outside. and a little bit of a cooling trend getting started a bit later today. we'll have temperatures out of the upper mid 90s across the tri-valley. upper 80s to near 90 today. 60s in san francisco. and no rain is in the forecast. flooded roadway. >> yes, glad you said no rain. the bellagio. no, unfortunately is a car crash. we haven't heard about major injuries but this is in concord. that car is getting soaked. this is just off clayton road. 1600 block of ga len da. this is basically the light show rauz r because of the flashing lights. crews taking care of this water main break. but again, that car involved there so we are finding out more details. as we take the map we're going to show you where this is. this is off of clayton road over at gelinda. this is not affected by this water. we have the b.a.r.t. station nearby as well. that's not effected. that's good news. 242 and 680. we'll get a look at the big bay shot. there are no major issues. as far as the freeways go,

freeway flows fine. bob redell is in san jose. there is an issue for the light rail trains. what's the latest you hear. >> well, good morning, mike. we're on highway 87 not far from the children's discovery museum. disabled light rail train. this was a car not in service but presumably getting in place for the morning commute. what happened is that lost its pantigraph. if you see that metallic piece of equipment between the two rails, that's the thing that is supposed to be on top of the car. it's the spring like device. we've all seen it before. mounted on top of these light rails. it delivers power to the light rail by making contact with the electrical line. that broke and fell off. in the process damaged the power line itself. you can see the bright lights. you might see men and women in fluorescent vests. they are working on fixing this line right now. and then they are also in the process of moving the light rail, the disabled light railcar out of here. the whole point of this is that

it's going to effect the morning commute. vta, valley transportation authority, has told us that there will be an emergency bus bridge in effect for the 901 and 902 lines. for 901 between san antonio and curter in stations and 902 line between san antonio and sent fernando stations. and they said this would be going on through the morning commute. that's an update they gave us an hour ago. maybe things have changed. maybe they're going to be able to get this done. perhaps sooner than the entire morning commute. we're still trying to get that information. but as you can see right now they've got a disabled light railcar here on the track underneath highway 87 not far from the children's discovery museum. damaged power line because that piece of equipment broke off and caused damage to the power lines above. you see they do have an emergency response out here trying to get this fixed in time for the friday morning commute. reporting live in san jose, bob redell, "today in the bay." we move now to breaking news out of new jersey where rescue

crews are at the scene of a crash involving two commuter buses. look at that scene. all of this is happening in newark. and as we try to digest this wnbc reports a new jersey transit bus t-boned another bus. that is the aftermath you see that one of the buses there in an accordion style crash is crumpled. at least seven people are injured. chopper footage showed some of those treated on a nearby sidewalk. one bus nearly split in half. we're talking right now with our new york news desk and we'll continue to update this of story throughout the course of the morning. new this morning, a structure burned to the ground in the south bay. a fire that started around 1:00 this morning around east main street and hill road in morgan hill. not too far from libo high school. you can see those flames completely engulfing that structure. firefighters have not yet said whether this is a home or what kind of building it was, what was inside. so far, no word on a cause.

a developing story out of southern california where that wildfire continues to rage out of control. right now the blue cut fire in san bernardino county is at 36,000 acres, only 22% contained. 1600 firefighters are on the front lines trying to douse those flames and protect homes in the area. "today in the bay's" cheryl hurd is tracking the latest from the devastation and she is going to have a look at the aftermath for us throughout the morning. here in northern california, firefighters are finally getting the upper hand on the clayton fire burning in lake county. at this point that fire is up to 60% contained. full containment is expected by this sunday which would be about eight days after the fire started. in the process, it's destroyed more than 300 structures, including almost 200 homes. a suspected serial arsonist has been arrested for starting this fire. as we talk about the highs and lows here and specifically the impact of the fire, a key system

for the medal winning u.s. fencing team returned from rio to find his home among the hundreds destroyed in that wildfire. matthew porter is the armor for the u.s. fencing team. he fits the athletes in their gear and makes sure that everything works. well, after helping celebrate the team's performance in the summer games elation turned to devastation. last sunday his wife had to evacuate their lower lake home with their family's pets. on thursday, they got word that their home was gone. >> as long as she's safe, i told her the rest is paperwork. we'll get through it. >> perspective there. the porters ran their fencing supply company from their garage. even though they lost a lifetime of mementos, their hoping to keep their spirits high. >> that is really sad. we go back now, kris, to rio. more breaking news. a hit to the reputation of team usa over night we learned a member of the u.s. swim team is being forced to pay $11,000 fine just to leave rio. this after authorities investigated and found that

several swimmers including gold medalist ryan lochte lied about being robbed at gun point. >> nbc bay area anchor jessica aguirre is tracking the story from rio. and, jess, the truth is kind of evident in that surveillance video. >> well, that surveillance video certainly very telling, kris and sam. and it's what brazilian authorities here really wanted to get out because the one thing they didn't want was this stain on them that brazil is a dangerous country. they've had a few mishaps and obviously there has been some crime issues here. but that is not what they wanted out there today. so american swimmer jimmy feigen will be headed back to the u.s. he made a court appearance this morning in a brazilian courtroom before a judge. feigen reached a deal with brazilian police, agreeing to pay $11,000 to a local charity. feigen will be getting his passport back after it was seized wednesday and kept from leaving rio. as you said, it stems from that alleged robbery with teammates gunnar bentz , jack conger and

ryan lochte. lochte initially told if press he was robbed at gun point. brazilian police found the su surveillance video and showed that they were drunk, vandalized a gas station and that they were confronted by armed guards. that demanded they pay for the vandalism. a fabricated story that various swim commentator and olympic natalie conklin said should have been recity fid. >> it got so big and i just don't know why he dug his heels in. >> now, lochte was the first one to leave the country. he's back in north carolina. conger and bentz left yesterday and we just received word that they have arrived in the nights. they landed just a short while ago in miami. the attorney for them says that they were never part of lochte's story. they never lied. they never said anything at all.

the u.s. has issued an apology to the host country saying they're embarrassed by what happened and what these four swimmers is involved in is not a reflection of team usa and they could face some sort of sanctions when they are back in the united states. that will be looked at by the olympic committee. lochte may face a misdemeanor charge at this point. it's unclear. some of the attorneys we've spoken to says it's really not going to come to anything. he's already out of the country. one thing is for sure, he is facing a lot of embarrassment and it has tarnished his reputation and potentially many endorsements deals for the future. kris and sam? >> all right, thank you very much, jess. new this morning, donald trump in the flesh, sort of, if you didn't catch a glimpse of the naked trump statue in the castro district for yourself in person you're too late. it was hauled away overnight. >> a whole lot of people took out their phones and started getting video when they saw it it was there. statue? >> yeah, you guys mentioned, the naked donald trump statue, a big talker here in san francisco but it had been moved to sfpd and it's because the group behind it could face vandalism charges. for one they didn't have a permit. two, there's that glue substance and we're being told it could take thousands of dollars to remove that from the sidewalk. we want to show you guys some of that new cellphone video we got of the statue being taken away by the department of public works. this morning before 3:00 a.m. and according to them, that statue is being taken to the mission station of sfpd for possible vandalism charges. anonymous anarchist group behind the stunt that posted five naked trump statues across the country. their goal is to get people's attention, mission accomplished. >> we wanted someone who not just capture likeness but do something utterly ter feig and that is how we feel about trump. >> his persona is huge.

comcast. identifying a serial bank robber-- they've named the "audi the fbi is asking for help identifying a serial bank robber that they've named the outy bandit. he's suspected in three bank robberies and one attempted robbery a across the bay area. investigators say during that break, during the spring, we should say, he hit banks in burlingame, livermore, and pleasanton. after each robbery the suspect took off in a different audi car.

anyone with information is asked to get in touch with the fbi. only on nbc, she was paid to be a caregiver to the elderly but now a medical technician in the east bay is accused of violating their trust and robbing them. burl levy seen here in her facebook page is charge with stealing with those she was hired to care for. since 201 she's worked at san ramon villa. 95-year-old man living there started seeing things disappearing like this ring he had. then a few weeks ago police say 61-year-old lee i have was caught on camera. >> essentially showed the suspect walking into, removing property from a drawer and leaving. >> from there the detectives looked at levee's fanses and discovered she had been making large cash deposits into her bank account and selling large amounts of jewelry at a local.shop. police recovered several of those items. they say the challenge now will be identifying who that jewelry

belongs to. bus news. hotly debated issue is coming back. uber is headed back to court over the argument over whether its drivers are employees. >> scott mcgrew, i thought we settled this question. >> so did uber. so did the drivers. the drivers wanted to be counted as employees, not contractors. uber didn't want that. the two settled out of court. the final decision uber drivers would remain contractors, not employee, but they would get a financial settlement of $100 million split up amongst the drivers and that wasn't very much money once you split it up. a judge would have to agree to all that but thursday the san francisco judge in charge of the case said no. it wasn't enough money to start with. so the case goes back in the settlement talks and, if necessary, back to trial. of course all this comes as uber works to replace the whole concept of a driver. uber will start using robotic controlled volvos in pittsburg, pennsylvania, before the end of the year. you can get a ride in one of these.

you can see here in san jose, we're at 59 degrees. hazy skies. smokey skies again around the south bay and over towards the tri-valley. a little bit of low clouds in san francisco. 58 degrees. and there's a view. out towards dublin, 59 with hazy skies. again, the hayes is the story. "spare the air" alert. worst to be out towards the tri-valley and ground level ozone, your typical summertime pollution but the smoke which you can see here in one of the models we look at to look at ground level smoke, you see how high to consent administrations are in the south bay and east bay. here's improvement by tomorrow morning. may begin to see more smoke drift off to the east. so we need here is a shift in the wind. may not get it until very late today and then by tomorrow and for the weekend as the temperatures begin to cool down air quality, too, should begin to improve. around the bay area, low clouds, big story for us today. if your weekend plans include the sierra, look out for a chance for afternoon thunder showers. some of that, the cloud cover

prison labor did not meet minimum standards. degraded material reduced the helmets's effectiveness in withstanding bullets and shrapnel. they recalled them in 2010. no injuries or deaths though were tied directly to the defects. for the first time, kris, the u.s. state department is conceding a $400 million cash payment to iran, was tied to the release of four u.s. hostages but then it wasn't exactly a ransom payment. the u.s. made that payment in january ahead of the release of four americans. now in a statement yesterday state department spokesman john kirby clarified the money was part of a frozen iranian account. he says the u.s. withheld it and used it as, quote, leverage until iran released those hostages. coming up next, rolling flames in southern california forcing thousands to flee. a closer look at the aftermath left behind from the blue cut fire.

equipment. you can see it there in the gravel between the two rails. panic route. that's what helps the car get power. and in the process it snapped one of the overhead power lines. you have crews trying to remove the disabled car and fix that power line. the last update is that this would be going on throughout the morning commute. reporting live here in san jose, bob redell, "today in the bay." >> bob, thank you very much. right now at 5:32, breaking news just getting word that berkeley police is reporting the city's first homicide of the year. here's what we know about it. police say that several people called about gunshots in the area of mabel and burnett streets. this happened about midnight in the southwest part of berkeley. the victim is an adult man who died from gunshot wounds. they do not have anyone in custody a tht moment. "today in the bay's" pete suratos is headed there. he will bring us a live report. moric breaking news, this time out of rio. one of four u.s. swimmers accused of lying about being

robbed at gun point appears in court and agrees to make a large payments. and now he will be free to go home. >> nbc bay area anchor jessica aguirre has been tracking the fallout from this scandal. she joins us live from rio. what's the latest? >> reporter: sam and kris, three down, one to go. we just learned that two of the swimmers involved in theal lenked lochte lie have or lived in miami. we want to show you the pictures from miami international airport. gunnar bentz , jack conger arriving a short time ago. they were able to leave rio yesterday on thursday after talking to brazilian police. this morning though jimmy feigen faced brazilian judge so that he could exit the country. the american swimmer will be headed back to the u.s. he reached a deal, donating $11,000 almost to a local charity in exchange forgetting his passport back. that's apparently something they do here in brazil where you can avoid being charged with something if you make a

donation. now, this all stems from that alleged robbery with teammates bentz , conger, and ryan lochte. if you remember lochte told the press the group had been taken over by these armed gunmen and that they had put a gun to his head and now surveillance video the brazilian video found shows the men at the gas station where they apparently vandalized the gas station and then got into an altercation with the security guards who were armed who asked the men to pay for the vandal m vandalism. that didn't happen. the story got out and lochte now could face a misdemeanor charge as well. experts that we've talked to say it is unlikely and that he could always just say he really didn't understand what was going on. >> it's a language issue. and maybe he wasn't doing more than he was supposed to. had a little too much to drink and the next thing you know someone is pointing a gub at him, he doesn't know what's happening. >> as we just showed you conger and bentz are back in the u.s. they actually got pulled off

their flights and then talked to brazilian police. the attorney that represented them in rio maintained the two men never lied because they never corroborated lochte's story in public, p they just reminding their own business, the oc has apologized for the home country of rio and said that it is embarrassed by the actions that these swimmers tookd and that when they get back the u.s. they may face consequences within the swimming community and could face some sort of sanctions. as for lochte he is in north carolina, ironically he was the first one to leave the country so he hasn't had to deal with brazilian authorities the way his other three teammates has. he's tweaked his story and said maybe it didn't happen exactly the way he meant it. but that it was more not on a truth issue, just a misunderstanding. we shall see. >> of course, yeah, we have that interview with bulilly bush on e "today" show. live from rio. let's go back now to california.

evacuees in southern california with still being told to stay away from their homes where the blue cut wildfire is burning ferociously. that fire is more than 20% contained. but at least 36,000 acres have been burned and many homes are destroyed. "today in the bay's" cheryl hurd went out with firefighters to assess the burn zone. >> reporter: i am standing along highway 138. many of the homes had been reduced to twisted metal and ash. i went on a ride-along with the san bernardino county fire captain and i talked with the man who was very concerned about looting. >> i've been through some pretty big fires, this one kind of amazed a lot of people. >> reporter: san bernardino county fire captain john garber giving us a tour of what the fire is leaving behind. he says the rightwood area has been through a lot of fires. many of the people there are so confident that they stay when told to evacuate. at the height of the fire 82,000 people were told to leave the

area, an undetermined amount of homes and structures are gone. things are not back to normal yet. people who live in rightwood are working on it. carl and his wife dog left when told to evacuate but he stayed. he spends his evenings and nights patrolling the streets looking for looters. >> we just had some groups of kids that we watched. and i have haven't seen anything. i haven't heard of anything. but at night i just made it a point of driving through the neighbor hood to see if anybody was wandering around or looked like they might be up to no good. >> the sheriff's department arrested three people for hooting. they are wondering what their move might be. i talked to one family and we will hear more from them later on in the newscast. i'm cheryl hurd, "today in the bay." >> cheryl, thank you very much. here in northern california, firefighters are getting the upper hand on the clayton fire burning in lake county. right now it's up to 60% contained. full containment is eth ped by

this sunday which is eight days after it started. in the meantime, the fire has destroyed more than 300 structures including almost 200 homes. a suspected arsonist. a follow-up now charges accuse of making death threats against the acting san francisco police chief. arrested donald last month after he posted controversial racist tweets about chief tony chaplain. the san francisco public defender confirmed the changes were being dropped saying his tweets were protected under the first amendment and contained both political and religious elements. a dorm downgrade for hundreds of san jose state freshman. they were supposed to be moving into the university's newest housing development but instead they're going to have to bed down in a run down dorm slated for demolition. according to the mercury news construction of the university's new ten-story freshman dorm is behind schedule and it could be another month before it's

finished. in the meantime, students will be living three to a dorm at the bricks. that's the dormitory built in the 1960s. that's supposed to be torn down. now it will have to wait. >> torn down to taken away. if you haven't seen him yet check out naked donald trump. the statue popped up in the castro yesterday and became an immediate tourist attraction. the public works department removed it around 3:00 this morning. it's only happened in the last few hours. the people behind the naked donald trump statue is actually appeared across the country yesterday. there were five of them. say they wanted to get people talking. if that was the mission, mission accomplished. a political activist group called in decline installed statues in five different cities. a member of the in decline says the group selected an artist who specializes in creating monsters. >> art is essentially made to create conversation, to get people thinking, to get them talking and to stir some type of

we'll see that today and again saturday into sunday. highs today around san jose. mid 80s. south of downtown. numbers closer to the upper 80s around morgan hill. 60s near san francisco. north bay temperatures in the 70s and 80s. 80s still near 90 degrees inland for today. speaking of inland locations, "spare the air" day for the east bay, interior valleys as smoke continues to be a big story here. south winds aloft. notice the transition into saturday now. we're gibbing to see the winds turn more out of the west. so for most of today we're still likely to see those hazy skies and then as we go through the weekend we will see the winds begin to fire up and we hope push more of the smoke out of the bay area. one thing you will also notice is temperatures cooling as the upcoming weekend, san francisco dropping into the low 60s with drizzle likely over the morning hours. and for valleys, bigger difference in temperatures as we cool down maybe even below. a slightly early next week. mid 80s could be in the forecast there approaching monday.
