be gaining some ground among white uneducated voters. in scranton yesterday clinton blasted trump's new security plan. trump is fushi ingpushing for et for immigrants. we're going the have more on trump. in the meantime, running mates tim kaine will be in north carolina today campaigning. mike pence will be in new mexico. at 4:50. business news this morning major health insurance providers dropping out of most "bay cafe" health exchanges and billionaire warr warren buffett is taking a big bite out of cupertino's a. >> for that and the news before

the bell, landon dowdy at cnbc's world headquarters. good morning. >> good morning to you. the market will try to build on yesterday's gains after all three indexes hit all-time highs. retail dominating the earnings headlines today with t.j. maxx, home depot and urban outfitters reporting. home construction numbers today and industrial production results and weekly api crude inventory. the dow at 59 points to 18, 636. nasdaq closing up 29 points to end at 5262. pay jor health insurer is quitting most of the obama care health, changes citing costs. aetna will only remain on exchange in four states. those include delaware, iowa, nebraska, and virginia starting next year. it's the first major health insurer to make a decision like this and it will still offer individual policies outside of

are searching for a man accused of sexual ast authorities in alameda county are searching for a man accused of sexual assault against a child. deputies say andrew flurry knows the victim. he became a suspect in march but fled and has not been seen since. sflurry was last seen driving a green 1997 ford taurus. so-called dreaded bandit's crime spree is over. fbi identified the suspect sometime who wore a wig and makeup. husband accu he's accuse of robbing bachks in april. they had been trapping the suspect in san francisco. fbi agents believe he was headed to rob another bank when they arrested him. back to the lower lake fire. areas like this held livestock

and pets. frank haas and his wife escaped with their two dogs but fire forced them to leave their cat behind. luckily they came back and they found the cat. >> and we were talking to the pg&e guy and we could hear this cat. the cat was over there. the cat cuzz spawas spared. it's calming down now. >> a lot of animals were at risk. not just cats but horses, too. dakota was last left behind but she's okay. local vets are working to try and treat all of those animals. >> catch them, too. another pet rescue, a little dog rescued by a dumpster in marin county now needs a new home. this is mozzarella. someone found him abandoned in a mill valley dirty carrier. he's got a bit of a makeover since workers took them in at the marin humane society. before and after shots there. had to coax him out with a little mozzarella. the humane society said he was

inland, very different story. >> we will be hitting the 90s again today. it starts out nice and cool. it doesn't end that way for many spots. as we get a live look outside. all of our microclimate show showing that we start out with low clouds and patchy fog as well as some temperatures in the 50s and low 60s. heading into today we'll have some drifts of smoke in the north bay. 87 degrees there. 77 in the peninsula. and 93 in the tri-valley. while once again san francisco stays in the 60s. i'll detail that, what else to expect as we head into the next few minutes. mike takes a look a t the tri-valley. >> that's right. >> sunnyvale, gilroy today, more folks coming online. we'll see a shift in the next couple of weeks. the tri-valley where we haven't seen any change though. a tiny bit of slowing into the altamont pass and all this construction zone right now. nothing unusual. tri-valley is good at the dublin
