violence hitting the city when "today in the bay" continues right now. very good busy wednesday morning to you. thanks so much for joining us. i'm laura garcia-cannon. >> i'm sam brock. we'll have updates on multiple fires in just a second but first it is back to school forecast time for everyone in san jose unified. >> a pretty view behind us. san jose. clear skies. right now, temperatures cool enough for a light jacket as you get the kids ready for school around san jose in the south bay right now. drizzle though possible around san francisco from the morning and by the afternoon, mid 90s out towards the tri-valley. upper 80s in the warmer spots around san jose. speen speaking of san jose, not too bad. temperatures in the low to mid 80s. coming up, we'll talk about changes for the weekend in your seven-day forecast. but right now let's look at that hayward commute with mike. >> that's right, rob. we're talking about the schools and indeed san jose will have a change today but more impacted when san jose state comes back

online and san francisco in about a week or so. we're looking at no problems as far as major standouts but looking at more slowing for 680 south out of pleasanton. starting around just south of stone ridge. tapping the brakes down to sunol boulevard. standard there. hayward, a street past 92 down toward tennison. nice volume of traffic through the maze through the bay bridge where the metering lights are on. a note, midday game, 12:45, giants are playing. midday traffic there and not far from the bay bridge moving smoothly from the oakland side. the bachup is there. low clouds hover around the deck as well. happening it back to you for breaking news. let's go straight to that. breaking news, nighttime walk that takes a very violent turn as a married couple is robbed and the husband is shot in the hayward neighborhood. >> "today in the bay's" bob redell live at the hayward police department this morning. bob, this is just the latest violent crime to hit the city in the past couple of weeks. >> unfortunately you are

correct, laura and sam. what happened here last night in the hayward is the latest in the string of violent crimes. if you look at just the past two weeks, five people have been murdered within the city limits. then you have last night's shooting. fortunately police are telling us overnight that that victim is expected to survive. this happened around 11:45 last night. a man and his wife were walking down florida street near the intersection with dolphin lane. this a residential area not far from tennison. a man pulled a gun on the couple and demanded their cellphone. husband and wife complied but police tell us that for whatever reason the man still shot the husband one time. again, his injuries is nonlife threatening. the couple tells police the robber was tall and african-american. that he drove off in a candy apple red suv with gold rims. as i mentioned, it's been a violent summer for the city of hayward. this map we put to the shows the locations of the five homicides taken place over the past 14 days.

there's a few between 880 and 238. one by the airport and another near the hills the p most recent munder was this past sunday night on cottonwood avenue. a man was stabbed to death. police are still looking for his killer. >> multiple in a day or multiple at an incident, but never that many incidents within a 24-hour period or, you know, for that matter a week. >> reporter: hayward police expressing how unprecedented this is to have this much violence in such a short amount of time. again, five homicides over the past 14 days. a total of eight murders so far this year. reporting live here outside hayward police, bob redell, "today in the bay." >> thank you very much, bob. 6:06 right now. 6:03, i should say, breaking news we're tracking in southern california as this new massive wildfire is now threatening tens of thousands of homes near san bernardino. in fact, we can take you live up above from the scene from our nbc chopper in that area.

so much smoke engulfing the skies over the cajon pass where this fire is burning. it's actually 60 miles east of los angeles. the blue cut fire is what they're calling it started yesterday morning. it quickly exploded to 18,000 acres. dozens of homes and businesses are gone and thousands more are in its path. 82,000 people remain out of their homes this morning. 34,000 homes in the san bernardino area alone are in danger at this hour. now, the governor declared a state of emergency. right now a portion of interstate 15 through that area is also closed. stay with n brbc bay area for t latest in breaking news. we'll update throughout our newscast and on nbcbayarea.com. sam? >> laura, of course, we've had a fire much closer to home we're dealing with here, too. developing story right now as firefighters continue to race to douse destructive flames burning in lake county. the man authorities say is behind the clayton fire is going

to be in court later today. damin pashilk faces 17 arson charges. we are also learning that he trained and served as an inmate firefighter back in 2007. now, pashilk has been convicted of several crimes over the past 16 years that includes evading a police officer and firearms charges. back to the clayton fire. as for the fire itself, crews are slowly making progress. that's the good news. here's the look at the latest numbers. now, 35% containment is an improvement from yesterday. it was at 20% yesterday. as far as some of the other details here, things holding pretty steady. 200 homes and businesses in the lake county area are gone. same as yesterday. 4,000 acres are burned. also the same figure as yesterday. again, the suspect accused of starting this fire is going to make his first court appearance in only a few hours. our own pete suratos has been following this story for several days now. he's going to have a live report from lake county. that is coming up in the next half hour. sam, at 6:05 right now,

we're still awaiting an update from police about a fire that heavily damaged an oakland liquor store if happened about 9:00 last night. here's what we know so far. police say they got a call about an armed man throwing items inside the seminary market and liquors on seminary avenue near mills college. the caller then told police the same man set fire to the store. police didn't report any injuries but they're also giving no indication about whether the man got away or was arrested. in the south bay, cellphone video shows the moments after a truck crashed into a tattoo parlor and music studio in san jose just before 9:00 on west end carlos and lincoln. it stared a fire which spread to the roof. there was a music hall in that building. witnesses say ten bands were inside playing during that time and they couldn't even hear that crash. so a man we spoke with, he said he ran inside to alert them. >> we came out front to see if the car was on fire and if somebody needed help. when we realized it was a gas line, we were like, gets go get

everybody out of there. call 911. get everybody out of the building safely. you know what i mean? >> everyone worked quickly. no one was hurt. 100 people from neighboring businesses were evacuated because of the gas leak. firefighters say the building has heavy water damage. 6:07. new this morning. san jose leers giving the green light to a plan to boost housing for the homeless. they approved a plan to use six arkers of vacant land in willow glen. the exact type of project is still in limbo. one plan includes more than 100 temporary modular homes. another idea proposes some 450 permanent units. council members will hold more talks about which plan to implement. back now to our olympic coverage as we look at the olympic torch still going strong and burning brightly in rio de janiero. the hopes of another gold medal for the bay area's own kerri walsh jennings dimmed with a heartbreaking loss on the sand. >> it's tough to see. let's bring in jessica aguirre.

the bright side, it's not over though for our south bay native. >> no, it is not over but it is a bummer on the beach because kerri walsh and her partner april ross won't be going for gold. they will be going for bronze. and that is a first for kerri walsh. certainly the news resonating here in copacabana and throughout brazil and back home. walsh and ross losing to agatha and barbara, the brazilian duo in a raucous match last night. walsh saying they just couldn't pull it. the brazilians out did them but they say they're going to come back strong tonight. again, they play another brazilian duo this evening but they are going to have their a game. they want to get that bronze medal tonight. let's take you indoors where the men are playing indoor volleyball and in there with it two bay area products eric and koweka, brothers from stanford are hoping to hold on. they play poland tonight. and they're going to take on

star player kareq. that's going to be a tough match. let's take you to the pool where it is going to be a rumble in rio this afternoon. u.s. women's water polo team who is unstoppable, these ladies are going to take on hungary. they've trounced hungary seven times before. so expect them to do it again today. this is a critical match for the ladies. as you know danville's steph fans is team captain but you also k.k. clark on there and you have melissa, she's from from walnut creek. you have a lot of bay area ties and two other ladies from stanford. it is going to be a fabulous match. we're going to show up to make sure we watch that. now, there is bad news coming out here of olympic park. the last half hour we told you about the arrest here in rio of an ioc official allege i'dly for scalping tick ining tickets. now we're hearing the thousands of volunteers helping to run the games smoothly are complaining a lot of them have quit saying they're doing long hours and not getting fed enough and that

we should see some cooling even for antioch. across inland valleys. to see how your morning commute is changing up as kids get back to school and around the south bay, san jose and hayward, here's mike. >> that's right, rob. one concern because biggest school district in the bay is in san jose. san jose unified is back on. we may see parents delaying their commute just a bit. the traffic flow doesn't look too bad. we're going to zoom into the south bay. san jose 101 lowing from 680 to 880. a little blip knot of 87. by the time we got to santa clara, it was clear and now things have restored back to what we would expect at this time on a typical wednesday. the tri-valley slow shows slowing toward the castro valley y. from a street down past tennison. san mateo and dumbarton bridge is showing more traffic. the metering lights will be on. the live shot does show you that volume westbound. not a major problem. watching things -- oh, and

it is 6:15. san francisco police are looking for two men accuse of shooting another man who apparently kicked a dog. all of this happened monday night in ingleside district. a woman walking her dog got into an argument with a man. that man allegedly kicked her dog. the woman called for two sons to help her and they started shooting. the dog kicker got away by getting on a muni bus but an innocent bystander was struck in the arm by a stray bullet. the victim is expected to make a full recovery. >> it could have been much worse, a few inches closer and we could have had a fatality on our hands. >> the dog owner is cooperating with police but the suspect has not been seen since that shooting. 6:15. disturbing talks this morning about san jose's largest

employer cisco. >> all right. scott mcgrew, just did an initial report but talk of layoffs, big layoffs. >> big. we're kind of in a rough spot here, sam. i'm going to be honest with you. there's one report from a news agency that cisco could cut as many as one in five employees worldwide. that would be 14,000 people. the reports come from an industry news group called crn. they in turn are quoting anonymous sources. our sources at cisco aren't confirming anything. san jose -- cisco, rather, as you point out, san jose's largest private employer. now, we've been working the phone, working our sources. i talked to my colleagues at cnbc. they're quoting the same news report we are but we're working on getting better information. cisco does report its financials of a closing bell today so we can ask them hard questions there. cisco is pivoting like many other companies for making boxes, server, computers into a company to works as software as a service. you saw it ibm and hp and now

cisco. the markets started tuesday at record levels and then back down a bit. we get the minutes from the most recent fed meeting about 11:00 a.m. our time. ford brought a couple in morgan hill that makes the sensors you see on the top of this ford fusion. ford also says it's going to expand its palo alto research center already world class into a major center for autonomous cars. >> we're expanding our presence right here in silicon valley from that single research and innovation center building right across the way there to the creation of an entire campus. >> ford says it will have a fleet of self-driving car tons road in the bay area by 2021. that's cars you can use, not cars you can drive, cars you can use. no steering wheel. like uber, send me a car. interesting, carmakers are going to make fewer cars because you don't need a car when you can just order up a robot car to slide up in front of your house. >> wow. kit change buying, leasing, everything. >> manufacturing, everything.

that we have nice weather to start for a lot of people, first day of school. >> right now seeing a cool start to the morning but depending on where you are it will still be soaring into the 90s later on this an. let's show you the temperatures we're waking up to. upper 50s to near 60. so cool whether there. take a closer look at san francisco or just half of the golden gate bridge this morning. misty skies there morning commute in the numbers in the 50s right now and around san mateo union as we go through the day today. comfortable temperatures in the 70s. so a light jacket will be just fine. live view at san jose. currently 60 degrees. clear skies out at evergreen today as we see evergreen school district getting under way again. numbers in the upper 80s as we move through the afternoon. so lots of low clouds around the inner east bay and parts of the tri-valley this morning. then hazy sun moving into the afternoon hours as we also have to watch as the winds begin to shift into the south bay later on for you're out door exercise plans, recess over the next

couple of afternoons. watch out for smoke coming up from morgan hill in the south as we head into thursday and friday. high temperatures today, mid 80s around downtown an jose. closer to 90 in morgan hill. mid 60s around san francisco for the north bay. highs in the upper 70s to mid 80s. pleasanton and livermore, soaring in mid 90s. san francisco comfortably cool. numbers in the mid 60s. you will see as we move through the weekend some relief from some of that heat as the highs begin to cool off in the 90s. few upper 80s in the forecast. one thing if you watch out to the sierra, increasing chans of thunder showers in the forecast. mike? >> rob, we're going to take you out to the roadways. looking at a typical pattern as far as the sensors go. san jose though because we do have slowing north 101 right by the airport. right there. but also look at this. 280 at ol. right at the connector. chp just got a report of a crash and a mile or so of backup be you you don't see it on the

sensors and we have a camera in the area. live camera doesn't yield anything unusual. i took a wide look. 880 coming up. here turning to 17 coming up to 880. there's 280 north toward us. no lanes blocked. but again, we'll track the chp reports because that is an issue and critical point for san jose. meanwhile, look toward the bay bridge toll plaza where the backup is here. the fastrak lanes. left approach looking light all of a sudden traffic flowing lightly in this portion. we'll track that flow as well. the golden gate we're seeing will fog affecting your view. rob showed you that. mist, drizzle, and maybe a wipe or two with the wipers but not a major concern. of course the schools coming back online around the south bay. may see a delayed commute the morning. back to you. it is 6:21. coming up next, consumer investigator chris chmura with more of your problems solved. >> today a short trip and a long fight for a refund. so nbc bay area responds. good morning from rio. coming up on a wednesday morning here along the beach we're going

this morning nbc bay area responds to a sunnyvale family who had trouble with a bus ticket. >> we helped steer them out of trouble. consumer investigator chris chmura is here to explain how. >> cynthia said she paid paid $376 for greyhound tickets to send her step kids to visit grandmother. the bus didn't show. two hours after departure time the robles gave up, canceled and requested a refund. that was april. it's august. and still nothing. so cynthia called us and we called greyhound. the very next day a spokesperson said we have been in contact with her and apologized for her experience and inconvenience. the bus line issued a $376 refund and said it's currentlying looking into the reason for the delay in issuing a refund. let's change gears. coming up tonight of a olympics. upset pet owners complain to us

update to breaking news. state of emergency in effect right now as this new wildfire explodes incisize. we will have much more on that in just a moment. first, i want to say good wednesday morn pentagon. thanks for joining us. i'm laura garcia-cannon. >> i'm sam brock. a bit of a foggy start here on your wednesday morning but there are hot, dry conditions we've been seeing all week, rob. >> yeah, even around the bay area. go from the fog up towards lower lake and clearlake later on today where the clayton fire continues. temperatures there still near 100 degrees later on. light jacket weather for you this morning. across the bay area. notice the east bay though. talking the tri-valley around livermore, 95 degrees later on. 80s south of downtown san jose. speaking of san jose, hazy skies at 60 as we are going back to school in san jose. san jose unified numbers today climbing into the low to mid 80s now. speaking of san jose, tough commute this morning. several crashes. mike? >> several crashes, rob. we talk about the earlier one at

280 and 880 and update that in a second. the speed patterns are light lightening up a bit in the bay. we'll confirm that in one second. i want to talk about that first one. reported at 280, 880, reports come until. the update at chp says it's at the off-ramp near valley. it's not affecting the freeway but might affect your stevens creek off-ramp. slowing north from downtown. 101 bogging down here. trimble and the first crash, northern crash over at month p. expressway. the traffic break. a lot of slowing. everything is off to the shoulder but spectator slowing as you pass by san jose airport. the west bay, light we slowing through hayward. 238 past a street and then bogging down once again from 92 to tennison. holding steady there. the bay bridge toll plaza, look at the live shot. the fastrak lanes and the right approach backed up. left lanes easy and no problem

off the berkeley curve. lighter volume getting a break at the toll plaza. enjoy that. low clouds hovering around the deck. update to breaking news at 6:32. a state of emergency in southern california right now as we bring youes the live pictures of an out of control wildfire. it is threatening tens of thousands of homes. not far from san bernardino. look at all the smoke billowing up and look at what the fire has engulfed so far. it is burning in the cajon pass. at this hour 82,000 people are under evacuation orders. that is more than the population of redwood city. so far there's no numbers on the amount of structures destroyed but we have seen videos of homes up in flames. it started yesterday morning. it quickly exploded to 18,000 acres. sister station in southern station just filed this report minutes ago. >> when the freeway reopens you can see the look at the damage. here it is this morning. thele whats crumbled. the building leveled by this

fire yesterday as it burned through here. the owners just purchased this six-year-old restaurant 45 days ago and they tell us that there were ten tables full of people, customers, and staff that were in the building that had to evacuate yesterday when firefighters came through here telling them to get out of the area because of this fire. just a few hours later our helicopter was overhead as we watched this building burn to the ground. several buildings on this lot, you see them still burning this morning. a lot of rumble left behind here. there was a lot of memorabilia because this restaurant was known to feed a lot of celebrities and lot of other people as they made their way through here between los angeles and las vegas over the last six decades this restaurant sat here next to the 15 freeway. it is now, as you can see, destroyed by the blue cut fire that burned true here yesterday afternoon. this is just one of a handful of other biuildings and homes destroyed. we're still waiting for a full

count to see what exactly was lost so far and of course firefighters are going to have another difficult day aheald of them. reporting in oak hills, rick montanez, back to you. >> thank you very much. we also are following a devastating and developing story in our neck of the woods as well. the clayton fire now the man accused of set that wildfire burning to our north in lake county will face a judge for the first time today. authorities say that dame inmany pashilk started the clayton fire and at least a dozen other fires on purpose. "today in the bay's" pete suratos has been following this story for the past couple of days now. pete, we just learned the containment is now at 40%, up from 35% earlier this morning. a piece of good news here. good morning. >> reporter: good morning. it looks like they are making progress. authorities say that 40-year-old damin pashilk is the man responsible for the clayton fire that led to the damage that you see behind me. we've seen this for the past few days around lower lake.

now at historic lower lake. this building is burned down to the ground. now, he's due in court later this afternoon. like you mentioned. the clearlake resident will be in court facing 17 arson charges. also learn that he's an exfelon who was once trained as a prison firefighter. he's also been convicted of several crimes over the past 16 years including evading a police officer, possession of meth, as well as firearm charges. according to a lake county da's office cal fire had a shpapa a n their radar for some time now. >> cal fire knew of this gentleman. he was under some surveillance. >> it's scary. it's awful. but it's also really reassure that they got him. >> he's obviously a sick guy. nobody in their right mind does this. >> reporter: cameras will be at the lake county courthouse later this afternoon. pashilk is due in court at 1:15 p.m. we're live in lower lake.

pete suratos for "today in the bay." >> all right, thank you very much, pete. 6:35. a man who recently tried to pull off a kidnapping in san leandro may be linked to two more kidnapping attempts. we have a sketch of the man police are looking for. take a look. police say he attempted to kidnap a woman on washington avenue on july 28th and may have made similar attempts on two other women in the days after that attack. all three attempts happened in daylight hours. this morning police are hoping someone who sees this sketch can help trigger new leads. another meeting taking place today to shape the future of santa clara fair grounds. the county is now planning to create a new fairground in san jose. it would include a new community park, a sports complex, maybe even a performing arts venue. right now many possibilities are being considered. today's meeting will cover recommendations about requesting qualifications on bids for the fairgrounds master plan. the possibility of some divine intervention now for worshippers who routinely park

illegally in the median of one busy san francisco traffic corridor. there's going to be no more praying for forgiveness. thast that's because they're getting relief thanks to san francisco's transit agency. a new pilot program approved last night is going to make it legal to park in the middle of deloris treat from 14th to 18th on sundays. the mta also approved more red curbs to improve visit and signs making clear exactly when that parking will be allowed. local faith leaders are applauding this decision. >> they want to be connected with san francisco and they want to feel that they're part of this community and their houses of worship give them that opportunity. >> there are three houses of worship at 16th and dolores. those changes will roll out within the next six months. mta agreed to roll back recently approved restrictions for drivers along mission between 14th and 30th streets. six months ago red bus only lane were a..ed to improve transit

service. it also eliminated left turns for krars and created several forced right turns. two of the forced right turns will be eliminated. taxis will also be allowed to turn left on 21st street. busy time for parents and kids right now as you've been tracking and talking about all week, back to school rush that's in full swing. today the silicon's valley largest district is back to the books. >> made the list and checked them twice. kris sanchez among them this morning. for the first time, san jose unified is fully staffed starting this school year. >> fully staffed, laura and sam. and while parents are trying to stuff the backpacks leading up to this day, the district was trying to make sure they're going to file into the classes today they will have their permanent teacher, clearly it's time for some of those kids to go back to school. >> look likes we lost audio for kris. the good news about it is that

dublin. south of downtown san jose. north bay will see the numbers soaring into the 80s as we look at napa valley unified school district numbers in the low 80s later on this afternoon. another hot start to the school year as you would expect for antioch unified today. highs today soaring into the mid 90s. but low clouds and misty skies can cause some issues for your morning commute around san francisco. but some other issues happening near san jose airport. mike? >> that's right. we are talking about perhaps the delayed commute this morning. san jose as you said also san mateo school districts there los gatos coming online. some moeks want to say later to see kids off for the first day of school. we do have issues going on here for 101. a number of crashes. trimble, cleared to the shoulder. slowing past the airport. 280, earlier crash reported there. around 880 and stevens creek getting to the valley may be an issue. on the peninsula we also have southbound 101 at marsh. reports of a crash there. we don't see a lot of slowing

currently tornado wat lly tempe. around san francisco this morning, higher than that. evergreen school district back at work today. 80s in the forecast. heading through the afternoon, notice san francisco you got misty skies across the golden gate bridge. current temperature of 56 degrees. and to the south, san mateo union today, you will have temperatures comfortably cool, low 70sthis afternoon. light jacket. pretty much everywhere around the bay area but you want to lose the jacket inland out towards and ok and the tri-valley as the highs soar towards the 90s. low clouds lingering through almost midday around the inner east bay and staying on the coast as we head through the afternoon. again, another hot day across some of those interior valleys and one thing to watch, increasing areas of smoke we suspect as the upper level winds begin to shift for parts of the south bay. you may notice this as we head towards sun sets tonight. more smoke moving up from the fires burning to the south as we get into thursday morning. high temperatures today, mid 80s around downtown san jose.

and then hotter as you head over saratoga and morgan hill to the south. and to areas south of downtown san jose. upper 80s to some 90s. mid to upper 60s closer to san francisco. for the north bay, 80s in santa rosa and tri-valley from livermore out towards antioch. hottest temperatures with the numbers making a run at the mid 90s. seven 46 day forecast for san francisco, keeps things relatively cool. but for those interior valleys, the heat is going to linger for a little bit. head towards the weekend we will begin to see some cooling and watching out for a chance of mountain thunder showers starting friday. tracking what's happening on your peninsula commute here's mike. >> rob, we got a couple of reports we talked about that on our 101. earlier in the woodside area. let's take a second to look at the entire bay, south bay. gradual build. focusing on south 101 around mar marsh, the original report came in. closer to woodside. i saw slowing. they got lanes cleared because we see the speeds restored again but we will track the area. volume starts to build off the

san mateo and dumbarton bridges coming westbound showing slowing off of 880. not bad, union city. clearing by the time you get to tennison for the southbound nimitz. we also have the bay bridge toll plaza. look over here on our camera from emeryville and the maze. the approach. smooth flow of traffic. there is a bender fender reported along this stretch. don't see it. off of interstate 80 westbound, you're fine. it's westbound 580 that has a slower drive. that's the reason why traffic is flowing into the fastrak lanes and the lanes off 2 approach are slower. golden gate bridge also a little slow. you have to tap the brakes for visit on the north side of the bridge. by the time you get to the san francisco side, everything is free and clear. through san rafael, you're fine as well. >> thanks. it is 6:53. coming up next, nothing to breaking news we've been following this morning. since we came on air at 4:30, a couple out for a nighttime walk is robbed. and the husband shot right in the middle of a hayward street.

update now to breaking news. a husband is shot while walking with his wife in an east bay neighborho neighborhood. >> "today in the bay's" bob redell is live from hayward this morning. bob, we're talking about a city that's seen a spike in violent crime in just the past couple of weeks. >> sam and laura, i want to put out this number for you over just the past 14 days, 5 people have been murdered in high ward. and then the shooting last night. fortunately police tell us

overnight the victim in that instance is going to survive. it was around 11:45, a man was walking with his wife down florida street near the intersection of dolphin lane. this is in a residential area not far from tennison. a man pulled a gun on the couple, demanded their cellphones. they complied but for whatever reason the man still shot the husband. once. again, his injury is nonlife threatening. the couple tells police the robber was tall, african-american, that he drove off in a candy apple red suv with gold rims. as i mentioned, it's been a violent summer for the city of hayward. the map we put together shows the locations of five homicides that took place over the past two weeks. there are three between 880 and 238. one by the airport and another near the hills. the most recent murder this past sunday night on cottonwood avenue. a man was stabbed to dealt after he had a run-in with two other men. police are looking for his killer. he becomes the eighth person, the eighth homicide victim this
