a lot of clouds but we'll see that clearing out for some sunshine and it stays hot in the tri-valley today reaching sbhoo the low 90s. while san francisco will see a high of 66 degrees. we'll talk about this temperature spread coming up. heading over to mike, more slowing on the drive through fremont. when i was younger we had to remind him to put his pants on. he forgot something. smooth drive. nothing memorable about this commute. standard flow of traffic. we do see more traffic flowing. past sunol boulevard and fremont. same direction off the castro valley y slowing past a street and industrial. now the build toward the dumbarton bridge. westbound directions build a bit. looking at the bay bridge toll plaza. big westbound commute in oakland. the span itself moves smoothly. even the fastrak lanes are moving well. we'll track that build. >> mike, thank you. we go back to our north and

update to the clayton fire that continues to burn out of control in lake county. this morning a major twist in the storys a authorities announce the arrest of a man accused of starting this devastating fire. he's facing 17 charges. here is the very latest. state of emergency is now in effect for that area. roughly 90 miles north of san francisco. 4,000 acres of land are scorched. nearly 200 homes and businesses wiped out. that fire is only 5% contained. "today in the bay's" pete suratos has been covering this story since yesterday. pete, tell us more about the suspect in this case as we heard the folks there applaud when his arrest was announced. >> reporter: p. >> reporter: it was an emotion ol moment when they were applauding. we're going to get to that but i want to show you guys exactly where we're at. quarter horse lane. here's what folks are going to come home to in lower lake as a result of this clayton fire. and last night as you mentioned authorities announced the arrest of a man who they say is

responsible for the fire. >> we're able to arrest mr. pashilk on 17 counts of arson. >> reporter: that was that emotional reaction from about 200 homeowners last night when cal fire announced the arrest of damin pashilk. they believe he is responsible for starting the clayton fire as well as more than a dozen other fires over the past year. he was arrested yesterday on 17 counts of arson. the 40-year-old clearlake man is being described by authorities as serial arsonist. california fire explained last night why it was important to get this man off the streets. >> the suspect is in jail tonight. that's what is important. so thank you. >> it's not much comfort when you don't know if your house is still there. >> reporter: hefz booked at the lake county jail yesterday. scheduled for a court arraignment tomorrow. lake county sheriff's department did not disclose on what led

hospital. the other is expected to survive. police so far have not released the suspect or vehicle description. authorities in alameda county are search for a man accuse of sexual assault of a child. andrew flurry knows the victivi. he was last seen driving a green 1997 ford taurus. a cure few brought some peace to milwaukee over the night. the city has been overwhelmed by protests after a black man was shot and killed by a black police officer on saturday. the officer claims the suspect was armed with a semi automatic weapon. shooting was captured by the officer's body camera but that footage has not been released. leaders implemented a 10:00 p.m. curfew last night for anyone 18 or younger. laura, it is the highest profile police job in the bay area and getting it is no easy task. last night the san francisco city commission held the first of five community meetings to help out in a search for a permanent chief of police.

this comes just days after acting police chief tony chaplain announced he wants the role. chaplain was named interim chief in may, the same day that chief greg sir was forced out following several controversies. on tuesday morning, back to our olympic coverage from rio. did you see this? photo finish in the women's 400 meters yesterday. american allyson felix was looking to defend her title but watch there. did you see it as the bahamas shaun miller went all in, completely diving across the finish line. and that was the difference, by .07. felix settles for silver. and that adds to team's usa overall medal count. the americans dominating there with 75 total. china a distant second with 46. a lot of folks talk about whether or not that dive at the end of the race was fair. let's bring in jessica aguirre who joins us live from rio this morning. jess, another huge day of competition for many bay area olympians. good morning.

also in the water today, concord's maria and her partner anita alvarez. they will be doing synchronized swimming. they're doing really well. 12 pairs advance to the duet finals which take place today. the ladies are hoping to do well. russia has won gold at every game since 2000 in synchronized swimming. yes, they can actually hear their music to keep their timing in place because there are speakers under water. on land, simone biles and aly raisman favorites for gold and silver in the women's individual floor exercise. biles will perform the signature biles movement as it's come to pass. it is an extraordinary difficult to pass and raisman will perform her difficult tumbling pass as well. yesterday simone biles stumbled a little bit. she had a problem with the balance beam. ended up with bronze which

major concerns out of mexico this morning after up to 16 people were kidnapp f there are major concerns out of mexico this morning after up to 16 people were kidnapped from an upscale restaurant in the popular pacific tourist city of puerto vallarta, new mexico. the man abducted the group on monday morning right from the restaurant in the city's hotel zone. the state's attorney general's office said gunmen arrived in two pickup trucks monday morning and carried out the kidnappings. the tourism board said tourist were not among the victims. the governor says investigators are going over security footage to try and track down some leads. it is 6:14.

crime concerns at one of the bay area's busiest shopping centers. police are investigating both the homicide and a vicious robbery inside westfield san francisco center on market. "today in the bay's" bob redell is live in san francisco with reaction from family directly impacted by all of this violence. of course concern by so many shoppers in that area, bob. >> reporter: good morning to you, laura. luis galicia tell us right now hend his family in the dark trying to figure out what happened to his brother frank who police say was murdered here last week at the westfield shopping center, a high end mall here in downtown san francisco. frank who was 28 years old and was a chef at a high-end restaurant in union square was found dead last wednesday morning in a stairwell connected to bloomingdales. the mall had several security cameras that appear to cover that area. luis galicia thinks there is

most likely video evidence to explain what happened to his brother but so far police aren't saying much to him or his family. he thinks law enforcement and the mall needs to do a better job of securing this location. >> my brother is gone. but if we can prevent something else, we need that to happen. >> reporter: sfpd says they can't comment on this homicide investigation because it's still active. the westfield center management says it is cooperating with the investigation. on friday just two days after frank's body was found three men beat and robbed a 20-year-old man in one of the mall's bathrooms. the galicia family thinks the mall, again, needs to make security a greater priority. reporting live here in sf, bob redell, "today in the bay." >> bob, thank you very much fshlgs as you're just waking up, maybe getting that cup cough coffee the marngts are definitely stirring there. they are waking up feeling just fine this morning. >> scott mcgrew, yet another day of all-time records. >> that's right. 3 for 3 on the indices that we care most about. take a look.

the dow starting the day at a record. the nasdaq, it has a star next to it, too, because it's a new record. the s&p at a record as well. now, admittedly this happened just last week but before that we hadn't seen this since 1999. hackers this morning claim they have stolen the software used by the nsa to spy on other countries' computers and frankly sometimes used to spy on americans as well. the hackers say they will sell the spy tools to the highest bidder. now, we don't know if the claims are true but security experts aren't dismissing it. they say the group is real and the programs they've seen look legit. the tools can be used to unlock secrets in the very computer that we make here in silicon value like cisco servers. that was the central argument by the way against making a software key for the apple iphone. you remember that argument. after the san bernardino shooting. apple says, if you build the tool it's going to fall into the

>> thank you. >> thank you, coffeest. i like it. not bad. >> thank you. >> thanks, scott. >> we'll see how much caffeine it has in it in a little bit. the numbers are crunching and when it comes to cash it looks like february's super bowl 50 was super for the bay area. some of the good times depended on location. new independent study sponsored by the super bowl 50 host committee finds game generated $240 million in revenues across the bay area. san francisco netted $137 million. san jose and santa clara received a smaller slice, $48 million. come on. critics say this study doesn't explain how the money totals were derived and that the true revenue totals may actually be lower. a slice of very nice weather all over the bay area. certainly on parts coast land and on the peninsula, more heat inland, kari. a bit of a variety. >> a big variety today. in the past few days. this is the weather we've gotten used to because we haven't seen any changes and it continues on

today as we get a looi look outside at sunol. you see the clouds kind of settling below our camera there. but if you want to get a view of the sun rise this morning, here we are. well above the clouds. and a beautiful start to this day. right now it's 57 degrees there. and we've seen the 50s and low 60s. but one concern today will be the air quality. still moderate for the north bay, east bay, and south bay. it will be some areas of smoke drifting in from the north bay. and the peninsula still looking good. so we do start out with northerly wind once again that carries the smoke from the clayton fire farther to the north into the bay area. so you may see these hazy conditions. and then as those temperatures heat up, we'll also have om high levels of ozone. and then as the wind shifts in from the west, a little bit later on this evening we'll see things kind of clearing out, feeling a little bit cooler with our natural air conditioning kicking in. and our wind speeds at 10 to 15 miles an hour. looking at the day in oakland, some clouds to start. lit be 59 degrees at 8:00.

lunchtime, 66 degrees. beautiful weather to take the lunch outside. some low 70s there. and once again it will be nice and breezy. highs reaching into the 80s and even some mid 90s for the south bay. gilroy up to 95. school starting there. palo alto, 79 degrees. 65 in the castro. it will be 83 in napa today while 73 in oakland. 93 in concord. you can see these temperatures are all over the place. and we will see this into the next few days as this intense heat continues for the far inland areas. high pressure continues but then we'll start to see a little bit of a shift as that moves to the north. our winds will turn into the deeper marine layer. and ocean breeze returns in time for the weekend. so although we won't see much of a change for san francisco, the inland areas will catch a little bit of break. we'll bring the temperatures from the mid 90s for the next couple of days into the upper 80s. and even some mid 80s to start out early next week. heading over to mike now, tracking a report now for

this morning nbc bay area responds to a south bay woman who couldn't get a refundable deposit back from an apartment complex. >> kris xhuchris chmura is herer story. >> she's been trying to get her money back for two years. she gave monterrey grove apartments in san jose $750 hold deposit for an apartment knowing there's a $100 penalty for canceling. an e-mail from a leasing agency she showed us explains how it works. $100 is what she would forfeit. nancy did change her mind and didn't move in yet she could not get the $650 refund she was due. she said the apartment complex kept giving her excuses or ignored her. again, for two years. so we contacted monterrey grove and pointed out the paper trail within seven days, its corporate office refunded nancy the entire deposit, full $750. in a statement monterrey grove's parent company apologized and said returning the entire deposit without penalty is,

north of 17. 101, live look. slowing at capital expressway. over here at 680 we haven't seen that slowing just yet but the build will start here all of the way up towards 880 as well. that is the trend. we also got the bay bridge with the metering lights lon on. no surprise. a major break in the clayton fire this morning. it's been burning out of control in lake county. authorities now say they've arrested damin pashilk. he started more than another dozen fires as well over the past year. pete suratos has been following the story for more than 24 hours now. pete, we've also just learned that crews are trying to make progress as they announce the fire is 20% contained, up from 5% earlier this morning. >> reporter: that's right. new numbers that it is 20% contained. yesterday we showed you main street. there were the businesses that were burned down as a result of

this clayton fire. and right now we're seeing this now, guys, daylight now. we're at quarter horse lane. you see this home in this area has been reduced to just rubble. remember that fire started on saturday on clayton creek road just off highway 29 and has since destroyed at least 175 structures. the fire burning close to 4,000 acres and many of the structures effected on sunday when those winds and high temperatures led to spot fires and lower lake. according to cal firing looking at $10 million worth of damages in the area. leaving families homeless and a lot of them wondering why someone would do this. >> it's not much comfort when you don't know if your house is still there. >> morgan valley, couldn't have been doing it by himself. >> shock. i'm in shock. i can't imagine what would motivate somebody to do something like that.

>> thousands were evacuated as a result with several hundred still at local shelters around the county. and now some lower lake residents will come home to unfortunate situations like the ones you see here, guys. we're live in lower lake, pete suratos for "today in the bay." >> thanks so much, pete. our coverage of the clayton fire continues throughout the morning both on air and online. we'll check back with pete coming up in 20 minutes. we're also posting updates across our digital platforms as we get them. now to a developing story in the south bay where police are trying to piece together clues in the double shooting that left one man dead and another injured in san jose. >> "today in the bay's" kris sanchez is live at police headquarters in san jose with the latest on the investigation. kris? >> reporter: good morning, laura. good morning, sam. it's not clear at this point whether those two men shot knew who pulled the trigger nor whether they were targeted specifically. but we do know that they managed to drive themselves to regional hospital not too far away. we counted three bullet holes in the driver's side door of that

small green sedan they arrived in the hospital in. san jose police say the duo was in that car near north white road and mckee rode around 6:20 yesterday. in the evening when the shooting happened. somehow again they managed to drive themselves to regional medical center which the about a mile and a half away. for one of the two men shot it was too late for doctors to keep hum alive. the other man though had at least one gunshot wound but will recover from his injuries. police are not releasing their identities nor are investigators giving us a description of the suspects at this point. sometimes they withhold that because they have an idea of who that might be and they don't yet need the public's help. the victim who died is the 32nd homicide victim in san jose this year. in san jose, kris sanchez, "today in the bay." >> thanks for the latest, kris. the so-called dreaded bandit's crime spree is officially over. he's now behind bars. the fbi says the unidentified suspect sometimes wore a wig and

makeup. he's accused of committing takeover style robberies at four bay area banks since april. police have been tracking the suspect in san francisco. fbi agents believe he was headed to rob another bank when they arrested him. now to our continuing coverage of what some have termed the leaning tower of san francisco. talking about the millennium tower sinking and possible tower's problems, those issues could cost taxpayer s millions. nbc bay area obtained a document from 2008 that shows the builders of the new transit building which is right next to the millennium tower might be to blame. the document which is an agreement reads, quote, in particular the trans bay joint towers authority shall repair damage to the waterproofing or cracks in the foundations or walls of a development that result from settlement or movement substantially caused by that construction activity. the tower has sunk as much as 16 inches. >> too far off center, the elevators won't work or they'll

a constant concern around here of course the possibility of the next big earthquake. but a new multimillion dollar award could take us closer to know when it could hit. the usgs is giving six colleges across the country more than $3 million specifically to study earthquakes. among the recipient, uc berkeley and the university of oregon. congress approved $8 million in new funding earlier this year earmarked for the early warning system called shake alert that could provide an extra few seconds warning. google is taking on apple this morning with its own version of face time. >> interesting, scott. they call it duo. >> that's right. good morning to you. it's super easy to understand how it works because it works just like face time except it works on both android and iphone. so anybody can make a video called anyone else without worrying about what kind of phone the other guy has. one fun feature is you get to see the video of the person

calling beverly hills yfore you phone so you have context. peter thiel is back in the news this morning. defending his role in the lawsuit against the gawker website. thiel helped hulk hogan sue gawker that it forced them to declare bankruptcy. thiel responded in an especially ed piece says the cruelty and recklessness were intrinsic parts of gawkers's business model and somebody had to stop them. thiel had been angry at gawker for years not just for outing him as a gay man against his will they did it really cruelly. so when the opportunity came for thiel to hurt gawker he took it. some people, mostly journalists, were alarmed by that. one billionaire with a war chest so big he could shut down the website. another 3 for 3 on the open. the dow opened at a record. the s&p 500 opened at a record.

the nasdaq opened at a record. this morning the markets are slightly lower despite the fact we saw consumer prices are down or level again. inflation is just not an issue and it doesn't look like, the fed is always going to look at that. so another reason not to raise interest rates. >> remaining pretty low. >> maybe people will be in the market to buy an apple iphone. we'll have more on that in a little bit. but first, let's get to what everyone is talking about the rio olympics. we take a live look at rio de janiero this morning. the olympic flame still burning brightly as the 11th day of competition is under way. >> jessica aguirre has been tracking the olympians every step of the way. every dive of the way. j jess, we saw one of the most dramatic finishes yesterday on the track. good morning. >> we did. and you know it's really raising the question here at olympic park as do the means justify the end or does the end just nify t means in any sport.

we're talking about that dramatic finish yesterday for the bohemian runner shaunae miller. she really wanted that gold p and she took a dive to get it. let's show you what a looked like. she was in the 400 meter and american allisoyson felix was s to win her fifth career gold but shaunae miller would not be denied. literally taking that dive across the finish line to win and she literally won by .07. she got a lot of scrapes on her legs for that as well but she did get the gold. but it has a lot of people asking whether that was fair. now, we checked and the track coaches say it's not encouraged but it is fair and it's not unprecedented. it has happened before. and so that gold medal stands for shaunae miller. it was not a dive but a little bit of a stumble on the balance beam that kept golden gymnast simone biles from winning

another gold on beam. she took a slip on the balance beam and ended up with a bronze medal instead of the predicted gold. her teammate lori hernandez got silver. that's her first individual medal. both ladies, simone biles will be back out on the floor today for the individual floor exercises along with teammate aly raisman. we'll see how they do there. in track and field, shannon competes in the women's 1500 meter final this afternoon. she advanced to become the semis yesterday. she's a san franciscon and doing fantastic. third olympics. and she's trying to make another run for a medal. and then in the pool, we have kristian ipsen. he came out of yesterday's preliminaries in third place. he dives again today. he's doing very, very strong getting rave reviews from the judges. this will be his second olympics. this will be the first time in men's individual three meter dive me did win a bronze in

2012. in synchronized diving. ipsen has a really good chance today. he is looking great and you can bet that if he medals, there's going to be a huge party at his parents' back in the bay area on those restaurants and there will be pizza, a big pizza party for lots of folks. that's for sure. >> no doubt. the tables will fill up. thanks, jess. >> pizza pies for everybody. you get a pizza. you get a pizza. >> there you go. we've seen scattered temperatures kind of all over the map this morning as a lot of people get ready to head to school. >> a lot of people heading to school. the parents are cheering and kids are like, okay. first day, it's all right. right? we'll have some clouds starting out. let's go above the clouds and get a view from mt. hamilton this morning. beautiful start to this day. we'll see those clouds clearing out. and then here's a look from mt. tam as you can see the clouds just kind of rolling across. temperatures there now 54 degrees. we do have a cool start to the

day. even though it's 62 degrees in san jose. mostly some 50s elsewhere. as you head out the door. and we start out with a northerly wind today. now, that could bring down the smoke from the wildfire farther to the north along the clearlake area. we'll be watching for the air quality. but then as the wind shifts later on today it will help bring our temperatures back down and the winds start to pick up. feels more comfortable. wind speeds at 15 miles per hour. the highs are all over the place once again. pacifica, 67. while 77 in los gatos. 65 degrees in the castro. 92 in fairfield. fremo fremont, 83 degrees. 93 today in livermore. as far as our changes, our weather systems that are moving across the region, high pressure well to the west of us. bringing in that northerly wind and once again it turns onshore as we go into the evening. by the end of the week, a few changes work again as we get the return of the onshore flow. it will help bring our

temperatures back down just a few degrees. but a hot week ahead with some dry and breezy conditions. not much of a change in san francisco as high temperatures stay in the 60s. but for the inland valleys we will be from 90 today to 94 for the next couple of days. and then by the weekend, we'll drop it back closer to average for this time of year. still pretty warm even as we start out early next week. heading over to mike now, some special attention needed for the south bay. >> we have talked about schools coming online. first of all, let's look at your bay. pretty predictable pattern. san mateo bridge getting more traffic flow and slowing to the peninsula. going to zoom in to the south bay where the northbound routes find the slowing. capital, clearing by kirtner. 85 from the expressway all of the way past highway 17. we'll go farther south. we talked about season aunnyval. sunnyvale's first day is today. morgan hill, gilroy, schools as

an update to breaking news as we continue to track that devastating clayton fire that has already destroyed almost 200 homes in and businesses. >> and now we know one man might be to blame. last night authorities announced the arrest of damin pashilk. they say he's a serial arsonist accuse of not only starting this fire but more than a dozen other fires as well over the past year. pete suratos is live among the damage in lake county this morning. pete, firefighters are making a little bit of progress this morning. >> reporter: yeah, cal fire just giving us those new numbers the clayton fire is now at 20% containment. i want to show you what we're seeing here at quarter horse lane. this is a neighborhood that is simply been destroyed due to this fire. and last night authorities did

arrest 40-year-old damin pashilk who lake county sheriff's department says is responsible for starting the clayton fire. as well as more than a dozen other fires over the past year. now, he was arrested on 17 counts of arson in the fire right now has reached 4,000 acres. destroying 175 structures, leading to the evacuation of thousands throughout lake county. california fire says the area currently has $10 million worth of damages in pashilk is scheduled to appear in court tomorrow. live at lower lake, pete suratos for "today in the bay." >> let's hope they make even more progress today. thanks, pete. pete has been talking about and so have you, the wind directionality being an issue in trying to fight that fire. >> it just shifts as we go through the day. that will make that drift into different parts of the bay area. as the day goes along. now, as we start out we have some low clouds. temperatures anywhere from low 50s to the low 60s to start. kids heading back to school will have to deal with hot inland temperatures. 93 today in the tri-valley.
