inland, very different story. >> we will be hitting the 90s again today. it starts out nice and cool. it doesn't end that way for many spots. as we get a live look outside. all of our microclimate show showing that we start out with low clouds and patchy fog as well as some temperatures in the 50s and low 60s. heading into today we'll have some drifts of smoke in the north bay. 87 degrees there. 77 in the peninsula. and 93 in the tri-valley. while once again san francisco stays in the 60s. i'll detail that, what else to expect as we head into the next few minutes. mike takes a look a t the tri-valley. >> that's right. >> sunnyvale, gilroy today, more folks coming online. we'll see a shift in the next couple of weeks. the tri-valley where we haven't seen any change though. a tiny bit of slowing into the altamont pass and all this construction zone right now. nothing unusual. tri-valley is good at the dublin

interchange. bay bridge toll plaza. we'll jump over there where we see a smooth flow of traffic. low clouds over the oakland hills. so far drivers are not having a problem. now to that breaking news out of lake county where wildfires are tearing apart homes and businesses and charring thousands of acres. this morning a major twist in the story as the suspected serial arsonist is locked up. >> here's the latest at this hour. a state of emergency is now in effect for the area about 90 miles north of san francisco. 4,000 acres are scorched. nearly 200 homes and businesses just gone. the blaze only 5% contained. now let's bring in "today in the bay's" pete suratos who has been covering this story since yesterday. pete, what's happening right now and tell us more about what we uncovered about the suspect in this case. >> reporter: well, authorities are describing that suspect as a serial arsonist but we're near quarter horse lane and we showed you these communities. pretty much ravaged as a result

of this clayton fire. here's an example of this car that's in front of what used to be a home behind us that's pretty much burned down. and last night we had a big break in the case where authorities arresting a potential suspect. >> we're able to arrest mr. pashilk on 17 counts of arson. >> reporter: emotional reaction from about 200 homeowners last night when cal fire announced the arrest of damin pashilk. they believe he is responsible for starting not only the clayton fire but more than a dozen other fires over the past year. arrested on 17 counts of arson and the 40-year-old clearlake man is being described by authorities as a serial arsonist and cal fire explained last night the importance of this arrest for the community. >> the suspect is in jail tonight. that's what is important. so thank you. >> it's not much comfort when you don't know if your house is

still there. >> reporter: he was booked at the lake county jail yesterday. scheduled for court arraignment tomorrow in the lake county sheriff's department did not disclose what led them to pashilk or how he may have allegedly set the fire off. in the next half hour we'll discuss the overall damages to the area from the clayton fire. live in lower lake, pete suratos for "today in the bay." >> thanks so much. nbc bay area has teams dedicated to this story. update on our website nbcbayarea.com or you can always download our free app. developing at this hour, one person has died, another is seriously injured after a shooting in east san jose. you see that car with bullets in it. police say that two victims arrived in the same car at about 6:00 p.m. at regional medical center. investigators later determined that shooting likely happened near north white and mckee roads. one of the men died at the hospital. the other is expected to survive. police so far have not released

a suspect or a vehicle description. there are new questions arising about safety at the we t westfield shopping center. last week there were two violent incidents. first a homicide and a robberien side of that mall. everything fra gal cia's body was found in the stairwell last wednesday morning. now police say two days later three men beat and robbed a 20-year-old man in the same mall's bathroom. as gal cia's family waits for answers the incident sparks concerns about mall security. >> my brother is gone. but if we can prevent something else we need that to happen. >> the westfield center management says it's taking this investigation and security matters very seriously. it is the highest pro fight police job in the bay area and getting it is no sighs task. last night the san francisco city commission hold the first of five community meetings to help in the search for a permanent chief of police.

comes afterst just days after tony chal lan announced he wants it permanently. he was announced interim chief in may. a curfew apparently brought some peace to milwaukee overnight. the city has been overwhelmed by protests after a black man was shot and killed by a black police officer on saturday. the officer claims the suspect was armed with a semi automatic weapon. shooting was captured by the officer's body camera but the footage has not been released. they implemented the 10:00 p.m. kur fi last night for anyone 18 years old or younger. it was another action packed day on tap for the summer games. several bay area athletes are going to be back at it trying to snatch the gold as we enter day ten of the rio olympics. nbc bay area anchor jessica aguirre is live with what's in store for today's competitions. jess, get us up to speed. good morning. >> reporter: good morning, sam. you can see it is a sunny day here in rio. quite a change from yesterday

where we saw lots of wind and rain but, to be on most, yesterday started off a lot like this, too, with lots of sunshine. now, no matter rain or shine, we will be hitting the beach tonight. kerri walsh jennings and april ross will be back at copacabana. yesterday was walsh's 38th birthday. today they take on brazil so that's going to be a super, super match-up. clayton's kristen ipson will be on the individual springboard. finished in the third place in the prelims yesterday but it's a fresh start today for all the men going in. ipsen is a two-time olympian. he won bronze in the 2012 synchronized springboard. good chance today. back for a second olympics is concord maria and her rookie partner anita alvarez. they're moving on 'n sync kro nized swimming. 12 pairs advance to the final duets today. now, listen to this. russia has won gold at every

game since 2000 synchronized swimming. the ladies are hoping that they can score well. and if you're wondering how they actually stay so close together and in tune underwater, there are speakers under water so they can hear the music. on land, we have simone biles and aly raisman in the women's individual floor exercise today. now, biles was performing that famous move of hers, the buys, it's an extraordinary tumbling pass. we'll see that again today. she was scheduled to win or people thought she would win five gold medals but she had a little bit of a stumble yesterday on the balance beam so she ended up with the bronze. if she takes gold today she would have four golds. the only female gymnast ever in the u.s. to have that. and as you all know i love horses and i love riding so today madden, the american, will be competing in the show jumping

event in the pink finals and individual preliminaries. bees si is the oldest female olympian here at 52. she's a four-time olympian. i got to give a shoutout to the more mature olympians out there. go, beasy. >> showing those golds in the in the meantime, at 5:08, a look at your local forecast. >> that's right. lots of kids going back to school this week, kari. >> yes, and it will be a great week. but rewith looking at the forecast of rio as we look at those events on television and it looks like for the most part today should be pretty dry as jess was just talking about some rain yesterday. temperatures nice and comfortable there. but we'll have a wide range in temperatures again here in the bay area. up to 73 degrees today in oakland. 66 in san francisco. we'll still have those low 90s for fairfield, over to concord, livermore, and morgan hill. also starting school today and santa rosa today expect a high of 85 but we'll also have drifts

in our nbc news survey monkey online poll. about same as last weekend in that weekly tracking poll. but on both sides clinton and trump, the unfavorable numbers still very high. ♪ hillary clinton's back in battleground pennsylvania today signing up new voters. she's got an 11-point lead there. but donald trump's gaining among white uneducated voters. >> most of the people i talk to are pretty fed up with her lying. >> reporter: in joe biden's hometown scranton she mocked trump's national security plan. >> sometimes he says he won't tell anyone what he'll do because he wants to keep his plan, quote, secret. and then it turns out the secret is he has no plan. >> reporter: biden says terrorists are already repeating trump's claim that president obama found eed isis. >> if my son were still in iraq and i say to all those who are there, the threat to their life

use against other countries and frankly sometimes use against our own country. software, think of it as a digital safe cracking tools, that would open up computers and expose their secrets. we know the nsa has made special software to attack the very computers we make here in silicon valley. cisco servers. the hackers claim they have the spy tool thgs morning and offering them online. it's assumed if they're real russia or china will snap them up probably for millions of dollars. again, if they're real. here at home, google is taking on apple's face time with person to person video chat software called duo encrypted in nsa a proved. you can use it on your android or iphone. we'll talk about that later. in the meantime, let's do a person to person chat with landon dowdy live at cnbc's world headquarters. good morning, landon. >> come on, scott. you don't want to duo the markets? quick update. the markets will try to build on

yesterday's gains after all three indexes hit all time highs. retail dominating the earnings headlines today with t.j. maxx, home depot and urban outfitters reporting on the economic front investors will get inflation da data, home construction numbers and weekly api crude inventories. the market closes, dow up 59 points to 18636. the nasdaq up 29 to 5262. scott, back over to you. >> thank you. sam and laura, bhp said its business is $6 billion, billion, $6 billion in the hole for the year. it's a mining company. one of the problems is the demand for coal is falling. i bring this up because it re-enforces something we've been talking about. politicians saying they're going to bring back the american coal industry. the problem is coal's competitors, mostly natural gas, is just super cheap. you can't make money on coal no matter what you promise to do. let's talk about voegs

the clouds are back once again. it's 56 degrees. and as we take a look at all of our microclimates, the temperatures in the 50s and low 60s. san jose now at 62 degrees. and as we go through the day we'll start out with some clouds for a little while. it will be 59 degrees at 8:00 and then lunchtime it's bright and sunny. making it into the mid 70s and mid 80s for the high. as you get ready to head home, and mostly clear skies as the sun sets this evening. we start out with the knotterly wind this morning. clouds in spots. and then it clears out. our winds turn more westerly. it picks up to 10 to 15 miles per hour. a nice breeze. we will still have some very warm air in spots like gilroy where the high tops out at 95 degrees today. san mateo will be up to 78 degrees and 65 degrees in the castro. 85 in santa rosa while oakland is at 73. we'll have 93 in concord. and pleasanton up to 90 degrees. over the next several days we will see the 60s sticking around

san francisco. and morning clouds with a lot of sunshine, a breezy wind. but then as we go into the inland areas we go from some very hot temperatures over the next several days to something a little bit milder and closer to average as we go into this weekend and to start next week. heading over to mike now, he's got a traffic forecast for you. >> forecasting some slowing. bay bridge, san jose. we'll talk about that in a second. also forecasts changes. schools coming back online. a change to the know the first couple weeks as know parents tend to delay the departure from home to be with their kids on that first day. that's for elementary school kids mostly. nothing unusual about the tri-valley. 880 and 680, no slowing shows up here either. bay bridge toll plaza, forecast some backup over there. live camera shows you just a little bit for the cash lanes. over the next ten minutes, the build and metering lights likely

investigate claims that the hot line calls aren't being answered by the right people and how that could be putting children at risk. if have a tip, give us a call at 888 888-996-tips. now to our continuing coverage this morning at 5:25. what some are calling the leaning tower of san francisco. we're talking about the millennium tower which is set to be sinking and very possible tower problems could cost taxpayers millions. we've obtained a document from 2008 that shows the builders of the new transit building which is right next to the millennium tower may be to blame. the document which is an agreement reads, quote, in particular, the trans joint powers authority shall repair the damage to the waterproofing or cracks in the foundation or walls of the development resulting from settlement or movement substantially caused by construction activity. unquote. the tower has sunk as much as 16 inches. >> if they get too far off

center the elevator won't work, they will jam. cause many doors to jam and people couldn't get out. there's a serious problem in my opinion. >> it's very unlikely the fight over who is responsible for the sinking will end up in the court. at 5:26. today a navy ship will be named after the late san francisco supervisor and gay rights activist harveymilk it's going to be the named the usns harvey milk later today. the u.s. secretary of the navy congresswoman nancy pelosi and san francisco mayor ed lee are all going to be on deck for the ship naming ceremony that's going to take place at treasure island. milk was one of the first openly gay elected officials in the county. became a supervisor in 19 7. two years later milk and then mayor was assassinated. coming up, a devastating scene unfolding if lake county.

see you later. we have great weather, too. start out with jacket weather across the bay area. as temperatures spread out we may have highs reaching into the 90s depending on where you live. let's get a look at the microclimates. 56 degrees in the tri-valley and san francisco. 51 degrees in the north bay with a high there expected to top out at 87. 77 in the peninsula. 88 in the south bay. and san francisco up to 66 degrees. 93 in the tri-valley. we'll have more 90s in the forecast for spots like that. i'll talk about what else to expect but as we head over to mike, change is now in the works. >> that's right. changes all around the bay. i'm not so evident from the speed sensors although behind me slowing out of the altamont pass and gilroy. by the time you get to greenville you're just fine. that's a typical pattern. no problems coming off the carquinez or benicia bridges. may be low clouds hovering

around the deck. l look at the bay bridge toll pla plaza. the metering lights are on. just filling in right now. laura? >> thanks so much, mike. at 5:32. back to breaking news. a new twist on this out of control wildfire we've been following for three days. about 90 miles north of san francisco. nearly 200 homes and businesses are destroyed in lake county. firefighters are rushing to save thousands more right now. this morning we're learning police believe this man, damin pa pashilk is accuse of starting a dozen fires. he faces 17 charge ofrs s of ar. they hope when they return there will be something to come back to. we spent "today in the bay's" pete suratos back to lower lake this morning. one of the hardest hit areas to give us a better look at what is going on there this morning.

and a look at the aftermath. good morning, pete. >> reporter: yes, good morning, guys. that fire is currently at 5% containment. quarter horse lane. take a look to my left. this is what's left of the home in the area as a result of that devastating clayton fire. the fire started on saturday on clayton creek road just off highway 29. it destroyed at least 175 structures. that fire has burned close to 4,000 acres. many of those structures effected on sunday when the winds and high temperatures led to spot fires in the lower lake area. cording to cal fire this is what they are telling us, looking at $10 million worth of damages in the area. leaving families homeless and a lot of them wondering why someone would do this. >> it's not much comfort when you don't know if your house is still there. >> they've been setting fires for years. and it's not by themselves.

"today in the bay's" bob redell is live with more on the latest incident. bob, police say a man was brutally beaten up in one of the

mall bathrooms. >> correct, sam, this happened on friday when three men beat and robbed a 20-year-old man inside one of the rest rooms at the westfield shopping center here in downtown san francisco behind me. this was just two days after frank galcia was murder we at the mall. you might call on wednesday morning 28-year-old man, a chef at a high end restaurant here in union square, was found dead last wednesday morning in a stairwell inside bloomingdale's. that opened up to an alley way on the back side of the mall. we spoke with frank's brother luis in town to bring his brother's body back to los angeles for burial. he tells us his family is in the dark about the circumstances surrounding his brother's death. giving it the mall has several security cameras, luis thinks there's most likely video evidence that would explain what happened but so far police aren't saying much to him or his family.

>> we're almost at a week and it's frustrating. it's getting to point now where we haven't heard anything other than, we found your brother. no kind of resolution. >> reporter: sfpd tells us it can't comment on the homicide investigation because it's still active. the westfield center management says it is cooperating with the investigation. reporting live here in san francisco, bob redell for "today in the bay." >> thank you, bob. at 5:36. new concerns in hayward this morning after a fifth homicide in less than two weeks. the most recent happened sunday. investigators say a man was stabbed to death on cottonwood avenue. as you can see on this map the other homicides happened not far from each other. police have made arrests in two of the homicides in both of the cases the suspect knew their victims. s for the latest shooting on sunday the neighbor said the incident is putting everyone on alert. >> after i heard, it really

shocked me. it touches me. >> takes more than police. it takes like neighbors keeping an eye on stuff. >> hayward police are still trying to determine if there's a link between the three unsolved homicides. new this morning, another mountain lion spotted close to homes on the peninsula that was seen in this secluded community of port to valley not far from menlo park. san mateo sheriff said someone reported seeing that animal at the westridge drive and golden hills drive last night after 9:00. the animal ran away after being spotted and never actually threatened anyone living there. go back out live to rio right now where it is day ten of the summer games and team usa is hoping to bounce back today after not winning a single gold medal yesterday. the one track star came awfully close. that is the first since the games began. >> we're getting spoiled, getting used to the golds. nbc bay area anchor jessica aguirre is there.

expected to be another action-facted day. >> reporter: it is going to be an action-packed day. lots on tap. let's talk about what happened yesterday. we all know that olympians have a drive and determination that most of us don't have but apparently that quest to get a medal is just unstoppable as we saw shaun they mailer take a dive yesterday to get a medal. but this is track and field. it's not diving. check out what happened. american allyson felix was set to win her fifth career gold in the 400 meters went bohemian miller would not be denied. miller diving across the finish to win by .07. all right. love diving but a stumble cost golden gymnast simone biles a gold on the beam yesterday. it's the first slip-up of the games. she won bronze on the balance beam and got -- and then lori hernandez got silver in her first individual medal. but thely difficults will be back today competing.

aly raisman and simone biles competing in the individual floor. shanna competes in the 1500 meter final this morning. she advanced to the semis yesterday. placing second in middle distance running. from san francisco. this is her third olympics so she is going to come out strong. and clayton's kristian ipsen will be soaring in the springboard. finished third in the prelims yesterday. it's fresh start today. all men going in start from the beginning but ipsen has a really, really good chance. he won bronze in 2012 in synchronized diving. this olympian is going in with lots of experience. as for the weather outside today, it has been crazy here in the rio. it changes constantly. sunny today. but who knows what the afternoon will bring. this is the way we started yesterday. we ended up with a lot of wind and rain. sam and laura? >> right now good conditions for some beach volleyball. we'll check back with you again in half an hour. thank you very much. >> or diving or gymnastics or

today with high ozone levels also with smoke drifting in from the north. we start out with the wind blowing in from the north. that will spread that smoke across most of the bay area. we will have hey i have conditions and then as the winds shift onshore we will see our visibility improving and our temperatures starting to dip later on this evening, too. but not before we're hitting 87 degrees in los gatos and 67 in pacifica. castro today, expect a high of 65 degrees. 92 in fairfield. 93 in concord. and dublin today we'll be seeing the highs topping out in the low 90s as well. so as we go into the day we're looking at some high pressure that will be continuing to stay just to the west of us. bringing in that northerly wind but then toward the end of the week we'll start to see a shift in our wind direction that will make it feel cooler and just in time for saturday and sunday. although we won't see much in the way of changes as far as temperatures in san francisco, 60s all week long. we'll see some low 90s today.

actually a big threat with ships unknowingly hitting and killing whales. >> many of those whales are already endangerered in the first place but we learned a government plan to protect them from fast moving ships in the bay has largely failed. >> reporter: guys, good morning. a top whale researcher estimates that hundreds of whales may have been killed off the california coast just over the past decade. now to minimize the threat against whales in the shipping lane that feed into the bay last year the federal government started issuing a voluntary slowdown of ten knots during the peak whale season. but the data we obtained showed that ships traveled faster than that 18% of the time. those in the shipping industry tell us if cargo vessels are late getting into port because of the slowdown that can cause huge losses. they also say adjusting schedules to plan for the slowdown would be difficult. but the federal government tells us unless ships comply that voluntary slowdown could eventually become permanent which would carry hefty fines.
